Circular No. 29/2017/TT-BYT promulgates the Circular on standards, conditions, contents, and forms for considering promotion to higher ranks of occupational titles for health sector civil servants.

PROVISIONS ON STANDARDS, CONDITIONS, CONTENT, AND FORM OF PROMOTION REVIEW FOR THE RANK OF PROFESSIONAL TITLES OF HEALTH SPECIALIST CIVIL SERVANTS

Pursuant to the Civil Servant Law dated November 15, 2010;

Pursuant to Decree No. 29/2012/NĐ-CP dated April 12, 2012 of the Government on recruitment, utilization, and management of civil servants;

BASED ON DECREE NO. 75/2017/ND-CP dated June 20, 2017 of the Government stipulating functions, tasks, and powers;Government stipulates the functions, tasks, powers, and organizational structure ofthe Ministry of Health;

Pursuant to the proposal of the Director the Cadres and Civil Servants Organization Department;

The Minister of Health issues the Circular on standards, conditions, content, and form of promotion review for the rank of professional titles of health specialist civil servants.

Article 1. Scope of Regulation and Applicability

1. This Circular provides provisions on standards, conditions, content, and form of promotion review for the rank of professional titles of health specialist civil servants in public health service units.

2. This Circular applies to health specialist civil servants in public health service units.

3. For civil servants in the leadership and management machinery of public health service units currently holding the rank of professional titles of health specialist civil servants, this Circular shall apply to allow them to participate in the promotion review for the rank of professional titles of health specialist civil servants.

Article 2. Principles of Promotion Review for the Rank of Professional Titles of Health Specialist Civil Servants

1. In accordance with the authority, procedures, formalities, and legal regulations on promotion review for the rank of professional titles of civil servants.

2. Ensuring the appropriate position and the structure of civil servants according to the professional titles of public health service units.

3. Civil servants must meet the standards and conditions of the professional title being reviewed for promotion.

4. Ensuring equality, fairness, transparency, objectivity, and compliance with the law.

Article 3. Standards and Conditions for Registration of Promotion Review for the Rank of Professional Titles of Health Specialist Civil Servants

Civil servants are eligible to register for promotion review for the rank of professional titles when they meet the standards and conditions prescribed in Article 9 of Circular No. 12/2012/TT-BNV dated December 18, 2012, issued by the Ministry of Home Affairs on professional titles and changes in professional titles for civil servants (hereinafter referred to as Circular No. 12/2012/TT-BNV) and the following standards and conditions:

1. Promotion review from Class II to Class I

a) Meeting the standards of the professional title of health specialist civil servant Class I;

b) Holding the academic title of Professor or Associate Professor in a relevant field consistent with the standards of the professional title being reviewed for promotion;

c) Currently holding the professional title of Class II, having the same first four digits in the professional title code as the professional title being reviewed for promotion.

2. Promotion examination for occupational titles from Class III to Class II

a) Meeting the standards of the professional title of health specialist civil servant Class II;

b) Holding a Master's degree or Doctorate in a relevant field consistent with the standards of the professional title being reviewed for promotion;

c) Currently holding the professional title of Class III, having the ability to assume or currently working in a position consistent with the professional title being reviewed for promotion.

3. Promotion review from Class IV to Class III

a) Meeting the standards of the professional title of health specialist civil servant Class III;

b) Having a Bachelor's degree or higher in a relevant field consistent with the standards of the professional title being reviewed for promotion;

c) Currently holding the professional title of Class IV, having the ability to assume or currently working in a position consistent with the professional title being reviewed for promotion.

Article 4. Content and Form of Promotion Review for the Rank of Professional Titles of Health Specialist Civil Servants

1. The examination for promotion to higher rank in the professional title of health sector civil servants shall be conducted through the Examination Board for Promotion to Higher Rank in accordance with the provisions of the law.

2. The promotion review for the rank of professional titles must comply with the principles and standards of the professional title being reviewed for promotion. Civil servants registering for promotion review for the rank of professional titles must meet all the standards, conditions, and documents as prescribed in Articles 3 and 5 of this Circular.

3. Content of Promotion Review for the Rank of Professional Titles: The Promotion Review Board for the Rank of Professional Titles of Health Specialist Civil Servants examines and evaluates the dossier to appoint or recommend the competent authority to consider and appoint to a higher rank of professional titles.

Article 5. Documents for consideration of promotion to higher rank in the healthcare profession

1. Registration documents for consideration of promotion to higher rank:

a) Application form for registration of consideration for promotion to higher rank according to Appendix 1 issued together with this Circular;

b) Brief resume of the civil servant according to Model No. 2 issued together with Circular No. 12/2012/TT-BNV and confirmed by the agency or unit using or managing the civil servant;

c) Evaluation and assessment by the head of the agency or unit employing the civil servant in cases where the civil servant does not hold a managerial position, or by the head of the agency or unit authorized to appoint managerial civil servants;

d) Copies of diplomas and certificates according to the registered rank for promotion, certified by the competent agency or unit;

đ) Copies of decisions: Appointment to the civil servant's professional rank for the most recent salary increase;

e) Health certificate issued by the health authority within 30 days from the final date of submission of the application for registration of consideration for promotion to higher rank.

2. The retention and management of registration documents for consideration of promotion to higher rank in the healthcare profession shall be carried out in accordance with Clause 2, Article 10 of Circular No. 12/2012/TT-BNV.

Article 6. Organization of Consideration for Promotion to Higher Rank in the Healthcare Profession

1. For consideration of promotion from Rank II to Rank I in the healthcare profession, annually, based on the Ministry of Health’s plan for consideration of promotion to higher rank in the healthcare profession, the Ministries, agencies at the level of ministries, government agencies, People's Committees of provinces and centrally-administered cities shall establish lists and documents of civil servants meeting all criteria and conditions for consideration of promotion from Rank II to Rank I and submit them to the Ministry of Health for organization of consideration for promotion in accordance with regulations. After completion, the Ministry of Health will send the decision recognizing the results of the consideration for promotion from Rank II to Rank I to the Ministry of Home Affairs.

2. For consideration of promotion from Rank III to Rank II in the healthcare profession, the competent authority organizing the consideration for promotion as stipulated in Point a, Clause 2, Article 30 of Government Decree No. 29/2012/NĐ-CP dated April 12, 2012 on recruitment, utilization, and management of civil servants (hereinafter referred to as Decree No. 29/2012/NĐ-CP) shall establish a Board for consideration of promotion to higher rank in the healthcare profession; decide the list of civil servants for consideration of promotion to higher rank in the healthcare profession after reaching a consensus with the Ministry of Home Affairs. After completion, report the results to the Ministry of Health and the Ministry of Home Affairs for monitoring and summarizing.

3. For consideration of promotion from Rank IV to Rank III in the healthcare profession, based on the decentralization provisions of the competent authorities organizing the consideration for promotion from Rank IV to Rank III as stipulated in Clause 3, Article 30 of Decree No. 29/2012/NĐ-CP, the head of the competent authority shall develop a plan for organization of consideration for promotion to higher rank in the healthcare profession; establish a Board for consideration of promotion to higher rank in the healthcare profession; decide the list of civil servants for consideration of promotion to higher rank in the healthcare profession after reaching a consensus with the Personnel Department of the Ministries, agencies at the level of ministries, government agencies, or the Provincial Departments of Home Affairs of centrally-administered cities. After completion, report the results to the Ministry of Health and the Ministry of Home Affairs for monitoring and summarizing.

4. Based on Joint Circular No. 56/2015/TTLT-BYT-BNV dated December 29, 2015 of the Minister of Health and the Minister of Home Affairs on standards, conditions, contents, and forms of examination for promotion to higher rank in the healthcare profession and the provisions of this Circular, the heads of units authorized to consider promotion from Rank IV to Rank III may choose the form of examination or consideration for promotion for civil servants in the healthcare profession from Rank IV to Rank III.

Article 7. Procedures, formalities, and authority for nominating civil servants to participate in rank promotion examinations, examination boards for rank promotion, determining successful candidates, appointment, and job classification salary

1. The procedures, formalities, and authority for nominating civil servants to participate in rank promotion examinations for professional ranks in the health sector shall be implemented in accordance with the provisions set forth in Article 11 of Circular No. 12/2012/TT-BNV.

2. Examination boards for rank promotion of professional ranks for civil servants in the health sector shall be established in accordance with the provisions set forth in Article 13 of Circular No. 12/2012/TT-BNV.

3. Determining successful candidates in the rank promotion examination for professional ranks of civil servants in the health sector shall be carried out in accordance with the provisions set forth in Clause 2 and Clause 3 of Article 14 of Circular No. 12/2012/TT-BNV.

In cases where the number of individuals meeting the criteria and conditions for participating in the rank promotion examination for professional ranks exceeds the number of positions allocated within the organizational structure of public health institutions approved by the competent authority, the examination board for rank promotion of professional ranks shall consider in the following priority order:

a) Scientific research achievements;

b) Years held at the current professional rank;

c) Results of civil servant evaluation and classification over two consecutive years prior to the rank promotion examination;

d) Interview results (if applicable).

4. Appointment and job classification salary for civil servants in the health sector shall be implemented in accordance with the provisions set forth in Article 15 of Circular No. 12/2012/TT-BNV.

Article 8. Effective Date

This Circular takes effect from September 1, 2017.

Article 9. Cross-References

In case the regulatory legal documents and provisions cited in this Circular are amended, supplemented, or replaced, they shall be implemented according to the new regulatory legal documents.

Article 10. Responsibility for Implementation

The Minister, Heads of Ministries equivalent to Ministries, Heads of Government Agencies; Chairpersons of People's Committees of provinces and centrally governed cities, and Heads of public health institutions shall base their decisions on the criteria and conditions stipulated in this Circular within their respective authorities for rank promotion of professional ranks and shall be responsible for the criteria and conditions of civil servants subject to rank promotion in accordance with the relevant laws.

During implementation, if there are any difficulties, they are requested to report to the Ministry of Health for consolidation, consideration, and resolution./.
