CIRCULAR

Regulations on energy consumption levels in industrial plastic production

      Pursuant to the Law on Rational Energy Use and Efficiency dated June 17, 2010;

  Pursuant to Decree No. 96/2022/NĐ-CP dated November 29, 2022 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Industry and Trade;

     Pursuant to Decree No. 105/2024/NĐ-CP dated August 1, 2024 of the Government amending and supplementing certain articles of Decree No. 96/2022/NĐ-CP dated November 29, 2022 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Industry and Trade and Decree No. 26/2018/NĐ-CP dated February 28, 2018 of the Government on the Charter of Organization and Operation of Vietnam Electricity Corporation;

       At the proposal of the Director of the Department of Energy Saving and Sustainable Development;

      The Minister of Industry and Trade promulgates this Circular stipulating energy consumption levels in the plastic manufacturing industry.

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation

This Circular stipulates the methods for determining energy consumption levels, energy consumption quotas, and reporting procedures in the plastic manufacturing industry.

Article 2. Applicability

1. Plastic product manufacturing facilities such as packaging plastics, construction materials plastics, household plastics, technical plastics with electricity usage of 3,000,000 kWh/year or more.

2. Other relevant agencies, organizations, and individuals.

Article 3. Explanation of Terms

1. Energy consumption level (SEC) is the total amount of energy used to produce one unit of product volume.

2. Energy consumption quota is the energy consumption level applied to specific products as prescribed in this Circular.

3. Plastic bag: is a nylon bag produced using extrusion blow molding technology.

4. Plastic bottle: includes bottles made from PET (Polyethylene Terephthalate) using blow molding technology and other bottles produced using extrusion blow molding technology.

5. Packaging plastic: includes plastic film products (shrink PE film (Polyethylene), food wrap film, protective film, bubble wrap film), multi-layer packaging, household tape, plastic sheet.

6. Construction material plastic: includes various types of plastic pipes used in construction produced through extrusion forming processes using PVC (Polyvinylchloride), HDPE (High Density Polyethylene), and PPR (Polypropylene Random Copolymers) materials.

7. Household plastic: includes household plastic products produced through injection molding processes such as kitchenware, bathroom items, cleaning tools, storage boxes, plastic baskets, plastic toys, chairs, baby strollers, tables, plant pots, watering cans.

8. Technical plastic: includes technical plastic products produced through injection molding processes, excluding technical plastic components used in electrical-electronic equipment.

PART II

METHODS FOR DETERMINING ENERGY CONSUMPTION LEVELS AND QUOTAS IN THE PLASTIC INDUSTRY AND REPORTING REGIMES

Article 4. Method for Determining Energy Consumption Levels

Energy consumption levels in the plastic manufacturing industry shall be determined according to the method prescribed in Appendix I of this Circular.

Article 5. Energy Consumption Quotas

Energy consumption quotas applicable to plastic product manufacturing facilities are specified as follows:

Article 6. Regular Reporting System on the Implementation of Energy Consumption Standards in the Plastic Manufacturing Industry

1. By January 31 each year, plastic product manufacturing facilities shall be responsible for reporting to the Department of Industry and Trade of their locality in writing through direct submission, postal service, or via the website https://dataenergy.vn regarding the implementation of energy consumption standards according to the form prescribed in Appendix III attached to this Circular. In case of reporting through the website https://dataenergy.vn, the plastic product manufacturing facility shall be responsible for contacting the Department of Industry and Trade to establish and provide an account.

Within twenty working days from the date of receipt of the report from the plastic product manufacturing facility, the Department of Industry and Trade shall provide feedback and request additional information if necessary.

Within five working days from the date of receipt of the request for additional information from the Department of Industry and Trade, the plastic product manufacturing facility shall be responsible for revising and supplementing the information as required.

2. By March 31 each year, the Department of Industry and Trade shall report on the implementation of energy consumption standards to the Ministry of Industry and Trade (Department of Energy Saving and Sustainable Development) in writing through direct submission, postal service, or via the website https://dataenergy.vn according to the form prescribed in Appendix II attached to this Circular.

Chapter III

IMPLEMENTATION

Article 7. Responsibilities of the Department of Energy Saving and Sustainable Development

1. To take the lead and coordinate with relevant agencies to disseminate, promote, and guide organizations and individuals related to the implementation of the provisions of this Circular.

2. To coordinate with local Departments of Industry and Trade to inspect the implementation of energy consumption standards for plastic manufacturing facilities within the scope regulated by this Circular.

3. To compile and statistically analyze energy consumption data for the plastic industry based on reports from localities.

Article 8. Responsibilities of the Department of Industry and Trade

1. Annually, to take the lead in guiding, urging, reminding, developing inspection plans, and inspecting compliance with energy consumption standards for manufacturing facilities subject to this Circular at the local level and handle violations according to the law.

2. To coordinate with the Department of Energy Saving and Sustainable Development to guide, urge, and inspect the implementation of energy consumption standards according to the contents of this Circular.

3. To implement the reporting system as stipulated in Article 6 of this Circular.

Article 9. Responsibilities of Plastic Manufacturing Facilities

1. To manage and supervise the production process to determine the amount of energy consumed.

2. To comply with the energy consumption standards prescribed in Article 5 of this Circular. In cases where changes or fluctuations during production prevent the facility from meeting the standards, the facility shall be responsible for reporting and explaining to the competent authority the reasons and plans for implementation to meet the standards based on an energy audit report.

3. To implement the reporting system as stipulated in Article 6 of this Circular.

Article 10. Effective Date

This Circular takes effect from April 1, 2025, and replaces Circular No. 38/2016/TT-BCT dated December 28, 2016, issued by the Ministry of Industry and Trade on energy consumption standards in the plastic industry.

2. During the course of implementation, if there are any issues or difficulties, relevant agencies, organizations, and individuals shall promptly report to the Ministry of Industry and Trade for study, amendment, and supplementation of the Circular./.
