Regulations on reporting activities and data in the civil aviation industry of VietnamIn the field of civil aviation in Vietnam

Pursuant to the Civil Aviation Law of Vietnam dated June 29, 2006 and the Law Amending and Supplementing Certain Provisions of the Civil Aviation Law of Vietnam dated November 21, 2014; The Minister of Transport hereby promulgates this Circular regulating the reporting of activities and data in the civil aviation industry of Vietnam.

Pursuant to Decree No. 107/2012/NĐ-CP dated December 20, 2012 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Transport;

Pursuant to Decree No. 66/2015/NĐ-CP dated August 12, 2015, issued by the Government on Civil Aviation Authority;

PURSUANT TO THE PROPOSAL OF THE DIRECTOR OF THE TRANSPORT DEPARTMENT AND THE DIRECTOR OF THE VIETNAM CIVIL AVIATION ADMINISTRATION;

Article 1. This Circular stipulates the reporting of activities and data in the civil aviation industry of Vietnam.

Article 1. Scope of Regulation and Applicability

Article 2. This Circular applies to the Civil Aviation Authority of Vietnam, civil aviation port inspection units, the General Corporation for Air Navigation (including regional air navigation companies), airport operators, airlines in Vietnam, foreign airlines operating in Vietnam, enterprises providing aviation fuel, the Civil Aviation Medical Center, the Vietnam Aviation Academy, and other organizations and individuals related to the reporting of activities and data in the civil aviation industry of Vietnam.

Point 1. Data: refers to production figures determined according to the indicators and time periods specified in the reporting forms. The content of each indicator and time period is defined in the guidance on reporting accompanying each form.

Article 2. Interpretation of Terms

Point 2. Time: time in reports is Hanoi time (GMT+7). Cases where coordinated universal time (UTC) is applied are specifically provided for in this Circular and the forms attached as appendices to this Circular.

Article 3. Reporting of Activities

Clause 1. Content of the report on activities:

Point a) State management work within the scope of authority;

Point b) Progress of key projects;

Point c) Activities of subordinate units;

Point d) Civil aviation security and safety work, incidents threatening aviation security and safety, and measures taken to address them;

Point đ) Evaluation of the implementation of unit activities according to functions, tasks, and plans;

Point e) Key tasks for the upcoming period;

Point g) Proposals and recommendations to other units;

Point h) Other contents as required.

Clause 2. The Civil Aviation Authority of Vietnam shall receive and compile activity reports from agencies and units specified in Clause 3 of this Article; submit periodic reports on the civil aviation industry (monthly, quarterly, and annually) to the Ministry of Transport:

Point a) Monthly activity report: covering the period from the 16th of the previous month to the 15th of the current month, submitted before the 20th of each month;

Point b) Quarterly and annual activity reports: March and first quarter reports submitted before March 18; June and mid-year reports submitted before June 18; September and third quarter reports submitted before September 18; December and full-year reports submitted before December 15.

Clause 3. Civil aviation port inspection units, the General Corporation for Air Navigation, airport operators, Vietnamese airlines, the Civil Aviation Medical Center, and the Vietnam Aviation Academy shall submit periodic activity reports (weekly, monthly, quarterly, and annually) to the Civil Aviation Authority of Vietnam:

Point a) Weekly activity report: covering the period from Thursday of the previous week to Wednesday of the current week, submitted before 10:00 AM on Thursday of each week;

Point b) Monthly activity report: covering the period from the 16th of the previous month to the 15th of the current month, submitted before the 18th of each month;

Point c) Quarterly and annual activity reports: March and first quarter reports submitted before March 16; June and mid-year reports submitted before June 16; September and third quarter reports submitted before September 16; December and full-year reports submitted before December 10;

Point d) Airport operators shall simultaneously submit their activity reports to both the Civil Aviation Authority of Vietnam and civil aviation port inspection units.

Clause 4. In cases where the reporting deadline coincides with statutory holidays or rest days, the submission date will be the first working day following the holiday or rest day.

Clause 5. Method of reporting activities: Agencies and units shall submit activity reports via fax or email (E-mail), and at the same time send one (01) original copy to the designated recipients of the activity reports.

5. Method of reporting activities: Agencies and units shall submit their activity reports via fax or email (E-mail), and simultaneously send one (01) original copy to the entities responsible for receiving activity reports.

1. The Civil Aviation Administration of Vietnam shall report data to the Ministry of Transport including:

a) Production and business report on transportation and cargo handling (monthly) according to Model HK-1 of the Appendix issued together with this Circular: data from the 1st to the end of the month, reported before the 10th day of the following month;

b) Transportation vehicle report (semi-annually) according to Model HK-2 of the Appendix issued together with this Circular: data from January to June, reported before July 20; data from July to December, reported before January 20 of the following year;

c) Report on delayed and cancelled flights of Vietnamese airlines (monthly) according to Model HK-3 of the Appendix issued together with this Circular: data from the 1st to the last day of the month, reported before the 10th day of the following month;

d) Aircraft accident report of aircraft registered under the nationality of Vietnam (annually) according to Model HK-4 of the Appendix issued together with this Circular: data from January 1 to December 31 of each year, reported before January 20 of the following year.

2. Air Port Control Units shall report data to the Civil Aviation Administration of Vietnam including:

b) Productivity data report of Air Port Control Units (weekly) according to Model CV-2 of the Appendix issued together with this Circular: data from Wednesday of the previous week to Tuesday of the current week, reported before 10:00 AM on Thursday of each week;

c) Estimated throughput data report of airports (monthly) according to Model CV-3 of the Appendix issued together with this Circular: estimated productivity data for the month, reported before 10:00 AM on the 18th of each month;

d) Throughput data report of airports (monthly) according to Model CV-4 of the Appendix issued together with this Circular: data from the 1st to the last day of the month, reported before 10:00 AM on the 5th of the following month;

đ) Summary report on delayed and cancelled flights of Vietnamese airlines at airports (monthly) according to Model CV-5 of the Appendix issued together with this Circular: data from the 1st to the last day of the month, reported before 10:00 AM on the 5th of the following month.

Air Port Control Units and airport operators are permitted to coordinate in transferring flight data of airlines operating to and from Vietnam and transferring responsibility for implementing data reporting tasks according to the above forms to the Civil Aviation Administration of Vietnam.

3. The Vietnam Air Traffic Management Corporation shall report data to the Civil Aviation Administration of Vietnam and Air Port Control Units including:

a) Air traffic management volume report weekly (weekly) according to Model QLB-1 of the Appendix issued together with this Circular to the Civil Aviation Administration of Vietnam: data from Wednesday of the previous week to Tuesday of the current week (UTC time), reported before 10:00 AM on Thursday of each week;

b) Estimated air traffic management volume report in Vietnam's Flight Information Regions (monthly) according to Model QLB-2 of the Appendix issued together with this Circular to the Civil Aviation Administration of Vietnam: estimated air traffic management volume for the month, reported before 10:00 AM on the 18th of each month;

c) Air traffic management activity data report (monthly) according to Model QLB-3 of the Appendix issued together with this Circular to the Civil Aviation Administration of Vietnam: data from the 1st to the last day of the month (UTC time), reported before 10:00 AM on the 5th of the following month;

d) Flight data report through international and domestic airways in Vietnam's Flight Information Regions (monthly) according to Model QLB-4 of the Appendix issued together with this Circular to the Civil Aviation Administration of Vietnam: data from the 1st to the last day of the month (UTC time), reported before 10:00 AM on the 5th of the following month;

đ) Daily air traffic operation summary report (daily) according to Model QLB-5 of the Appendix issued together with this Circular to the Civil Aviation Administration of Vietnam: data from 00:00 to 23:59 (UTC time), reported before 3:00 PM on the following day;

e) General aviation activity data report by flight (weekly) according to Model QLB-6 of the Appendix issued together with this Circular to the Civil Aviation Administration of Vietnam: data from Wednesday of the previous week to Tuesday of the current week (UTC time), reported before 3:00 PM on Wednesday of each week;

g) Regional Air Traffic Management Companies shall report actual takeoff and landing times of each flight of Vietnamese and foreign airlines at airports (daily) according to Model QLB-7 of the Appendix issued together with this Circular to the Air Port Control Unit or its representative at the corresponding airport: data from 00:00 to 23:59 (UTC time), reported before 3:00 PM on the following day.

4. Vietnamese airlines shall report data to the Civil Aviation Administration of Vietnam and Air Port Control Units including:

a) Transportation volume report weekly (weekly) according to Model HHK-1 of the Appendix issued together with this Circular to the Civil Aviation Administration of Vietnam: data from Wednesday of the previous week to Tuesday of the current week, reported before 10:00 AM on Thursday of each week;

c) Transportation volume report monthly (monthly) according to Model HHK-3 of the Appendix issued together with this Circular to the Civil Aviation Administration of Vietnam: data from the 1st to the last day of the month, reported before 10:00 AM on the 5th of the following month;

d) Transportation volume report quarterly (quarterly) according to Model HHK-4 of the Appendix issued together with this Circular to the Civil Aviation Administration of Vietnam: data from the first to the last day of the quarter, reported within the first month of the next quarter;

đ) Transportation volume report annually (annually) according to Model HHK-5 of the Appendix issued together with this Circular to the Civil Aviation Administration of Vietnam: data from January 1 to December 31, reported within January of the following year;

g) Aircraft fleet and personnel report (annually) according to Model HHK-7 of the Appendix issued together with this Circular to the Civil Aviation Administration of Vietnam: data from January 1 to December 31, reported within January of the following year;

h) Financial data report (annually) according to Model HHK-8 of the Appendix issued together with this Circular to the Civil Aviation Administration of Vietnam: data from January 1 to December 31, reported before June 30 of the following year.

5. An enterprise providing aviation fuel shall report to the Civil Aviation Port Authority or its representative at the corresponding airport the daily refueling data at such airport (weekly) according to Form XDHK attached hereto: data from Wednesday of the previous week to Tuesday of the current week, to be reported before 15:00 on Wednesday of each week.

6. Vietnamese airlines and foreign airlines operating in Vietnam or organizations and individuals authorized thereby shall report to the Civil Aviation Port Authority or its representative at the corresponding airport the data on each flight transported daily at such airport (weekly) according to Form PVMĐ attached hereto: data from Wednesday of the previous week to Tuesday of the current week, to be reported before 15:00 on Wednesday of each week.

7. In case the reporting deadline coincides with a holiday or rest day as prescribed, the submission date for the report will be the first working day following such holiday or rest day.

8. The format, style, and method of submitting reports on statistical data:

a) Application software for building reports: Microsoft Excel;

b) Basic formats on the machine (Regional Settings): thousands separator in numbers: "." (period); decimal separator in numbers: "," (comma); number of digits after the decimal point: two digits; measurement system: Metric; date format: day/month/year (dd/mm/yyyy); font: UNICODE (Times New Roman), 14 pt;

c) Agencies and units shall submit statistical data reports via email to the designated recipients.

Article 5. Implementation Provisions

1. This Circular takes effect from January 1, 2017.

2. Repeal Circular No. 14/2009/TT-BGTVT dated August 4, 2009, issued by the Minister of Transport on the reporting of civil aviation activities and statistical data in Vietnam.

3. The Civil Aviation Administration shall be responsible for:

a) Announcing detailed information about the recipients of activity reports and statistical data reports;

b) Implementing, inspecting, and supervising the implementation of this Circular.

4. The Director of the Ministry's Office, the Inspector General of the Ministry, the Heads of Departments, the Director of the Civil Aviation Administration, the Directors of Civil Aviation Port Authorities, and the Heads of agencies, units, and individuals concerned are responsible for enforcing this Circular./.
