Pursuant to Decree No.04/CP||| January 16, 1995 of the Government on the Regulations on Protection of National Defense Works and Military Zones;

Pursuant to Decree No.58/2017/NĐ-CP||| May 10, 2017 of the Government detailing certain provisions ofThe Vietnam Maritime Code||| concerning maritime activities management;

"Based on the proposal of the Minister of National Defense;"

The Prime Minister issues the Decision amending and supplementing some articles of the Regulations on the Management of Activities at the Cam Ranh International Port - Ministry of National Defense issued together with Decision No.25/2016/QĐ-TTg||| June 27, 2016 of the Prime Minister.

Article 1. Amending and supplementing some articles of the Regulations on the Management of Activities at the Cam Ranh International Port - Ministry of National Defense (hereinafter referred to as the Cam Ranh International Port) issued together with Decision No. 25/2016/QĐ-TTg dated June 27, 2016 of the Prime Minister:

1. Clause 4 is amended and supplemented as follows:

"Article 4. Scope of the Cam Ranh International Port

1. The Cam Ranh International Port includes land and water areas within the Cam Ranh Military Base area.

2. The boundary between the Cam Ranh International Port and the Cam Ranh Military Base is delineated by a fence system and buoy signals.

3. The Minister of National Defense shall specify in detail the land and water areas and regulations for entering and exiting the Cam Ranh International Port by road."

2. Clause 5 is amended as follows:

"Article 5. Technical Infrastructure of the Cam Ranh International Port

1. Traffic principles in the Cam Ranh International Port area:

a) Ensuring convenience for cargo transportation, management, equipment operation, security, and fire prevention and explosion control; internal traffic routes must be divided and designated for each type of vehicle, with hard and soft separation strips, traffic signs, and signals complying with the current Vietnamese Road Traffic Law; there must be guidance for pedestrians and persons with disabilities;

b) Segments prohibiting foreign individuals and vehicles from participating in traffic must be marked with warning signs.

2. Signage System

a) In the port area and access roads to the Cam Ranh International Port, directional signs must be installed at locations such as storage areas, buying and selling points, packaging and repackaging points, sorting and resorting points, reinforcement and repair points, equipment maintenance points, goods display areas, fire and explosion prevention equipment storage areas, entrances and exits, and other relevant activity points;

b) Directional signs must be placed in easily visible positions;

c) Directional signs must be written in Vietnamese with English subtitles below the Vietnamese text, the English text must be smaller than the Vietnamese text.

3. Information and security surveillance and protection systems in the Cam Ranh International Port area must be connected to relevant agencies to provide and exchange necessary information for port operations according to current laws and regulations of the Ministry of National Defense."

3. The name of Chapter II is amended as follows:

"Chapter II

MANAGEMENT OF ACTIVITIES AT THE CAM RANH INTERNATIONAL PORT"

4. Clause 9 is amended and supplemented as follows:

"Article 9. Management of Activities of Vietnamese Civilian Personnel and Vessels, Foreign Civilian Vessels in the Waters of the Cam Ranh International Port

The management of activities of Vietnamese civilian personnel and vessels, and foreign civilian vessels in the waters of the Cam Ranh International Port shall be carried out in accordance with Decree No. 58/2017/ND-CP dated May 10, 2017 of the Government detailing certain provisions of the Vietnam Maritime Code on maritime activities management (hereinafter referred to as Decree No. 58/2017/ND-CP); Decree No. 71/2015/ND-CP dated September 3, 2015 of the Government on the management of activities of people and means in the coastal border area of the Socialist Republic of Vietnam (hereinafter referred to as Decree No. 71/2015/ND-CP); Decree No. 77/2017/ND-CP dated March 17, 2017 of the Government on management and protection of security and order at port gateways (hereinafter referred to as Decree No. 77/2017/ND-CP)" and other related legal provisions.

5. Supplement Article 10a as follows:

"Article 10a. Vietnamese Personnel and Means Entering and Exiting the Cam Ranh International Port

1. For Vietnamese military personnel and military means of transport, they shall comply with the regulations of the Ministry of National Defense.

2. For civilian personnel and means entering and exiting the Cam Ranh International Port according to plans, the following procedures apply:

a) Authority to issue permits: The Command of the Fourth Naval Zone issues permits for civilian personnel and means entering and exiting the Cam Ranh International Port.

b) Application documents include: A request for permit issuance for personnel and means entering and exiting the Cam Ranh International Port from the Tan Cang - Petro Cam Ranh Company accompanied by a list of personnel and means entering and exiting the Cam Ranh International Port according to Model Nos. 07, 08, 09 issued together with this Decision.

c) Procedure: After receiving registration requests from organizations and individuals for entry and exit from the Cam Ranh International Port, the Tan Cang - Petro Cam Ranh Company must prepare one set of application documents in accordance with point b of this clause and submit them directly to the Command of the Fourth Naval Zone (through the Security Protection Department) at least two days before the expected entry and exit date. Within one day of receiving valid application documents, the Command of the Fourth Naval Zone will review and approve entry and exit permits for personnel and means; if not approved, the reasons must be specified. After the result is obtained, the Tan Cang - Petro Cam Ranh Company will notify the organization or individual to proceed.

3. Vietnamese personnel and means of state management agencies at the Cam Ranh International Port; organizations and enterprises that have long-term contracts with the Tan Cang - Petro Cam Ranh Company and frequently enter and exit the Cam Ranh International Port may be granted entry and exit permits valid for three months, as follows:

a) Issuing authority for entry and exit permits: The Command of the Fourth Naval Zone issues entry and exit permits to the international port of Cam Ranh for personnel and vehicles of state management agencies at the international port of Cam Ranh; organizations and enterprises that have long-term contracts with Tan Cang - Petro Cam Ranh Company.

b) Application documents for issuing entry and exit permits include: A request for issuance of entry and exit permits to the international port of Cam Ranh from Tan Cang - Petro Cam Ranh Company accompanied by a list of personnel and vehicles entering and exiting the international port of Cam Ranh according to Model No. 10, 11, 12 issued together with this Decision; a copy of Identity Card or Citizen Identification Card or Passport; a copy of vehicle registration certificate.

c) Procedure and formalities: After receiving the application for issuance of entry and exit permits to the international port of Cam Ranh from agencies, organizations, and enterprises, Tan Cang - Petro Cam Ranh Company shall prepare one set of application documents in accordance with point b of this clause and submit them directly to the Command of the Fourth Naval Zone (through the Security Protection Department) no later than four days before the expected entry and exit of personnel and vehicles at the international port of Cam Ranh. Within three days from the date of receipt of valid application documents, the Command of the Fourth Naval Zone will issue entry and exit permits according to Model No. 13 issued together with this Decision; if the permit is not issued, the reasons must be clearly stated. After obtaining the result, Tan Cang - Petro Cam Ranh Company will notify the relevant organizations and individuals to implement.

4. In case of urgent situations, visitors arriving on the same day, or during holidays, Tan Cang - Petro Cam Ranh Company shall prepare a list of personnel and vehicles entering and exiting the international port of Cam Ranh according to Model No. 08, 09 issued together with this Decision and submit it directly to the Command of the Fourth Naval Zone (through the Security Protection Department) while coordinating with security forces at the base, and dispatching personnel to guide visitors and vehicles entering and exiting the international port of Cam Ranh.

5. For Vietnamese crew members and passengers on vessels moored at the international port of Cam Ranh when going ashore, they may use one of the following documents: Identity Card; Citizen Identification Card; Passport or Seaman's Book and their names must be included in the list of crew members and passengers reported by Tan Cang - Petro Cam Ranh Company to the Command of the Fourth Naval Zone, instead of an Entry and Exit Permit.

6. Supplement Article 10b as follows:

"Article 10b. Foreigners, Vietnamese residing abroad, and Vietnamese working for foreign organizations entering and exiting the international port of Cam Ranh"

1. For foreigners and Vietnamese residing abroad holding foreign passports entering and exiting the international port of Cam Ranh

a) Issuing authority: The Navy Command issues permits for foreigners and Vietnamese residing abroad holding foreign passports to enter and exit the international port of Cam Ranh.

b) Application documents for issuing permits: A request for issuance of permits for foreigners and Vietnamese residing abroad holding foreign passports to enter and exit the international port of Cam Ranh from Tan Cang - Petro Cam Ranh Company accompanied by a list of foreigners and Vietnamese residing abroad holding foreign passports entering and exiting the international port of Cam Ranh according to Model No. 14, 15 issued together with this Decision; a copy of Passport or travel document.

c) Procedure and formalities for handling: After receiving the application from organizations and individuals registering to enter and exit the international port of Cam Ranh, Tan Cang - Petro Cam Ranh Company shall prepare three sets of application documents in accordance with point b of this clause and submit them directly to the Navy Command (through the External Relations Department), and also send them to the Navy General Staff (through the Operations Department) and the Navy Political Department (through the Security Protection Department) no later than five days before the expected entry and exit of foreigners and Vietnamese residing abroad holding foreign passports at the international port of Cam Ranh. Within three working days from the date of receipt of valid application documents, the Navy Command will respond in writing according to Model No. 16 issued together with this Decision, sending it to the Command of the Fourth Naval Zone and Tan Cang - Petro Cam Ranh Company; if the permit is not issued, the reasons must be clearly stated. After obtaining the result, Tan Cang - Petro Cam Ranh Company will notify the relevant organizations and individuals to implement.

2. For Vietnamese residing abroad holding Vietnamese passports, and Vietnamese working for foreign organizations entering and exiting the international port of Cam Ranh

a) Issuing authority: The Security Protection Office (Navy Political Department) issues permits for Vietnamese residing abroad holding Vietnamese passports and Vietnamese working for foreign organizations to enter and exit the international port of Cam Ranh.

b) Application documents for issuing permits: A request for issuance of permits for Vietnamese residing abroad holding Vietnamese passports and Vietnamese working for foreign organizations to enter and exit the international port of Cam Ranh from Tan Cang - Petro Cam Ranh Company accompanied by a list of Vietnamese residing abroad holding Vietnamese passports and Vietnamese working for foreign organizations entering and exiting the international port of Cam Ranh according to Model No. 17, 18 issued together with this Decision; a copy of Passport or Identity Card or Citizen Identification Card.

c) Procedure and formalities for handling: After receiving the application from organizations and individuals registering to enter and exit the international port of Cam Ranh, Tan Cang - Petro Cam Ranh Company shall prepare one set of application documents in accordance with point b of this clause and submit it directly to the Navy Political Department (through the Security Protection Office) no later than five days before the expected entry and exit of personnel and vehicles at the international port of Cam Ranh. Within two days from the date of receipt of valid application documents, the Security Protection Office will respond in writing according to Model No. 19 issued together with this Decision, sending it directly to the Command of the Fourth Naval Zone and Tan Cang - Petro Cam Ranh Company; if the permit is not issued, the reasons must be clearly stated. After obtaining the result, Tan Cang - Petro Cam Ranh Company will notify the relevant organizations and individuals to implement.

3. For foreign crew members and passengers on vessels moored at the international port of Cam Ranh when going ashore: Passengers use passports or travel documents, while crew members use shore passes issued by border guards according to Vietnamese law and their names must be included in the list of crew members and passengers reported by Tan Cang - Petro Cam Ranh Company to the Command of the Fourth Naval Zone, instead of an Entry and Exit Permit.

7. Article 11 is amended as follows:

"Article 11. Regulations on pilotage services for vessels in the waters of Cam Ranh International Port

1. Foreign vessels shall implement mandatory pilotage when arriving at, departing from, or navigating within the waters of Cam Ranh International Port. Civilian Vietnamese vessels shall comply with the pilotage regulations stipulated in Article 247 of the Vietnam Maritime Code.

2. The provision of pilotage services to vessels when arriving at, departing from, or navigating within the waters of Cam Ranh International Port shall be organized and implemented by the maritime pilot organization under the Ministry of National Defense in accordance with the provisions of Clause 103 of Decree No. 58/2017/ND-CP and other relevant legal regulations.

3. The responsibilities and obligations of pilots guiding vessels shall be carried out in accordance with the provisions of Clauses 104 and 105 of Decree No. 58/2017/ND-CP and other relevant legal regulations."

8. Article 18 is amended as follows:

"The organization of maritime and naval exhibitions in the area of Cam Ranh International Port shall be conducted in accordance with the provisions of Chapter III of Decree No. 81/2018/ND-CP dated May 22, 2018, of the Government detailing the Law on Trade regarding trade promotion activities and other relevant legal regulations."

9. Article 19 is amended as follows:

"1. Medical examination and treatment activities of healthcare service facilities in the area of Cam Ranh International Port shall be carried out in accordance with Decree No. 87/2011/ND-CP dated September 27, 2011, of the Government detailing and guiding the implementation of certain provisions of the Law on Medical Examination and Treatment; Decree No. 54/2017/ND-CP dated May 8, 2017, of the Government detailing certain provisions and measures for implementing the Law on Medicines, and other relevant legal regulations.

2. Disease prevention and control activities shall be conducted in accordance with Decree No. 89/2018/ND-CP dated June 25, 2018, detailing the implementation of certain provisions of the Law on Prevention and Control of Infectious Diseases concerning border health quarantine, and other relevant legal regulations."

Article 2. This Decision takes effect from November 25, 2019.

Article 3.Ministers, heads of ministerial-level agencies, heads of government-affiliated agencies, Chairpersons of provincial and centrally-administered city People's Committees, and related agencies and organizations are responsible for implementing this Decision./.
