CIRCULAR
Guidelines on the functions, tasks, and authorities of specialized agencies for agriculture and rural development under provincial and district people's committees
On the basis of Decree No. 105/2022/NĐ-CP dated December 22, 2022 of the Government stipulating the functions; tasks, authorities, and organizational structure of the Ministry of Agriculture and Rural Development;
On the basis of Decree No. 24/2014/NĐ-CP dated April 4, 2014 of the Government stipulating the organization of specialized agencies under provincial people's committees and municipal people's committees directly under the central government and Decree No. 107/2020/NĐ-CP dated September 14, 2020 of the Government amending and supplementing certain articles of Decree No. 24/2014/NĐ-CP dated April 4, 2014 of the Government;
On the basis of Decree No. 37/2014/NĐ-CP dated May 5, 2014 of the Government stipulating the organization of specialized agencies under district people's committees, urban district people's committees, town people's committees, and city people's committees directly under provinces and Decree No. 108/2020/NĐ-CP dated September 14, 2020 of the Government amending and supplementing certain articles of Decree No. 37/2014/NĐ-CP dated May 5, 2014 of the Government;

The Minister of Agriculture and Rural Development issues this Circular to guide the functions, tasks, and authorities of specialized agencies for agriculture and rural development under provincial people's committees (hereinafter referred to collectively as provincial level) and district people's committees, urban district people's committees, town people's committees, and city people's committees directly under provinces (hereinafter referred to collectively as district level).
PART I
DEPARTMENT OF AGRICULTURE AND RURAL DEVELOPMENT
Article 1. Position and Functions
1. The Department of Agriculture and Rural Development is a specialized agency under the provincial people's committee, performing the function of advising and assisting the provincial people's committee in state management over: agriculture; forestry; salt industry; fisheries; irrigation; disaster prevention and control; rural development; quality and safety of food products from agricultural, forestry, fishery, and salt products; public services within the scope of agriculture and rural development according to the law.
2. The Department of Agriculture and Rural Development (hereinafter referred to as the Department) has legal personality, its own seal and bank account, subject to the direction and management of the provincial people's committee, while also being subject to professional guidance, inspection, and supervision by the Ministry of Agriculture and Rural Development.
b) Draft five-year and annual socio-economic development plans for the province; major economic and social balances for the province; draft five-year and annual plans, programs, projects, measures to organize and implement tasks related to socio-economic development, finance-budget, planning-investment, and other tasks within the scope of state management of the Department of Finance as prescribed by law;
1. Submit to the provincial People's Committee:
a) Draft decisions of the provincial people's committee related to areas under the jurisdiction of the Department and other documents assigned by the provincial people's committee;
b) Draft plans, programs, projects, proposals, measures to organize the implementation of tasks related to agriculture and rural development under the jurisdiction of the Department within the province;
c) Draft decisions on the delegation of state management tasks in the field of agriculture and rural development to the Department and district people's committees according to regulations;
d) Draft decisions defining the functions, tasks, authorities, and organizational structure of the Department and its bureaus; draft decisions on establishing, restructuring, and dissolving public service organizations under the Department according to the law;
đ) Draft decisions on implementing socialization of activities providing public services in the field of agriculture and rural development within the authority of the provincial people's committee and according to the delegation of higher-level state agencies.
2. Submitting to the Chairman of the Provincial People's Committee:
a) Drafting documents within the authority to issue by the Chairman of the Provincial People's Committee as assigned;
b) Draft decisions on defining the functions, tasks, authorities, and organizational structure of public service organizations under the Department;
c) Draft regulations on the management, coordination of work, and reporting system of provincial agricultural and rural development sector organizations located in districts with district people's committees; technical staff working in communes with commune people's committees.
3. Implement legal normative documents, strategies, plans, programs, proposals, projects, national standards, national technical regulations, economic-technical norms in the field of agriculture and rural development decided and approved by competent authorities; provide information, propaganda, guidance, inspection, and monitoring of the implementation of laws in areas under state management.
4. On crop production and plant protection:
a) Advise and submit to the provincial people's committee for issuance within its authority or submit to higher authorities: plans for adjusting crop structures suitable to local conditions, crop structures on paddy fields within the area; plans for local crop production development; policies supporting production, trade, and use of crop seeds, fertilizers, and plant protection chemicals; plans for preventing and controlling harmful organisms, domestic plant quarantine;
b) Assist the provincial people's committee in directing the implementation of seed varieties, planting seasons, cultivation techniques, harvesting, storage, and processing of agricultural products; establish and implement pest-free zones within the area; organize pest control, implement protective measures when plant pests occur; record and assess losses caused by pests; implement policies to stabilize livelihoods and restore production; organize the collection and packaging of used plant protection chemicals; build databases on crop production activities within the province and update the national crop production database system; build databases on plant protection and quarantine;
c) Guide and inspect the implementation of crop production activities; develop crop production areas and safe food production areas within the province; implement plans for the use, protection, and improvement of soil fertility, erosion control, desertification prevention, and land collapse; implement coding of crop production areas within the province according to the law;
d) Guide and organize the implementation of domestic plant quarantine within the province according to regulations;
đ) Organize the implementation of work on collecting, storing, preserving, utilizing germplasm resources of crop seeds; manage crop seeds, fertilizers, plant protection chemicals, and other materials serving agricultural production according to the law;
e) Manage and utilize local reserves of crop seeds, plant protection chemicals, and other goods and materials in the field of crop cultivation within the province after being approved by the provincial People's Committee;
g) Guide and organize the construction of good agricultural practices models (VietGAP) in agriculture.
5. Regarding animal husbandry and veterinary services:
a) Advise and submit to the provincial People's Committee for issuance within its authority or submit to the competent authority: strategies, plans for developing animal husbandry, regulations on livestock density in the locality; decisions of the provincial People's Council regarding areas within urban centers of cities, towns, townships, residential areas that are not permitted for animal husbandry; decisions on bird-nest farming zones and support policies when relocating animal husbandry facilities from non-permitted areas; support policies for production, trade, and use of veterinary drugs; regulations, policies, and guidelines on animal slaughter activities, animal slaughter control, veterinary hygiene inspections; plans for preventing and controlling animal diseases; programs for monitoring, controlling, and eradicating animal diseases, building disease-free zones and facilities, and establishing safe animal disease zones and facilities;
b) Assist the provincial People's Committee in directing the establishment and organization of disease-free zones and facilities for animals, animal husbandry zones, production and processing zones for animal feed, centralized animal slaughter zones, preliminary processing and manufacturing of animal products with waste treatment and environmental protection measures; statistics and assessment of losses caused by animal diseases; implementation of support policies to stabilize livelihoods and restore animal husbandry and aquaculture after animal diseases; construction of databases, updating data, exploitation, and management of national databases on animal husbandry; databases on animal disease surveillance and information on animal disease forecasting and warning at the local level;
c) Guide and inspect animal husbandry activities and veterinary activities in the province in accordance with the law;
d) Guide and implement domestic quarantine activities for animals and animal products in the province; quarantine animals and animal products for export, import, temporary entry for re-export, transfer between border gates, bonded warehouses, and transit through Vietnam's territory when authorized by law;
đ) Organize the implementation of work related to the collection, storage, conservation, and utilization of livestock genetic resources; manage livestock breeds; manage animal feed and other materials in the field of animal husbandry and veterinary services according to the provisions of the law;
e) Manage and utilize local reserves of veterinary drugs, materials, and goods in the field of animal husbandry and veterinary services within the province after being approved by the provincial People's Committee;
g) Implement tasks related to the supervision of animal slaughter activities, preliminary processing, and manufacturing of animals and animal products; veterinary hygiene inspections; veterinary practice; management of veterinary drugs according to the provisions of the law;
h) Conduct state inspections on the quality of imported animal feed after customs clearance, animal feed produced and circulated domestically in the province; inspect conditions, evaluate, and maintain the conditions of animal feed production facilities; supervise the destruction of substandard animal feed in violation of quality standards in the province according to the law; inspect breeding conditions of medium and small-scale farm animal husbandry facilities; evaluate and maintain breeding conditions of large-scale farm animal husbandry facilities according to the law;
6. Regarding forestry:
a) Advise and submit to the provincial People's Committee for issuance within its authority or submit to the competent authority: programs and projects for sustainable forestry development in the locality; policies for changing forest types and converting forest land use purposes to other purposes; classification of forests and demarcation of boundaries of different forest types; decisions on allocating and leasing forests, changing forest types; decisions on converting forest land use purposes to other purposes, reclaiming forests, leasing land for commercial forest planting; replacement forest planting plans when converting forest land use purposes to other purposes; decisions on local forest price ranges; decisions on establishing special-use forests and protective forests in the locality; decisions on opening and closing natural forest gates in the locality according to regulations; reports on the management and use of the Forest Protection and Development Fund at the provincial level; plans to mobilize forces, materials, equipment, and devices of organizations, households, and individuals in the locality to respond urgently to forest fires according to the authority of the provincial People's Committee;
b) Assist the provincial People's Committee in organizing propaganda, dissemination, education, and monitoring the enforcement of forestry laws; implementing forest surveys, forest inventories, and forest condition monitoring; updating local forest management databases and files; protecting forests; conserving nature and biodiversity in various types of forests; forest fire prevention and firefighting; prevention and control of forest pests; forest development; forest use; timber harvesting; organizing forestry production linked to timber processing and trade in the locality;
c) Implement legal normative documents on forestry, forestry development strategies, forestry planning; forestry programs, plans, projects, and proposals according to the decisions of the provincial People's Committee;
d) Fully perform the functions and tasks of forestry rangers in the locality according to the law;
đ) Guide and inspect combined agricultural, forestry, and aquatic production activities in the forest according to the law in the province;
e) Guide and inspect the implementation of national standards and technical regulations on forestry; recognize mother trees, parent trees, seedling gardens, nurseries, and seedling forests in the province; develop plans, measures, direct, and inspect the production of forestry crop seeds and the use of forestry materials; compile, update, and publicly announce lists of recognized or revoked recognized forestry crop seeds; afforestation; forest nurturing; enriching forests; rehabilitating natural forests and setting aside areas for regeneration; timber processing and preservation; prevention and control of forest pests; forest fire prevention and firefighting;
g) Organize the review and submit to the competent authority for approval the sustainable forest management plan, eco-tourism and leisure project proposals within special-use forests and protective forests under local management, design and budget estimates for forestry works in accordance with the provisions of the law;
h) Advise and assist the provincial People's Committee in directing, guiding, and inspecting the implementation of the payment for forest environmental services policy at the local level; direct, guide, and inspect afforestation and protection of special-use forests and protective forests; develop scattered forestry trees in accordance with the regulations;
i) Guide and inspect the implementation of regulations on the responsibilities of district-level People's Committees, commune-level People's Committees, and forest owners in managing and protecting forests, preventing and extinguishing forest fires, and managing forest products, conserving nature and biodiversity in various types of forests; coordinate and mobilize forces and means from organizations and individuals in the locality for forest protection, fire prevention and extinguishing, forest product management, nature conservation, and biodiversity maintenance;
7. Regarding salt industry:
a) Advise and submit to the provincial People's Committee for issuance within its authority or submit to the competent authority for approval: mechanisms, policies, plans, programs, projects, and proposals for developing salt production in the locality;
b) Assist the provincial People's Committee in directing and organizing salt production and processing in the locality;
c) Guide and inspect salt production, processing, and storage, as well as salt-based products in the locality; implement national technical standards and quality criteria, food safety, labor safety, and environmental protection for salt production, processing, and trading facilities (excluding salt used in the medical field);
8. Regarding fisheries:
a) Advise and submit to the provincial People's Committee for issuance within its authority or submit to the competent authority for approval: decisions on establishing national marine protected areas within the managed area; plans for protecting and developing fishery resources in the province according to regulations; decisions recognizing and transferring management rights for fishery resource protection in areas covering two or more districts; decisions on establishing provincial fishery resource protection and development funds; supplementary regulations on fishing methods, gear, and prohibited fishing zones not listed in the legal inventory; quotas for fishing permits, allowable catch quantities by species in coastal and brackish water areas under management;
b) Advise and submit to the provincial People's Committee for issuing aquaculture permits in marine areas; participate and cooperate in implementing the allocation and recovery of marine areas allocated for aquaculture according to legal regulations;
c) Assist the provincial People's Committee in directing and organizing the management of fisheries activities in the locality; organize fishery production; manage marine protected areas and fishery resource protection zones; conduct investigations and assessments of fishery resources and living environments of aquatic species in the province; organize fishery resource regeneration and habitat restoration activities; investigate and supplement fishery resource protection zones; guide and inspect fishery resource management and aquatic ecosystem management in special-use forests, protective forests, wetland conservation areas, aquaculture, and fishing; establish a database on fisheries in the province and update the national fisheries database system;
d) Implement management of fishery seeds, fish feed, and aquaculture environment treatment products; monitor fish feed testing and aquaculture environment treatment product activities; monitor and warn about aquaculture environment conditions; prevent and control fish diseases according to legal regulations;
đ) Submit to the provincial People's Committee for organization and operation of local fishery inspection forces, equipping patrol boats and vessels, weapons, auxiliary tools, specialized equipment, uniforms, insignia, badges, flags for fishery inspectors according to legal regulations. Organize patrols, inspections, detection, and handling of violations of fisheries laws within the managed area according to regulations;
e) Fully perform the functions and tasks of local fishery inspection according to legal regulations;
g) Manage fishing vessels, fishery service vessels, fishing ports, anchorage areas for fishing vessels according to classification and legal regulations; carry out inspections, supervision, and control over compliance with laws on fishing operations, fishery resource protection, food safety on fishing vessels, at fishing ports, environmental protection, fire prevention and extinguishing at fishing ports; manage, exploit, and use provincial fishing vessel monitoring data, process monitoring data for fishing vessels with a length of 15 meters or more but less than 24 meters; collect and compile statistical reports on fisheries through fishing ports according to regulations;
h) Manage fishing activities in coastal and brackish water areas and inland fisheries within the province according to regulations;
i) Organize the implementation of food safety control at major seafood markets in the province; manage purchasing, selling, preliminary processing, processing, storage, export, and import of seafood and seafood products in the province according to regulations;
9. Regarding irrigation:
a) Advise and submit to the provincial People's Committee for issuance within its authority or submit to the competent authority for approval: decisions on approving and announcing the results of basic irrigation surveys, operating procedures for irrigation works within the managed area in the province; decisions on assigning organizations to manage or分级管理灌溉工程和农村清洁供水工程的分级管理;具体规定灌溉工程保护区范围及设置保护界桩方案;批准或分级批准管辖范围内大坝、水库和其他水利设施的保护方案;发生事故或有事故发生风险时调动人员、物资和设备保护水利设施的方案;农田水利规模;地方管理的水利工程建设、管理和维护投资资金、运营和保护费用。
b) Chair the coordination with relevant agencies and units at the local level to advise and submit to the Provincial People's Council for approval through the Provincial People's Committee the levels and specific prices of water supply products and services according to the provisions of the law;
c) Chair the development of plans for the expansion of irrigation networks and rural clean water supply systems in accordance with the law; organize the implementation of the national strategy for irrigation development, contents related to irrigation and rural clean water supply within the provincial planning, irrigation planning, and national sectoral planning as prescribed by law;
d) Guide and inspect the implementation of legal regulations and decisions of the Provincial People's Committee on the分级管理水资源库、水利设施和农村清洁供水设施;指导和检查省级范围内由省人民委员会负责的水资源库、水利设施和农村清洁供水设施的建设、运营、使用和保护工作;根据省人民委员会的分工,组织落实国家农村清洁供水和卫生战略;
đ) Receive and manage files and permits for activities within the scope of protecting water conservancy works under the management authority of the Provincial People's Committee within the province; organize the management of assets of water conservancy infrastructure and rural clean water supply infrastructure, statistics, establishment, and management of databases on water conservancy according to the law and the division of work of the Provincial People's Committee;
e) Guide and inspect the implementation of state management regulations on the management, operation, protection, and safety assurance of water conservancy works and rural clean water supply facilities; coordinate in managing the discharge of wastewater into water conservancy works under the management of the province;
g) Guide and inspect the implementation of irrigation, drainage, and flood control work serving agricultural production within the province according to the law;
h) Monitor, supervise, and observe sedimentation and erosion of water conservancy works; guide and manage the organization of comprehensive, economical, safe, and effective utilization of water from water conservancy works; guide and inspect the management and operation of water resources in water conservancy works systems; ensure the provision of clean water for daily use in implementing drought prevention, water shortage relief, saline intrusion prevention, desertification prevention, flood prevention, and drainage within the province; organize monitoring, forecasting, and warning about droughts, saline intrusion, floods, drainage, water quantity, and quality in the water conservancy works system within the province;
i) Chair the development and submission to the Provincial People's Committee for mechanisms, policies, and guidance on small-scale irrigation development, field irrigation, advanced irrigation, water-saving irrigation; rural clean water supply within the province according to the law;
10. Regarding disaster prevention and mitigation:
a) Advise and submit to the Provincial People's Committee for issuance within its authority or to higher authorities with competent authority: plans for disaster prevention and mitigation, investment construction plans for disaster prevention and mitigation works in the locality according to assigned tasks; standards and quotas for disaster prevention and mitigation materials, equipment, and specialized tools; decisions on the organization of construction, management, operation, and use of specialized disaster prevention and mitigation databases and monitoring systems; decisions on the approval and announcement of basic investigation results on disaster prevention and mitigation within the province; decisions on announcing emergency situations regarding disasters according to the assigned tasks of the Provincial People's Committee; decisions on dedicated forces for dike management, people's dike management forces; policies and benefits for people's dike management forces, patrol, and guard forces; permits for activities related to dikes; use of river banks, floating islands, and land masses related to flood drainage and dike management; approval of construction and renovation of transportation works related to dike management;
b) Guide and inspect the implementation of flood prevention planning for rivers with dikes, dike planning, and flood prevention plans for rivers with dikes, and dike development plans within the provincial planning; investment construction, repair, upgrading, reinforcement, maintenance, and management of dikes to ensure their safety according to the assigned tasks or delegated authority of the Provincial People's Committee;
c) Guide and organize the implementation of dike condition assessments, identification of critical weak points in dikes; inspect the construction and implementation of dike protection plans and dike protection work to ensure dike safety; aggregate and manage information and data on dikes within the province;
d) Guide and inspect the investment construction, maintenance, operation, and protection of disaster prevention and mitigation works within the province according to the law and assigned tasks of the Provincial People's Committee;
đ) Promote and disseminate the requirements for disaster prevention and mitigation in the management, operation, and use of mineral exploitation areas and other natural resource exploitation areas; urban areas; tourist sites, tourist zones; industrial zones; historical relic zones; rural residential areas, and works;
e) Implement tasks according to the law on setting boundary markers for the protected areas of dike works; develop plans and measures for relocating works and residences related to the protected areas of dike works and river banks according to the law.
11. Regarding rural development:
a) Advise and submit to the People's Committee at the provincial level for issuance within its authority or submit to the competent authority: mechanisms, policies, measures to encourage rural development; development of agricultural farm economies, collective economies, cooperatives, and production linkages and product consumption in agriculture; plans for economic restructuring and rural development programs; policies for developing agricultural electromechanical industries; organization of production to develop concentrated agricultural, forestry, fishery, and salt raw material areas; synchronous mechanization development in agricultural production and processing; development of rural trades; conservation and development of traditional trades; development of rural handicrafts; training and dissemination of public policy in agriculture; vocational training for agricultural workers in rural areas;
b) Guide, inspect, and organize the implementation of regulations on the division of responsibilities and delegation of authority for assessing programs and projects related to household economy development, agricultural farm economies, cooperative economies, production and consumption linkages of agricultural, forestry, fishery, and salt products; development of concentrated agricultural, forestry, fishery, and salt raw material areas; synchronous mechanization development in agricultural production and processing; development of rural trades; agricultural insurance; conservation and development of traditional rural trades and craft villages; vocational training for agricultural workers in rural areas as prescribed; resettlement of residents and relocation in rural areas; monitor and compile reports to the People's Committee at the provincial level on rural development in the area;
c) Guide and inspect the implementation of work to eliminate drug-containing plants; permanent cultivation; resettlement of residents and relocation in rural areas linked with criteria for new rural standards;
d) Implement programs, projects, or components of programs and projects to eradicate poverty and social security in rural areas; action programs to end hunger; agricultural insurance; construction of new rural areas; construction of residential areas; construction of rural infrastructure according to the division of labor or delegation of authority by the People's Committee at the provincial level and as prescribed by law;
đ) Guide and inspect programs and projects for the construction of technical infrastructure works in rural areas within the province according to the division of labor and specialized laws;
12. Regarding processing and development of agricultural, forestry, fishery, and salt product markets:
a) Guide and inspect the implementation of planning, programs, mechanisms, and policies for the development of the processing sector linked with production and markets for goods under the management of the Department;
b) Guide, inspect, and evaluate the development of processing and preservation for agricultural, forestry, fishery, and salt products;
c) Carry out information collection, analysis, and forecasting of market conditions, market development programs, and promotion of trade for agricultural, forestry, fishery, and salt products within the scope of the Department's management;
d) Take the lead and coordinate with relevant agencies to organize trade promotion activities for agricultural, forestry, fishery, and salt products;
13. Regarding quality and food safety of agricultural, forestry, fishery, and salt products:
a) Guide and inspect the quality and food safety of agricultural, forestry, fishery, and salt products in the province as prescribed by law; guide and organize the assessment and certification of food safety conditions for food production and business establishments of agricultural, forestry, fishery, and salt products within the assigned scope in the province;
b) Statistic, evaluate, and classify the conditions for ensuring quality and food safety of production and business establishments of agricultural, forestry, fishery, and salt products; compile and report the results of evaluation and classification of production and business establishments of agricultural inputs as prescribed;
c) Implement food safety monitoring programs, risk assessments, and traceability, investigate causes of food safety incidents within the assigned scope in the province as prescribed;
d) Inspect, trace, recall, and handle non-compliant food products according to the guidance of specialized management agencies and as prescribed by law;
đ) Manage certification and declaration activities within the scope of management as prescribed by law;
e) Manage inspection activities and provide quality and food safety services for agricultural, forestry, fishery, and salt products according to the provisions of law;
g) Manage food safety in agricultural logistics zones and centers, wholesale markets, and auction markets for agricultural products within the scope assigned by the People's Committee at the provincial level;
14. Advise and assist the People's Committee at the provincial level in implementing state management over agricultural extension activities in the province as prescribed by law;
15. Advise and assist the People's Committee at the provincial level in implementing state management over organic agriculture, circular agriculture, ecological agriculture, smart agriculture, high-tech agriculture, agro-industrial integration, agro-service integration, green growth, and sharing economy in the province as prescribed by law;
16. Develop and guide the implementation of environmental protection measures in agricultural, forestry, salt, and fishery production and rural development activities locally; guide and inspect the implementation of tasks to conserve and sustainably develop biodiversity in agriculture, forestry, and fisheries as prescribed by law;
17. Organize the implementation and be responsible for appraisal, inspection, registration, issuance, reissuance, renewal, revocation of permits, certificates, confirmation decisions, and professional certificates within the scope of the Department's management as prescribed by law, division of labor, and delegation of authority by the People's Committee at the provincial level and guidance from the Ministry of Agriculture and Rural Development.
18. Establishing information systems and storing materials on agriculture and rural development; organizing statistical work on the dynamics of agricultural land, forestry land, salt production land, forest dynamics, surface water for aquaculture, and other information, storage, and statistical activities to serve the management requirements of the agriculture and rural development sector as prescribed.
19. Implementing specialized construction investment management tasks in accordance with the law; guiding, inspecting, supervising, and evaluating the implementation of projects and developing models for agricultural, forestry, fisheries, irrigation, rural clean water supply, dyke and flood control, salt production, and rural development within the province; being responsible for implementing assigned programs and projects.
20. Implementing international cooperation in fields under the Department's jurisdiction and as assigned or authorized by the provincial People's Committee in accordance with the law.
21. Guiding the implementation of self-management mechanisms for public service units; managing the activities of public service units within the agriculture and rural development sector in accordance with the law; being responsible for public services organized and implemented by the Department.
22. Advising and assisting the provincial People's Committee in directing, guiding, and inspecting businesses, collective economic organizations, private enterprises, associations, and non-governmental organizations operating in the agriculture and rural development sector in accordance with the law.
23. Exercising rights, responsibilities, and obligations of state ownership as delegated and classified by the provincial People's Committee for wholly state-owned limited liability companies and state capital invested in other enterprises in accordance with the law.
24. Providing professional guidance to the Agriculture and Rural Development Departments of district People's Committees, Economic Departments of municipal and town People's Committees, and professional positions at commune-level People's Committees; inspecting the implementation of management regulations, coordination of work, and reporting systems of provincial-level agricultural and rural development organizations located within districts with district People's Committees; technical staff working in communes with commune-level People's Committees.
25. Organizing research and application of scientific and technological progress into production in the agriculture and rural development sector within the province; submitting to the provincial People's Committee proposals and orders for scientific and technological tasks within the Department's jurisdiction as prescribed by the law.
26. Conducting inspections, checks, receiving citizens' visits, handling complaints and denunciations; preventing and combating corruption and wastefulness; practicing thrift and combating waste and handling violations of laws within the Department's jurisdiction as prescribed by the law or delegated and authorized by the provincial People's Committee.
27. Implementing digital transformation in agriculture and rural development as prescribed.
28. Performing permanent agency tasks related to disaster prevention and control; forest protection and development; new rural construction; rural clean water and environmental sanitation; combating desertification; managing trade in wild animals and plants that are endangered, precious, and rare; disease prevention and control in agriculture, forestry, and fisheries within the province; and other permanent agency tasks as assigned by the provincial People's Committee and prescribed by the law.
29. Implementing administrative reform programs in areas under the Department's jurisdiction as prescribed.
30. Specifying the functions, tasks, powers of specialized departments and offices (if any); the working relationships among units under the Department in accordance with the general guidelines of the Ministry of Agriculture and Rural Development and the regulations of the provincial People's Committee.
31. Managing organizational structures, civil servant quotas, civil service grade structures, job positions, and the number of personnel in public service units based on occupational titles; implementing salary systems and incentive policies, training, rewards, and disciplinary measures for civil servants, public officials, and workers under the Department's jurisdiction in accordance with the law and delegated or authorized by the provincial People's Committee.
Organizing training and capacity building for civil servants, public officials, and non-professional village, ward, and town cadres engaged in agricultural and rural development management in accordance with the provincial People's Committee and the Ministry of Agriculture and Rural Development's regulations.
32. Managing and being responsible for finances and assets allocated in accordance with the law and delegated and classified by the provincial People's Committee.
33. Implementing information and periodic or ad hoc reporting on the implementation of assigned tasks as prescribed by the provincial People's Committee and the Ministry of Agriculture and Rural Development.
34. Performing other tasks assigned by the provincial People's Committee or the Chairman of the provincial People's Committee and as prescribed by the law.
Article 3. Agencies under the Department of Agriculture and Rural Development
1. The establishment of agencies under the Department of Agriculture and Rural Development (including internal organizations) must comply with the provisions of specialized laws and meet the criteria for establishment as stipulated in Decree No. 107/2020/ND-CP dated September 14, 2020, of the Government amending and supplementing certain articles of Decree No. 24/2014/ND-CP dated April 4, 2014, of the Government on the organization of specialized agencies under provincial People's Committees directly under the central government (hereinafter referred to as Decree No. 107/2020/ND-CP).
a) In cases where a specialized agency under the Department of Agriculture and Rural Development is established, the organizational structure of the agency's departments must be rearranged according to the criteria specified in Decree No. 107/2020/ND-CP.
b) If the criteria for establishing an agency are not met or if the criteria are met but it is not necessary to establish an agency, the Department of Agriculture and Rural Development shall report to the provincial People's Committee for consideration of merging, consolidating, or reorganizing the agencies under the Department of Agriculture and Rural Development or the specialized departments under the Department of Agriculture and Rural Development to perform tasks related to that sector or field.
2. Functions, tasks, and powers of agencies under the Department of Agriculture and Rural Development:
a) The agency responsible for crop production and plant protection assists the Director of the Department of Agriculture and Rural Development in performing advisory functions for the provincial People's Committee in state management and enforcement of laws on crop production and plant protection as prescribed by laws on crop production and plant quarantine; implements tasks and powers in the field of crop production and plant protection as stipulated in Clause 4, Article 2 and other relevant provisions of this Circular, as assigned by the Director of the Department and in accordance with the law.
b) The agency responsible for animal husbandry and veterinary services assists the Director of the Department of Agriculture and Rural Development in performing advisory functions for the provincial People's Committee in state management and enforcement of laws on animal husbandry and veterinary services as prescribed by laws on animal husbandry and veterinary services; implements tasks and powers in the field of animal husbandry and veterinary services as stipulated in Clause 5, Article 2 and other relevant provisions of this Circular, as assigned by the Director of the Department and in accordance with the law.
c) The agency responsible for forestry and forest protection assists the Director of the Department of Agriculture and Rural Development in performing advisory functions for the provincial People's Committee in state management and enforcement of laws on forestry and forest protection as prescribed by laws on forestry; implements tasks and powers in the field of forestry as stipulated in Clause 6, Article 2 and other relevant provisions of this Circular, as assigned by the Director of the Department and in accordance with the law.
d) The agency responsible for fisheries and fishery inspection assists the Director of the Department of Agriculture and Rural Development in performing advisory functions for the provincial People's Committee in state management and enforcement of laws on fisheries and fishery inspection as prescribed by laws on fisheries; implements tasks and powers in the field of fisheries as stipulated in Clause 8, Article 2 and other relevant provisions of this Circular, as assigned by the Director of the Department and in accordance with the law.
đ) The agency responsible for water resources, dyke management, flood prevention, and disaster response assists the Director of the Department of Agriculture and Rural Development in performing advisory functions for the provincial People's Committee in state management and enforcement of laws on water resources, rural clean water supply, water resource security, dam and reservoir safety, dyke management, flood prevention, and disaster response within the province; implements tasks and powers in the fields of water resources, dyke management, flood prevention, and disaster response as stipulated in Clauses 9 and 10, Article 2 and other relevant provisions of this Circular, as assigned by the Director of the Department and in accordance with the law.
e) The agency responsible for cooperative economic development and rural development assists the Director of the Department of Agriculture and Rural Development in performing advisory functions for the provincial People's Committee in state management and enforcement of laws on collective economic development, cooperatives, farmstead economies, production and product marketing linkages, agricultural electromechanical industry, agricultural insurance, rural development, rural industries and craft villages, rural population resettlement, poverty reduction and social welfare in rural areas, vocational training for rural laborers as prescribed by laws; implements tasks and powers in the field of rural development as stipulated in Clause 11, Article 2 and other relevant provisions of this Circular, as assigned by the Director of the Department and in accordance with the law.
g) The agency responsible for quality control, processing, and market development assists the Director of the Department of Agriculture and Rural Development in performing advisory functions for the provincial People's Committee in state management and enforcement of laws on product quality, food safety, processing, and market development for agricultural, forestry, fisheries, and salt products as prescribed by laws on product quality and food safety; implements tasks and powers in the fields of product quality, food safety, processing, and market development for agricultural, forestry, fisheries, and salt products as stipulated in Clauses 7, 12, and 13, Article 2 and other relevant provisions of this Circular, as assigned by the Director of the Department and in accordance with the law.
Chapter II
SPECIALIZED AGENCIES ON AGRICULTURE AND RURAL DEVELOPMENT UNDER THE PEOPLE'S COMMITTEES OF DISTRICTS
1. The position and functions of the Social and Cultural Department shall be carried out in accordance with Article 11 of Decree No. 150/2025/NĐ-CP.
1. The Department of Agriculture and Rural Development in districts or the Economic Department in towns and cities directly under provincial-level provinces is a specialized agency under the People's Committee at the district level; it advises and assists the People's Committee at the district level in performing state management functions locally regarding agriculture; forestry; salt production; water resources; fisheries; disaster prevention and control; quality and safety of agricultural, forestry, fishery, and salt products; rural development; household economic development; rural farmstead economy; agricultural, forestry, fishery, and salt industry cooperatives linked to trades and village crafts in rural areas, and performs certain tasks and powers delegated by the People's Committee at the district level and as prescribed by law.
The Economic Department in urban districts advises and assists the People's Committee of the district in performing state management functions locally regarding disaster prevention and control, fields within the agricultural sector and rural development, and other fields as prescribed by law.
2. The Department of Agriculture and Rural Development or the Economic Department (hereinafter referred to as the Department) has legal personality, its own seal and separate account; it is subject to the direction and management of the People's Committee at the district level in accordance with the law; at the same time, it is subject to the direction, guidance, and inspection on professional matters within the agricultural and rural development sector by the Department of Agriculture and Rural Development.
Article 5. Tasks and Powers
1. Submit to the People's Committee at the district level:
a) Draft decisions, master plans, medium-term plans, annual plans, and other contents of tasks related to agriculture and rural development within the authority of the People's Committee at the district level as prescribed; programs and measures for organizing the implementation of administrative reform tasks assigned by the state management according to the regulations.
b) Draft specific regulations on the functions, tasks, powers, and organizational structure of the Department of Agriculture and Rural Development or the Economic Department.
2. Submit to the Chairman of the People's Committee at the district level draft documents on the agricultural and rural development sector within the authority of the Chairman of the People's Committee at the district level.
3. Implement legal regulatory documents, strategies, plans, programs, projects, national standards, national technical regulations, and economic-technical norms in the specialized field after approval by the competent authority; disseminate information, publicize laws, monitor law enforcement in the fields under its jurisdiction.
4. Organize the implementation of work to develop agricultural, forestry, fishery, and salt production; organic agricultural production, high-tech application; crop and livestock structure adjustment; work on disaster prevention and control, pest and disease control in the district.
5. Advise and assist the People's Committee at the district level in organizing inspections and audits of the implementation of laws on dikes and handling violations of laws on dikes; guide the People's Committee at the commune level to organize civilian dike management forces and patrol guards; decide within its authority or submit to the competent authority for decision on mobilizing forces, materials, and means to protect dikes and mitigate consequences caused by floods, storms, and typhoons affecting dikes according to the division of labor by the People's Committee at the district level.
6. Coordinate in organizing the protection of dikes, small and medium-sized water conservancy works, aquaculture facilities, rural water supply and drainage works, disaster prevention and control works; manage the irrigation network in the district in accordance with the law.
7. Serve as the focal point for organizing and guiding the implementation of content related to rural development; report to the People's Committee at the district level on the construction and development of rural areas in the district in the following fields: farmstead economy, collective economy, cooperative and production linkage in agricultural product production and consumption; rural industry and craft village development; agricultural insurance, production support, and rural social security; rural clean water exploitation and utilization; processing of agricultural, forestry, fishery, and salt products; guide and inspect the implementation of land consolidation and resettlement work in agriculture and rural areas.
8. Organize statistical activities serving management requirements as prescribed; statistics on the evolution of agricultural, forestry, salt production, and aquaculture water surfaces; statistics, construction, and management of water resources data; implement appropriate cultivation measures to rationally exploit and utilize land and water resources for agricultural production, aquaculture, and salt production.
9. Manage the quality of agricultural inputs, food safety of agricultural, forestry, fishery, and salt products in the district in accordance with the law.
10. Manage service activities supporting the development of agriculture, forestry, salt production, and fisheries; agricultural and forestry inputs, animal feed, fish feed, aquaculture in the district.
11. Manage extension work in agriculture, forestry, salt production, and fisheries, and development projects in these sectors, water resources management, disaster prevention and control, and rural development in the district in accordance with the law.
12. Assist the People's Committee at the district level in implementing and being responsible for the examination, registration, issuance, and revocation of permits and certificates within the scope of responsibility and authority of the specialized agency in accordance with the law and the division of labor by the People's Committee at the district level.
13. Assist the People's Committee at the district level in managing state affairs concerning collective economic organizations, private economic organizations, associations, and non-governmental organizations operating in the fields managed by the Department in accordance with the law.
14. Provide professional guidance on management fields for commune-level civil servants in agriculture and rural development.
15. Inspect the implementation of laws on agriculture and rural development by organizations and individuals under its jurisdiction; resolve complaints and denunciations; prevent corruption and waste in accordance with the law and the division of labor by the People's Committee at the district level.
16. Organize the application of scientific and technological progress; build information and storage systems to serve state management and professional tasks of the Department.
17. Carry out permanent tasks related to disaster prevention and control; forest protection and development; new rural construction; clean water and environmental sanitation in rural areas; desertification prevention; disease prevention and control in agriculture, forestry, and aquaculture within the district's jurisdiction.
18. Implement regular and urgent reporting on the implementation of assigned tasks in the fields of agriculture and rural development according to the regulations of the provincial People's Committee and the Department of Agriculture and Rural Development.

Chapter III
IMPLEMENTATION
Article 6. Effectiveness
1. This Circular takes effect from March 31, 2023.
2. Repeal the following provisions and Circulars:
a) Joint Circular No. 14/2015/TTLT-BNNPTNT-BNV dated March 25, 2015, issued by the Minister of Agriculture and Rural Development and the Minister of Home Affairs guiding the functions, tasks, authorities, and organizational structure of specialized agencies for agriculture and rural development under provincial and district-level People's Committees.
b) Article 1, Article 2, Article 3, Article 4, Article 5, Article 6, and Article 7 of Circular No. 15/2015/TT-BNNPTNT dated March 26, 2015, issued by the Minister of Agriculture and Rural Development guiding the tasks of the district agricultural extension services and affiliated organizations under the Department of Agriculture and Rural Development.
c) Clause 2 of Article 9 of Circular No. 15/2015/TT-BNNPTNT dated March 26, 2015, issued by the Minister of Agriculture and Rural Development, amended and supplemented by Article 1 of Circular No. 30/2016/TT-BNNPTNT dated August 25, 2016, issued by the Minister of Agriculture and Rural Development amending and supplementing Article 9 of Circular No. 15/2015/TT-BNNPTNT dated March 26, 2015 guiding the tasks of the district agricultural extension services and affiliated organizations under the Department of Agriculture and Rural Development.
d) Clause 2 of Article 2 of Circular No. 30/2016/TT-BNNPTNT dated August 25, 2016, issued by the Minister of Agriculture and Rural Development amending and supplementing Article 9 of Circular No. 15/2015/TT-BNNPTNT dated March 26, 2015 guiding the tasks of the district agricultural extension services and affiliated organizations under the Department of Agriculture and Rural Development.
Article 7. Responsibility for Implementation
1. Provincial People's Committees shall be responsible for:
a) Specify the functions, tasks, and authorities of the Department of Agriculture and Rural Development; decide on the organizational structure of the Department of Agriculture and Rural Development in line with the requirements of state management over the agricultural sector and rural development in the following areas: crop production, plant protection; animal husbandry, veterinary medicine; forestry; fisheries; irrigation; dike and flood control, disaster prevention and control; cooperative economy and rural development; quality, processing, and market development, and other tasks as prescribed by law.
b) Direct and guide the district People's Committees to specify the functions, tasks, authorities, organization, and staffing of the Department of Agriculture and Rural Development or the Economic Department in accordance with the law.
2. The Chairman of the Provincial People's Committee shall be responsible for organizing the implementation of this Circular. During the implementation process, if there are difficulties or need for supplementation or amendment, the provincial People's Committee and the Department of Agriculture and Rural Development shall report to the Ministry of Agriculture and Rural Development for consideration and resolution within their authority.
