Circular No. 30/2018/TT-BVHTTDL Abolishes Certain Legal Normative Documents within the Authority of the Minister of Culture, Sports and Tourism

CIRCULAR

Repeals some normative legal documents within the jurisdiction of the Minister of Culture, Sports and Tourism

Pursuant to the Law on Legislative Regulatory Documents issued on June 22, 2015;

Pursuant to Decree No. 34/2016/NĐ-CP dated May 14, 2016 of the Government detailing certain provisions and measures for implementing the Law on Legislative Regulatory Documents;

Pursuant to Decree No. 79/2017/NĐ-CP dated July 17, 2017 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Culture, Sports and Tourism;

At the proposal of the Director of the Legal Department;

Article 1. Repeal all five regulatory legal documents within the purview of the Minister of Culture, Sports and Tourism.

Article 1. Repeal the entire content of some regulatory legal documents within the purview of the Minister of Culture, Sports and Tourism

Repeal entirely some normative legal documents within the jurisdiction of the Minister of Culture, Sports and Tourism as follows:

1. Circular Joint No. 1314-TTLB/XD-VH dated July 23, 1991 of the Ministry of Construction and the Ministry of Culture, Information, Sports and Tourism on the copyright of architectural works.

2. Decision No. 2262/1998/QĐ-BVHTT dated October 15, 1998 of the Minister of Culture and Information on setting design fees for artistic works.

3. Circular Joint No. 04/2003/TTLT-BVHTT-BXD dated January 24, 2003 of the Ministry of Culture and Information and the Ministry of Construction guiding the copyright for architectural works.

4. Circular Joint No. 06/2007/TTLT-BVHTT-BYT-BNN-BXD dated February 28, 2007 of the Ministry of Culture and Information, the Ministry of Health, the Ministry of Agriculture and Rural Development, and the Ministry of Construction guiding the procedures for issuing one-stop-shop advertising permits.

5. Decision No. 80/2008/QĐ-BVHTTDL dated September 10, 2008 of the Minister of Culture, Sports and Tourism on the regulations for implementing democracy in the activities of the Ministry of Culture, Sports and Tourism.

6. Circular Joint No. 85/2008/TTLT-BVHTTDL-BTTTT dated December 18, 2008 of the Ministry of Culture, Sports and Tourism and the Ministry of Information and Communications guiding the issuance, registration, implementation of advertising in newspapers, online media, publications, and inspection, supervision, and handling of violations.

7. Circular No. 17/2014/TT-BVHTTDL dated December 4, 2014 of the Minister of Culture, Sports and Tourism on the control of administrative procedures in the management of the Ministry of Culture, Sports and Tourism.

Article 2. Repeal part of the content of some regulatory legal documents within the purview of the Minister of Culture, Sports and Tourism

Repeal part of the content of some normative legal documents within the jurisdiction of the Minister of Culture, Sports and Tourism as follows:

1. Clause 1; the contents at the first, third, fourth, and fifth bullet points of Clause 2, Article 1 of Decision No. 24/2000/QĐ-BVHTT dated September 28, 2000 of the Minister of Culture and Information on the validity periods of certain types of licenses.

2. Article 13 of Circular Joint No. 19/2013/TTLT-BVHTTDL-BTNMT dated December 30, 2013 of the Minister of Culture, Sports and Tourism and the Minister of Natural Resources and Environment guiding environmental protection in tourism activities, festival organization, and the preservation and promotion of heritage values.

3. Point c Clause 1, Article 6; Point h Clause 1, Article 10 and Section 3 of Circular No. 04/2011/TT-BVHTTDL dated January 21, 2011 of the Ministry of Culture, Sports and Tourism on the implementation of civilized practices in weddings, funerals, and festivals.

Article 3. Effectiveness

This Circular takes effect from December 1, 2018.

Article 4. Responsibilities for Implementation

Heads of agencies and units under the Ministry; Directors of Departments of Culture, Sports and Tourism, Departments of Culture and Sports, Departments of Tourism of provinces and centrally-administered cities and related agencies, organizations, and individuals are responsible for enforcing this Circular./.
