On piloting the issuance of electronic visas
for foreigners entering Vietnam
OF THE NATIONAL ASSEMBLY

On the basis of the Constitution of the Socialist Republic of Vietnam;
Pursuant to the Law on the Organization of the National Assembly No. 57/2014/QH13;
Pursuant to the Law on Legal Documents No. 80/2015/QH13;
Pursuant to the Law on Entry into, Exit from, Transit through, and Residence of Foreigners in Vietnam No. 47/2014/QH13;
Pursuant to the Law on Electronic Transactions No. 51/2005/QH11;
Pursuant to the Law on Information Technology No. 67/2006/QH11;
After considering Report No. 500/TTr-CP dated October 25, 2016 of the Government, Report No. 104/BC-UBQPAN14 dated November 7, 2016 of the National Defense and Security Committee of the National Assembly, and the opinions of the National Assembly deputies,
RESOLUTION:
Article 1
The Government is tasked with piloting the issuance of electronic visas for foreigners entering Vietnam.
Article 2
Article 1. An electronic visa is a type of visa issued by immigration management authorities to foreigners residing abroad who wish to enter Vietnam.
Clause 2. An electronic visa is issued through an electronic transaction system, valid for a single entry, with a duration not exceeding 30 days.
Article 3
Article 2. The pilot issuance of electronic visas shall apply to citizens of countries meeting the following conditions:
a) Having diplomatic relations with Vietnam;
b) Being consistent with Vietnam's economic and social development policies and foreign policy at each period;
c) Not harming Vietnam's national defense, security, and public order and safety.
Clause 2. The Government decides the list of countries whose citizens are eligible for the pilot issuance of electronic visas; and the list of border gates allowing entry and exit by electronic visa.
Article 4
Article 3. Foreigners receiving an electronic visa must have a passport and not fall under the circumstances prohibiting entry as stipulated in Article 21 of the Law on Entry into, Exit from, Transit through, and Residence of Foreigners in Vietnam.
Clause 2. Foreigners receiving an electronic visa, upon entering Vietnam, if they request a new visa, the immigration management authority shall consider and process according to the provisions of the Law on Entry into, Exit from, Transit through, and Residence of Foreigners in Vietnam.
Article 5
Applicants for an electronic visa must pay the visa fee through a bank account. The visa fee will not be refunded in cases where the visa is not issued.
Article 6
Article 6. The Government shall specify the procedures and formalities for issuing electronic visas.
Clause 2. The Government shall ensure the conditions for the issuance and control of electronic visas to be strict, secure, uniform, and convenient.

Article 7. The pilot issuance of electronic visas shall be implemented within a two-year period starting from February 1, 2017. The Government shall report to the National Assembly on the results of implementing this Resolution at the final session of 2018.
Clause 2. Foreigners applying for a visa that is not an electronic visa shall comply with the provisions of the Law on Entry into, Exit from, Transit through, and Residence of Foreigners in Vietnam and relevant international treaties to which the Socialist Republic of Vietnam is a party.
