DIRECTIVE OF THE PRIME MINISTER

Summarizing the Implementation of Decree No. 12/2002/NĐ-CP dated January 22, 2002

of the Government on Surveying and Mapping Activities

Decree No. 12/2002/NĐ-CP dated January 22, 2002 of the Government on Surveying and Mapping Activities (hereinafter referred to as Decree No. 12) has created a legal basis for unified state management and implementation of surveying and mapping activities. In recent years, ministries, sectors, and localities have actively directed, guided, and organized the implementation of the Decree. State management work and the quality of surveying and mapping have been significantly improved; surveying and mapping activities increasingly provide comprehensive, accurate, and timely surveying and mapping materials to serve the requirements of state management over territory, land, natural resources, and environment, economic and social activities, national defense and security, earth science research; the level of science and technology in surveying and mapping has reached the advanced level of the region and is approaching the world average.

However, the implementation of Decree No. 12 still has some limitations and shortcomings such as: the coordination between sectors and levels at the central and local levels is not yet synchronized; the Strategy for the Development of the Surveying and Mapping Sector has not been issued, the planning for the development of surveying and mapping work nationwide and in each locality has not been developed, leading to overlapping plans and tasks in surveying and mapping, causing wastage of state budget; the establishment and issuance of regulations on national geographic information standards are slow, resulting in limited sharing and common use of infrastructure and surveying and mapping information; the development and application of technology in the field of surveying and mapping are not synchronized between the central and local levels, between the sector management ministry and other ministries and sectors.

To address these limitations and shortcomings in the implementation of the Decree and prepare the groundwork for drafting the Surveying and Mapping Law project, the Prime Minister issues this Directive:

1. Organize a nationwide summary of the results of six years (2002-2007) implementing Decree No. 12 of the Government with the main contents as follows:

a) Evaluate the implementation of tasks:

- Work on drafting, issuing guiding documents, disseminating, promoting, building mechanisms and policies, results of enforcement, inspection, and supervision;

- Work on drafting and implementing strategies for development, planning, programs, target projects, and key projects on surveying and mapping;

- Work on implementing tasks related to surveying and mapping activities, coordination among ministries, sectors, and localities in implementing Decree No. 12, Decree No. 30/2005/NĐ-CP dated March 11, 2005 of the Government on handling administrative violations in surveying and mapping activities, Decision No. 83/2000/QĐ-TTg dated July 12, 2000 of the Prime Minister on the use of National Reference System and Coordinate System Vietnam 2000, Decision No. 212/2003/QĐ-TTg dated October 21, 2003 of the Prime Minister on the List of Top Secret State Secrets in the Field of Natural Resources and Environment (part on the List of Top Secret State Secrets in the Field of Surveying and Mapping) at ministries, sectors, and localities;

- Work on organizing and effectively using surveying and mapping projects at localities. Analyze and clarify strengths, weaknesses, specific causes, and draw lessons from the guidance and management of ministries, sectors, and localities in state management of surveying and mapping;

b) Evaluate strengths, clearly identify difficulties, obstacles, and inadequacies that limit the results of implementing the above Decrees and Decisions, thereby proposing amendments and supplements as a basis for drafting the Surveying and Mapping Law project.

2. The Ministry of Natural Resources and Environment shall be responsible:

a) Drafting a plan and guiding ministries, sectors, and localities to implement the plan for summarizing and evaluating the results of implementing the Government's Decrees and the Prime Minister's Decisions on surveying and mapping activities nationwide;

b) Taking the lead and coordinating with relevant agencies and organizations at the local level to assist provincial People's Committees under the Central Government in conducting summaries and evaluations at the local level on the results of six years of implementing Decree No. 12;

c) Taking the lead and coordinating with the Ministry of Justice and relevant ministries and agencies in researching and drafting the Surveying and Mapping Law project to be submitted to the National Assembly in 2010.

3. Ministries: Defense, Public Security, Construction, Transport, Industry and Trade, Agriculture and Rural Development, Education and Training, Science and Technology, Home Affairs, Foreign Affairs, Provincial People's Committees under the Central Government shall be responsible for organizing the summary according to the content stipulated in Clause 1 of this Directive; report the results of the summary to the Prime Minister, and send them to the Ministry of Natural Resources and Environment before March 31, 2008.

4. The funds allocated for the work of summarizing the implementation of Decree No. 12 will be arranged within the budget estimates allocated to ministries, ministerial-level agencies, government agencies, and localities.

5. Ministers, heads of ministerial-level agencies, heads of government agencies, and Chairmen of Provincial People's Committees under the Central Government shall organize the implementation of this Directive.

The Ministry of Natural Resources and Environment shall be responsible for monitoring, urging, and inspecting the implementation of this Directive; compiling the results of the summary and reporting to the Prime Minister before June 30, 2008.

During the implementation of this Directive, if there are any difficulties, ministries, sectors, and localities shall promptly report to the Prime Minister for consideration and resolution./.
