ORDINANCE
Hanoi, the capital city
To build and develop Hanoi - the capital of the Socialist Republic of Vietnam, a heart that becomes increasingly prosperous, civilized, and modern; to inherit and promote the thousand-year-old cultural tradition of Thang Long - Hanoi, contributing to building the country more dignified and beautiful;
Based on the Constitution of the Socialist Republic of Vietnam in 1992;
Based on the Resolution of the 10th National Assembly, 6th Session regarding the Law and Ordinance Drafting Program for 2000;
This Ordinance stipulates the provisions concerning the capital city of Hanoi.
PART I
GENERAL PROVISIONS
Article 1. The Position of the Capital City of Hanoi
The capital city of Hanoi is the national political-administrative center, a large center for culture, science, education, economy, and international transactions; it is where the central agencies of the Party and State, political-social organizations, diplomatic agencies, and international organizations are located, and where the most important domestic and foreign activities of the country take place.
Article 2. Scope of Regulation
This Ordinance stipulates the objectives, mechanisms, policies, division of responsibilities, and decentralization of state management in the cause of building, developing, and protecting the capital city.
Article 3. Objectives of Building and Developing the Capital City
1. To build and develop a socialist capital city that is prosperous, civilized, elegant, modern, and exemplary for the whole country.
2. To have a synchronized and modern urban technical infrastructure system with a sustainable environment.
3. To ensure political security, national defense, social order, and safety; to protect the people and guarantee absolute safety for the operations of central agencies of the Party and State, political-social organizations, diplomatic agencies, and international organizations.
4. To preserve and promote the cultural heritage of the thousand-year-old capital city, contributing to building and developing a progressive Vietnamese culture rich in national identity; to build a civilized, elegant, and exemplary citizen of the capital city representing the intelligence and fine traditions of the Vietnamese nation; to establish leading national bases for scientific research, application, culture, education, healthcare, and sports.
5. To develop the capital city's economy at a high, sustainable growth rate with a reasonable structure, meeting the requirements of domestic economic development and actively integrating into the international economy.
6. To focus on purifying and cleaning up the cultural and social environment; to prevent and eliminate social evils and negative phenomena.
Article 4. Tasks of Building, Developing, and Protecting the Capital City
1. Building, developing, and protecting the capital city is the right and duty of every resident of the capital city, and a regular and direct task of all levels of the municipal authority of Hanoi.
Organizations and individuals operating and residing within the territory have the responsibility to contribute to building, developing, and protecting the capital city.
2. Building, developing, and protecting the capital city is the task of the entire Vietnamese people.
The Government directs, assigns, and organizes coordination among central state management agencies and localities throughout the country to mobilize resources to serve the cause of building, developing, and protecting the capital city.
3. Within 10 working days from the date of receipt of the dossier as mentioned in Sub-clause b, Clause 1, Article 3 above, the Ministry of Foreign Affairs will review and submit to the competent authority for decision (Issues exceeding the Ministry of Foreign Affairs' jurisdiction will be referred to the Prime Minister for consideration and decision).The Vietnam Fatherland Front and its member organizations have the responsibility to mobilize all strata of the people both inside and outside the country to participate in building, developing, and protecting the capital city.
Article 5. Investment Policy for Construction and Development of the Capital City
1. The State identifies the capital city as a key area to be concentratedly invested with special resources to ensure the achievement of the objectives stipulated in Article 3 of this Ordinance.
2. The State has preferential policies and encourages domestic organizations and individuals, overseas Vietnamese, and foreign organizations and individuals to invest in construction and development of the capital city.
Article 6. International Cooperation in Construction and Development of the Capital City
The State encourages and creates conditions to expand international exchange and cooperation activities, to utilize external resources, and to proactively integrate into regional and global economies to construct and develop the capital city.
Chapter II
ECONOMIC DEVELOPMENT, EDUCATION, SCIENCE AND TECHNOLOGY, CULTURE - SOCIAL DEVELOPMENT OF THE CAPITAL CITY
CULTURE AND SOCIETY OF THE CAPITAL
Article 7. Economic Development
1. The long-term strategy and phased strategies for economic development of the capital city are planned to rapidly transform the economic structure towards a rational service-industry-agriculture model, achieving high and sustainable economic growth rates, and leveraging the strengths of the capital city as a driving force for the northern key economic region and the entire country.
2. The State has policies:
a) To diversify and improve the level and quality of various service sectors, focusing on investing in information services, tourism, trade, finance, banking, technology transfer, human resource training, insurance, aviation, postal and telecommunications services, and other services; to build the capital city into a wholesale goods center, export-import center, leading financial-banking center in the northern region, and a significant center nationwide;
b) To prioritize the development of high-tech industries aimed at producing new products that are economically efficient, competitive, and cause minimal environmental pollution; to focus investment on industries capable of serving the economic development needs of northern provinces and the entire country; to promote the production of export goods and substitute imported goods;
c) To develop urban agriculture and suburban economy towards urban and ecological agriculture; to implement industrialization and modernization of agriculture and rural areas; to prioritize clean agriculture, traditional crafts, and eco-tourism villages; to invest in developing new technologies and breeding new varieties to serve agricultural production; to pay attention to post-harvest preservation and processing technologies.
3. The Government, ministries, ministerial-level agencies, governmental agencies, People's Councils, and People's Committees of Hanoi City shall issue preferential regulations for key sectors and encourage development during each period and for each service and production sector. Within 10 working days from the date of receipt of the dossier as mentioned in Sub-clause b, Clause 1, Article 3 above, the Ministry of Foreign Affairs will review and submit to the competent authority for decision (Issues exceeding the Ministry of Foreign Affairs' jurisdiction will be referred to the Prime Minister for consideration and decision).The People's Committee of Hanoi City shall issue preferential regulations for key industries, encouraging development during each period and for each service and production sector.
Article 8. Development of Education and Training
1. To develop a comprehensive education and training system in the capital city with modern infrastructure to make it a human resource training and talent cultivation center for the country, striving to become a reputable training center in the region and having a highly educated population.
2. The State has policies:
a) To invest in building several high-quality universities and colleges meeting regional and world standards;
b) To diversify educational forms and training programs; to retrain management cadres, scientific and technological cadres, and technical workers.
3. The Government, ministries, ministerial-level agencies, governmental agencies, People's Councils, and People's Committees of Hanoi City shall issue regulations encouraging and creating favorable conditions for organizations and individuals to invest in the education and training industry in the capital city. Within 10 working days from the date of receipt of the dossier as mentioned in Sub-clause b, Clause 1, Article 3 above, the Ministry of Foreign Affairs will review and submit to the competent authority for decision (Issues exceeding the Ministry of Foreign Affairs' jurisdiction will be referred to the Prime Minister for consideration and decision).The People's Committee of Hanoi City shall issue regulations to encourage and create favorable conditions for organizations and individuals to invest in developing educational and training activities in the capital.
Article 9. Development of Science and Technology
1. The development of science and technology in the Capital shall prioritize the advancement of high-tech industries in information technology - electronics, biotechnology, mechanical - automation, production and utilization of new materials.
2. The State has policies:
a) Investing in building some modern research facilities and laboratories meeting regional and world standards;
b) Developing and expanding the technology market; prioritizing the transfer and application of advanced technologies in production, business, and management activities.
3. The Government, ministries, ministerial-level agencies, governmental agencies, People's Councils, and People's Committees of Hanoi City shall issue regulations encouraging and creating favorable conditions for organizations and individuals to invest in the education and training industry in the capital city. Within 10 working days from the date of receipt of the dossier as mentioned in Sub-clause b, Clause 1, Article 3 above, the Ministry of Foreign Affairs will review and submit to the competent authority for decision (Issues exceeding the Ministry of Foreign Affairs' jurisdiction will be referred to the Prime Minister for consideration and decision).y the People's Committee of Hanoi City shall issue preferential regulations to encourage organizations and individuals to invest in developing scientific and technological endeavors in the Capital, creating favorable conditions for the full utilization of talents, intelligence, and creativity of leading scientists and outstanding experts.
Article 10. Development of Culture and Society
1. The development of culture and society in the Capital aims to create a civilized and healthy cultural and social environment.
2. The State has policies:
a) Preserving and enhancing historical, cultural, scenic spots, and representative old quarters in the Capital; establishing museums, cultural, historical, revolutionary monuments, modern parks, entertainment areas, libraries, and other cultural and artistic works to meet the increasingly high spiritual needs of the people;
b) Developing a healthcare system capable of meeting the growing and diverse needs of the people; promoting preventive health care and community health services; renovating and upgrading health centers; constructing some modern, high-quality general and specialized hospitals;
c) Building modern sports complexes and sports centers with conditions to serve domestic and international sports activities; developing mass sports and establishing a grassroots sports network.
3. The Government assigns responsibilities and directs ministries, ministerial-level agencies, government agencies, and the People's Councils, Within 10 working days from the date of receipt of the dossier as mentioned in Sub-clause b, Clause 1, Article 3 above, the Ministry of Foreign Affairs will review and submit to the competent authority for decision (Issues exceeding the Ministry of Foreign Affairs' jurisdiction will be referred to the Prime Minister for consideration and decision).y the People's Committee of Hanoi City to develop management regulations, investment, and usage of cultural, health, and sports facilities within its jurisdiction; encouraging organizations and individuals to invest in developing cultural and social endeavors in the Capital.
Chapter III
MANAGEMENT AND URBAN DEVELOPMENT OF THE CAPITAL CITY
URBAN DEVELOPMENT OF THE CAPITAL CITY
Article 11. Management of the Capital's Master Plan
1. The Capital shall be constructed and developed according to the overall master plan approved by the Government.
Based on the Capital's overall master plan, Within 10 working days from the date of receipt of the dossier as mentioned in Sub-clause b, Clause 1, Article 3 above, the Ministry of Foreign Affairs will review and submit to the competent authority for decision (Issues exceeding the Ministry of Foreign Affairs' jurisdiction will be referred to the Prime Minister for consideration and decision).y the People's Committee of Hanoi City shall establish detailed plans for districts, counties, residential areas, and new development zones; actively coordinate with relevant ministries, ministerial-level agencies, and government agencies in the construction of specialized plans within its jurisdiction, strictly managing the implementation of approved plans.
Ministries, ministerial-level agencies, and government agencies within their respective duties and authorities shall have the responsibility to coordinate with Within 10 working days from the date of receipt of the dossier as mentioned in Sub-clause b, Clause 1, Article 3 above, the Ministry of Foreign Affairs will review and submit to the competent authority for decision (Issues exceeding the Ministry of Foreign Affairs' jurisdiction will be referred to the Prime Minister for consideration and decision).y the People's Committee of Hanoi City to develop annual plans to implement the master plan.
2. Within 10 working days from the date of receipt of the dossier as mentioned in Sub-clause b, Clause 1, Article 3 above, the Ministry of Foreign Affairs will review and submit to the competent authority for decision (Issues exceeding the Ministry of Foreign Affairs' jurisdiction will be referred to the Prime Minister for consideration and decision).y the People's Committee of Hanoi City shall direct the implementation of detailed plans, ensuring the synchronous construction of new urban areas according to the master plan; issuing regulations on construction management and urban order.
In cases where necessary and with the approval of the Government, Within 10 working days from the date of receipt of the dossier as mentioned in Sub-clause b, Clause 1, Article 3 above, the Ministry of Foreign Affairs will review and submit to the competent authority for decision (Issues exceeding the Ministry of Foreign Affairs' jurisdiction will be referred to the Prime Minister for consideration and decision).y the People's Committee of Hanoi City may adjust the overall master plan partially to ensure the synchronous development of the Capital.
3. Organizations, entities, and individuals investing in construction within the area must strictly comply with legal provisions and regulations of Within 10 working days from the date of receipt of the dossier as mentioned in Sub-clause b, Clause 1, Article 3 above, the Ministry of Foreign Affairs will review and submit to the competent authority for decision (Issues exceeding the Ministry of Foreign Affairs' jurisdiction will be referred to the Prime Minister for consideration and decision).y the People's Committee of Hanoi City regarding planning, construction management, and urban order.
Article 12. Management of natural resources, land, rivers, and lakes
1. Natural resources, land, rivers, and lakes within the capital area shall be exploited and utilized reasonably, effectively, and in accordance with the overall planning.
2. The People's Council and the People's Committee of Hanoi City shall have the responsibility within their respective tasks and powers to: Within 10 working days from the date of receipt of the dossier as mentioned in Sub-clause b, Clause 1, Article 3 above, the Ministry of Foreign Affairs will review and submit to the competent authority for decision (Issues exceeding the Ministry of Foreign Affairs' jurisdiction will be referred to the Prime Minister for consideration and decision).a) Directly manage the exploitation and utilization of natural resources, land, rivers, and lakes within their jurisdiction;
b) Develop long-term and annual plans for the use of natural resources, land, rivers, and lakes to serve economic and social development, urbanization, and public welfare;
c) Issue regulations to protect and organize the effective exploitation of natural resources, land, rivers, and lakes within their jurisdiction;
d) Manage, monitor, and promptly address any changes concerning natural resources, land, rivers, and lakes within their jurisdiction.
3. Land users must use the land for the designated purpose, fulfill their obligations as prescribed by law and the regulations of the People's Committee of Hanoi City on land.
In cases where the State reclaims land for construction and development purposes according to the planning, land users must strictly comply and be compensated in accordance with the law. Within 10 working days from the date of receipt of the dossier as mentioned in Sub-clause b, Clause 1, Article 3 above, the Ministry of Foreign Affairs will review and submit to the competent authority for decision (Issues exceeding the Ministry of Foreign Affairs' jurisdiction will be referred to the Prime Minister for consideration and decision).Article 13. Management and Construction and Development of Housing
1. Construction and development of housing within the jurisdiction must be consistent with planning requirements, meeting the needs of modern urban development and improving the quality of life for citizens.
The People's Committee of Hanoi City shall have the responsibility to:
a) Annually publish publicly the plans and investment programs of the State regarding the renovation of old urban areas and the construction of new urban areas;
2. Within 10 working days from the date of receipt of the dossier as mentioned in Sub-clause b, Clause 1, Article 3 above, the Ministry of Foreign Affairs will review and submit to the competent authority for decision (Issues exceeding the Ministry of Foreign Affairs' jurisdiction will be referred to the Prime Minister for consideration and decision).b) Encourage organizations and individuals to invest, choose business models, develop housing, residential areas, and new urban areas that meet the requirements of each period and type of target group; pay special attention to building housing for low-income people; expand the real estate market;
c) Manage various types of housing funds within their jurisdiction.
3. Agencies, organizations, and individuals using houses under various forms of ownership must strictly comply with the provisions of the law and the regulations of the People's Committee of Hanoi City on housing management.
Article 14. Management and Construction and Development of Urban Technical Infrastructure Systems
1. The urban technical infrastructure system of the capital is classified as particularly important by the State and concentrated investments are made ahead of the requirements for the construction and development of the capital. Within 10 working days from the date of receipt of the dossier as mentioned in Sub-clause b, Clause 1, Article 3 above, the Ministry of Foreign Affairs will review and submit to the competent authority for decision (Issues exceeding the Ministry of Foreign Affairs' jurisdiction will be referred to the Prime Minister for consideration and decision).The State focuses on investing in the construction of a synchronized, modern urban technical infrastructure system that is consistent with the overall planning; prioritizing the development of urban transportation systems, completing information networks, power supply systems, water supply and drainage systems, waste treatment, and environmental sanitation in the capital.
a) Develop investment plans, organize unified management of investment activities, exploitation, and use of the urban technical infrastructure system within their jurisdiction according to the classification by the Government;
b) Delegate and classify management according to authority and issue regulations encouraging investment; establish operational guidelines for the exploitation and use of each type of urban technical infrastructure project.
Article 15. Management and Protection of the Environment
2. Within 10 working days from the date of receipt of the dossier as mentioned in Sub-clause b, Clause 1, Article 3 above, the Ministry of Foreign Affairs will review and submit to the competent authority for decision (Issues exceeding the Ministry of Foreign Affairs' jurisdiction will be referred to the Prime Minister for consideration and decision).b) Encourage organizations and individuals to invest, choose business models, develop housing, residential areas, and new urban areas that meet the requirements of each period and type of target group; pay special attention to building housing for low-income people; expand the real estate market;
1. The environment of the capital shall be protected and developed sustainably, ensuring green, clean, beautiful cities, ecological balance, contributing to improving the quality of life for citizens.
2. Agencies, organizations, and individuals shall have the responsibility to maintain and protect the environment at their places of residence, work, and public areas.
3. Ministries, agencies equivalent to ministries, and government agencies within their respective tasks and powers shall have the responsibility to guide and coordinate with the People's Committee of Hanoi City:
a) Invest in a synchronized environmental monitoring equipment system;
b) Annually organize evaluations of current conditions and environmental impacts and implement appropriate investment solutions.
a) Issue environmental protection regulations, manage sources causing harm to the environment; encourage organizations and individuals to participate in environmental protection; Within 10 working days from the date of receipt of the dossier as mentioned in Sub-clause b, Clause 1, Article 3 above, the Ministry of Foreign Affairs will review and submit to the competent authority for decision (Issues exceeding the Ministry of Foreign Affairs' jurisdiction will be referred to the Prime Minister for consideration and decision).b) Organize the relocation of production and business establishments causing environmental pollution to suitable locations; renovate the environment along streets, villages, and communes; address the causes of environmental pollution on-site;
c) Protect nature, maintain ecological balance; develop a network of parks, flower gardens, and green spaces within their jurisdiction.
b) Annually organize evaluations of current conditions and environmental impacts, and develop appropriate investment solutions.
4. Within 10 working days from the date of receipt of the dossier as mentioned in Sub-clause b, Clause 1, Article 3 above, the Ministry of Foreign Affairs will review and submit to the competent authority for decision (Issues exceeding the Ministry of Foreign Affairs' jurisdiction will be referred to the Prime Minister for consideration and decision).b) Encourage organizations and individuals to invest, choose business models, develop housing, residential areas, and new urban areas that meet the requirements of each period and type of target group; pay special attention to building housing for low-income people; expand the real estate market;
a) Issue environmental protection regulations, manage sources that cause harm to the environment; encourage organizations and individuals to participate in environmental protection;
b) Organize the relocation of production and business establishments causing environmental pollution to suitable locations; renovate the environment along streets, villages, and communes; address at the source causes of environmental pollution;
c) Protect nature, maintain ecological balance; develop networks of parks, flower gardens, and green spaces within the area.
Article 16. Population Management
1. The population within the territory shall be managed with appropriate scale, density, and structure according to the overall planning, suitable for the characteristics of the Capital.
2. The People's Council, Within 10 working days from the date of receipt of the dossier as mentioned in Sub-clause b, Clause 1, Article 3 above, the Ministry of Foreign Affairs will review and submit to the competent authority for decision (Issues exceeding the Ministry of Foreign Affairs' jurisdiction will be referred to the Prime Minister for consideration and decision).b) Encourage organizations and individuals to invest, choose business models, develop housing, residential areas, and new urban areas that meet the requirements of each period and type of target group; pay special attention to building housing for low-income people; expand the real estate market;
a) Shall promulgate preferential regulations and create favorable conditions for highly qualified individuals and excellent experts to reside and work within the territory;
b) Shall promulgate regulations on population management; stipulate measures to control and limit spontaneous and illegal immigration into the Capital;
c) Shall promulgate regulations on labor management; take measures to create new job opportunities, reduce unemployment rates; provide preferential treatment to those who have rendered meritorious service to the country; combat crime and social evils;
d) Shall promulgate the population management regulations within the territory in accordance with the provisions of the law.
Chapter IV
INVESTMENT CONSTRUCTION AND DEVELOPMENT OF THE CAPITAL CITY
Article 17. State Budget Investment for Construction and Development of the Capital
1. The State shall have special mechanisms and policies for investment from the budget and other financial sources for the Capital; allocate and gradually increase the budget allocation ratio in each three-year stable period.
The Capital shall be allowed to use the entire amount of annual budget surplus exceeding the plan as prescribed by law to invest in construction and development.
2. The People's Council and the People's Committee of Hanoi City shall have the responsibility within their respective tasks and powers to: Within 10 working days from the date of receipt of the dossier as mentioned in Sub-clause b, Clause 1, Article 3 above, the Ministry of Foreign Affairs will review and submit to the competent authority for decision (Issues exceeding the Ministry of Foreign Affairs' jurisdiction will be referred to the Prime Minister for consideration and decision).The People's Committee of Hanoi City shall be responsible for effectively utilizing the allocated state budget and attracting domestic and foreign investment funds through various forms to implement programs and projects for the construction and development of the Capital.
Article 18. Sources of Support Funds
The Government shall prioritize allocating official development assistance (ODA) funds together with domestic counterpart funds, funds for implementing programs and projects, and preferential credit sources for the Capital based on programs and projects for constructing urban technical infrastructure systems, environment, and public welfare facilities.
Article 19. Other Financial Measures
The People's Council, Within 10 working days from the date of receipt of the dossier as mentioned in Sub-clause b, Clause 1, Article 3 above, the Ministry of Foreign Affairs will review and submit to the competent authority for decision (Issues exceeding the Ministry of Foreign Affairs' jurisdiction will be referred to the Prime Minister for consideration and decision).The People's Committee of Hanoi City shall implement the following financial measures to construct and develop the Capital:
1. Issuing capital bonds for Capital construction;
2. Utilizing land funds to generate capital for constructing urban technical infrastructure and public welfare facilities in accordance with the provisions of the law;
3. Establishing a Capital Construction and Development Fund;
4. In cases of necessity, borrowing funds from various state financial sources, organizations, and individuals both domestically and internationally to invest in the construction and development of the Capital in accordance with the provisions of the law.
Chapter V
RESPONSIBILITIES FOR CONSTRUCTION, DEVELOPMENT AND PROTECTION OF THE CAPITAL
DEVELOPMENT AND PROTECTION OF THE CAPITAL
Article 20. Responsibilities of the Government
1. The Government shall be responsible:
a) Directly guiding the formulation and implementation of the overall planning, programs, and plans for economic and social development of the Capital; prioritizing timely resolution of issues related to the Capital; deciding on budget investment for the contents specified in point a, Clause 2, Article 8, point a, Clause 2, Article 9, Clause 1, Article 14, point d, Clause 1, Article 20, and point a, Clause 2, Article 21 of this Ordinance;
b) Directing relevant ministries, ministerial-level agencies, and government agencies to coordinate with Within 10 working days from the date of receipt of the dossier as mentioned in Sub-clause b, Clause 1, Article 3 above, the Ministry of Foreign Affairs will review and submit to the competent authority for decision (Issues exceeding the Ministry of Foreign Affairs' jurisdiction will be referred to the Prime Minister for consideration and decision).The People's Committee of Hanoi City in formulating and implementing programs and plans for Capital development; directing the establishment of some special mechanisms and policies for Capital development; mobilizing Within 10 working days from the date of receipt of the dossier as mentioned in Sub-clause b, Clause 1, Article 3 above, the Ministry of Foreign Affairs will review and submit to the competent authority for decision (Issues exceeding the Ministry of Foreign Affairs' jurisdiction will be referred to the Prime Minister for consideration and decision).The People's Committees of provinces and centrally-administered cities to participate, cooperate, and support the Capital in specific fields;
c) Specifying the responsibilities of state management by sector and territory between relevant ministries, ministerial-level agencies, and government agencies and Within 10 working days from the date of receipt of the dossier as mentioned in Sub-clause b, Clause 1, Article 3 above, the Ministry of Foreign Affairs will review and submit to the competent authority for decision (Issues exceeding the Ministry of Foreign Affairs' jurisdiction will be referred to the Prime Minister for consideration and decision).The People's Committee of Hanoi City in the cause of Capital construction and development;
d) Directing the planning and construction of the International Conference Center, National Assembly Headquarters, Revolutionary Museum, National Sports and Physical Culture Center, and headquarters of central agencies to serve national political, economic, cultural, and diplomatic activities.
2. The Prime Minister shall directly guide the work of urban construction and management in the Capital.
Article 21. Responsibilities of central agencies and local authorities throughout the country
1. Ministries, ministerial-level agencies, and agencies under the Government within their respective duties and powers shall be responsible for:
a) Formulating plans for investment in construction and development of the Capital City in accordance with the overall plan and specialized plans;
b) Coordinating with Within 10 working days from the date of receipt of the dossier as mentioned in Sub-clause b, Clause 1, Article 3 above, the Ministry of Foreign Affairs will review and submit to the competent authority for decision (Issues exceeding the Ministry of Foreign Affairs' jurisdiction will be referred to the Prime Minister for consideration and decision).the People's Committee of Hanoi City when establishing certain special mechanisms and policies for the Capital City and implementing investment programs and projects on its territory to ensure unified management in accordance with the plan;
c) Coordinating and creating conditions for Within 10 working days from the date of receipt of the dossier as mentioned in Sub-clause b, Clause 1, Article 3 above, the Ministry of Foreign Affairs will review and submit to the competent authority for decision (Issues exceeding the Ministry of Foreign Affairs' jurisdiction will be referred to the Prime Minister for consideration and decision).the People's Committee of Hanoi City to expand international exchange and cooperation activities and develop foreign economic relations.
2. Ministries, ministerial-level agencies, agencies under the Government, other state agencies, political organizations, and socio-political organizations at the central level shall be responsible for:
a) Based on the overall plan, concentrating investment in constructing office premises commensurate with the Capital City's status;
b) Coordinating with Within 10 working days from the date of receipt of the dossier as mentioned in Sub-clause b, Clause 1, Article 3 above, the Ministry of Foreign Affairs will review and submit to the competent authority for decision (Issues exceeding the Ministry of Foreign Affairs' jurisdiction will be referred to the Prime Minister for consideration and decision).the People's Committee of Hanoi City shall take care of living conditions for cadres and civil servants under their management who reside in the city.
3. Within 10 working days from the date of receipt of the dossier as mentioned in Sub-clause b, Clause 1, Article 3 above, the Ministry of Foreign Affairs will review and submit to the competent authority for decision (Issues exceeding the Ministry of Foreign Affairs' jurisdiction will be referred to the Prime Minister for consideration and decision).the People's Committees of provinces and centrally-administered cities shall proactively expand forms of linkage and cooperation with the Capital City in accordance with the needs and strengths of their locality, contributing to accelerating the pace of construction and development of the Capital City.
Article 22. Responsibilities of the People's Council, Within 10 working days from the date of receipt of the dossier as mentioned in Sub-clause b, Clause 1, Article 3 above, the Ministry of Foreign Affairs will review and submit to the competent authority for decision (Issues exceeding the Ministry of Foreign Affairs' jurisdiction will be referred to the Prime Minister for consideration and decision).the People's Committee of Hanoi City
1. The People's Council, Within 10 working days from the date of receipt of the dossier as mentioned in Sub-clause b, Clause 1, Article 3 above, the Ministry of Foreign Affairs will review and submit to the competent authority for decision (Issues exceeding the Ministry of Foreign Affairs' jurisdiction will be referred to the Prime Minister for consideration and decision).a) Directly manage the exploitation and utilization of natural resources, land, rivers, and lakes within their jurisdiction;
a) Proactively coordinating with ministries, ministerial-level agencies, and agencies under the Government to study and propose to the Government strategies for economic and social development, ensuring national defense and security, and special mechanisms and policies for the Capital City;
b) Coordinating with competent state agencies to provide services to ensure important internal and external activities of the Party and State;
- c) Expanding external activities, formulating programs and plans to actively integrate into regional and global economies; formulating the Capital City's foreign policy based on the Party and State's foreign policy guidelines;
d) Encouraging and creating favorable conditions for organizations and individuals to participate in international exchange and cooperation activities in economic, cultural-social, educational, scientific, and technological fields.
1. Loans from local government bonds are recorded as revenue in the provincial budget to fund approved projects. Within 10 working days from the date of receipt of the dossier as mentioned in Sub-clause b, Clause 1, Article 3 above, the Ministry of Foreign Affairs will review and submit to the competent authority for decision (Issues exceeding the Ministry of Foreign Affairs' jurisdiction will be referred to the Prime Minister for consideration and decision).the People's Committee of Hanoi City directly manages and directs urban construction and management work in the Capital City.
Article 23. Responsibilities of organizations and individuals
1. Organizations and individuals operating and residing in the Capital City shall be responsible for participating in building civilized and elegant lifestyles, maintaining social order and safety in the area; strictly complying with the provisions of this Ordinance, other relevant laws, and regulations of the People's Council, Within 10 working days from the date of receipt of the dossier as mentioned in Sub-clause b, Clause 1, Article 3 above, the Ministry of Foreign Affairs will review and submit to the competent authority for decision (Issues exceeding the Ministry of Foreign Affairs' jurisdiction will be referred to the Prime Minister for consideration and decision).the People's Committee of Hanoi City.
2. Within 10 working days from the date of receipt of the dossier as mentioned in Sub-clause b, Clause 1, Article 3 above, the Ministry of Foreign Affairs will review and submit to the competent authority for decision (Issues exceeding the Ministry of Foreign Affairs' jurisdiction will be referred to the Prime Minister for consideration and decision).the Vietnam Fatherland Front and its member organizations shall be responsible for coordinating with the People's Council, Within 10 working days from the date of receipt of the dossier as mentioned in Sub-clause b, Clause 1, Article 3 above, the Ministry of Foreign Affairs will review and submit to the competent authority for decision (Issues exceeding the Ministry of Foreign Affairs' jurisdiction will be referred to the Prime Minister for consideration and decision).the People's Committee of Hanoi City to ensure the exercise of people's mastery, implementation of grassroots democracy, and contribute to the construction, development, and protection of the Capital City.
Article 24. Responsibilities for protecting the Capital City
1. Protecting the Capital City is the responsibility of all agencies, organizations, and citizens.
2. Based on the tasks of ensuring national defense and security, the Government shall direct the Ministry of National Defense and the Ministry of Public Security to coordinate with ministries, ministerial-level agencies, and agencies under the Government to formulate plans for protecting and absolutely ensuring the safety of the Capital City in all situations.
3. Within 10 working days from the date of receipt of the dossier as mentioned in Sub-clause b, Clause 1, Article 3 above, the Ministry of Foreign Affairs will review and submit to the competent authority for decision (Issues exceeding the Ministry of Foreign Affairs' jurisdiction will be referred to the Prime Minister for consideration and decision).the People's Committee of Hanoi City within its duties and powers shall be responsible for directing the implementation and organizing forces to ensure national defense, security, and public order and safety in the area in conjunction with the implementation of economic and social development programs of the Capital City.
Chapter VI
REWARD AND VIOLATION HANDLING
Article 25. Awards
Organizations and individuals who make outstanding contributions to the cause of building, developing, and protecting the Capital City shall be rewarded according to the provisions of the law.
Article 26. Handling Violations
Organizations and individuals violating the provisions of this Ordinance and other relevant laws shall be subject to handling according to the provisions of the law depending on the nature and extent of the violation.
Chapter VII
IMPLEMENTING PROVISIONS
Article 27. Effective Date
This Ordinance takes effect from February 3, 2001.
Previous regulations contrary to this Ordinance are abolished.
Article 28. Guidance on Implementation
The Government shall provide detailed regulations and guidance for the implementation of this Ordinance./.
