Pursuant to the Civil Servant Law dated November 15, 2010; and the Law Amending and Supplementing Certain Provisions of the Civil Servants and Public Officials Law and the Civil Servant Law dated November 25, 2019;

Pursuant to the Education Law dated June 14, 2019;

Pursuant to Decree No. 69/2017/NĐ-CP dated May 25, 2017 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Education and Training;

Based on the proposal of the Director of the Cadre and Civil Servant Department;

After receiving the unified opinion of the Ministry of Home Affairs in Circular number 4621/BNV-CCVC dated September 20, 2021;

At the proposal of the Director of the Department of Teachers and Educational Management Staff;

The Minister of Education and Training issues this Circular to regulate standards, conditions for examination or assessment for promotion; content, form, and determination of successful candidates in the examination period for promotion of teaching staff positions in public teacher training colleges and public higher education institutions.

 

PART I

GENERAL PROVISIONS

 

Article 1. Scope of Regulation

This Circular regulates standards, conditions for examination or assessment for promotion; content, form, and determination of successful candidates in the examination period for promotion of teaching staff positions in public teacher training colleges, public colleges with teacher training programs at the college level under the management authority of the Ministry of Education and Training (hereinafter referred to collectively as public teacher training colleges), and public higher education institutions that have registered to participate in examinations or assessments for promotion of teaching staff positions.

Article 2. Applicability

This Circular applies to teaching staff in public teacher training colleges, teaching staff in public colleges with teacher training programs at the college level under the management authority of the Ministry of Education and Training (hereinafter referred to collectively as teaching staff in public teacher training colleges), public higher education institutions that have registered to participate in examinations or assessments for promotion of teaching staff positions, and related organizations and individuals.

 

Chapter II

STANDARDS AND CONDITIONS FOR EXAMINATION OR ASSESSMENT FOR PROMOTION

 

Section 1

STANDARDS AND CONDITIONS FOR EXAMINATION OR ASSESSMENT FOR PROMOTION OF TEACHING STAFF IN TEACHER TRAINING COLLEGES

 

Article 3. Standards and conditions for examination or assessment for promotion to the position of full-time lecturer in teacher training colleges (Class II), code V.07.08.21

Teaching staff in teacher training colleges may register to participate in examinations or assessments for promotion to the position of full-time lecturer in teacher training colleges (Class II), code V.07.08.21 if they meet the following standards and conditions:

1. The teacher training college has a need and is authorized by the competent authority to participate in the examination or assessment for promotion.

2. Currently holding the rank and position of Teacher College Lecturer (Class III), code V.07.08.22.

3. They are rated as having satisfactorily completed their tasks or better in the year immediately preceding the year of examination or assessment for promotion to the position of full-time lecturer in teacher training colleges (Class II), code V.07.08.21; they possess good political qualities and professional ethics; they are not within the disciplinary penalty period, nor are they during the implementation period of regulations related to disciplinary penalties for civil servants as stipulated in Article 56 of the Civil Servant Law amended and supplemented in Clause 8, Article 2 of the Law Amending and Supplementing Certain Provisions of the Civil Servants Law and the Civil Servant Law.

4. They have the capability and professional qualifications to undertake the duties of the position of full-time lecturer in teacher training colleges (Class II), code V.07.08.21.

5. They meet the requirements of the educational qualification, training, and professional capability standards for the position of full-time lecturer in teacher training colleges (Class II), code V.07.08.21 as prescribed in Clauses 2 and 3 of Article 5 of Circular No. 35/2020/TT-BGDĐT dated October 1, 2020 issued by the Minister of Education and Training on job title codes, job title standards, appointment, and salary grading for teaching staff in public teacher training colleges.

In cases where teaching staff are exempt from foreign language and information technology subjects according to the provisions of Clauses 6 and 7 of Article 39 of Decree No. 115/2020/NĐ-CP dated September 25, 2020 of the Government on recruitment, utilization, and management of civil servants, they shall meet the requirements of the foreign language and information technology standards for the position of full-time lecturer in teacher training colleges (Class II), code V.07.08.21.

6. They meet the minimum time requirement for holding the position of lecturer in teacher training colleges (Class III), code V.07.08.22 or equivalent as stipulated in Point g, Clause 3 of Article 5 of Circular No. 35/2020/TT-BGDĐT.

Article 4. Standards and conditions for taking the examination or being considered for promotion to the senior lecturer position (Class I), code V.07.08.20 in higher normal colleges.

Teaching civil servants in higher normal colleges may register to take the examination or be considered for promotion to the senior lecturer position (Class I), code V.07.08.20 when they meet the following standards and conditions:

1. The teacher training college has a need and is authorized by the competent authority to participate in the examination or assessment for promotion.

2. Currently holding the position of principal lecturer (Class II), code V.07.08.21.

3. Being rated at least as having satisfactorily completed their tasks in the immediate preceding working year before the year of the examination or promotion to the senior lecturer position (Class I), code V.07.08.20; possessing good political qualities and professional ethics; not within the disciplinary action period, nor during the implementation period of regulations related to civil servant discipline as stipulated in Article 56 of the Civil Servant Law amended and supplemented in Clause 8, Article 2 of the Law Amending and Supplementing Certain Provisions of the Civil Servants Law and the Civil Servant Law.

4. Having the capacity and professional qualifications to undertake the duties of the senior lecturer position (Class I), code V.07.08.20.

5. Meeting the requirements of the training level, professional development, and professional capacity standards for the senior lecturer position (Class I), code V.07.08.20 as prescribed in Clauses 2 and 3, Article 6 of Circular No. 35/2020/TT-BGDĐT.

In cases where teaching civil servants are exempted from foreign language and information technology subjects according to the provisions of Clauses 6 and 7, Article 39 of Decree No. 115/2020/NĐ-CP, they shall meet the requirements of the foreign language and information technology standards for the position being examined or promoted to the senior lecturer position (Class I), code V.07.08.20.

6. Meeting the minimum time requirement for holding the position of principal lecturer (Class II), code V.07.08.21 or equivalent as prescribed in Point g, Clause 3, Article 6 of Circular No. 35/2020/TT-BGDĐT.

 

Section 2

STANDARDS AND CONDITIONS FOR TAKING THE EXAMINATION OR BEING CONSIDERED FOR PROMOTION OF TEACHING CIVIL SERVANTS IN PUBLIC UNIVERSITIES

 

Article 5. Standards and conditions for taking the examination or being considered for promotion to the principal lecturer position (Class II), code V.07.01.02

Teaching civil servants in public universities may register to take the examination or be considered for promotion to the principal lecturer position (Class II), code V.07.01.02 when they meet the following standards and conditions:

1. Public universities have the need and are authorized by competent authorities to participate in the examination or promotion period.

2. Currently holding the rank of Lecturer (Class III), code V.07.01.03.

3. Being rated at least as having satisfactorily completed their tasks in the immediate preceding working year before the year of the examination or promotion to the principal lecturer position (Class II), code V.07.01.02; possessing good political qualities and professional ethics; not within the disciplinary action period, nor during the implementation period of regulations related to civil servant discipline as stipulated in Article 56 of the Civil Servant Law amended and supplemented in Clause 8, Article 2 of the Law Amending and Supplementing Certain Provisions of the Civil Servants Law and the Civil Servant Law.

4. Having the capacity and professional qualifications to undertake the duties of the principal lecturer position (Class II), code V.07.01.02.

5. Meeting the requirements of the training level, professional development, and professional capacity standards for the principal lecturer position (Class II), code V.07.01.02 as prescribed in Clauses 2 and 3, Article 6 of Circular No. 40/2020/TT-BGDĐT dated October 26, 2020 issued by the Minister of Education and Training on the code, standards, appointment, and salary grading for teaching civil servants in public universities.

In cases where teaching civil servants are exempted from foreign language and information technology subjects according to the provisions of Clauses 6 and 7, Article 39 of Decree No. 115/2020/NĐ-CP, they shall meet the requirements of the foreign language and information technology standards for the position being examined or promoted to the principal lecturer position (Class II), code V.07.01.02.

6. Meeting the minimum time requirement for holding the position of lecturer (Class III), code V.07.01.03 or equivalent as prescribed in Point g, Clause 3, Article 6 of Circular No. 40/2020/TT-BGDĐT.

Article 6. Standards and conditions for taking the examination or being considered for promotion to the senior lecturer (Class I) position, code V.07.01.01.

Teaching civil servants working in public higher education institutions may register to take the examination or be considered for promotion to the senior lecturer (Class I) position, code V.07.01.01, if they meet the following standards and conditions:

1. Public universities have the need and are authorized by competent authorities to participate in the examination or promotion period.

2. Currently holding the rank and position of Associate Professor (Class II), code V.07.01.02.

3. Being rated at least as having satisfactorily completed their tasks in the work year immediately preceding the year of the examination or consideration for promotion to the senior lecturer (Class I) position, code V.07.01.01; possessing good political qualities and professional ethics; not being within the period of disciplinary action, and not being during the time implementing regulations related to disciplinary actions on civil servants as stipulated in Article 56 of the Civil Servant Law amended and supplemented in Clause 8, Article 2 of the Law Amending and Supplementing Certain Provisions of the Civil Servants and Public Officials Law.

4. Having the capacity and professional qualifications to undertake the duties of the senior lecturer (Class I) position, code V.07.01.01.

5. Meeting the requirements of the training level, upgrading, and professional capacity standards of the senior lecturer (Class I) position, code V.07.01.01 as prescribed in Clauses 2 and 3 of Article 7 of Circular No. 40/2020/TT-BGDĐT.

In cases where teaching civil servants meet the conditions for exemption from foreign language and information technology subjects as provided for in Clauses 6 and 7 of Article 39 of Decree No. 115/2020/NĐ-CP, they shall satisfy the requirements regarding foreign language and information technology standards for the position of senior lecturer (Class I), code V.07.01.01.

6. Meeting the minimum time requirement for holding the associate professor (Class II) position, code V.07.01.02 or equivalent, as prescribed in Point h, Clause 3 of Article 7 of Circular No. 40/2020/TT-BGDĐT.

 

Chapter III

CONTENT AND FORM OF PROMOTION ASSESSMENT AND THE DETERMINATION OF THE SUCCESSFUL APPLICANT IN THE PROMOTION ASSESSMENT PERIOD

 

Article 7. Content and form of promotion assessment

1. Content of promotion assessment

The content of promotion assessment includes evaluating the fulfillment of the requirements of standards and conditions for the position under consideration for promotion; among which, the results of professional activities are implemented according to Article 8 and the Appendix attached to this Circular.

2. Form of promotion assessment

The form of promotion assessment includes reviewing the application file according to Article 36 of Decree No. 115/2020/NĐ-CP, evaluating the fulfillment of the standards and conditions for promotion as prescribed in Articles 3, 4, 5, and 6 of this Circular corresponding to the applied position; in which, points are converted from the results of professional activities and carried out through two steps as follows:

a) Step 1: Reviewing the application file and evaluating the fulfillment of general standards and conditions for promotion as prescribed in Articles 3, 4, 5, and 6 of this Circular corresponding to the applied position.

b) Step 2: Converting points from the results of professional activities of the applicant who has met the general standards and conditions of the applied position in Step 1, carried out according to the provisions of Article 8 and the Appendix attached to this Circular.

Article 8. Results of professional activities are converted into points

1. The results of professional activities that are converted into points (details set out in the Appendix attached to this Circular) include:

a) Results of scientific and technological tasks at various levels that have been accepted from the level of achievement upwards;

b) Scientific articles;

c) Training books: Monographs, textbooks, reference books, guidebooks;

d) Results of guiding students who obtain a master's degree; guiding students to successfully defend their specialized thesis or intern physician thesis for lecturers teaching health science fields; guiding doctoral candidates who obtain a doctorate degree;

đ) Research works, creative works that win national or international awards for lecturers teaching arts fields; achievements in training and competing in sports that win national or international awards for lecturers teaching physical education fields.

2. Each result of professional activities converted under Clause 1 of this Article must be consistent with the field and specialty currently taught by the civil servant, and consistent with the position held by the civil servant. For civil servants being considered for promotion to the senior lecturer (Class I) title (code V.07.01.01), the points converted from professional activity results are counted from after the civil servant was appointed to the associate professor (Class II) title (code V.07.01.02) or equivalent.

3. Scientific articles and training books published with overlapping content of 30% or more with other works of the same author shall only be counted once for point conversion. Point conversion shall not be applied to training books and scientific articles formed from scientific and technological tasks that have already been counted for point conversion.

4. If multiple authors participate in the converted professional activity results, the main author receives one-third of the points, and the remaining points are divided according to the contribution of each participant, including the main author; if it is impossible to determine the specific contribution of each person, the remaining points are equally divided among all participants, including the main author. In cases where the main author cannot be determined, the points are equally divided among all participants.

Article 9. Determining successful candidates in the period of promotion examination

1. Determining successful candidates in the period of promotion examination for occupational titles

a) Successful candidates in the period of promotion examination for the associate senior college teacher (Class II) title (code: V07.08.21) are civil servants confirmed by the Promotion Examination Board to meet the criteria and conditions stipulated in Article 3 of this Circular, wherein the converted points of professional activity results reach a minimum of 2.0 (two) points and are selected in descending order of points within the allocated promotion quota;

b) Successful candidates in the period of promotion examination for the senior college teacher (Class I) title (code: V07.08.20) are civil servants confirmed by the Promotion Examination Board to meet the criteria and conditions stipulated in Article 4 of this Circular, wherein the converted points of professional activity results reach a minimum of 4.0 (four) points and are selected in descending order of points within the allocated promotion quota;

c) Successful candidates in the period of promotion examination for the associate professor (Class II) title (code: V.07.01.02) are civil servants confirmed by the Promotion Examination Board to meet the criteria and conditions stipulated in Article 5 of this Circular, wherein the converted points of professional activity results reach a minimum of 3.5 (three point five) points and are selected in descending order of points within the allocated promotion quota;

d) Successful candidates in the period of promotion examination for the senior professor (Class I) title (code: V.07.01.01) are civil servants confirmed by the Promotion Examination Board to meet the criteria and conditions stipulated in Article 6 of this Circular, wherein the converted points of professional activity results reach a minimum of 8.0 (eight) points and are selected in descending order of points within the allocated promotion quota.

2. In cases where two or more candidates have the same converted points of professional activity results at the last quota, the successful candidates are determined in the following priority order:

a) Female civil servants;

b) Civil servants from ethnic minorities;

c) Civil servants with longer service time;

d) Older civil servants (based on date of birth).

3. If it is still not possible to determine the successful candidate based on the above priorities, the head of the agency or unit authorized to organize the promotion examination shall exchange opinions in writing with the head of the agency authorized to manage the civil servants and decide on the successful candidate based on the recommendation of the head of the agency authorized to manage the civil servants.

4. Results are not carried over to subsequent promotion examinations.

5. Announcing the results of the promotion examination for civil servants' occupational titles:

a) Within ten days from the completion of the examination, the Promotion Examination Board for civil servants' occupational titles must report to the head of the agency or unit authorized to organize the promotion examination about the examination results; simultaneously, they must publicize the results on the electronic information website or the portal of the agency or unit authorized to organize the promotion examination and send a written notification to the agency or unit that nominated the civil servant for the examination to inform the civil servant of the results;

b) Within fifteen days from the announcement of the examination results, candidates may submit a request for a review of the examination results. The Promotion Examination Board for civil servants' occupational titles is responsible for establishing a Review Committee and organizing a review, announcing the review results no later than fifteen days from the end of the review request submission period as stipulated in this clause.

c) Not later than five (5) working days from the date of announcing the results of the review examination, the Appraisal Board for Promotion of Professional Rank shall report to the head of the agency or unit with the authority to organize the promotion examination of professional rank of civil servants to approve the results of the promotion examination period and the list of successful civil servants;

d) Not later than five (5) working days from the date of the decision approving the results of the professional rank promotion examination period, the Appraisal Board for Promotion of Professional Rank of Civil Servants shall be responsible for notifying the results of the examination and the list of successful civil servants in writing to the agencies or units that send civil servants to participate in the examination period.

 

Chapter IV

IMPLEMENTATION

 

Article 10. Provisions on implementation

1. This Circular takes effect from December 26, 2021.

2. The following Circulars shall cease to be effective from the date this Circular comes into force:

a) Circular No. 18/2017/TT-BGDĐT dated July 21, 2017 of the Minister of Education and Training stipulating the conditions, contents, and forms of the examination for promotion of professional rank of teaching civil servants in public higher education institutions;

b) Circular No. 08/2018/TT-BGDĐT dated March 12, 2018 of the Minister of Education and Training stipulating the conditions, contents, and forms of the examination for promotion of professional rank of teaching civil servants in public higher education institutions.

Article 11. Responsibility for organizing implementation

1. The Minister, Heads of Ministries equivalent to Ministries, Heads of Governmental Agencies, Chairpersons of Provincial People's Committees and Municipal People's Committees directly under the Central Government; Principals of teacher training colleges, Heads of public higher education institutions, and relevant agencies, organizations, and individuals are responsible for implementing this Circular.

2. In cases where the referenced documents in this Circular are amended, supplemented, or replaced, they shall be implemented according to the new documents.

3. During the implementation process, if there are any difficulties, please report to the Ministry of Education and Training for guidance or review and resolution./.
