Circular No. 30/2018/TT-BCA stipulates the adjustment of the monthly allowance for police officers of the People's Public Security who are entitled to monthly allowances under Decision No. 53/2010/QĐ-TTg dated August 20, 2010 and Decision No. 62/2011/QĐ-TTg dated November 9, 2011 of the Government.

of the People's Public Security who are entitled to monthly allowances under Decision
No. 53/2010/QĐ-TTg dated August 20, 2010 and Decision No. 62/2011/QĐ-TTg

Pursuant to Decree No. 01/2018/NĐ-CP dated August 6, 2018 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Public Security;

Based on Government Decree No. 88/2018/NĐ-CP dated June 15, 2018 adjusting pensions, social insurance allowances, and monthly allowances;

At the proposal of the Director of the Personnel Department, Ministry of Public Security;

The Minister of Public Security issues this Circular regulating the adjustment of monthly allowances for cadres and soldiers of the People's Public Security who are entitled to monthly allowances under Decision No. 53/2010/QĐ-TTg dated August 20, 2010 and Decision No. 62/2011/QĐ-TTg dated November 9, 2011 of the Prime Minister.

Article 1. Scope of Regulation

This Circular regulates the adjustment of monthly allowances for cadres and soldiers of the People's Public Security who participated in the war against America with less than 20 years of service in the Public Security, have retired, been discharged, or left their jobs, and those who participated in the war to protect the country and international missions in Cambodia and Laos after April 30, 1975, have been demobilized, discharged, or left their jobs.

Article 2. Applicability

1. Cadres and soldiers of the People's Public Security who are entitled to monthly allowances as prescribed in Article 4 of Joint Circular No. 05/2010/TTLT-BCA-BLDTBXH-BTC dated November 8, 2010 of the Ministry of Public Security, the Ministry of Labor, Invalids and Social Affairs, and the Ministry of Finance guiding the implementation of Decision No. 53/2010/QĐ-TTg dated August 20, 2010 of the Prime Minister on the regime for cadres and soldiers of the People's Public Security who participated in the war against America with less than 20 years of service in the Public Security, have retired, been discharged, or left their jobs (hereinafter referred to as Joint Circular No. 05/2010/TTLT-BCA-BLDTBXH-BTC).

2. Cadres and soldiers of the People's Public Security who are entitled to monthly allowances as prescribed in Clause 1, Article 3 of Joint Circular No. 05/2012/TTLT-BCA-BLDTBXH-BTC dated May 4, 2012 of the Ministry of Public Security, the Ministry of Labor, Invalids and Social Affairs, and the Ministry of Finance guiding the implementation of the regime and policies for officers, non-commissioned officers, soldiers, workers, and civil servants of the Public Security according to Decision No. 62/2011/QĐ-TTg dated November 9, 2011 of the Prime Minister on the regime and policies for individuals who participated in the war to protect the country and international missions in Cambodia and Laos after April 30, 1975, have been demobilized, discharged, or left their jobs (hereinafter referred to as Joint Circular No. 05/2012/TTLT-BCA-BLDTBXH-BTC).

Article 3. Time and amount of additional monthly adjustment

As of July 1, 2018, the subjects specified in Article 2 of this Circular shall be adjusted their monthly allowances according to the following formula:

Example 1: Comrade Nguyen Van A belongs to the category entitled to monthly allowances under Decision No. 53/2010/QĐ-TTg dated August 20, 2010 of the Prime Minister, with a service period eligible for benefits of 18 years and 6 months, and a monthly allowance in June 2018 of 1,872,622 VND.

From July 1, 2018, Comrade Nguyen Van A's monthly allowance will be adjusted as follows:

1,872,622 VND x 1.0692 = 2,002,207 VND.

Example 2: Comrade Pham Van B belongs to the category entitled to monthly allowances under Decision No. 62/2011/QĐ-TTg dated November 9, 2011 of the Prime Minister, with a service period eligible for benefits of 16 years and 10 months, and a monthly allowance in June 2018 of 1,723,665 VND.

From July 1, 2018, Comrade Pham Van B's monthly allowance will be adjusted as follows:

1,723,665 VND x 1.0692 = 1,842,943 VND.

Article 4. Forms for implementing the monthly allowance regime

1. Decision on receiving the monthly allowance regime pursuant to Decision No. 53/2010/QĐ-TTg dated August 20, 2010 of the Government Prime Minister (Form No. 01/QĐ-X01);

2. Introduction letter for disbursing the monthly allowance regime pursuant to Decision No. 53/2010/QĐ-TTg dated August 20, 2010 of the Government Prime Minister (Form No. 02/GT-X01);

3. Decision on receiving the monthly allowance regime pursuant to Decision No. 62/2011/QĐ-TTg dated November 9, 2011 of the Government Prime Minister (Form No. 03/QĐ-X01);

4. Introduction letter for disbursing the monthly allowance regime pursuant to Decision No. 62/2011/QĐ-TTg dated November 9, 2011 of the Government Prime Minister (Form No. 04/GT-X01);

Article 5. Effective Date

This Circular takes effect from October 12, 2018.

Repeal point a, point b Clause 2 Article 6 Joint Circular No. 05/2010/TTLT-BCA-BLĐTBXH-BTC; Form No. 04, Form No. 05 stipulated in point a Clause 3 Article 5 Joint Circular No. 05/2012/TTLT-BCA-BLĐTBXH-BTC; Article 4 Circular No. 31/2017/TT-BCA dated September 13, 2017 guiding the adjustment of the monthly allowance level for officers, soldiers, People's Police under the group entitled to monthly allowances according to Decision No. 53/2010/QĐ-TTg dated August 20, 2010 and Decision No. 62/2011/QĐ-TTg dated November 9, 2011 of the Government Prime Minister.

Article 6. Responsibility for Implementation

1. The Personnel Organization Department, Ministry of Public Security shall adjust the monthly allowance level as prescribed in Article 3 of this Circular for cases with Decisions on receiving monthly allowances from the date this Circular takes effect.

2. Departments of Labor, Invalids and Social Affairs of provinces and centrally governed cities shall adjust the monthly allowance level and disburse monthly allowances for cases prescribed in Article 2 of this Circular who are currently receiving monthly allowances at Departments of Labor, Invalids and Social Affairs of provinces and centrally governed cities or have Decisions on receiving monthly allowances before the date this Circular takes effect.

3. Heads of units under Ministries, Directors of Public Security Departments of provinces and centrally governed cities are responsible for implementing this Circular.

In the process of organizing implementation, if there are difficulties, agencies and units shall report to the Personnel Organization Department, Ministry of Public Security for timely guidance.
