RESOLUTION

On the Allocation of the Central State Budget for 2013

OF THE NATIONAL ASSEMBLY
SOCIALIST REPUBLIC OF VIET NAM

BASED ON THE CONSTITUTION OF THE SOCIALIST REPUBLIC OF VIETNAM IN 1992 AS AMENDED AND COMPLEMENTED BY RESOLUTION NO. 51/2001/QH10;

Pursuant to the Law on State Budget No. 01/2002/QH11 and Resolution No. 32/2012/QH13 dated November 10, 2012 of the National Assembly on the State budget estimate for 2013;

After considering Report No. 286/BC-CP dated October 19, 2012 of the Government on the plan for allocating the central state budget for 2013; Report No. 906/BC-UBTCNS13 dated October 20, 2012 of the Committee for Finance and Budget of the National Assembly; Report No. 273/BC-UBTVQH13 dated November 13, 2012 of the Standing Committee of the National Assembly on the allocation of the central state budget for 2013 and the opinions of the National Assembly deputies, Article 1. The total revenue and expenditure balance of the central state budget for 2013

RESOLUTION:

519,836 billion VND

The total revenue of the central state budget is (five hundred nineteen billion eight hundred thirty-six billion VND). The total revenue balance of local state budgets is 296,164 billion VND (two hundred ninety-six billion one hundred sixty-four billion VND). 681,836 billion VND

The total expenditure of the central state budget is (six hundred eighty-one billion eight hundred thirty-six billion VND), including 193,595 billion VND (one hundred ninety-three billion five hundred ninety-five billion VND) supplementary balance and targeted supplementary from the central state budget to local state budgets. Article 2. Allocation of the Central State Budget for 2013

Allocate the central state budget for 2013 to each ministry, sector, central agencies, and the level of supplementation from the central state budget to each provincial and municipal state budget according to Appendices 1, 2, 3, 4, and 5 attached hereto.

Implement the assignment of tasks for revenue and expenditure of the state budget and the allocation of the central state budget to each ministry, sector, central agencies, and each provincial and municipal state budget in accordance with the provisions of the Law on State Budget, Resolutions of the National Assembly, Resolutions of the Standing Committee of the National Assembly, and notify each Provincial and Municipal Delegation of the National Assembly.

Article 3. Assign the Government

1. Direct the People's Committees of provinces and centrally-administered cities to submit to the People's Councils at the same level for decision on the revenue budget estimate of the state budget in their respective areas, the expenditure budget estimate of the local budget, and the decision on the allocation of the state budget estimate within their authority, in compliance with the law.

2. Direct ministries, sectors, central agencies, and People's Committees at all levels to decide on the assignment of the revenue and expenditure budget estimate of the state budget for 2013 in accordance with the Resolution of the National Assembly to each beneficiary unit of the state budget before December 31, 2012; implement public disclosure of the state budget estimate in accordance with the Law on State Budget; report to the National Assembly on the progress and results of the allocation and assignment of the state budget estimate of ministries, sectors, central agencies, and localities at the fifth session of the XIIIth National Assembly.

3. Review the contents, tasks, and component projects of the National Target Programs on Responding to Climate Change and the National Target Program on Pollution Control and Environmental Improvement, report to the Standing Committee of the National Assembly for decision and implementation of allocation and assignment of the budget estimate before December 31, 2012.

4. Direct ministries, sectors, central agencies, and localities

5. a) Allocate investment expenditures to ensure priority for repaying construction debts and projects and works that can be completed in 2013; minimize the commencement of new projects, allocate funds to repay advance capital from the state budget, ensuring sufficient counterpart funds for projects using official development assistance (ODA) funds. Construction projects and investments must comply with assigned estimates, only advance funds for truly urgent projects.

b) Use the 10% savings from regular expenditures (after deducting salaries and salary-like allowances) to increase the source of salary reform in 2013.

c) The People's Councils and People's Committees of provinces and centrally-administered cities are responsible for arranging counterpart funds from local state budgets in accordance with regulations to implement national target programs managed by localities.

Strengthen strict control over the budget estimates for investment expenditures allocated to state-owned corporations, joint-stock companies, and enterprises to ensure efficiency and prevent loss and waste; enhance management and strict control over government-guaranteed and non-government-guaranteed foreign loans for enterprises, especially state-owned enterprises, to ensure debt repayment capacity, efficient use of capital, and maintain national financial security.

6. Closely control the budget items for development investment expenditures allocated to corporations, state-owned enterprises, and state enterprises to ensure effectiveness and prevent losses and waste; strengthen management and closely monitor government-guaranteed loans and non-government-guaranteed loans for foreign borrowing by businesses, particularly state-owned enterprises, to ensure debt repayment capacity, effective use of capital, and national financial security.

Article 4. Supervision of the allocation and implementation of the central state budget estimate

The Standing Committee of the National Assembly, the Finance-Budget Committee, the Ethnic Council, and other Committees of the National Assembly, delegations of National Assembly members, and National Assembly deputies shall supervise the allocation and implementation of the 2013 central state budget estimate for ministries, sectors, central agencies, and People's Councils and People's Committees at all levels in accordance with the provisions of the law.

This Resolution was adopted by the National Assembly of the Socialist Republic of Vietnam, the Thirteenth Session, Fourth Meeting on November 15, 2012./.
