CIRCULAR

REGULATING THE IMPLEMENTATION OF RULES OF ORIGIN

in the Vietnam-Chile Free Trade Agreement

Pursuant to Decree No. 95/2012/NĐ-CP dated November 12, 2012, of the Government, detailing the functions, tasks, powers, and organizational structure of the Ministry of Industry and Trade;

Pursuant to the Vietnam-Chile Free Trade Agreement signed on November 11, 2011, in Honolulu, Hawaii, United States, by the Ministers of the two countries;

Pursuant to the Vietnam-Chile Free Trade Agreement signed on November 11, 2011, in Honolulu, Hawaii, United States, amended by the two countries on May 20, 2013;

Pursuant to Decree No. 19/2006/NĐ-CP dated February 20, 2006, of the Government detailing the Law on Commerce regarding the origin of goods.

The Minister of Industry and Trade issues this Circular regulating the implementation of Rules of Origin in the Vietnam-Chile Free Trade Agreement as follows:

Article 1. 1. National Technical Regulation on Railway Traffic Signals, number QCVN 21:2025/BXD.

1. Rules of Origin (Appendix I);

2. Specific Product Rules (Appendix II);

3. Procedures for issuing and checking Certificates of Origin (Annex III);

4. Sample Certificate of Origin VC (referred to in this Circular as Certificate of Origin Form VC) of Vietnam (Annex IV-A);

5. Sample Certificate of Origin VC of Chile (Annex IV-B);

6. Guidelines for completing the Certificate of Origin (Annex V); and

7. List of Organizations issuing Certificates of Origin (Annex VI).

Article 2. In addition to the procedures for issuing and checking Certificates of Origin specified in Annex III issued together with this Circular, the procedures for issuing Certificate of Origin Form VC of Vietnam shall be carried out in accordance with Circular No. 06/2011/TT-BCT dated March 21, 2011, of the Ministry of Industry and Trade stipulating procedures for issuing certificates of origin for preferential treatment, and Circular No. 01/2013/TT-BCT dated January 3, 2013, of the Ministry of Industry and Trade amending and supplementing Circular No. 06/2011/TT-BCT dated March 21, 2011, mentioned above.

Article 3. This Circular takes effect from January 1, 2014.
