Decree No. 309/2025/NĐ-CP amends and supplements some articles of Decree No. 26/2019/NĐ-CP dated March 8, 2019, of the Government on detailed regulations for certain provisions and implementation measures of the Fisheries Law which has been amended and supplemented with some articles according to Decree No. 37/2024/NĐ-CP dated April 4, 2024, of the Government.

On the basis of 61/2014/QH13;

On the basis of 26/2019/NĐ-CP

At the proposal of the Minister of Agriculture and Rural Development;

THE GOVERNMENT ISSUES THE DECREE AMENDING AND SUPPLEMENTING CERTAIN PROVISIONS OF DECREE NO. dated March 8, 2019, of the Government detailing certain provisions and implementing measures of the Fisheries Law which has been amended and supplemented by the Government Decree No. 37/2024/NĐ-CP dated April 4, 2024. dated April 4, 2024 of the Government.

Article 1. Repeal the phrase "and other relevant provisions" at point b, Clause 5, Article 36 of the Government Decree No. 26/2019/NĐ-CP as amended and supplemented by Clause 14, Article 1 of the Government Decree No. 37/2024/NĐ-CP.

Article 2. Repeal point c, Clause 6, Article 70b of the Government Decree No. 26/2019/NĐ-CP as added by Clause 36, Article 1 of the Government Decree No. 37/2024/NĐ-CP.

Article 3. Suspend the implementation of the regulations on the minimum size allowed for exploitation of certain fish species living in natural waters set out in Appendix V attached to the Government Decree No. 37/2024/NĐ-CP until such regulations are amended to ensure compliance with the laws, Party guidelines, government directives, and Prime Minister's instructions, specifically:

1. Round scad (Auxis thazard) at item 11, sub-item 1.(Auxis thazard)at serial number 11, item 1.

2. Yellowfin scad (Euthynnus affinis) at item 12, sub-item 1.(Euthynnus affinis)at serial number 12, item 1.

6. Yellowfin tuna (Thunnus albacares) at item 64, sub-item 1.(Thunnus albacares)at serial number 64, item 1.

Article 4. Implementation clause

This Decree takes effect from the date of issuance.

Article 5. Responsibility for Implementation

The Ministers, Heads of ministerial-level agencies, Heads of governmental agencies, Chairpersons of People's Committees at all levels, and other related organizations and individuals shall be responsible for implementing this Decree.
