CIRCULAR

GUIDELINES FOR IMPLEMENTATION OF REGIME, POLICIES, AND SUPPORT WORK FOR ORGANIZATIONS AND INDIVIDUALS PERFORMING THE TASK OF SEARCHING AND COLLECTING REMAINS OF REVOLUTIONARY SOLDIERS

 ORGANIZATIONS AND INDIVIDUALS PERFORMING THE TASK OF SEARCHING AND COLLECTING REMAINS OF REVOLUTIONARY SOLDIERS

Pursuant to Decree No. 35/2013/NĐ-CP dated April 22, 2013, of the Government, stipulating the functions, tasks, powers, and organizational structure of the Ministry of National Defense;

Pursuant to Decision No. 75/2013/QĐ-TTg dated December 6, 2013 of the Prime Minister on the regime, policies, and support work for organizations and individuals performing the task of searching and collecting remains of revolutionary soldiers;

Pursuant to Decision No. 35/2017/QĐ-TTg dated July 25, 2017 of the Prime Minister amending and supplementing some articles of Decision No. 75/2013/QĐ-TTg dated December 6, 2013 of the Prime Minister on the regime, policies, and support work for organizations and individuals performing the task of searching and collecting remains of revolutionary soldiers;

At the proposal of the Director of the General Political Department;

The Minister of National Defense issues this Circular guiding the implementation of the regime, policies, and support work for organizations and individuals performing the task of searching and collecting remains of revolutionary soldiers.

Article 1. Scope of Regulation

This Circular guides the implementation of certain allowances, subsidies, supplements, material standards, and logistics support for those performing the task of searching and collecting remains of revolutionary soldiers, and certain policies for related persons; ensuring equipment, means, materials, and financial support for activities of Teams directly performing the task of searching and collecting remains of revolutionary soldiers both within and outside the country, and organizations directly assigned to direct and implement the task of searching and collecting remains of revolutionary soldiers according to Decision No. 75/2013/QĐ-TTg dated December 6, 2013 of the Prime Minister on the regime, policies, and support work for organizations and individuals performing the task of searching and collecting remains of revolutionary soldiers, which has been amended and supplemented by Decision No. 35/2017/QĐ-TTg dated July 25, 2017 of the Prime Minister (hereinafter referred to as Decision No. 75/2013/QĐ-TTg, as amended and supplemented).

Article 2. Applicability

1. Officers, professional military personnel, non-commissioned officers, soldiers, workers, and civil servants under the establishment of Teams directly performing the task of searching and collecting remains of revolutionary soldiers both within and outside the country.

2. Organizations directly directing and implementing the task of searching and collecting remains of revolutionary soldiers, including:

a) Search and Collection Steering Committees at all levels (hereinafter referred to as Steering Committee 1237 at all levels); Special Task Forces at all levels; Government Special Committees, Provincial Special Committees; Office of the National Steering Committee 1237, Permanent Office of the Steering Committee 1237 at all levels; Permanent Office of the Special Task Force, Government Special Committee;

b) Teams directly performing the task of searching and collecting remains of revolutionary soldiers (hereinafter referred to as Search and Collection Teams) both within and outside the country;

c) Units and localities assigned the task of collecting and completing files on revolutionary soldiers, soldier graves; Military units receiving relatives or worshippers of revolutionary soldiers seeking their graves.

3. Persons directly mobilized by competent authorities to perform the task of searching and collecting remains of revolutionary soldiers (guides, guards, directly participating in search and collection activities); persons providing information about revolutionary soldiers and their graves; relatives or worshippers of revolutionary soldiers seeking their graves.

4. Members of the organizations mentioned in point a, Clause 2 of this Article.

Article 3. The regime and policies for subjects within the establishment of search and collection teams inside and outside the country.

Subjects specified in Clause 1, Article 2 of this Circular, when directly performing tasks of searching for and collecting烈士遗骸 in both domestic and foreign countries, shall enjoy the regime and policies as stipulated in Article 3 of Decision No. 75/2013/QĐ-TTg, which has been amended and supplemented. In addition to salary, allowances, and other regimes prescribed, they also enjoy the following regimes:

1. An allowance equal to 100% of the current rank-based military salary level or grade/staff level plus leadership position allowance and seniority bonus above the ceiling (if applicable) for those receiving salaries or military rank allowances for non-commissioned officers and soldiers when directly performing tasks of searching for and collecting烈士遗骸 in foreign countries, calculated on a monthly basis; if less than a month but at least 15 days, it is calculated as one month, and less than 15 days, it is calculated as half a month.

2. A regional allowance equivalent to 1.0 times the basic wage level for those receiving salaries, and equivalent to the second-grade military rank allowance for non-commissioned officers and soldiers, calculated on a monthly basis when directly performing tasks of searching for and collecting烈士遗骸 in foreign countries.

3. A responsibility allowance equivalent to 0.5 times the basic wage level for those receiving salaries, and equivalent to the second-grade military rank allowance for non-commissioned officers and soldiers, calculated on a monthly basis from the month determined by the competent authority to directly perform tasks of searching for and collecting烈士遗骸 in both domestic and foreign countries.

4. A subsidy of 220,000 VND/person/day for the days directly performing tasks of searching for and collecting烈士遗骸 in both domestic and foreign countries. When enjoying the subsidy regime, the travel expense regime shall not be enjoyed.

5. A health subsidy of 500,000 VND/person (not exceeding two times/year), calculated as follows: For time directly performing tasks of searching for and collecting烈士遗骸 from six months to twelve months, two subsidies will be provided; for less than six months, one subsidy will be provided.

6. Additional food allowance at the basic food level of infantry non-commissioned officers and soldiers, calculated on a daily basis when directly performing tasks of searching for and collecting烈士遗骸 in both domestic and foreign countries.

7. Support for learning Lao and Cambodian languages at a level of 500,000 VND/person/year (duration not exceeding three years), distributed centrally to search and collection teams in foreign countries based on actual personnel strength performing tasks.

8. Issuance of specialized uniforms in kind as prescribed in Appendix I, promulgated together with Decision No. 75/2013/QĐ-TTg, which has been amended and supplemented.

9. Expenses for hospitalization fees and medical evacuation shall be implemented as follows:

a) In cases where illness or injury requires examination and treatment at healthcare facilities in the host country, expenses for examination and treatment shall be reimbursed according to the regulations of the host country; the search and collection team retains relevant documents and papers as the basis for settlement and final accounting (admission and discharge certificates; payment receipts and invoices for hospitalization fees).

b) In cases where patients need to be evacuated back to the home country for treatment, transportation costs shall be reimbursed according to actual expenses; the search and collection team prepares documentation detailing the patient's transport route and specific expenses for each case as the basis for settlement and final accounting.

Article 4. The regime and policies for members of Directive Board 1237 at all levels, Special Task Force Boards at all levels, Government Special Committees, Provincial Special Committees; members of the Office of the National Directive Board 1237, the Standing Office of Directive Board 1237 at all levels; members of the Standing Office of the Special Task Force, Government Special Committees.

Members of the organizations specified in point a, Clause 2, Article 2 of this Circular during the time directly performing duties to direct the search and collection of烈士遗骸,按照规定享受第75/2013/QĐ-TTg号决定第四条规定的制度和政策(已修改和补充)。除了工资、补贴和其他规定制度外,还享有以下制度:

1. Living expenses at a rate of 220,000 VND/person/day for actual days assigned by competent authorities to directly inspect and direct the work of searching and collecting烈士遗骸 within and outside the country. In cases where living expenses are enjoyed, they shall not enjoy accommodation allowances as stipulated for civil servants on domestic business trips.

2. When performing tasks to direct the work of searching and collecting烈士遗骸 outside the country, they shall enjoy travel expense allowances according to the provisions of Circular No. 102/2012/TT-BTC dated June 21, 2012 of the Ministry of Finance regarding travel expense allowances for state officials on short-term overseas business trips (hereinafter referred to as Circular No. 102/2012/TT-BTC), guaranteed by the state budget.

3. In case of illness or injury, medical fees and transportation costs will be reimbursed as guided in Clause 9, Article 3 of this Circular.

Article 5. The regime and policies for persons directly mobilized by competent authorities to perform the task of searching and collecting烈士遗骸;persons providing information about martyrs and their graves; relatives or those who worship martyrs going to find their graves.

1. Persons directly mobilized by competent authorities to perform the task of searching and collecting烈士遗骸 (including guides, guards, and those directly participating in activities to search and collect烈士遗骸) shall enjoy the regime and policies as stipulated in Clause 1, Article 5 of Decision No. 75/2013/QĐ-TTg (amended and supplemented); implemented as follows:

a) Subsidies at a rate of 220,000 VND/person/day for actual days mobilized to perform the task of searching and collecting烈士遗骸 within and outside the country;

b) Guaranteed meal allowance at twice the basic meal allowance for lower-ranking officers and soldiers of the infantry, calculated based on actual days mobilized to perform the task of searching and collecting烈士遗骸 within and outside the country;

c) Provided with funds to purchase specialized uniforms if they have been directly engaged in the task of searching and collecting烈士遗骸 for three months or more;

d) Arranged transportation means or transportation costs reimbursed as stipulated for civil servants on domestic business trips during the days mobilized to perform the task of searching and collecting烈士遗骸 within and outside the country;

đ) In case of illness or injury, medical fees and transportation costs will be reimbursed as guided in Clause 9, Article 3 of this Circular;

e) Basis for payment: Decision on mobilization by the Head of Directive Board 1237 of provinces and centrally-administered cities, or by the Head of Political Department of Military Region, based on the approved search and collection plan (the decision clearly states the mobilization period, benefits to be enjoyed, and funding);

g) Payment organization: Within the country, paid by the Provincial Military Command; outside the country, paid by the Search and Collection Team; issue payment vouchers (Form 02) as evidence for settlement;

2. Persons providing accurate information leading to the discovery and collection of烈士遗骸shall enjoy subsidies and rewards as stipulated in Clause 2, Article 5 of Decision No. 75/2013/QĐ-TTg (amended and supplemented); implemented as follows:

a) Subsidies at a rate of 3,000,000 VND for accurate information leading to the discovery and collection of one烈士遗骸; 5,000,000 VND for accurate information leading to the discovery and collection of a collective grave containing two to five烈士遗骸; 10,000,000 VND for accurate information leading to the discovery and collection of a collective grave containing six or more烈士遗骸;

b) Those with outstanding achievements in providing accurate information shall be rewarded immediately upon successful search and collection results, decided by the Commander or Political Commissar of the Military Region or the Chairman of the People's Committee of provinces and centrally-administered cities;

c) The Provincial Military Command or the Search and Collection Team (if working outside the country) shall establish a document confirmed by the local authority (at village level) and the commanding unit of the search and collection team (Form 01) to directly pay the subsidy to the person providing accurate information; issue payment vouchers (Form 02) as evidence for settlement;

3. Relatives or those who worship martyrs going to find their graves shall be supported with travel and meal expenses as stipulated in Clause 3, Article 5 of Decision No. 75/2013/QĐ-TTg (amended and supplemented); implemented as follows:

a) Supported with round-trip travel expenses (including both departure and return) based on the distance from their place of residence to the units where the martyr served or fought; up to three people per year; specific amount per trip as follows:

- Distance under 100 km: 150,000 VND/person;

- Distance from 100 km to under 300 km: 300,000 VND/person;

- Distance from 300 km to under 500 km: 500,000 VND/person;

- Distance from 500 km to under 1,000 km: 800,000 VND/person;

- Distance from 1,000 km to under 1,500 km: 1,100,000 VND/person;

- Distance from 1,500 km to under 2,000 km: 1,500,000 VND/person;

- Distance 2,000 km or more: 1,700,000 VND/person.

Example: Mr. Nguyen Van A, a relative of烈士Nguyen Van B; resides in Khương Mai Ward, Thanh Xuân District, Hanoi City; submitted an application and was granted by the People's Committee of Khương Mai Ward an Introduction Letter to search for the grave of烈士Nguyen Van B at the Military Command of Phú Yên Province/Fifth Military Zone; accompanying Mr. Nguyen Van A are two relatives of the烈士. The distance from Mr. Nguyen Van A's house to the Military Command of Phú Yên Province is 1,170 kilometers.

According to regulations, Mr. Nguyen Van A is entitled to travel expenses as follows:

1. 100,000 dong/person x 2 trips x 3 people = 6,600,000 dong.

b) He is entitled to food support for up to 3 people; for a period not exceeding 5 days; the daily food allowance per person is twice the basic food allowance for non-commissioned officers and soldiers of the infantry.

c) Relatives or those who worship the烈士when visiting the unit where the烈士served or fought shall submit the Introduction Letter (Form 03, original copy) and one certified copy of the烈士's Death Notification or Merit Certificate. The Military Command of the province or division-level unit or higher shall decide on the support and issue a payment voucher (Form 02); retain the aforementioned documents as evidence for settlement and finalization.

Article 6. Assurance and Operating Costs for Domestic and Overseas Search and Recovery Teams

Domestic and overseas search and recovery teams shall be assured according to the provisions of Article 6 of Decision No. 75/2013/QĐ-TTg, which has been amended and supplemented; implemented as follows:

1. Equipment, specialized means, logistics, and living conditions shall be provided in accordance with the provisions of Appendix II attached to Decision No. 75/2013/QĐ-TTg, which has been amended and supplemented.

2. Fuel costs, including: Expenses for purchasing fuel to serve surveying, searching, exhumation, and transportation of烈士remains (both domestically and internationally) shall be reimbursed based on actual expenditures incurred during the mission.

3. Temporary housing construction cost at 150,000,000 dong/house/team.

4. Exhumation cost for graves containing remains at 1,000,000 dong/grave. The expenditure includes: Tiles, shrouds, nylon, alcohol or spirits, incense, candles, soap, and local customs offerings.

5. Repair and replacement parts for vehicles at 40,000,000 dong/car/year.

6. Support for the Special Task Force and Provincial Special Responsibility Board of the Friendly Country for farewell ceremonies for烈士remains at 30,000,000 dong/time, not exceeding 2 times/year.

7. Support for mobilizing the people of the Friendly Country at 30,000,000 dong/team/year for one Friendly Province.

8. Purchase of common medicines for prevention and treatment at 20,000,000 dong/team/year (excluding the source of medicines supplied by the Ministry of Defense under the system).

9. Purchase of diplomatic gifts when traveling to the Friendly Country to coordinate tasks at 30,000,000 dong/time, not exceeding 2 times/team/year for one Friendly Province.

10. In case of illness or injury, hospital fees and medical transfer costs shall be reimbursed according to the guidance in Clause 9 of Article 3 of this Circular.

11. Purchase of water filtration equipment; passport fees and other fees shall be reimbursed based on actual expenditures.

12. Renting of means of transport, compensation for damage to infrastructure, crops, and flowers

a) For expenses below 100,000,000 dong, reported and requested for approval by the Military Command of the province to the Provincial Directive Board 1237 for examination and decision;

b) For expenses from 100,000,000 dong to less than 150,000,000 dong, reported and requested for approval by the Provincial Directive Board 1237 to the Military Zone Directive Board 1237 for examination and decision;

c) For expenses of 150,000,000 dong or more, reported and requested for approval by the Provincial Directive Board 1237 to the Military Zone Directive Board 1237; the Military Zone Directive Board 1237 reports and requests approval from the National Directive Board 1237 (through the Policy Department of the General Political Department - Office of the National Directive Board 1237)

Based on the approved plan, units establish contracts for renting means of transport, records of compensation for damages (with confirmation from the local government at the commune level), and payment vouchers as evidence for settlement and finalization.

13. Purchase of excavation tools (shovels, spades, crowbars, knives, axes, and other items) at 10,000,000 dong/team/year.

Article 7. Ensuring funding for the activities of the Directive Board 1237 at all levels; Special Task Force Boards at all levels; Government Special Commission, Provincial Special Boards; Office of the National Directive Board 1237, Permanent Office of the Directive Board 1237 at all levels; Permanent Office of the Special Task Force, Government Special Commission and units, localities assigned the task of collecting, perfecting烈士名单和烈士墓档案;迎接、移交和安葬烈士遗骸。

The content of ensuring funding for the activities of organizations as stipulated in point a and c, Clause 2, Article 2 of this Circular shall be implemented according to Article 7 of Decision No. 75/2013/QĐ-TTg, which has been amended and supplemented; it shall be carried out as follows:

1. Funding for serving outbound delegations and welcoming inbound delegations for the Directive Board 1237 at military region level and provincial level; Special Task Force Board. Each provincial Special Board shall not exceed two times per year; the funding level shall be implemented according to Circular No. 102/2012/TT-BTC, guaranteed by the state budget, and Circular No. 01/2010/TT-BTC dated January 6, 2010, issued by the Ministry of Finance, regarding the regulations on expenses for welcoming foreign guests working in Vietnam, organizing international conferences and seminars in Vietnam, and hosting domestic guests.

2. Supporting funds for the Government's Special Task Force Board, Lao Special Task Force Board at provincial level; Cambodian Government Special Commission, Military Region Special Board, Provincial Special Board shall be implemented according to the Decision of

3. Funding for mid-term and final review meetings; awards

a) Funding for mid-term and final review meetings shall be implemented according to Circular No. 259/2017/TT-BQP dated October 17, 2017, issued by the Ministry of Defense, regarding the regulations on travel expenses and conference expenses for agencies and units under the Ministry of Defense;

b) Award funding: Groups and individuals with outstanding achievements in searching for and collecting martyrs' remains shall be funded for monetary awards along with other forms of recognition. The level of monetary award funding shall be implemented according to Decree No. 91/2017/NĐ-CP dated July 31, 2017, issued by the Government, detailing the implementation of certain provisions of the Law on Encouragement and Reward, and guidelines from the General Political Department on the amount of monetary awards accompanying various forms of recognition within the Vietnam People's Army.

4. Funding for propaganda activities

b) The maximum support level for military region propaganda agencies is 200,000,000 VND/year; the Military Region Political Department shall report and seek opinions from the Directive Board 1237 Military Region for consideration and decision;

c) The support level for central propaganda agencies shall be reported and seek opinions from the Directive Board 1237 National Office by the Policy Bureau/General Political Department - Office of the National Directive Board 1237 for consideration and decision.

5. Funding for organizing information collection, processing, building, and perfecting documents and data on martyrs and martyrs' graves; decoding unit symbols; mapping areas for searching and collecting martyrs' remains

a) Persons authorized by competent authorities to undertake tasks of searching for and collecting information on martyrs and martyrs' graves; surveying, measuring, comparing, and determining areas where martyrs' graves have been collected and areas yet to be searched; counting and listing martyrs' graves in martyrs' cemeteries shall be entitled to a subsistence allowance of 220,000 VND/person/day for actual mission performance, without travel expense benefits;

b) Funding for conferences and seminars to standardize information, perfect martyr lists; conclude territorial conclusions for mapping areas for searching and collecting martyrs' remains shall be implemented according to Circular No. 259/2017/TT-BQP dated October 17, 2017, issued by the Ministry of Defense, regarding the regulations on travel expenses and conference expenses for agencies and units under the Ministry of Defense;

c) Funding for comparing, eliminating duplicates, sterilizing, supplementing information, integrating databases on martyrs and martyrs' graves, perfecting martyr lists; extracting information on martyrs and martyrs' graves shall be implemented according to Article 4 of Circular No. 194/2012/TT-BTC dated November 15, 2012, issued by the Ministry of Finance, guiding the level of funding for creating electronic information to maintain the regular operation of agencies and units using state budget;

d) Funding for the creation of maps and printing map materials for searching and collecting martyrs' remains (at a scale of 1/25,000 or 1/50,000) shall be implemented according to the General Staff of the Vietnam People's Army's regulations on approving product prices for national defense products in 2016 in the field of Geodesy and Cartography, and guidelines from the Ministry of Information and Communications on determining costs for developing and upgrading internal software;

đ) The Provincial Military Command or County Military Command shall be responsible for planning funding assurance and settlement according to regulations.

6. Funding for publishing publications; registering online information pages on the Internet; updating data and providing information on martyrs and martyrs' graves; maintaining the regular operation of the Department of Military Policy Electronic Portal shall be implemented according to Chapter II of Decree No. 18/2014/NĐ-CP dated March 14, 2014, issued by the Government, regulating remuneration systems in the field of press and publication, and Chapter II of Joint Circular No. 19/2012/TTLT-BTC-BKH&ĐT-BTTTT dated February 15, 2012, issued by the Ministry of Finance, Ministry of Planning and Investment, and Ministry of Information and Communications, guiding management and use of funds for implementing the national program on the application of information technology in government operations.

7. Ensuring equipment and means

a) The Office of the National Directive Board 1237; Permanent Office of the Directive Board 1237, specialized agencies at all levels shall be provided with equipment and means according to Appendix III, issued together with Decision No. 75/2013/QĐ-TTg, which has been amended and supplemented;

b) Division-level and equivalent units (excluding Provincial Military Commands and Military Region Political Departments) shall be equipped with one desktop computer, one printer, and one file cabinet.

8. Fuel guarantee expenses, including: Expenses for purchasing fuel to serve the task of directing, guiding, and inspecting the work of searching for and collecting烈士遗骸 (both within and outside the country); organizing the collection of information, improving the system of documents and data on martyrs and their graves; transferring the grave records; transporting and transferring the remains of martyrs to localities shall be reimbursed based on the actual performance of tasks.

9. Expenses for organizing funeral ceremonies, transferring, and burying the remains of martyrs

a) Expenses for the transportation and transfer of identified remains of martyrs to localities: Personnel assigned by authorized authorities to transport and transfer the remains of martyrs shall enjoy a subsistence allowance of 220,000 VND per person per day during the actual performance of tasks, without enjoying travel allowances.

b) Expenses for organizing funeral ceremonies and burying the remains of martyrs, including: Decorations, wreaths, incense, candles, sacrificial offerings according to local customs, and subsistence for service personnel; the maximum expenditure shall not exceed 40,000,000 VND per ceremony at the provincial level and 15,000,000 VND per ceremony at the district level (city districts).

c) The Provincial Military Command or the District Military Command shall be responsible for planning the guarantee and settling accounts in accordance with regulations.

Article 8. Implementation funds

1. The funds for implementing the policies and guarantees stipulated in this Circular shall be guaranteed by the state budget in accordance with the current state budget classification. Each year, agencies, units, and localities shall base their tasks to prepare the annual budget estimates and submit them to the financial authorities at the same level for consolidation and submission to the competent authority for approval in accordance with regulations.

2. The expenses specified in this Circular shall be guaranteed from the state budget, recorded under category 370, subcategory 371, item 7150, sub-item 7157, detail item 20, sector 38 "expenses for searching for martyrs' graves" and settled in accordance with regulations.

Article 9. Implementation Organization

a) Directing news agencies and press organs within the military to cooperate with central and local press organs to publicize the Party and State's policies on searching for and collecting martyrs' remains; mobilizing organizations, individuals, especially former soldiers, to provide information about martyrs and martyrs' graves.

a) Take the lead and coordinate with the General Staff Department, the General Departments, and functional agencies of the Ministry of National Defense to implement this Circular;

b) Direct propaganda, dissemination, and implementation of Decision No. 75/2013/QĐ-TTg, which has been amended and supplemented, and this Circular among cadres, staff, and soldiers.

c) Direct the Policy Bureau

- Annually, based on the regulations on preparing the annual state budget and the requirements of the search and collection tasks of martyrs' remains of agencies, units, and localities; the Policy Bureau shall prepare and allocate the annual state budget estimate for reporting to the head of the Political Bureau for approval to be included in the annual state budget estimate of the Political Bureau, reported to the Minister of National Defense (through the Finance Bureau/MoND) in accordance with regulations;

- Direct, guide, inspect, and resolve any difficulties and issues arising.

a) Directing and guiding agencies and units to continue organizing and utilizing the results of decoding unit symbols and designations in wars to serve the search for and collection of martyrs' remains.

Lead and coordinate with the Political Bureau to consolidate and report to the Ministry of National Defense to ensure equipment and supplies; direct, guide, and inspect the implementation in accordance with regulations.

3. General Department of Technology

Coordinate to ensure equipment and supplies; direct, guide, and inspect the implementation in accordance with regulations.

4. The Logistics General Department

Direct and guide the provision of uniforms, logistics equipment, living conditions, materials, and fuel in accordance with regulations; coordinate to direct, guide, and inspect the implementation in accordance with regulations.

5. The Finance Bureau/MoND

a) Based on the annual state budget estimate for the task of searching for and collecting martyrs' remains provided by the Political Bureau, consolidate it into the annual state budget estimate, report to the Minister of National Defense, and send to the Ministry of Finance. Review and allocate the state budget estimate for reporting to the Minister of National Defense for approval and allocation to relevant agencies and units;

b) Coordinate to direct, guide, inspect the implementation, and resolve any difficulties and issues arising.

6. Units subordinate to the Ministry of National Defense

a) Organize the dissemination, implementation, and guidance to relevant cadres, staff, and soldiers about the contents of Decision No. 75/2013/QĐ-TTg, which has been amended and supplemented, and this Circular;

b) On the basis of the annual budget estimates of subordinate agencies and units, consolidate and report to the Ministry of National Defense (through the Policy Bureau/PB, Finance Bureau/MoND); allocate funds in accordance with regulations;

c) Ensure the policies for beneficiaries as stipulated in this Circular. Annually, report the results of implementation to the Ministry of National Defense (through the Policy Bureau/PB, Finance Bureau/MoND); organize mid-term and final reviews in accordance with regulations; resolve any difficulties and issues within their authority.

Article 10. Effective Date

1. This Circular takes effect from January 16, 2018. The policies, guarantees, and implementation guidance stipulated in this Circular shall be implemented from September 10, 2017.

2. Repeal Joint Directive No. 748/HD-LC-CS-TC dated March 25, 2015 of the Policy Bureau and the Finance Bureau guiding the implementation of certain guarantee contents for the work of searching for and collecting martyrs' remains.

3. Entrust the Commander of Military Regions and Corps to decide on adjusting, managing, and using the UOAT and Xitec fuel-carrying vehicles that have been allocated but are no longer equipped to the Search and Collection Teams as stipulated in Appendix II issued together with Decision No. 75/2013/QĐ-TTg, which has been amended and supplemented.

4. If the referenced documents in this Circular are amended, supplemented, or replaced by new documents, the content shall be implemented in accordance with the amended, supplemented, or replacing documents.

Article 11. Responsibility for Implementation

1. The Chief of General Staff, the Director of the Political Bureau, and commanders of agencies, units, and individuals concerned shall be responsible for implementing this Circular.

2. During the implementation process, if there are any difficulties, agencies, units, and localities shall reflect them to the Ministry of National Defense (through the Policy Bureau/PB) for consideration and resolution./.
