Pursuant to the Law on Organization of the Government dated December 25, 2001;
Pursuant to the Labor Code on June 23, 1994 and the Law Amending and Supplementing Certain Articles of the Labor Code on April 2, 2002;
Pursuant to the Law on Physical Culture and Sports dated November 29, 2006;
Considering the proposal of the Minister of Culture, Sports and Tourism, the Minister of Finance, and the Minister of Labor, Invalids and Social Affairs,
DECISION:
Article 1. To pay fair daily wages to coaches and athletes in sports who are Vietnamese citizens during their concentrated training and competition periods as follows:
1. Coaches and athletes not receiving salaries from the state budget:
a) Head coach of national team: 300,000 VND/person/day;
b) Coach of national team: 200,000 VND/person/day;
c) Head coach of national youth team: 200,000 VND/person/day;
d) Coach of national youth team: 150,000 VND/person/day;
đ) Coach of sectoral, provincial, or centrally-administered municipal team: 120,000 VND/person/day;
e) Coach of sectoral, provincial, or centrally-administered municipal youth team: 90,000 VND/person/day;
g) Coach of sectoral, provincial, or centrally-administered municipal talent team: 90,000 VND/person/day.
h) Athlete of national team: 150,000 VND/person/day;
i) Athlete of national youth team: 120,000 VND/person/day;
k) Athlete of sectoral, provincial, or centrally-administered municipal team: 80,000 VND/person/day;
l) Athlete of sectoral, provincial, or centrally-administered municipal youth team: 40,000 VND/person/day;
m) Athlete of sectoral, provincial, or centrally-administered municipal talent team: 30,000 VND/person/day.
2. For coaches and athletes receiving salaries from the state budget during their concentrated training and competition periods, if their salary levels are lower than the daily wage rates specified in Clause 1 of this Article, the employing agencies or units shall be responsible for paying the difference to ensure that they receive the corresponding levels as stipulated in Clause 1 of this Article.
Article 2. Social insurance, health insurance, and allowances for coaches and athletes during their concentrated training and competition periods
1. Coaches and athletes of national teams, national youth teams, sectoral, provincial, or centrally-administered municipal teams receiving salaries from the state budget, and coaches and athletes not receiving salaries from the state budget working at agencies, enterprises, or organizations subject to mandatory social insurance, during their concentrated training and competition periods shall enjoy social insurance and health insurance benefits according to the provisions of the law.
2. If coaches and athletes suffer accidents or death while training or competing, they shall be compensated once according to the provisions of Clause 4, Article 1 of Decree No. 110/2002/NĐ-CP of the Government dated December 27, 2002, amending and supplementing some articles of Decree No. 06/CP dated January 20, 1995 of the Government detailing some provisions of the Labor Code on occupational safety and labor hygiene.
3. Coaches and athletes not receiving salaries from the state budget and not belonging to the category required to participate in social insurance and health insurance under the laws on social insurance and health insurance, during their concentrated training and competition periods, if they have to stop training or competing due to illness, accidents, or death, shall be handled as follows:
a) If they fall ill, all medical examination and treatment costs will be covered, and they will receive an allowance equal to 75% of their current daily wage for the days off due to illness (or implementing family planning measures).
b) If they suffer accidents while training or competing, all medical expenses from first aid to stable recovery will be covered, and they will receive an allowance equal to 100% of their daily wage during the treatment period.
c) After the injury stabilizes, a work capacity assessment will be conducted; if their work capacity is reduced by 5% or more, they will receive the following benefits:
- A one-time allowance equivalent to the current level prescribed by the law on social insurance for those participating in mandatory social insurance;
- Compensation according to Clause 4, Article 1 of Decree No. 110/2002/NĐ-CP.
d) If coaches or athletes die, the person handling the funeral will receive a funeral allowance equivalent to the current level prescribed by the law on social insurance for those participating in mandatory social insurance.
đ) If coaches or athletes die due to accidents while training or competing, their relatives will receive a one-time allowance equivalent to the current level prescribed by the law on social insurance for those participating in mandatory social insurance and compensation according to Clause 4, Article 1 of Decree No. 110/2002/NĐ-CP.
4. Coaches and athletes not participating in social insurance when they cease to be coaches or athletes will receive a one-time allowance.
The amount of the one-time allowance will be calculated based on the number of years (12 months) spent as concentrated coaches or athletes (cumulatively), multiplied by 1.5 months (26 days/month) of the pre-termination daily wage; however, it must be at least two months' worth of the daily wage.
Article 3. Monetary rewards for athletes and coaches achieving results in competitions
1. Athletes achieving results at international congresses and competitions will receive rewards according to the annex attached to this Decision.
2. Athletes achieving results at world, Asian, or Southeast Asian youth championships will receive maximum rewards equal to 50% of the rewards stipulated in Clause 1 of this Article.
3. Rewards for coaches directly training athletes achieving results at congresses and competitions will be the same as the rewards for athletes.
4. For team sports, the number of coaches and athletes eligible for rewards upon achieving results will be determined according to the regulations of the competition. The total reward will be the product of the number of people eligible for rewards and the corresponding reward levels stipulated in Clauses 1, 2, and 3 of this Article.
5. For team sports events (events where the individual and team achievements are determined in the same competition), the number of coaches and athletes eligible for rewards upon achieving the stipulated achievements shall be as provided in the tournament regulations. The total reward amount equals the number of people eligible for rewards multiplied by fifty percent of the corresponding reward levels specified in Clauses 1, 2, and 3 of this Article.
6. Coaches and athletes who achieve results at world, Asian, and Southeast Asian Paralympic Games and sports competitions for persons with disabilities shall receive rewards equal to fifty percent of the corresponding reward levels specified in Clauses 1, 2, 3, 4, and 5 of this Article.
7. Coaches and athletes who achieve results at world, Asian, and Southeast Asian sports competitions for students and university students shall receive rewards equal to thirty percent of the reward levels specified in Clauses 1, 2, 3, 4, and 5 of this Article.
8. The reward level for athletes and coaches from ministries, provinces, and centrally-administered municipalities who achieve results at national championships and tournaments organized by the Minister, the head of a ministry-level agency, the head of an agency under the Government, or the People's Committee Chairperson of a province or centrally-administered municipality shall be decided by the aforementioned authorities.
Article 4. 1. The funding for determining the degree of disability and issuing the Disability Confirmation Certificate is allocated in the annual budget estimate of the commune in accordance with the State Budget Law and guiding documents.
1. The funds allocated for the implementation of the provisions set forth in this Decision shall be included in the annual state budget for physical culture and sports according to the current state regulations on the hierarchical management of the state budget.
a) The Ministry of Culture, Sports and Tourism shall pay salaries, social insurance contributions, health insurance premiums, medical examination and treatment fees, accident compensation, and other allowances as prescribed for national team and junior national team coaches and athletes; and provide rewards to national team and junior national team coaches and athletes who achieve results at international sports competitions.
b) Ministries, sectors, provincial People's Committees, and centrally-administered municipal People's Committees shall pay salaries, social insurance contributions, health insurance premiums, medical examination and treatment fees, accident compensation, and other allowances as prescribed for coaches and athletes under their management; and provide rewards to coaches and athletes who achieve results at national sports competitions and sectoral, provincial, and centrally-administered municipal sports competitions.
2. The State encourages sports federations, associations, and units managing coaches and athletes to utilize legitimate sources to supplement salaries, rewards, medical examination and treatment fees, accident compensation, and other benefits and policies for coaches and athletes.
Article 5. This Decision shall take effect from July 22, 2011, and replace Decision No. 234/2006/QĐ-TTg dated October 18, 2006, of the Prime Minister regarding certain benefits for sports coaches and athletes.
Article 6. Implementation
1. The Minister of Culture, Sports and Tourism, the Minister of Finance, and the Minister of Labor, Invalids and Social Affairs shall be responsible for guiding the implementation of this Decision.
2. Ministers, Heads of ministerial-level agencies, Heads of government-affiliated agencies, Chairpersons of provincial People's Committees directly under the central government are responsible for implementing this Decision./.
