CIRCULAR

Regulations on technical safety quality inspection and environmental protection for specialized motorcycles

Circular No. 89/2015/TT-BGTVT dated December 31, 2015, issued by the Minister of Transport regarding the inspection of technical safety quality and environmental protection for specialized motorcycles, which took effect from July 1, 2016, has been amended and supplemented by:

1. Circular No. 42/2018/TT-BGTVT dated July 30, 2018, issued by the Minister of Transport amending and supplementing certain articles of several circulars in the field of vehicle inspection, which took effect from October 15, 2018;

2. Circular No. 23/2020/TT-BGTVT dated October 1, 2020, issued by the Minister of Transport amending and supplementing certain articles of Circular No. 89/2015/TT-BGTVT dated December 31, 2015, issued by the Minister of Transport regarding the inspection of technical safety quality and environmental protection for specialized motorcycles and Circular No. 42/2018/TT-BGTVT dated July 30, 2018, issued by the Minister of Transport regarding the amendment and supplementation of certain articles of several circulars in the field of vehicle inspection;

3. Circular No. 49/2023/TT-BGTVT dated December 31, 2023, issued by the Minister of Transport amending and supplementing certain articles of several circulars in the field of technical safety quality inspection and environmental protection for motor vehicles, specialized motorcycles, four-wheeled passenger vehicles with engines, four-wheeled cargo vehicles with engines, and electric bicycles produced, assembled, and imported, which took effect from February 15, 2024.

Pursuant to Decree No. 187/2013/NĐ-CP dated November 20, 2013, issued by the Government detailing the implementation of the Law on Trade concerning international trade activities and foreign trade agency buying, selling, processing, and transiting goods;

On the basis of Decree No. 86/2012/NĐ-CP dated October 19, 2012, issued by the Government detailing and guiding implementation of certain provisions of the Metrology Law;

Pursuant to the Law on Product Quality and Commodities dated November 21, 2007;

Pursuant to the Law on Trade dated June 14, 2005;

Pursuant to Decree No. 132/2008/NĐ-CP dated December 31, 2008 of the Government detailing certain provisions of the Law on Product Quality;

The Minister of Transport issues this Circular on the inspection of technical safety quality and environmental protection for specialized motorcycles

||| The Minister of Transport and the Minister of Finance jointly issue this Circular guiding the valuation methods and price management of public goods and services in the field of inland waterway management and maintenance carried out under the government procurement method using central budget funds.

The Minister of Transport issues this Circular amending and supplementing certain articles of Circular No. 29/2018/TT-BGTVT dated May 14, 2018, issued by the Minister of Transport on quality inspection, technical safety, and environmental protection for railway transportation vehicles, and Circular No. 18/2019/TT-BGTVT dated May 20, 2019, issued by the Minister of Transport guiding the implementation of Decree No. 139/2018/NĐ-CP dated October 8, 2018, of the Government on business operations of vehicle inspection services.

This Circular stipulates the inspection of technical safety quality and environmental protection (hereinafter referred to as ATKT & BVMT) for imported specialized motorcycles; those produced and assembled from new parts not previously used or from new vehicles not previously used and without license plates (referred to as base vehicles); those modified and operated.¹.

Chapter I. GENERAL PROVISIONS

Article 1. Scope of Regulation

1.² This Circular does not apply to specialized motorcycles produced, assembled, and imported for direct use in national defense and security purposes by the Ministry of National Defense and the Ministry of Public Security.

This Circular applies to agencies, organizations, and individuals related to management, inspection, importation; production and assembly from new parts not previously used or from base vehicles; modification and operation of specialized motorcycles.

Article 2. Applicability³

Some terms used in this Circular include:

Article 3. Explanation of Terms⁴

(hereinafter referred to as vehicle) includes types of vehicles listed in Vietnam Standard TCVN 7772:2007 "Mobile construction equipment, machines, and devices - Classification" and types of vehicles mentioned in Section C of Appendix I and Section D of Appendix II of Circular No. 12/2022/TT-BGTVT dated June 30, 2022, issued by the Minister of Transport regarding the List of products and goods that may cause safety risks under the responsibility of the Ministry of Transport for state management.

1.⁵ Specialized motor vehicles are vehicles of the same industrial owner, brand, design, basic technical specifications, and country of manufacture.

2. Same type of vehicle is a product inspected and evaluated to issue a Type Approval Quality Certificate.

3. Typical sample refers to one of the following documents: Notification of Exemption from Technical Safety Quality and Environmental Protection Inspection for Imported Vehicles (hereinafter referred to as Notification of Exemption), Certificate of Technical Safety Quality and Environmental Protection for Imported Vehicles (hereinafter referred to as Quality Certificate); Notification of Non-Conformity with Technical Safety Quality and Environmental Protection Standards for Imported Vehicles (hereinafter referred to as Non-Conformity Notification); Design Approval Certificate; Certificate of Technical Safety Quality and Environmental Protection for Produced and Assembled Vehicles (hereinafter referred to as Type Approval Certificate); Design Modification Approval Certificate; Certificate of Technical Safety Quality and Environmental Protection for Modified Vehicles.

4. Quality certificate refers to the process of inspecting, testing, reviewing, evaluating, and certifying the conformity of a type of product with current standards, technical regulations, and provisions of the Minister of Transport regarding technical safety quality and environmental protection.

5. type approval for products Certificate of Technical Safety Quality and Environmental Protection for Vehicles in Operation (hereinafter referred to as Certificate CNAT)

6. is a certificate confirming that the vehicle has been inspected and meets the standards, technical regulations, and provisions regarding technical safety quality and environmental protection. Inspection Safety Quality and Environmental Protection Label for Vehicles in Operation (hereinafter referred to as Inspection Label)

7. is a symbol granted to vehicles that have been issued a Certificate CNAT and are permitted to operate on public roads according to the period indicated on the Inspection Label. Importer

8. Importer refers to the review, inspection, and comparison of design product contents with current standards, technical regulations, and provisions to ensure that products produced, assembled, or modified meet the requirements for technical safety quality and environmental protection.

9. Design review is an organization registered for business and operating in the design industry or a Production and Modification Facility that designs its own vehicles for production, assembly, or modification.

10. Design entity Production and Modification Facility

11. is an enterprise producing, assembling, and modifying vehicles in accordance with current regulations. Vehicle Technical Safety Quality and Environmental Protection Inspection Unit in Operation (hereinafter referred to as Inspection Unit)

12. are Motor Vehicle Inspection Centers, Inspection Branches with adequate facilities, equipment, and personnel to conduct inspections in accordance with regulations and publicly announced on the website of the Vietnam Vehicle Inspection Bureau. Owner

13is an organization or individual owning; driver or person bringing the vehicle for inspection. Product Quality Assurance Assessment at the Production Facility (hereinafter referred to as COP Assessment)

14. Evaluation of quality assurance for products at the production facility (hereinafter referred to as COP assessment) is the process of reviewing and evaluating the quality management system, production and assembly processes, and the operation of the quality inspection system at the production facility during the production and assembly to ensure the technical safety and environmental protection quality for the types of vehicles registered for quality certification, meeting the technical standards, regulations, and requirements for such product types.

Article 3a. National Technical Standards and Regulations⁶

The national technical regulations, standards, and permissible measurement errors used in the inspection of technical safety and environmental protection quality for specialized motorcycles include:

1. QCVN 13: 2011/BGTVT: National technical regulation on the quality of technical safety and environmental protection for specialized motorcycles;

2. QCVN 22:2010/BGTVT: National technical regulation on manufacturing and inspecting handling equipment and devices;

3. QCVN 12:2011/BGTVT: National technical regulation on permissible measurement errors and rounding off for dimensions and weight of motor vehicles; permissible measurement errors and rounding off for dimensions and weight of vehicles are applied similarly to specialized motor vehicles;

4. TCVN 7772: National standard on mobile construction machinery, equipment, and devices - classification;

5. TCVN 4244: National standard on lifting equipment, design, manufacture, and technical inspection.

Chapter II. QUALITY INSPECTION OF TECHNICAL SAFETY AND ENVIRONMENTAL PROTECTION FOR IMPORTED SPECIALIZED MOTORCYCLESSPECIAL MOTORCYCLE ENVIRONMENT IMPORTED

Article 4. Registration Inspection Documents

1. The registration inspection documents (hereinafter referred to as the Registration Inspection File) include the following types of documents:

a) The registration inspection form according to the model prescribed in Appendix I issued together with this Circular;

b)⁷ (Repealed)

c)⁸ (Repealed)

d) Documentation introducing features and technical specifications or the Imported Vehicle Information Form according to the model prescribed in Appendix II issued together with this Circular;

đ) The original Factory Test Certificate issued by the manufacturer for each vehicle or the original Quality Certificate (QC) issued by the manufacturer for the vehicle. These documents apply to vehicles subject to type approval verification as stipulated in Clause 1, Article 6 of this Circular.

2. Exemption from submitting documentation introducing features and technical specifications as prescribed in Point d, Clause 1 of this Article for imported vehicles of the same type that have been granted a Quality Certificate, and vehicles whose Quality Certificates have been published on the website of the Vietnam Registering and Testing Agency.

Article 5. Procedures and Methods of Implementation

1. The importer submits one set of Registration Inspection Files as prescribed in Article 4 of this Circular directly or through postal services or other appropriate means to the Vietnam Registering and Testing Agency.

2. The Vietnam Registering and Testing Agency receives and checks the Registration Inspection Files and proceeds as follows:

a)⁹ If the file is complete as required, within one working day from the date of receipt, the Vietnam Registering and Testing Agency confirms the Quality Inspection Registration Form. The importer must bring the vehicle to the actual registration inspection location within fifteen days from the date of arrival for storage.

If more than fifteen days have passed since the date of arrival for storage and the importer has not brought the vehicle for actual inspection (except in cases of force majeure), the Vietnam Registering and Testing Agency will refuse to accept subsequent files until the importer brings the vehicle for actual inspection.

b) If the file is incomplete as required, within one working day from the date of receipt, the Vietnam Registering and Testing Agency guides the importer to supplement and perfect the file.

3. The Vietnam Registering and Testing Agency conducts actual vehicle inspections according to the agreed time and location with the importer. The actual inspection time is within one working day for vehicles that meet the inspection conditions.

4.¹⁰ Within four working days from the end of the actual vehicle inspection and receipt of all required documents, the Vietnam Registering and Testing Agency issues the Quality Certificate.

5. The Vietnam Registering and Testing Agency delivers the Quality Certificate after confirmation of payment of fees and charges.

Article 6. Inspection Methods

1.¹¹ (Repealed)

2. Probability inspection:

a) This inspection method applies to Used vehicles not previously imported, produced no more than three years prior to the importation date, with documentation as prescribed in Clause 1, Article 4 of this Circular, and not within the scope of the inspection method prescribed in Clause 1 of this Article.

b) Inspection contents: Randomly select one vehicle of each type for inspection of the following items: general inspection, braking system (excluding brake effectiveness test), control system, work system (excluding load testing), lighting and signaling systems, exhaust emissions, noise levels according to current technical standards and regulations; inspect the chassis number and engine number of each imported vehicle of the same type as shown in the Registration Technical Documentation.

3. Vehicle-by-vehicle inspection:

a) This inspection method applies to vehicles not within the scope of the inspection methods prescribed in Clauses 1 and 2 of this Article and with documentation as prescribed in Clause 1, Article 4 of this Circular;

b) Inspection contents: inspect according to the items specified in current technical standards and regulations (excluding load testing and brake effectiveness testing).

Article 7. Handling Inspection Results

1. After inspecting the actual vehicles and receiving complete documentation as prescribed, the Vietnam Registration Agency will issue a quality certificate for each specific case as follows:

a) For vehicles inspected under the Type Confirmation Method and meeting all requirements, the Vietnam Registration Agency will issue a Notification of Exemption according to the model prescribed in Appendix III issued along with this Circular;

b) For vehicles inspected under the Probability Inspection Method or individual vehicle inspection and meeting all requirements, the Vietnam Registration Agency will issue a Certificate of Conformity according to the model stated in Appendix IV issued along with this Circular;

c) For vehicles inspected but failing to meet the requirements, the Vietnam Registration Agency will issue a Non-Conformance Notification according to the model stated in Appendix V issued along with this Circular;

d) For vehicles with chassis numbers or engine numbers that have been erased, altered, or resealed, the Vietnam Registration Agency will handle as follows: suspend all inspection and certification procedures for imported specialized motor vehicles; record the vehicle's violation status in a report according to the model in Appendix VI issued along with this Circular. Within three working days from the date of the violation conclusion, the Vietnam Registration Agency will issue a Violation Notification according to the model in Appendix VII issued along with this Circular and send it to the Importer and Customs Authority (where the import procedures were handled) for resolution according to regulations.

2. Handling certain special cases during the inspection process is carried out as follows:

a) In the case of used vehicles with technical documents but lacking basic technical specifications, the basic technical specifications of the vehicle will be determined based on actual inspections;

b) In the case of large vehicles that must be disassembled for transportation to Vietnam, the Vietnam Registration Agency will only conduct import quality inspections after the vehicle has been fully reassembled;

c) In the case of imported vehicles damaged during transportation from the loading port to Vietnam, the importer is allowed to repair scratches on the paint layer; replace windshields and windows that are cracked or broken; repair or replace headlights and signal lights that are cracked or broken; repair or replace rearview mirrors that are cracked or broken; repair or replace windshield wipers that are malfunctioning; and address issues with batteries that are not functioning;

d)¹² Vehicles permitted for import as specified in Point a, Clause 8, Section II of Appendix I issued along with Decree No. 69/2018/NĐ-CP shall be inspected and certified according to regulations, with the Certificate noting: "This vehicle is intended for operation in narrow areas and does not participate in traffic";

đ)¹³ For vehicles listed in the Prohibited Import Goods Catalogue as specified in Section II of Appendix I issued along with Decree No. 69/2018/NĐ-CP, the Vietnam Registration Agency will handle as follows: suspend all inspection and certification procedures for imported specialized motor vehicles; record the vehicle's violation status in a report according to the model in Appendix VI issued along with this Circular. Within three working days from the date of the violation conclusion, the Vietnam Registration Agency will issue a Violation Notification according to the model in Appendix VII issued along with this Circular and send it to the Importer and Customs Authority (where the import procedures were handled) for resolution according to regulations.

e) In the case of vehicles designed with automatic acceleration based on load or with exhaust pipes specially designed where it is impossible to insert an exhaust gas sampling probe, exhaust gas testing will not be applied;

g) In the case of multiple chassis numbers or engine numbers on a vehicle, the Vietnam Registration Agency will specifically record the condition of the chassis or engine numbers in the vehicle's quality certificate and note the sealing positions in special cases;

h) In the case of vehicles suspected of having altered chassis or engine numbers, the Vietnam Registration Agency will request a specialized agency to conduct an appraisal to handle the situation specifically;

The year of manufacture of the vehicle will be determined based on the following grounds: vehicle identification number (PIN); chassis number; manufacturer's documentation such as: catalogs, technical specification manuals; international organization search software providing information about the vehicle; information on the manufacturer's label attached to or sealed on the vehicle; information recorded in copies of the Vehicle Registration Certificate or Vehicle Cancellation Certificate currently circulating abroad.

Chapter III^15. QUALITY INSPECTION OF TECHNICAL SAFETY AND ENVIRONMENTAL PROTECTION FOR IMPORTED SPECIALIZED MOTORCYCLESENVIRONMENT FOR SPECIALIZED MOTOR VEHICLES PRODUCTION AND ASSEMBLY

Article 8. Design Documents

1. The design documents for vehicles include:

a) Technical design description of the vehicle (original) in accordance with Section A of Appendix VIII issued together with this Circular;

b) Technical drawings (original) in accordance with Section B of Appendix VIII issued together with this Circular;

c) Technical specifications (copy) of the assemblies and systems related to the design calculation content.

2. Exemption from preparing design documents: For vehicles produced and assembled according to foreign brand designs, if the production facility provides the following substitute documents:

a) Technical drawings of the vehicle showing the general layout of the product; basic dimensions of the vehicle; layout and installation dimensions of the working system and cab;

b) Certified copy by the technology transferor of the Product Type Certificate issued by the competent authority of the foreign country;

c) Certified copy by the technology transferor of the technical specifications and basic features of the produced and assembled vehicle issued by the technology transferor.

3.¹⁶ When submitting design documents through the online public service system, the components of the design documents specified in Clause 1 of this Article shall be replaced by electronic documents.

Article 9. Design Review

1. Vehicle design documents must be reviewed by the Vietnam Motor Vehicle Inspection Center.

2. After the review, if the design documents meet the requirements, the Vietnam Motor Vehicle Inspection Center will issue a design review certification according to the model prescribed in Appendix IX issued together with this Circular.

3.¹⁷ The design entity receives the design review results as follows:

a) In case of receiving directly at the Quality Control Agency's office or through the postal system: One Design Review Certification; technical design description and technical drawings (one set if the design entity is also the production entity or two sets if the design entity is different from the production entity) of the design documents;

b) In case of receiving through the online public service system: One electronic Design Review Certification; one electronic technical design description and technical drawings of the design documents.

4. Supplementing and amending design documents

a) In cases where there are changes or supplements to the product design compared to the reviewed design documents, the product design entity must have supplementary and amended design documents and a request for the Vietnam Motor Vehicle Inspection Center to review the supplementary and amended contents according to the procedures stipulated in Clause 5 of this Article.

b) The design entity must prepare new design documents if the supplements or amendments do not meet the requirements for the same type of vehicle.

5. Methods of conducting design reviews

a)¹⁸ The application for design review includes:

In case of submitting documents through the online public service system: submit an electronic application form including one application form according to the model prescribed in Appendix XlVa issued together with this Circular; one set of design documents according to Clause 1 of Article 8 of this Circular;

In case of submitting documents directly or through the postal system: one application form according to the model prescribed in Appendix XIVa issued together with this Circular; in addition to submitting one set of design documents according to Clause 1 of Article 4 of this Circular, the design entity must also submit one additional document (or two additional documents if the design entity is different from the production entity) as stipulated in point a and b of Clause 1 of Article 8 of this Circular.

b)¹⁹ Procedure:

The design entity prepares one set of application documents for design review according to point a of Clause 5 of this Article, submits the documents directly or through the postal system or by other appropriate means to the Vietnam Motor Vehicle Inspection Center.

The Vietnam Motor Vehicle Inspection Center receives and checks the components of the application documents. If the documents are incomplete according to the regulations, the Vietnam Motor Vehicle Inspection Center returns the documents within one working day for direct submission or within two working days from the date of receipt for other submission methods and guides the design entity to complete the documents. If the documents are complete, the Vietnam Motor Vehicle Inspection Center receives and proceeds to review the documents.

The Vietnam Motor Vehicle Inspection Center conducts the design document review: performs verification and comparison of the contents of the design documents with the technical regulations, standards, and technical norms of the Minister of Transport regarding safety and environmental protection for special purpose vehicles. Within the time limit specified in point c of this clause, if the design documents meet the requirements, the Vietnam Motor Vehicle Inspection Center issues a Design Review Certification according to the model in Appendix IX issued together with this Circular.

If the design documents are complete but contain contents that do not meet the requirements, the Vietnam Motor Vehicle Inspection Center will notify in writing or through the online public service system the reasons and contents that do not meet the requirements for the design entity to perfect the design documents. The design entity is responsible for perfecting the design documents and resubmitting them within thirty working days from the date of notification. Within the time limit specified in point c of this clause from the date of receipt of the completed and full documents, the Quality Control Agency verifies and compares the contents of the design documents with the technical regulations, standards, and technical norms of the Minister of Transport regarding safety and environmental protection for special purpose vehicles. Within the time limit specified in point c of this clause, if the design documents meet the requirements, the Quality Control Agency issues a Design Review Certification according to the model prescribed in Appendix IX issued together with this Circular; if the design documents do not meet the requirements, the Quality Control Agency notifies in writing or through the online public service system about the non-issuance of the Design Review Certification and specifies the reasons.

Beyond thirty working days from the date of notification, if the design entity does not perfect the contents of the design documents that are not suitable, the Quality Control Agency will stop the design document review process and notify in writing or on the online public service system about the non-issuance of the Design Review Certification. To continue the design document review process, the design entity must resubmit the documents from the beginning.

c) Time limit for resolution:

The design review process shall be completed within ten working days from the date all required documents are received; the Design Review Certificate shall be issued within three working days from the date the design review meets the requirements.

Article 10. Inspection and Testing of Representative Samples

1. Manufacturers are responsible for preparing representative samples at the inspection location agreed upon with the Vietnam Vehicle Inspection Agency. The items and objects to be inspected and tested are specified in Appendix X attached hereto.

2. The Vietnam Vehicle Inspection Agency will conduct inspections and tests on representative samples according to technical standards and current regulations; prepare a report on the results of the inspection and testing of representative samples.

Article 11. Application Documents for Quality Safety Technical Certification and Environmental Protection of Vehicle Types

The application documents for quality safety technical certification and environmental protection of vehicle types (hereinafter referred to as the application documents for certification) include:

a) A request form in accordance with the model prescribed in Appendix XlVa attached hereto;

b) A copy of the report on the results of the inspection and testing of representative samples;

c) A copy of the Design Review Certificate, technical design description, and technical drawings of the design documents reviewed by the Vietnam Vehicle Inspection Agency, or alternative documents as stipulated in Clause 2 of Article 8 of this Circular;

d) Photographs of the vehicle's appearance; vehicle information in accordance with the model prescribed in Appendix XI attached hereto;

đ) A statistical list of domestic and imported assemblies and systems used in production and assembly of products in accordance with the model prescribed in Appendix XII attached hereto;

e) A description of the method and location for chassis number and engine number stamping.

Article 12. Product Quality Assurance in Production and Assembly

1. Manufacturers must implement a quality management system to ensure product quality during production, assembly, and shipment that complies with regulations, standards, and technical norms. Implementation of the quality management system is carried out through the establishment and implementation at the manufacturing facility of production and assembly procedures, quality control inspection procedures suitable for the type of product being produced from component quality control at the input stage, quality control at each production stage, and final quality control; procedures for implementing corrective and preventive actions for product defects; procedures for storing and controlling quality inspection records; suitability and operational status of inspection equipment according to production and final inspection stages; quality control inspector competencies and ability to operate inspection equipment.

2. The Vietnam Vehicle Inspection Agency will assess the quality assurance based on criteria set forth in ISO 9000 standards and corresponding product technical standards and norms as outlined in Clause 1 of this Article at the manufacturing facility through the following methods:

a) Initial assessment: conducted before issuing the Quality Safety Technical Certification and Environmental Protection Certificate for manufactured and assembled vehicles (hereinafter referred to as the Type Approval Certificate), based on reviewing and assessing the following contents: production and assembly technology processes and product quality inspection procedures; record storage and control procedures; personnel serving production, assembly, and quality inspection; final quality inspection equipment; operation of the quality control system during production, assembly, final product quality inspection, and market release;

b) Periodic assessment: conducted to evaluate the maintenance of quality assurance at the manufacturing facility for products already certified with the Type Approval Certificate, with a review cycle of twenty-four months. Expanded scope of inspection and assessment will be carried out if there are inconsistencies in production, assembly, and product quality inspection processes;

c) Unannounced assessment: conducted when there is a request from competent authorities or complaints about product quality on the market. The Vietnam Vehicle Inspection Agency issues a decision to establish an inspection team and conducts an unannounced assessment of the manufacturing facility regarding compliance with this Circular. If the assessment results show that the manufacturing facility violates regulations on maintaining product quality assurance, product quality inspection; products shipped out do not meet quality requirements or do not match the certification application documents; shipping certificates are issued incorrectly or other violations of this Circular, then they will be handled according to the provisions of Clauses 4 and 5 of Article 15 of this Circular.

3. Exemption from COP assessment applies to product types produced and assembled using similar or unchanged technological processes and inspection procedures compared to those previously assessed.

Article 13. Issuance of Type Approval Certificate

1. The Vietnam Registration Agency shall base on the results of reviewing the content of the registration dossier as stipulated in Article 11 of this Circular, the Report on the inspection and testing of typical samples, and the results of the COP assessment at the production facility to issue the Type Approval Certificate for the corresponding product type as prescribed in Appendix XIII attached to this Circular.

2. Procedures and methods of implementation:

a) The production facility shall prepare one set of registration dossier for certification in accordance with Article 11 of this Circular and submit it directly, through the postal service system, or by other appropriate means to the Vietnam Registration Agency;

b)²⁰ The Vietnam Registration Agency shall accept and examine the components of the registration dossier. In case the dossier is incomplete according to the regulations, the Vietnam Registration Agency shall return the dossier within one working day from the date of acceptance for direct submission or within two working days from the date of receipt for online submission via the public service system, and guide the enterprise to complete the dossier. If the dossier is complete, the Vietnam Registration Agency shall accept the dossier for content review;

c)²¹ The Vietnam Registration Agency shall conduct a review of the dossier content and the COP assessment results within seven working days. If the dossier is complete and valid according to the regulations and has a satisfactory COP assessment result, the Vietnam Registration Agency shall issue the Type Approval Certificate in accordance with the model prescribed in Appendix XIII attached to this Circular within the time limit specified in Clause 3 of this Article. If the dossier content is not valid, the Vietnam Registration Agency shall notify the production facility to supplement and complete the dossier. In case there is no COP assessment result, the Vietnam Registration Agency shall notify the enterprise to carry out the COP assessment in accordance with Article 12 of this Circular.

Within six months from the date of notification, the enterprise shall be responsible for completing the incomplete dossier content (including carrying out the COP assessment for cases without a COP assessment result) and resubmitting it to the Vietnam Registration Agency. Within seven working days from the date of receiving the completed and sufficient dossier and the COP assessment result, the Vietnam Registration Agency shall review the dossier content and the COP assessment result. If the dossier is complete and valid according to the regulations and has a satisfactory COP assessment result, the Vietnam Registration Agency shall issue the Type Approval Certificate in accordance with the model prescribed in Appendix XIII attached to this Circular within the time limit specified in Clause 3 of this Article; if there are any non-compliant contents, the Vietnam Registration Agency shall notify the enterprise about the non-issuance of the Type Approval Certificate and specify the reasons. In case the enterprise fails to complete the non-compliant contents notified within six months from the date of notification, the Vietnam Registration Agency will suspend the dossier review or COP assessment and notify in writing or through the public service system about the non-issuance of the Type Approval Certificate. To continue the issuance of the Type Approval Certificate, the enterprise must resubmit the dossier from the beginning.

3. Time limit for issuing the Type Approval Certificate: within three working days from the date the registration dossier is complete and compliant with the regulations and the COP assessment result meets the requirements.

Article 14. Inspection during mass production and assembly

1. After the product has been issued with a Type Approval Certificate, the production facility shall independently conduct mass production, quality inspection throughout the entire production and assembly process, perform outgoing inspection for each product, and ensure that these products comply with the registration dossier for certification and the sample model of the certified vehicle type.

2. The production facility shall be responsible for the origin, quality, and labeling of the products upon their release according to the law. The production and assembly facilities may only release products when the Type Approval Certificate for the vehicle type remains valid.

3. Release documentation for vehicles produced and assembled:

a) For vehicles that have been issued with a Type Approval Certificate and have a report on the results of outgoing quality inspection, the production facility shall receive corresponding outgoing quality inspection certificates based on the number of vehicles that meet the requirements, according to the model specified in Appendix XIV attached to this Circular. Based on the inspection results of each product, the production facility shall issue an outgoing quality inspection certificate (hereinafter referred to as the Release Certificate) for the vehicle. The Release Certificate must be signed and stamped by an authorized person. The Release Certificate issued for the aforementioned vehicle is used for vehicle registration procedures or to present when required.

b) The production facility is responsible for establishing and issuing the following documents for each released vehicle: the original Release Certificate (as stipulated in point a of this clause) for registration procedures; a copy of the Release Certificate for initial safety and environmental protection inspections; user manuals in Vietnamese, including key technical specifications and instructions for using safety equipment; warranty numbers or warranty certificates, clearly stating the warranty conditions and addresses of warranty facilities.

Article 15. Evaluation of product types that have been issued with a Type Approval Certificate; suspension and revocation of the Type Approval Certificate

1. The Vietnam Vehicle Inspection Agency shall conduct evaluations of product types that have been issued with a Type Approval Certificate in the following cases:

a) Periodic evaluation every 24 months;

b) Evaluation when there are changes to the product compared to the product that has been issued with a Type Approval Certificate;

c) Evaluation when there are changes to national technical standards and regulations related to the product type.

2. The basis for evaluating product types that have been issued with a Type Approval Certificate includes:

a) The results of the COP assessment at the production facility as stipulated in Clause 2 of Article 12 of this Circular;

b) The conformity of the product that has been issued with a Type Approval Certificate with relevant regulations, standards, and national technical norms.

3. When the relevant regulations, standards, and national technical norms related to the certified product type change, or when the product undergoes changes affecting its conformity with the relevant regulations, standards, and national technical norms, the production facility must re-inspect and test the product type according to the new regulations, standards, and national technical norms. In this case, the production facility must submit additional documents to the Vietnam Vehicle Inspection Agency as follows:

a) Documents related to the changes in the product;

b) A report on the results of the product type inspection according to the new regulations, standards, and national technical norms, or a supplementary report on the results of testing the changed components of the product type according to the new regulations, standards, and national technical norms.

The Vietnam Vehicle Inspection Agency will accept and review the additional documents to consider, evaluate, and issue the Certificate. The issuance procedure for the Certificate is carried out according to Article 13 of this Circular.

4. Suspension of the validity of the Type Approval Certificate

The Vietnam Vehicle Inspection Agency will suspend the validity of the Type Approval Certificate issued for a period of six months and notify the production facility in writing in the following cases:

a) The production facility violates regulations related to product quality inspection or uses quality inspection certificates for products leaving the factory;

b) Products released do not conform to the type approval dossier and the sample model that have been issued with a Type Approval Certificate, and the production facility does not rectify the non-conforming products that have been released.

During the period when the Type Approval Certificate is suspended, the production facility must rectify the violations. The Vietnam Vehicle Inspection Agency will review and inspect after the production facility notifies about the rectification of the violations; if the violations have been rectified, the Vietnam Vehicle Inspection Agency will revoke the suspension of the Type Approval Certificate and notify the production facility in writing; if the suspension period expires and the production facility still cannot rectify the violations, the Type Approval Certificate issued for the product type will be revoked according to point c of Clause 5 of this Article.

5. Revocation of the Type Approval Certificate

The Vietnam Vehicle Inspection Agency will notify in writing about the termination of the validity and revocation of the Type Approval Certificate issued in the following cases:

a) When the product type no longer meets current national technical regulations, standards, or norms, or when the product type has undergone changes that do not conform to the product inspection dossier and the Type Approval Certificate issued, and the production facility does not conduct supplementary inspections as required;

b) The COP assessment results show that the production facility seriously violates regulations related to product quality inspection or uses quality inspection certificates for products leaving the factory;

c) The Type Approval Certificate for the product type has been suspended for more than six months as stipulated in Clause 4 of this Article, and the production facility still cannot rectify the violations of the product type.

Chapter IV. QUALITY INSPECTION OF TECHNICAL SAFETY AND ENVIRONMENTAL PROTECTION FOR IMPORTED SPECIALIZED MOTORCYCLESSPECIALIZED MOTORCYCLE ENVIRONMENT MODIFICATION

Article 16. Design Documents for Modified Vehicles

1. The design documents for modified vehicles shall include:

a) A request for certification of the quality of the modified vehicle;

b) Business registration certificate or other equivalent documents of the design entity (for the first-time design entity);

c) Overall drawings of the vehicle before and after modification; Drawings and technical documents of the assemblies and systems used for modification; Calculations and explanations of the contents of modification that affect items requiring calculation checks as set out in Appendix XV issued together with this Circular; Photographs of the appearance of the vehicle before modification; Vehicle information sheet (if there are changes) according to the model prescribed in Appendix XVI issued together with this Circular.

2.²² Procedure and method for reviewing the design of modified vehicles:

a) The design entity prepares the design documents for modified vehicles and submits them directly or through the postal service or online public service system to the Inspection Branch.

In case of submitting the documents through the online public service system: submit one electronic design document for modified vehicles as stipulated in Clause 1 of this Article;

In case of submitting the documents directly or through the postal service: in addition to submitting one set of design documents for modified vehicles as stipulated in Clause 1 of this Article, the design entity must also submit one copy of the documents specified in Point c Clause 1 of this Article.

b) The Inspection Branch receives and reviews the components of the design documents for modified vehicles. If the documents are incomplete as required, the Inspection Branch returns the documents within one working day from the date of receipt for direct submission or within two working days from the date of receipt for online submission, and guides the design entity to complete the documents. If the documents are complete, the Inspection Branch accepts the documents for review of their content.

c) Within seven working days from the date the design entity submits all the design documents for modified vehicles: The Inspection Branch conducts a review and evaluation of the design documents for modified vehicles. If the design documents meet the requirements, the Inspection Branch issues a Design Review Certification according to the model at Appendix XVII issued together with this Circular within three working days from the date of the evaluation result showing that the design documents meet the requirements.

In case the design documents for motor vehicles are complete but contain contents that do not meet the requirements, the Inspection Branch notifies in writing or through the online public service system the reasons and contents that do not meet the requirements for the design entity to perfect the design documents for modified vehicles. The design entity is responsible for perfecting the design documents for modified vehicles and resubmitting them within thirty working days from the date of notification and sending them back to the Inspection Branch. Within seven working days from the date of receiving the completed and perfected design documents for modified vehicles, the Inspection Branch rechecks and evaluates the design documents for modified vehicles. Within three working days from the date of the review result, if the design documents for modified vehicles meet the requirements, the Inspection Branch issues a Design Review Certification according to the model at Appendix XVII issued together with this Circular; if the design documents for modified vehicles do not meet the requirements, the Inspection Branch notifies in writing or through the online public service system about the non-issuance of the Design Review Certification and specifies the reasons. Beyond thirty working days from the date of notification, if the design entity does not perfect the contents that do not meet the requirements of the design documents for modified vehicles, the Inspection Branch will stop the review of the design documents for modified vehicles and notify in writing or through the online public service system about the non-issuance of the Design Review Certification for modification. To continue the review of the design documents for modified vehicles, the design entity must resubmit the documents from the beginning.

d) The design entity receives the results of the design review as follows: In case of receiving directly at the Inspection Branch office or through the postal service: one Design Review Certification; one set of reviewed documents as specified in Point c Clause 1 of this Article; In case of receiving through the online public service system: one electronic version of the Design Review Certification; one electronic version of the documents as specified in Point c Clause 1 of this Article.

Article 17. Quality Acceptance of Modified Vehicles

1. The modification facility shall be responsible for preparing the modified vehicle at the inspection location that has been agreed upon.

2.²³ The Inspection and Registration Agency (the agency that reviewed the design) shall establish an inspection report based on inspecting and comparing the modified vehicle with the reviewed design documentation and checking the technical safety and environmental protection quality according to technical standards, regulations, and provisions on technical safety and environmental protection for specialized motor vehicles; if any part of the vehicle does not meet the requirements, it shall notify the modification facility to complete it again.

Article 18. Issuance of the Certificate of Quality for Modified Vehicles

1. A modified vehicle that has been accepted and meets the requirements shall be issued a Certificate of Quality for Modified Vehicles (hereinafter referred to as the Modification Certificate) according to the form prescribed in Appendix XVIII attached to this Circular.

2. The Modification Certificate consists of two copies, issued to the vehicle owner for registration inspection and license plate registration procedures.

3.²⁴ Time limit for issuing the Modification Certificate: Within three working days from the date the modified vehicle is accepted and meets the requirements.

4.²⁵ The design documentation of the modified vehicle as stipulated in Article 16 of this Circular, after review, and the inspection report of the modified vehicle shall be stored at the Inspection and Registration Agency according to regulations from the date the Certificate of Technical Safety and Environmental Protection Quality for the modified vehicle is issued.

Chapter V. PROVISIONS ON TECHNICAL SAFETY AND ENVIRONMENTAL PROTECTION INSPECTION OF SPECIALIZED MOTOR VEHICLES IN OPERATION AND USESPECIAL MOTORCYCLE ENVIRONMENT IN EXPLOITATION, USE

Article 19. Inspection Documentation

The inspection dossier includes:

1. The Application for Technical Safety and Environmental Protection Inspection of Vehicles in Operation and Use (hereinafter referred to as the Vehicle Inspection Application) shall be used when requesting an external inspection according to the model prescribed in Appendix XIX attached to this Circular.

2. One of the following documents for the first inspection of the vehicle:

a) Original or electronic copy of the Quality Certificate;

b) Original Shipping Out Certificate;

c) Copy of technical documentation including overall drawings and basic technical specifications of the vehicle or a Registration of Technical Specifications of the vehicle established by organizations or individuals for vehicles imported or manufactured, assembled before December 1, 2009 (the date the Circular No. 23/2009/TT-BGTVT dated October 15, 2009 of the Minister of Transport on the inspection of technical safety and environmental protection quality of specialized motor vehicles took effect).

3. Original Modification Certificate for modified vehicles.

Article 20. Procedures and methods for implementation

Article 20. Procedures and Methods of Implementation

1. The vehicle owner shall complete one set of inspection documentation according to the provisions of Article 19 of this Circular and submit it to the Inspection Unit.

2. The Inspection Unit shall accept and review the documentation: If the documentation is incomplete according to the regulations, it shall guide the organization or individual to supplement and complete it immediately on the same working day (for direct submission cases) or notify and guide to complete the documentation within two working days (for submission through postal services or other appropriate methods); If the documentation is complete according to the regulations, it shall agree on the time and place for inspection (for vehicles requiring external inspections).

3. The Inspection Unit shall conduct the inspection: If the result is unsatisfactory, it shall immediately notify the vehicle owner; If the result is satisfactory, it shall issue the Certificate of Quality according to the regulation within one working day when inspected at the Inspection Unit or within three working days when inspected externally, from the end of the inspection.

Article 21. Content of Inspection

1. Vehicles shall be inspected according to relevant technical standards and regulations. In cases where inspection is conducted outside the Inspection Unit, exhaust emission testing equipment need not be used.

2. A panoramic photograph must be taken at the inspection location from a diagonal angle of approximately 45° from the front side or rear corner of the vehicle, clearly showing the shape of the vehicle and its license plate; if the vehicle does not yet have a license plate, a photograph of the chassis number or a copy of the chassis number label must be taken for printing on the Certificate of Conformity (CNAT). The photograph must indicate the time it was taken.

3. The results of the vehicle inspection shall be recorded in the Vehicle Safety and Environmental Protection Inspection Report (hereinafter referred to as the Inspection Report) according to the model prescribed in Appendix XX attached to this Circular.

4.²⁶ Issuance of the Certificate of Conformity (CNAT) and Inspection Sticker

a) If the vehicle meets the requirements stipulated, it shall be issued with the Certificate of Conformity (CNAT) and Inspection Sticker according to the models prescribed in Appendices XXII and XXIII attached to this Circular. The Certificate of Conformity (CNAT) and Inspection Sticker shall be printed using the Motorcycle Specialized Vehicle Management software.

b) The validity period of the Certificate of Conformity (CNAT) and Inspection Sticker specified in point a of this clause is twelve months. The Certificate of Conformity (CNAT) and Inspection Sticker must have the same serial number.

c) The Certificate of Conformity (CNAT) and Inspection Sticker specified in point a of this clause become invalid when: The content of the Certificate of Conformity (CNAT) does not match the actual technical specifications of the vehicle; a new Certificate of Conformity (CNAT) has been issued for the vehicle; the owner has reported the loss of the Certificate of Conformity (CNAT); there has been a notice of recall from the Inspection Units; the vehicle has been involved in an accident that renders it unsafe for technical safety and environmental protection purposes; or the Certificate of Conformity (CNAT) and Inspection Sticker are damaged or torn.

d) When the Certificate of Conformity (CNAT) and Inspection Sticker issued under point a of this clause are lost or damaged, they can only be reissued after the vehicle has been reinspected and meets the requirements stipulated in Article 20 of this Circular. When ownership changes or the vehicle is transferred to another region, the Certificate of Conformity (CNAT) and Inspection Sticker remain valid within their validity period.

Article 22. Issuance of Blank Certificates of Conformity (CNAT) and Inspection Stickers and Reporting on Inspection Activities

1. Procedures for Issuing Blank Certificates of Conformity (CNAT) and Inspection Stickers

a) The Inspection Units shall prepare and submit requests for supply of blank certificates directly or through postal services or email according to the model prescribed in Appendix XXIV attached to this Circular to the Vietnam Registration Bureau from the 15th to the 20th of the last month of each quarter.

b) The Vietnam Registration Bureau shall send blank certificates through postal services or issue them directly to the Inspection Units from the 23rd to the 30th of the last month of each quarter based on the needs and capacity of the Inspection Units.

2. Reporting on Inspection Activities

The Inspection Units shall report on their inspection activities as follows:

a) Transmit inspection data to the Vietnam Registration Bureau's server immediately after printing the Certificate of Conformity (CNAT) and Inspection Sticker.

b) Submit periodic reports on the issuance of Certificates of Conformity (CNAT) and Inspection Stickers according to the model prescribed in Appendix XXV attached to this Circular before the 5th day of the following month.

c) Submit reports as required by competent authorities.

Chapter VI. RESPONSIBILITIES OF ORGANIZATIONS AND INDIVIDUALS INVOLVED IN BANKING SUPERVISION ACTIVITIES

Article 23. Responsibilities of the Vietnam Registration Bureau²⁷

The Vietnam Registration Bureau is the management agency responsible for organizing and implementing inspections, tests, and certification of quality for imported vehicles; production and assembly; modification and operation. The Vietnam Registration Bureau is responsible for:

1. Organizing and implementing this Circular.

2. Developing the program for the Vehicle Management Software in importation, production, assembly, modification, and operation, uniformly printing, managing various types of blank Certificates of Safety and Environmental Protection, inspection quality certificates, inspection stickers, and quality certificates as prescribed in this Circular.

3. Announcing on the Vietnam Registration Bureau's electronic information website no later than four hours from the time of occurrence during working hours or four hours from the start of the next working day for incidents occurring during statutory holidays in the event of electronic transaction failures on the electronic data processing system.

4. Archiving design files and quality certification files of vehicle models that have been certified according to regulations.

Article 24. Responsibilities of the Department of Transport

1. Organize the implementation of regular inspection work for Vehicles in operation at subordinate inspection units.

2. Coordinate with the Vietnam Vehicle Inspection Agency to manage the state's affairs regarding the quality and technical safety inspection and environmental protection of specialized vehicle machines within the local area according to their authority.

Article 25. Responsibilities of Inspection Units

1. Conduct inspections and issue the Certificate of Technical Safety and Environmental Protection for Vehicles in accordance with regulations. The head of the inspection unit and those directly conducting inspections shall be responsible for the results of the inspections.

2. Assign inspectors who have been trained and appointed by the Director of the Vietnam Vehicle Inspection Agency to conduct inspections on Vehicles.

3. Publicize procedures, formalities, contents, processes, standards, regulations, fees, and working hours; Utilize the Specialized Vehicle Management Software Program to evaluate inspection results and print out the Certificate of Technical Safety and Environmental Protection, and inspection labels.

4. Manage seals and stamps, implement storage, reporting, data transmission systems as prescribed, comply with and facilitate supervision activities of competent authorities.

5. Supervise inspection activities, regularly educate staff on professional ethics, prevent corruption in inspection activities.

6. Inspect, maintain, and repair equipment and tools used for inspection to ensure accuracy and operational status as prescribed.

7.²⁸ For design appraisal, acceptance, and issuance of the Quality Certificate for modified vehicles, the Inspection Sub-Department shall be responsible for:

a) Organizing and implementing design appraisals, acceptances, and issuing Quality Certificates for modified vehicles in accordance with this Circular.

b) Reporting and providing complete files and data for design appraisal, acceptance, and issuance of certificates when requested.

c) Uniformly printing and managing templates for design appraisal certificates and Quality Certificates for modified vehicles.

Article 26. Responsibilities of Importers

1. Be responsible for the origin, quality of imported Vehicles, and the truthfulness and accuracy of provided documents to the Vietnam Vehicle Inspection Agency.

2.²⁹ Ensure that the imported Vehicle remains in its original condition for the Vietnam Vehicle Inspection Agency to conduct quality inspections; prepare inspection facilities (with operators present, ensuring safe space during inspections).

3. Safeguard, do not modify or erase inspection result confirmation documents issued and present them upon request from authorized enforcement officers.

Article 27. Responsibilities of Production, Assembly, and Modification Facilities³⁰

1. Adhere to technical standards and current regulations when producing, assembling, and modifying vehicles.

2.³¹ Documents related to vehicle modifications must be stored for at least two years from the date of issuance of the Quality Certificate for modified vehicles.

3. Establish quality control procedures and invest in appropriate inspection equipment for production, assembly, and inspection processes; organize quality inspections for each product and be responsible for the origin and authenticity of parts used in production and assembly; be responsible for quality inspections during production and assembly and before product shipment; ensure product quality meets technical standards and regulations.

4. Preserve and safeguard, do not modify or erase inspection result confirmation documents issued.

5. Establish a quality management system and store information about customers purchasing products to inform customers when necessary.

6. Set up a system to collect product quality information, analyze technical faults, and retain relevant information.

7. Proactively report all information related to technical faults to the Vietnam Vehicle Inspection Agency; cooperate and provide necessary information when the Vietnam Vehicle Inspection Agency investigates technical faults.

8.³² Implement recalls for produced and assembled vehicles in accordance with Article 16 of Circular No. 25/2019/TT-BGTVT dated July 5, 2019, of the Minister of Transport on quality inspection and technical safety and environmental protection in automobile production and assembly, or implement recalls for imported vehicles in accordance with Clause 2, Article 8 of Circular No. 03/2018/TT-BGTVT dated January 10, 2018, of the Minister of Transport on quality inspection and technical safety and environmental protection for imported automobiles under Decree No. 116/2017/NĐ-CP.

9. Design documents, registration certification documents, and related materials from the production and inspection process of produced and assembled vehicle types must be stored for at least two years from the date the production facility ceases production and assembly of the certified vehicle type.

10. Production and assembly facilities are responsible for managing and using production release forms in accordance with regulations; periodically submit data on produced and assembled vehicles that have been released (certificate number, chassis number, engine number, release form number, release date) or upon request to the Vietnam Vehicle Inspection Agency. In case of lost release forms, the production facility must notify the Vietnam Vehicle Inspection Agency and can only obtain replacement release forms after 30 days from the notification date and must bear legal responsibility for reported information in case of loss.

11. Production and assembly facilities are responsible for returning issued type product certificates within 30 days from receiving the Vietnam Vehicle Inspection Agency's notice if they fall under the circumstances specified in Clause 5, Article 15 of this Circular.

Article 28. Responsibilities of the Vehicle Owner

1. Shall be responsible for repairing and maintaining the vehicle to ensure technical safety standards and environmental protection between two inspection periods;

2. Shall not forge, erase, or alter safety certificates that have been issued;

3. Shall provide necessary information related to the inspection content, administrative management, and technical parameters of the vehicle, including providing relevant files and documents to inspection units;

4. Shall return the Certificate of Conformity and Inspection Sticker upon notification of recall from the inspection unit;

5. The Certificate of Conformity shall be given to the vehicle owner for presentation when required by competent authorities. The Inspection Sticker shall be given to the vehicle owner to affix on the inside of the front windshield or in a visible and hard-to-damage location. The side with the expiration month and year should face outward and be easily observable from the front.

Article 29. Fees and Charges

Fees and charges related to inspection and certification shall be collected in accordance with the provisions of the law.

Article 30.³³ (Repealed)

Chapter VII.IMPLEMENTING PROVISIONS

Article 31. Application of Electronic Documents

Documents, materials, and quality certificates may be used in electronic form instead of paper form when applying procedures through the online portal.

Article 32. Effectiveness³⁴

1. This Circular takes effect from July 1, 2016, and revokes the following Circulars and their respective provisions:

a) Circular No. 23/2009/TT-BGTVT dated October 15, 2009, issued by the Minister of Transport regarding the inspection of technical safety and environmental protection of specialized motor vehicles;

b) Circular No. 41/2011/TT-BGTVT dated May 18, 2011, issued by the Minister of Transport amending and supplementing certain articles of Circular No. 23/2009/TT-BGTVT dated October 15, 2009, issued by the Minister of Transport regarding the inspection of technical safety and environmental protection of specialized motor vehicles;

c) Article 1 and Article 4 of Circular No. 19/2014/TT-BGTVT dated May 20, 2014, issued by the Minister of Transport amending and supplementing certain articles of Circular No. 23/2009/TT-BGTVT dated October 15, 2009, issued by the Minister of Transport regarding the inspection of technical safety and environmental protection of specialized motor vehicles, Circular No. 44/2012/TT-BGTVT dated October 23, 2012, issued by the Minister of Transport regarding the inspection of technical safety and environmental protection of imported motorcycles and engines used for motorcycle production and assembly, and Circular No. 41/2013/TT-BGTVT dated November 5, 2013, issued by the Minister of Transport regarding the inspection of technical safety of electric bicycles, concerning contents related to specialized motor vehicles.

2. Certificates issued for vehicles before the effective date of this Circular remain valid until their expiration date as indicated on the certificates.

Article 33. Implementation Organization

1. The Director of the Ministry's Office, the Director of the Ministry's Inspectorate, the Heads of Departments, the Director of the Vietnam Motor Vehicle Inspection Bureau, the Directors of Provincial Departments of Transport under central cities, and the Heads of agencies, organizations, and individuals concerned are responsible for implementing this Circular.

2. In the course of implementation, if any difficulties arise, the relevant agencies, organizations, and individuals shall promptly report to the Ministry of Transport for timely amendments and supplements to the document in accordance with regulations./.

Circular No. 49/2023/TT-BGTVT dated December 31, 2023, issued by the Minister of Transport amending and supplementing certain provisions of Circulars in the field of inspection of technical safety and environmental protection of motor vehicles, specialized motor vehicles, four-wheeled passenger vehicles with engines, four-wheeled cargo vehicles with engines, and domestically produced and imported electric bicycles is based on the following grounds:

BASED ON THE DECREE NO. 56/2022/ND-CP dated August 24, 2022 of THE GOVERNMENT stipulating the functions, tasks, powers, and organizational structure of THE MINISTRY OF TRANSPORT;

At the proposal of the Director of the Science, Technology, and Environment Department and the Director of the Vietnam Registration Agency;

The Minister of Transport issues the Circular amending and supplementing certain provisions of the Circulars in the field of quality and technical safety inspection and environmental protection for motor vehicles, special-purpose motorcycles, four-wheeled passenger vehicles with engines, four-wheeled cargo vehicles with engines, and electric bicycles produced, assembled, and imported.

² This Clause is amended pursuant to Clause 1, Article 1 of Circular No. 23/2020/TT-BGTVT amending and supplementing certain provisions of Circular No. 89/2015/TT-BGTVT on quality and technical safety inspection and environmental protection for special-purpose motorcycles and Circular No. 42/2018/TT-BGTVT amending and supplementing certain provisions of the Circulars in the field of vehicle registration inspection, which shall take effect from November 15, 2020.

²⁹ This clause is amended and supplemented in accordance with Clause 12, Article 7 of Circular No. 49/2023/TT-BGTVT dated December 31, 2023, issued by the Minister of Transport to amend and supplement certain provisions of several circulars in the field of technical quality and environmental protection inspection for motor vehicles, specialized motorcycles, four-wheeled passenger vehicles with engines, four-wheeled cargo vehicles with engines, and electric bicycles produced, assembled, and imported, which took effect from February 15, 2024.

³¹ This clause is amended and supplemented in accordance with Point a, Clause 13, Article 7 of Circular No. 49/2023/TT-BGTVT dated December 31, 2023, issued by the Minister of Transport to amend and supplement certain provisions of several circulars in the field of technical quality and environmental protection inspection for motor vehicles, specialized motorcycles, four-wheeled passenger vehicles with engines, four-wheeled cargo vehicles with engines, and electric bicycles produced, assembled, and imported, which took effect from February 15, 2024.

³³ This provision is repealed pursuant to Clause 13, Article 1 of Circular No. 42/2018/TT-BGTVT amending and supplementing certain Articles of several Circulars in the field of vehicle inspection, which took effect from October 15, 2018.

³⁴ Article 10 of Circular No. 42/2018/TT-BGTVT amending and supplementing certain Articles of several Circulars in the field of vehicle inspection, which took effect from October 15, 2018, provides as follows:

"Article 10. Effective Date

1. This Circular takes effect from October 15, 2018.

2. The Director of the Ministry's Office, the Inspector General of the Ministry, the Heads of Departments, the Director of the Vietnam Vehicle Inspection Agency, and the Heads of agencies, organizations, and individuals related to this matter shall be responsible for implementing this Circular./”

Article 3 of Circular No. 23/2020/TT-BGTVT amending and supplementing certain provisions of Circular No. 89/2015/TT-BGTVT on technical quality and environmental protection inspections of motorized two-wheel vehicles and Circular No. 42/2018/TT-BGTVT amending and supplementing certain provisions of several Circulars in the field of vehicle inspection, which took effect from November 15, 2020, provides as follows:

“Article 3. Effective Date

1. This Circular takes effect from November 15, 2020.

2. The Director of the Ministry's Office, the Inspector General of the Ministry, the Heads of Departments, the Director of the Vietnam Vehicle Inspection Agency, and the Heads of agencies, organizations, and individuals related to this matter shall be responsible for implementing this Circular./”

Article 10 and Article 11 of Circular No. 49/2023/TT-BGTVT dated December 31, 2023 issued by the Minister of Transport amending and supplementing certain provisions of several Circulars in the field of technical quality and environmental protection inspections of motor vehicles, motorized two-wheel vehicles, four-wheeled passenger vehicles with engines, four-wheeled cargo vehicles with engines, and electric bicycles produced, assembled, and imported, which took effect from February 15, 2024, provide as follows:

"Article 10. Effective Date

1. This Circular takes effect from February 15, 2024.

2. For imported electric bicycles; motorcycles, motorized two-wheelers, and motorcycle engines, motorized two-wheeler engines imported before the date this Circular takes effect, the following shall apply:

a) Imported electric bicycles shall comply with the provisions of Circular No. 41/2013/TT-BGTVT, Circular No. 19/2014/TT-BGTVT, Circular No. 42/2018/TT-BGTVT, and Circular No. 16/2022/TT-BGTVT;

b) Imported motorcycles, motorized two-wheelers, and motorcycle engines, motorized two-wheeler engines shall comply with the provisions of Circular No. 44/2012/TT-BGTVT, Circular No. 19/2014/TT-BGTVT, and Circular No. 42/2018/TT-BGTVT.

3. Design approval files, product registration files, or certification registration files of various types of motor vehicles, electric bicycles produced, assembled, and parts used for motor vehicles submitted before the date this Circular takes effect shall be handled as follows:

a) For domestically produced and assembled passenger cars within the scope of Decree No. 116/2017/NĐ-CP dated October 17, 2017 of the Government on conditions for production, assembly, importation, and warranty, maintenance services for passenger cars (hereinafter referred to as Decree No. 116/2017/NĐ-CP), and parts used for passenger cars, the provisions of Circular No. 25/2019/TT-BGTVT shall apply;

b) For domestically produced and assembled passenger cars not within the scope of Decree No. 116/2017/NĐ-CP, trailers, semi-trailers, and parts used for passenger cars, the provisions of Circular No. 30/2011/TT-BGTVT, Circular No. 54/2014/TT-BGTVT, and Circular No. 16/2022/TT-BGTVT shall apply;

c) For domestically produced and assembled motorcycles, motorized two-wheelers, and parts used for motorcycles, motorized two-wheelers, the provisions of Circular No. 45/2012/TT-BGTVT, Circular No. 42/2018/TT-BGTVT, and Circular No. 16/2022/TT-BGTVT shall apply;

d) For domestically produced and assembled four-wheeled cargo vehicles with engines, and parts used for four-wheeled cargo vehicles with engines, the provisions of Circular No. 16/2014/TT-BGTVT, Circular No. 42/2018/TT-BGTVT, and Circular No. 16/2022/TT-BGTVT shall apply;

đ) For domestically produced and assembled electric bicycles, the provisions of Circular No. 41/2013/TT-BGTVT, Circular No. 19/2014/TT-BGTVT, Circular No. 42/2018/TT-BGTVT, and Circular No. 16/2022/TT-BGTVT shall apply;

e) For domestically produced and assembled four-wheeled passenger vehicles with engines, the provisions of Circular No. 86/2014/TT-BGTVT, Circular No. 42/2018/TT-BGTVT, and Circular No. 16/2022/TT-BGTVT shall apply;

g) For domestically produced and assembled special-purpose motorized vehicles, the provisions of Circular No. 89/2015/TT-BGTVT, Circular No. 42/2018/TT-BGTVT, and Circular No. 23/2020/TT-BGTVT shall apply.

Article 11. Implementation Organization

The Director of the Ministry's Office, the Inspector General of the Ministry, the Heads of Departments, the Director of the Vietnam Vehicle Inspection Agency, and the Heads of agencies, organizations, and individuals related to this matter shall be responsible for implementing this Circular./”
