CIRCULAR

Regulations on the selection and recruitment of professional military personnel, defense workers, and defense civil servants

 

Circular No. 241/2017/TT-BQP dated September 29, 2017, issued by the Minister of National Defense, regarding the selection and recruitment of professional military personnel, defense workers, and defense civil servants, took effect from November 15, 2017, and was amended and supplemented by:

Circular No. 65/2025/TT-BQP dated July 3, 2025, issued by the Minister of National Defense, amending and supplementing certain articles of Circulars of the Minister of National Defense concerning age calculation for military service; issuance, management, and use of identification cards and certificates; selection and recruitment of professional military personnel, defense workers, and defense civil servants; promotion, demotion, appointment, dismissal, and discharge procedures for non-commissioned officers and conscripts; forms, contents, and times of activities for reserve military personnel, taking effect from July 3, 2025.

Based on the Law on Professional Military Personnel, Defense Workers, and Defense Civil Servants dated November 26, 2015;

Based on Decree No. 35/2013/NĐ-CP dated April 22, 2013, of the Government, stipulating the functions, tasks, powers, and organizational structure of the Ministry of National Defense;

At the proposal of the Chief of General Staff;

The Minister of National Defense issues this Circular to regulate the selection and recruitment of professional military personnel, defense workers, and defense civil servants[1].

Chapter I. GENERAL PROVISIONS

Article 1. Scope of Regulation

This Circular stipulates the principles, subjects, conditions, standards, authorities, procedures, and processes for the selection and recruitment of professional military personnel, defense workers, and defense civil servants; responsibilities of agencies, organizations, units, and individuals.

Article 2. Applicability

This Circular applies to agencies, organizations, units (hereinafter referred to collectively as agencies and units), and individuals related to the selection and recruitment of professional military personnel, defense workers, and defense civil servants.

Article 3. Explanation of Terms

In this Circular, the following terms are understood as follows:

1. Selection is the process of choosing military personnel, defense workers, and defense civil servants who meet the political qualities, morals, health, and professional technical and vocational qualifications to serve under the professional military personnel system or defense worker system or defense civil servant system.

2. Recruitment is the process of selecting citizens outside the military who meet the conditions and standards to work at agencies and units within the standing forces of the People's Army, assuming positions in the establishment as professional military personnel or job positions as defense workers or occupational titles as defense civil servants.

Article 4. Principles of Implementation

The principles of selection and recruitment shall be carried out in accordance with Article 8 of the Law on Professional Military Personnel, Defense Workers, and Defense Civil Servants and the following provisions:

1. Implement the principle of centralized democracy; emphasize the responsibility of party committees and commanders of agencies and units,

2. Ensure the correct target, sufficient conditions, and standards to meet the requirements of tasks, establishments, and positions.

3. Correct authority, procedure, and annual quotas assigned.

Article 5. Authority for Selection and Recruitment

The Minister of National Defense decides on the selection and recruitment of professional military personnel, defense workers, and defense civil servants.

Chapter II. SELECTION OF PROFESSIONAL MILITARY PERSONNEL, DEFENSE WORKERS, AND DEFENSE CIVIL SERVANTS

Article 6. Subjects of Selection

1. Professional military personnel shall be implemented in accordance with Clause 1 of Article 14 of the Law on Professional Military Personnel, Defense Workers, and Defense Civil Servants.

2. Defense workers and defense civil servants shall be implemented in accordance with Clause 1 of Article 28 of the Law on Professional Military Personnel, Defense Workers, and Defense Civil Servants.

Article 7. Conditions for Selection

For professional military personnel, follow the provisions of Clause 3, Article 14; for defense workers and defense civil servants, follow the provisions of Clause 3, Article 28 of the Law on Professional Military Personnel, Defense Workers, and Defense Civil Servants, and the following regulations:

1. The People's Army has a need for staffing.

2. Currently holding a position that is to be arranged as a professional military personnel or a job position as a defense worker or a professional title as a defense civil servant.

3. Possessing appropriate technical expertise and vocational skills corresponding to the position of professional military personnel or the job position of defense worker or the professional title of defense civil servant.

Article 8. Standards for Selection

1. Individuals meeting the following standards shall be selected as professional military personnel, defense workers, and defense civil servants:

a)[2] Political quality and morality shall be implemented according to Circular No. 05/2019/TT-BQP dated January 16, 2019, issued by the Minister of National Defense, stipulating political standards for officers, professional military personnel, defense workers, and defense civil servants in the People's Army of Vietnam; Article 10 of Circular No. 263/2013/TT-BQP dated December 31, 2013, issued by the Minister of National Defense, stipulating agencies, units, and key positions in the military, and having the ability and responsibility to complete assigned tasks, ready to fight and sacrifice to protect the Party, State, People, and socialist regime, national independence, sovereignty, territorial integrity, and national security.

b)[3] Health:

Meeting health standards of Class 1, Class 2, or Class 3 as prescribed in Circular No. 105/2023/TT-BQP dated December 6, 2023, issued by the Minister of National Defense, stipulating health standards and health examinations for subjects under the management of the Ministry of National Defense.

c) Educational level: Graduated from secondary education or higher.

2.[4] Professional military personnel, defense workers, and defense civil servants shall not be selected for individuals falling within one of the cases prescribed in Article 8 of Circular No. 05/2019/TT-BQP; Article 11 of Circular No. 263/2013/TT-BQP.

Article 9. Priority in Selection

Priority in selection shall be given to individuals who meet the provisions of Clause 5, Article 8, Clause 4, Article 14, and Clause 4, Article 28 of the Law on Professional Military Personnel, Defense Workers, and Defense Civil Servants, and the following regulations:

1. Non-commissioned officers and soldiers who have achieved outstanding results in performing their duties at the agency or unit and have been awarded the title of Model Soldier at the grassroots level or higher by the competent authority.

2. Graduates of college or university programs in specialized technical and vocational fields of the military that are not trained, suitable for the position of professional military personnel or the job position of defense worker or the professional title of defense civil servant.

3. Individuals with special talent and aptitude meeting the requirements of tasks and staffing in the People's Army in sports, arts, and other fields.

4. Members of ethnic minorities.

Article 10. Application Documents for Selection

1. A voluntary application form to serve in the military under the professional military personnel system or defense worker system or defense civil servant system according to Form No. 01 attached as an appendix to this Circular.

2. Certified copies of technical and vocational certificates and transcripts of academic records for the entire course of study. In cases where certificates and transcripts are issued by educational institutions abroad, they must be translated into Vietnamese and certified by the competent authority in accordance with the law regarding the level of education.

3. An evaluation and review report by the competent authority classifying the results of fulfilling assigned responsibilities and tasks:

a) Evaluation and classification form for officers, professional military personnel, defense workers, and defense civil servants.

b) Review form for non-commissioned officers and soldiers.

Article 11. Procedures and formalities for selecting professional soldiers, defense workers, and defense officials

1. The subjects specified in Article 6 of this Circular who wish to establish one selection file, including the documents prescribed in Clause 1 and Clause 2 of Article 10 of this Circular, shall directly submit such file to battalion, company-level units and equivalent units.

2. Within five working days from the date of receiving complete selection files, battalion, company-level units and equivalent units shall be responsible for:

a) Evaluating the qualifications and professional skills of each person proposed for selection;

b) Organizing the verification of conditions, standards, and requirements for positions of professional soldiers or jobs of defense workers or occupational titles of defense officials;

c) Verifying certificates and diplomas of each person proposed for selection;

d) Summarizing and reporting to the Party Committee and Command for review and reporting to the immediate superior unit in writing according to the management hierarchy.

3. Within ten working days from the date of receiving the report proposing from subordinate agencies and units: The military force agency at regiment, brigade, and equivalent levels and above shall be responsible for summarizing and reviewing the reports proposed by subordinate units; verifying conditions, standards, health status; certificates and diplomas; deployment plans and staffing needs of each person applying for selection; and reporting to the Party Committee and Command for review and reporting in writing to the Military Region, Army Corps, Military Branch, Armed Forces Service, and equivalent units (hereinafter referred to collectively as subordinate units under the Ministry of Defense).

4. Not later than twenty days from the date of receiving the report from the immediate subordinate unit: The military force agency of the subordinate unit under the Ministry of Defense shall be responsible for summarizing and reviewing; verifying conditions, standards; certificates and diplomas; deployment plans and staffing needs of the unit; reporting to the Party Committee and Command for review and reporting in writing to the General Department of Military Affairs.

5. Within forty-five days from the date of receiving the report proposing from the subordinate unit under the Ministry of Defense, the General Department of Military Affairs shall be responsible for reviewing and summarizing the report to the Deputy Chief of General Staff for decision by the Minister of Defense.

6. After receiving the decision of the Minister of Defense on the selection for service under the professional soldier, defense worker, and defense official system, not later than fifteen days, the Command of the regiment and equivalent level must announce and hand over the decision to the selected subject.

7. For graduates of technical and vocational training programs at educational institutions according to the plan of the Ministry of Defense; after graduation, the Party Committee and Command of the educational institution shall review and report to the immediate superior unit according to the management hierarchy for decision by the Minister of Defense.

8.[5] Selection for service under the reserve professional soldier system for non-commissioned officers and soldiers currently serving in the reserve ranks of the Military shall be organized and implemented by the Regional Defense Command, in coordination with the Military District Command and the reserve mobilization unit, in accordance with Clauses 1, 2, 3, and Clause 4 of this Article.

Article 12. Report Proposals and Implementation Time for Selection

1. Report Proposals for Selection:

a) Reports proposing selection for service under the professional soldier, defense worker, and defense official system from the Command of battalion, company-level units and above to subordinate units under the Ministry of Defense;

b) Lists proposing selection for service under the professional soldier, defense worker, and defense official system;

c) Selection files of professional soldiers, defense workers, and defense officials of each individual as prescribed in Article 10 of this Circular.

2. Implementation Time:

a) Selection for service under the professional soldier, defense worker, and defense official system for non-commissioned officers and soldiers completing their active service term shall be carried out in the first quarter of each year;

b) Selection for service under the professional soldier, defense worker, and defense official system for officers, professional soldiers, defense workers, and defense officials shall be carried out in the third quarter of each year;

c) Selection for service under the reserve professional soldier system for non-commissioned officers and soldiers serving in the reserve ranks of the Military shall be carried out in the fourth quarter of each year.

Chapter III. PROFESSIONAL SOLDIER, DEFENSE WORKER AND DEFENSE OFFICIAL RECRUITMENT

Article 13. Recruitment Objectives

Vietnamese citizens who do not fall under the provisions of Article 6 of this Circular, residing within the territory of Vietnam,

Article 14. Recruitment Conditions

Implementing the provisions stipulated in Clause 3 of Article 14, Clause 3 of Article 28 of the Law on Professional Military Personnel, Defense Workers, and Defense Civil Servants, and the following regulations:

1. The People's Army has a need for staffing.

2. Age must be at least 18 years old.

3. Possess technical expertise, vocational skills, aptitudes, and abilities suitable for the position of professional military personnel or the job role of defense workers or the profession of defense civil servants.

Article 15. Recruitment Standards

1. The person recruited must meet the standards regarding political quality, morality, health, and specialized technical and vocational training as prescribed in Clause 1 of Article 8 of this Circular.

2. Cases not eligible for recruitment:

a)[6] Persons falling under any of the cases specified in Article 8 of Circular No. 05/2019/TT-BQP; Article 11 of Circular No. 263/2013/TT-BQP;

b)[7] Not meeting the health standards as prescribed in Circular No. 105/2023/TT-BQP;

c) Losing civil capacity or being restricted in civil capacity.

Article 16. Priority in Recruitment

1. Priority in recruitment for certain categories shall be implemented according to the provisions stipulated in Clause 5 of Article 8, Clause 4 of Article 14, and Clause 4 of Article 28 of the Law on Professional Military Personnel, Defense Workers, and Defense Civil Servants.

2. Individuals meeting the conditions and standards set forth in Articles 14 and 15 of this Circular will be awarded additional points if they belong to any of the following priorities:

a) Awarded 20 additional points in the recruitment results:

- Graduating from university with honors or distinction; holding a master's degree or higher.

- Possessing high-level technical expertise and vocational skills; having a field of specialized technical expertise and vocational skills that align with the staffing needs of the Military which it does not train.

- Being a member of a minority ethnic group.

b) Awarded 10 additional points in the recruitment results:

- Achieving awards in national or international skill competitions.

- Demonstrating exceptional talent and aptitude that meets the requirements of tasks and staffing in sports, arts sectors of the People's Army.

3. In cases where an individual qualifies for multiple priorities as stipulated in Clause 2 of this Article, only the highest priority points will be added to the recruitment results.

Article 17. Application Documents for Recruitment

1. Application documents for recruitment include:

a) An application form for recruitment as a professional military personnel or defense worker or defense civil servant according to Model No. 02 attached as an appendix to this Circular.

b)[8] A self-written resume according to Model No. 03 attached as an appendix to this Circular, confirmed by the People's Committee of the commune, ward, or special administrative region where the applicant resides, within thirty days from the date of submission of the application documents as prescribed;

c) A copy of the birth certificate;

d) Copies of certificates and transcripts of technical and vocational qualifications and academic records;

If the certificates and transcripts are issued by educational institutions abroad, they must be translated into Vietnamese and certified by the competent authority in accordance with the law;

đ) A health certificate issued by a competent health authority within thirty days from the date of submission of the application documents as prescribed;

e) Four color photographs measuring 4cm x 6cm.

2. For current state employees and officials working in state agencies and organizations, in addition to the contents specified in points a, c, d, đ, e of Clause 1 of this Article, the following additional information should be provided:

a) A resume of the employee or official confirmed by the agency or organization where they work;

b) An evaluation and opinion on their work performance and consent for transfer of employment by the head of the agency or organization authorized to manage employees and officials;

c) Copies of decisions on salary grading and promotion made by the authorized agency or organization;

d) Copies of the social insurance book confirmed by the authorized agency.

Article 18. Units implementing recruitment

1. Units under the Ministry of National Defense (hereinafter referred to collectively as recruitment units) directly implement the recruitment of professional soldiers, defense workers, and defense civil servants; mobilize, arrange for use according to management levels.

2. When allocated quotas, the commander of units under the Ministry of National Defense decides to establish a Recruitment Council and decides on the form of examination for recruitment or competitive examination.

Article 19. Recruitment Council

1. The Recruitment Council consists of:

a) Chairman: Commander of units under the Ministry of National Defense;

b) Vice-Chairman: Commander of the General Staff Office;

c) Member: Heads of the Military Affairs Department, Security Protection Department, Medical Department, and Heads of related specialized departments;

d) Secretary: Professional staff member of the Military Affairs Department;

đ) Standing body: The Military Affairs Department.

2. When organizing recruitment, if the number of people registering in the same recruitment period is thirty or fewer, there is no need to establish a Recruitment Council; the commander of units under the Ministry of National Defense assigns the Military Affairs Department to take the lead, coordinate with the Security Protection Department, the Medical Department, and other related specialized departments to organize and implement.

3. The Recruitment Council operates based on the principle of collective work, concludes by majority vote, and self-dissolves after completing its tasks.

4. The Recruitment Council has the following duties and powers:

a) Assist the Party Committee and the commander of the unit in organizing and implementing recruitment through examination or competitive examination;

b) Establish working groups including: Examination Monitoring Board and Evaluation Board in cases of examination, or Examination Setting Board, Examination Supervision Board, Marking Board, and Grading Board in cases of competitive examination;

c) Organize the examination and evaluation of applications for examination or organize and grade examinations in cases of competitive examination;

d) Summarize the results of examination or competitive examination and submit them for review by the Party Committee and the commander, and report in writing to the Ministry of National Defense for recruitment decisions;

đ) Resolve complaints and denunciations during the examination or competitive examination process in accordance with the provisions of the law.

Article 20. Content of Examination

1. Check the application registration files, diplomas, and certificates of each individual, compare with the conditions, standards, and requirements of the positions of professional soldiers or the positions of defense workers or the job titles of defense civil servants.

2. Examine the academic results of the applicants, implemented as follows:

a) Academic points are determined by the average score of all subjects in the entire training period (training course) at the level of technical and vocational training, converted to a scale of 100 points, with a coefficient of 1.

b) Graduation points at the level of technical and vocational training, converted to a scale of 100 points, with a coefficient of 1, specifically:

- Graduation points are determined by the average score of final exam subjects.

- In cases where there are graduation thesis points, graduation project points, or graduation design points, the graduation points are determined by the graduation thesis points, graduation project points, or graduation design points.

- In cases where there is a diploma from a technical and vocational training program obtained through a joint-degree program at a certain level, the graduation points are determined by the graduation points at that training level.

c) In cases where the grade sheet provided by the educational institution is incomplete or cannot be determined, or there is no grade sheet, academic points are converted based on the classification or ranking of diplomas, certificates, and the scale of 100 points, with a coefficient of 1, as follows:

- Diplomas, certificates classified or ranked as average or not classified or ranked, are calculated as 50 points for academic points and 50 points for graduation points.

- Diplomas, certificates classified or ranked as good, are calculated as 60 points for academic points and 60 points for graduation points.

- Diplomas, certificates classified or ranked as excellent, are calculated as 70 points for academic points and 70 points for graduation points.

- Diplomas, certificates classified or ranked as very good, are calculated as 80 points for academic points and 80 points for graduation points.

- Diplomas, certificates classified or ranked as outstanding, are calculated as 90 points for academic points and 90 points for graduation points.

d) In cases of credit-based training systems, academic points are simultaneously graduation points, converted to a scale of 100 points, with a coefficient of 1.

3. The academic result is the total number of points of academic points and graduation points as stipulated in point a, b, or point d of Clause 2 of this Article.

Article 21. Content of the examination

1. Preliminary round:

a) Examination on general knowledge about the Law on Professional Military Personnel, Workers, and Defense Civil Servants; the Party's policies and the State's laws on the People's Army. The examination will be in multiple-choice format with a duration of 60 minutes.

b) Foreign language in one of five languages including English, French, German, Russian, Chinese, or another language as required for the position of Professional Military Personnel or Worker and Defense Civil Servant positions. The examination will be in multiple-choice format with a duration of 30 minutes.

In cases where the position of Professional Military Personnel or Worker and Defense Civil Servant positions require foreign language expertise, candidates are exempt from taking the foreign language examination.

c) Computer skills examination according to the requirements of the position of Professional Military Personnel or Worker and Defense Civil Servant positions as decided by the command of subordinate units under the Ministry of National Defense. The examination will be in multiple-choice format with a duration of 30 minutes.

In cases where the command of subordinate units under the Ministry of National Defense decides to organize the examination on computers, the examination will include general knowledge and foreign language.

d) Exemption from examination in the following cases:

- Exemption from foreign language examination: For those holding a bachelor's or postgraduate degree in foreign languages; having a bachelor's or postgraduate degree from abroad or obtained at a training institution in Vietnam using a foreign language.

- Those holding certificates in ethnic minority languages recognized by authorized authorities when applying for positions requiring the use of ethnic minority languages.

- Exemption from computer skills examination for those holding a diploma or higher in information technology, computer science, mathematics - computer science.

đ) The results of the preliminary examination are determined based on the general knowledge, foreign language, and computer skills examinations. If the candidate answers more than 50% of the questions correctly in each examination, they will be eligible to take the technical specialty and professional subject examination.

2. Technical specialty and professional subject examination:

a) Understanding, ability, and skills in technical specialties and professional subjects according to the requirements of the position of Professional Military Personnel, Worker and Defense Civil Servant positions, and the profession of Defense Civil Servant.

b) Written examination (essay), interview, or practical test, scored out of 100 points, with a coefficient of 1.

Article 22. Determination of successful candidates

1. Successful candidates in the recruitment period:

a) Candidates who are recommended by the Recruitment Board or the military force agency of subordinate units under the Ministry of National Defense to the same-level party committee and command for review must meet the conditions and criteria stipulated in Article 14, Clause 1 of Article 15 of this Circular and have scores of study and graduation of each type reaching 50 points or above.

b) Candidates who are reviewed by the party committee and command of subordinate units under the Ministry of National Defense and reported to the competent authority for recruitment decisions are those who meet the conditions and criteria and have a total score of study, graduation, and preferential points (if any) higher, taken in descending order until the recruitment quota is filled.

2. Successful candidates in the examination period:

a) Candidates who are recommended by the Recruitment Board or the military force agency of subordinate units under the Ministry of National Defense to the same-level party committee and command for review must meet the conditions and criteria stipulated in Article 14, Clause 1 of Article 15 of this Circular and have a total score of technical specialty and professional subject examination reaching 50 points or above.

b) Candidates who are reviewed by the party committee and command of subordinate units under the Ministry of National Defense and reported to the competent authority for recruitment decisions are those who meet the conditions and criteria and have a total score of technical specialty and professional subject examination and preferential points (if any) higher, taken in descending order until the recruitment quota is filled.

3. In cases where two or more candidates have the same total score of study, graduation, and preferential points (if any) or the same total score of technical specialty and professional subject examination and preferential points (if any) at the final quota, the candidate selected for recruitment decision by the party committee and command is chosen in the following order:

a) The candidate with a higher level of education in technical specialty and professional subjects.

b) If the educational levels are the same, the candidate with a higher ranking or classification in their graduation certificate.

c) The younger candidate.

d) The ethnic minority candidate.

đ) Female candidates.

4. In cases where there are still multiple candidates with the same scores after considering the criteria stipulated in Clause 3 of this Article, the party committee and command of subordinate units under the Ministry of National Defense will consider and decide on the successful candidates and report to the competent authority for recruitment.

5. Results cannot be carried over for future recruitment periods.

Article 23. Procedures and formalities for recruiting professional soldiers, workers, and defense officials

1. Units at the brigade level and above have the responsibility to:

Notify relevant agencies and units under their jurisdiction and publicly post at their workplace information on the target group, conditions, standards, recruitment quotas, application files, deadlines, and locations for receiving applications from those who wish to apply.

2. Individuals meeting the conditions and standards and having the willingness shall prepare one personal file as prescribed in Article 17 of this Circular and submit it to the agency or unit at the brigade level or higher or to a unit directly subordinate to the Ministry of National Defense.

3. At least seven working days before organizing the initial screening, units at the brigade level and above shall compile a list of individuals meeting the conditions for recruitment and publicly post the list at their workplace. They shall review and report in writing to the unit directly subordinate to the Ministry of National Defense.

4. Units directly subordinate to the Ministry of National Defense shall accept reports and recruitment registration files from subordinate units; organize selection or examination according to the provisions of Article 18 or Article 19 of this Circular. Within fifteen days from the date of receipt of the report on the results of the Recruitment Board, the Party Committee and Command of units directly subordinate to the Ministry of National Defense must review and report in writing to the Ministry of National Defense.

5. The General Department of Force Mobilization is responsible for accepting reports from units directly subordinate to the Ministry of National Defense; checking the target group, conditions, standards, and determining salary grades. It shall consolidate the report to the Deputy Chief of General Staff for decision by the Minister of National Defense.

6. After receiving the decision of the Minister of National Defense regarding recruitment, within fifteen days, the Command of units directly subordinate to the Ministry of National Defense:

a) Shall notify in writing to the recruited individual about the time to appear at the agency or unit to assume duties and fill out the professional soldier, worker, and defense official's personal history form for management purposes; organize the announcement and handover of the recruitment decision to the recruited individual. In cases where the recruited individual does not show up to assume duties or violates discipline or laws subject to penalties of warning or higher, report to the Minister of National Defense to revoke the recruitment decision.

b) Organize military training and knowledge enhancement for recruited professional soldiers, workers, and defense officials. Upon completion of the military training and knowledge enhancement period, the Command of units directly subordinate to the Ministry of National Defense shall decide on deployment and utilization according to the management hierarchy.

Article 24. Reporting and Implementation Time for Recruitment

1. Recruitment Proposal Report:

a) Report from the Command of units directly subordinate to the Ministry of National Defense, accompanied by a list proposing the recruitment of professional soldiers, workers, and defense officials;

b) Recruitment files of each individual professional soldier, worker, and defense official as prescribed in Article 17 of this Circular.

2. Implementation Time:

Recruitment of professional soldiers, workers, and defense officials to work in agencies and units within the standing forces of the People's Army shall be carried out in the third quarter of each year.

Chapter IV. RESPONSIBILITIES OF AGENCIES AND UNITS

Article 25. General Staff Department

The General Staff Department is responsible for directing the Military Personnel Department:

1. Managing the quantity, selection standards, recruitment; managing the quantity, positions, job positions, and professional military personnel, defense workers, and defense officials' staffing according to regulations.

2. Guiding agencies and units to build and implement plans for selecting and recruiting professional military personnel, defense workers, and defense officials in accordance with regulations, meeting the requirements of the mission of the Army.

3. Reviewing, compiling reports to the Chief of General Staff for submission to the Minister of National Defense for decisions on selecting and recruiting professional military personnel, defense workers, and defense officials.

4. Supervising, urging, guiding, and inspecting the implementation of selection and recruitment by agencies and units.

Article 26. Units under the Ministry of National Defense

1. Annually, based on staffing needs and the plan to ensure troop strength, direct subordinate agencies and units to build plans for selection and recruitment for review by the same-level commander and report to the immediate superior authority up to the Ministry of National Defense for approval of the quota for selection and recruitment to ensure for subordinate agencies and units.

2. Disseminate and implement the criteria and conditions for selection to managed objects; guide declaration and acceptance of application forms for the selection of professional military personnel, defense workers, and defense officials.

3. Manage the quantity, positions, job positions, and staffing of professional military personnel, defense workers, and defense officials according to the level of management.

4. Organize the strict implementation of selection and recruitment of professional military personnel, defense workers, and defense officials in accordance with the provisions of the law.

5. Be responsible before the Minister of National Defense during the organization and implementation of the selection and recruitment of professional military personnel, defense workers, and defense officials; handle complaints and denunciations regarding the selection and recruitment of professional military personnel, defense workers, and defense officials in accordance with the law on complaints and denunciations.

Chapter V. IMPLEMENTING PROVISIONS[9]

Article 27. Effective Date

1. This Circular takes effect from November 15, 2017, and replaces Circular No. 91/2010/TT-BQP dated July 5, 2010, of the Ministry of National Defense on the transfer of service system from civil servants, officials, and defense workers to professional military personnel.

2. In cases where the referenced documents in this Circular are amended, supplemented, replaced, or newly issued, the relevant contents of this Circular will also be changed in accordance with the amended, supplemented, replaced, or newly issued documents.

Article 28. Responsibility for Implementation

The Chief of General Staff, heads of agencies and units, and related individuals are responsible for implementing this Circular./.

BASED ON THE LAW ON OFFICERS OF THE VIETNAMESE PEOPLE'S ARMY dated December 21, 1999; amended and supplemented on June 3, 2008, November 27, 2014, and November 28, 2024;

[2] This point is amended and supplemented according to the provisions at Point a Clause 1 Article 3 of Circular No. 65/2025/TT-BQP dated July 3, 2025 of the Minister of National Defense amending and supplementing certain articles of Circulars of the Minister of National Defense on calculating military age; issuing, managing, and using Certificates and Cards; selecting and recruiting professional soldiers, workers, and defense officials; promoting, upgrading, demoting ranks, appointing, demoting positions, and implementing discharge for non-commissioned officers and conscripts; forms, contents, and times of activities for reserve soldiers, which shall take effect from July 3, 2025.

[9] Article 7 of Circular No. 65/2025/TT-BQP amending and supplementing certain provisions of Circulars issued by the Minister of National Defense regarding military age calculation; issuance, management, and use of Identification Cards and Passes; selection and recruitment of professional soldiers, workers, and defense civil servants; promotion, demotion, appointment, dismissal, and discharge of non-commissioned officers and conscripts; forms, contents, and times of activities for reserve military personnel, which shall take effect from July 3, 2025, provides as follows:

"Article 7. Implementation Provisions

1. This Circular takes effect from July 3, 2025.

2. Transitional provisions: Types of Officer Identification Cards; Professional Soldier, Worker, and Defense Civil Servant Identification Cards; Non-commissioned Officers and Conscripts In-service Passes; Reserve Officer Passes; Reserve Professional Soldiers and Non-commissioned Officers Passes issued before this Circular takes effect shall continue to be valid until their expiration date, in cases of reissue or replacement after this Circular takes effect, they shall be implemented according to this Circular.

3. The Chief of General Staff, Heads of Departments, Organizations, Units, and related individuals are responsible for implementing this Circular."

[10] This form has been replaced by Form No. 03 Appendix II pursuant to Clause 5, Article 3 of Circular No. 65/2025/TT-BQP amending and supplementing certain provisions of Circulars issued by the Minister of National Defense regarding military age calculation; issuance, management, and use of Identification Cards and Passes; selection and recruitment of professional soldiers, workers, and defense civil servants; promotion, demotion, appointment, dismissal, and discharge of non-commissioned officers and conscripts; forms, contents, and times of activities for reserve military personnel, which shall take effect from July 3, 2025.
