Regulations on Administrative Offense Penalties in the Field of Road Traffic
THE GOVERNMENT
Pursuant to the Law on Organization of the Government dated December 25, 2001;
On the basis of Decree No. 86/2012/NĐ-CP dated October 19, 2012, issued by the Government detailing and guiding implementation of certain provisions of the Metrology Law;
Based on the Ordinance on Handling Administrative Violations dated July 2, 2002 and the Ordinance Amending and Supplementing Certain Articles of the Ordinance on Handling Administrative Violations dated April 2, 2008 (hereinafter referred to collectively as the Ordinance on Handling Administrative Violations); 1. This Decree stipulates acts of violation, forms and levels of penalties, authority and procedures for handling administrative violations in the field of road traffic.
Considering the proposal of the Minister of Transport,
DECREE:
PART I
GENERAL PROVISIONS
Article 1. Scope of Regulation
2. Administrative violations in the field of road traffic are acts committed by individuals or organizations that violate regulations on road traffic intentionally or negligently, which are not criminal offenses and according to the law must be subject to administrative offense penalties, including:
a) Acts violating traffic rules on roads;
b) Acts violating regulations on road traffic infrastructure;
c) Acts violating regulations on vehicles participating in road traffic;;
d) Acts violating regulations on drivers of vehicles participating in road traffic;
e) Acts violating regulations on road transport;
f) Other acts violating road traffic regulations.
1. Individuals and organizations committing administrative violations in the field of road traffic on the territory of the Socialist Republic of Vietnam shall be punished in accordance with the provisions of this Decree.
Article 2. Applicability
2. For minors who commit administrative violations in the field of road traffic, the form of handling shall be applied as prescribed in Article 7 of the Ordinance on Handling Administrative Violations.

Article 3. Explanation of Terms

5. A pedal-assisted bicycle is a simple two-wheeled vehicle equipped with a motor, with a maximum designed speed of up to 30 km/h, and can still be pedaled when the motor is turned off (including electric bicycles).
6. Types of vehicles similar to motorbikes are road traffic vehicles powered by engines, with two or three wheels, and a maximum designed speed of up to 50 km/h, except for the vehicles specified in Clause 5 of this Article.
7. The period for using headlights at night is from 6 PM the previous day to 6 AM the following day.
Article 4. Principles of Administrative Offense Penalties
1. The principles of administrative offense penalties in the field of road traffic are implemented in accordance with the provisions of Article 3 of the Ordinance on Handling Administrative Violations and Decree No. 128/2008/ND-CP dated December 16, 2008 of the Government detailing the implementation of certain articles of the Ordinance on Handling Administrative Violations in 2002 and the Ordinance Amending and Supplementing Certain Articles of the Ordinance on Handling Administrative Violations in 2008
hereinafter referred to asDecree No. 128/2008/ND-CP 2. The handling of administrative offense penalties in the field of road traffic must be carried out by persons with authority as prescribed in Articles 47, 48, 49, and Article 50 of this Decree.).
3. Mitigating circumstances and aggravating circumstances are implemented in accordance with the provisions of Article 8 and Article 9 of the Ordinance on Handling Administrative Violations.

Article 5. Forms of administrative penalties and measures to remedy consequences
1. For each administrative violation in the field of road traffic as prescribed in this Decree, the violator, whether an individual or an organization, shall be subject to one of the following main forms of administrative penalty:
a) Warning;
b) Fine.
When imposing a fine, the specific amount of the fine for a single administrative violation is the average level within the fine range prescribed for that violation; if the violation has mitigating circumstances, the fine may be reduced below the average level but not below the minimum level of the fine range; if the violation has aggravating circumstances, the fine may be increased above the average level but not exceeding the maximum level of the fine range.
2. Depending on the nature and degree of the violation, the violator may also be subject to one or more of the following supplementary forms of administrative sanctions:
a) Suspension of the right to use licenses or certificates of practice for a limited or unlimited period.
b) Confiscation of objects and means used to commit administrative violations.
3. In addition to the main form of administrative penalty prescribed in Clause 1 and Clause 2 of this Article, individuals and organizations violating administrative regulations in the field of road traffic may also be subject to one or more of the following measures to remedy consequences:
a) Compelling restoration to the original state prior to the change caused by the administrative violation or compelling demolition of unauthorized construction works;
b) Compel the implementation of measures to address environmental pollution caused by the administrative violation;
c) Compel the removal from Vietnam or compel the re-exportation of the vehicle;
d) Other measures prescribed in Chapter II of this Decree.
Article 6. Suspension of the right to use a driving license, certificate of traffic law training for a period of time or indefinitely
1. The suspension of the right to use a driving license, certificate of traffic law training for a period of time or indefinitely shall be applied to the driver of a motorized vehicle, special-purpose motorcycle participating in traffic who seriously violates the provisions of the Road Traffic Law. During the period of suspension of the right to use a driving license, certificate of traffic law training, the violator shall not operate the types of vehicles (permitted to operate) recorded in the driving license, special-purpose motorcycle.2. The driver of a vehicle subject to the form of administrative penalty of suspending the right to use a driving license, certificate of traffic law training for a period of sixty days must retake and pass the Road Traffic Law examination before reclaiming the driving license, certificate of traffic law training. 3. In the case where the driver of a vehicle is subject to the form of administrative penalty of suspending the right to use a driving license, certificate of traffic law training indefinitely, the driving license, certificate of traffic law training will lose its validity. After a period of twelve months from the date the competent authority issues the decision to suspend the right to use a driving license, certificate of traffic law training indefinitely, the driver may proceed with the procedures as prescribed to undergo new training and examination for issuance of a new driving license, certificate of traffic law training. 4. The Ministry of Public Security shall take the lead and coordinate with the Ministry of Transport to guide and organize the retaking and passing of the Road Traffic Law examination for those whose right to use a driving license, certificate of traffic law training has been suspended for a period of time as stipulated in Clause 2 of this Article.
2. The person controlling the vehicle who is subject to the penalty form of revoking the driving license, certificate of traffic law knowledge training for a period of sixty (sixty) days must relearn and retake the Traffic Law before reclaiming the driving license, certificate of traffic law knowledge training.
3. In the case where the person controlling the vehicle is subject to the penalty form of revoking the driving license, certificate of traffic law knowledge training without a time limit, the driving license, certificate of traffic law knowledge training will no longer be valid for use. After a period of twelve (twelve) months from the date the competent authority issues the decision to revoke the driving license, certificate of traffic law knowledge training without a time limit, the driver may proceed with the procedures as prescribed to undergo new training and examination for issuance of a new driving license, certificate of traffic law knowledge training.
4. The Ministry of Public Security shall take the lead and coordinate with the Ministry of Transport to guide and organize the relearning and retaking of the Traffic Law for persons whose driving licenses, certificates of traffic law knowledge training have been revoked for a limited period as stipulated in Clause 2 of this Article.
Article 7. Statute of limitations for administrative violations and period considered as not having been administratively sanctioned
1. The statute of limitations for administrative violations in the field of road traffic is one year, counted from the date the violation was committed; for administrative violations related to construction, environment, housing, land in the field of road traffic, the statute of limitations for administrative sanctions is two years; if beyond these periods, no sanction will be imposed but measures to remedy consequences shall still be applied according to Clause 3, Article 12 of the Administrative Violations Handling Ordinance.
2. In cases where individuals have been indicted, prosecuted, or had a decision made to bring them to trial under criminal proceedings, but later there is a decision to terminate the investigation or close the case, and the act of violation has signs of administrative violation in the field of road traffic, they shall be subject to administrative sanctions; in this case, the statute of limitations for administrative violations is three months, counted from the date the competent authority receives the decision to terminate the investigation or close the case and the violation file.
3. Within the time limit specified in Clause 1 and Clause 2 of this Article, if individuals or organizations commit new administrative violations in the field of road traffic or intentionally evade or obstruct the imposition of sanctions, the statute of limitations specified in Clause 1 and Clause 2 of this Article shall not apply. The statute of limitations for administrative violations shall be recalculated from the date of committing the new administrative violation or the date when the act of evading or obstructing the imposition of sanctions ends.
4. Individuals or organizations who are administratively sanctioned for violations in the field of road traffic, if within one year from the date of completion of the sanction decision or from the date the enforcement deadline of the sanction decision expires without reoffending, shall be considered as not having been administratively sanctioned for violations in the field of road traffic.
Chapter II
For the act of trading counterfeit goods without utility or function as stipulated in Clause 1, Article 4 of this Decree, the fine shall be as follows:
Section 1
VIOLATIONS OF ROAD TRAFFIC RULES
Article 8. Sanctioning the driver and passengers of motor vehicles and similar vehicles violating road traffic regulations
1. A fine of VND 100,000 to VND 200,000 shall be imposed on any of the following violations:
a) Not complying with traffic signals, signs, markings on the road, except for violations stipulated at points a, c, g, h, i, k Clause 2; point a, point đ, point e Clause 3; point a, point b, point c, point d, point đ, point i Clause 4; point a Clause 5; point a Clause 6 of this Article;
b) Changing direction without yielding the right-of-way to: pedestrians crossing the road at places marked with pedestrian crosswalks; non-motorized vehicles traveling on lanes designated for non-motorized vehicles;
c) Changing direction without yielding the way to: vehicles coming from the opposite direction; pedestrians crossing the road at places without pedestrian crosswalks;
d) Stopping or parking without signaling other vehicle drivers;
đ) Stopping or parking on the driving lane outside urban areas where there is a sidewalk wider than the vehicle; stopping or parking not closely adjacent to the right edge of the road according to the direction of travel in narrow-sidewalked roads or roads without sidewalks; parking on a slope without wheel chocks; opening the car door or leaving the car door open without ensuring safety;
e) Stopping not closely adjacent to the sidewalk or street curb on the right side according to the direction of travel or the nearest wheel more than 0.25 meters away from the sidewalk or street curb; stopping on tram tracks, bus-only lanes; stopping over storm drains, manholes of telephone lines, high-voltage power lines, fire hydrant water intake areas; leaving the driver's seat, turning off the engine while stopped; stopping or parking in unauthorized locations in sections designated for stopping or parking; stopping or parking on pedestrian crossings;
g) When parking partially on the driving lane without immediately placing warning signs in front of and behind the vehicle as required, except when parking in designated areas allowed for parking;
h) Not displaying warning signs on the front of the towing vehicle, rear of the towed vehicle; not securely connecting the towing vehicle and the towed vehicle when towing; a trailer attached to a towing vehicle without the required warning sign;
i) Not maintaining a safe distance from the vehicle ahead to avoid collision or not adhering to the minimum distance between two vehicles as indicated by the "Minimum Distance Between Two Vehicles" sign, except for violations stipulated at point i Clause 4 of this Article;
k) Not complying with rules regarding yielding the right-of-way at intersections, except for violations stipulated at points d, đ Clause 2 of this Article;
l) Honking or making loud noises that disturb quietness in urban areas and densely populated residential areas from 10 p.m. of the previous day to 5 a.m. of the following day, except for priority vehicles performing duties as prescribed;
m) The driver or front-seat passenger in a motor vehicle equipped with seat belts not wearing seat belts while the vehicle is moving;
n) Transporting front-seat passengers in a motor vehicle equipped with seat belts who are not wearing seat belts while the vehicle is moving.
2. A fine of VND 300,000 to VND 500,000 shall be imposed on the driver of a vehicle violating any of the following acts:
a) Changing lanes improperly or without prior signal, except for violations stipulated at point i Clause 4 of this Article;
b) Driving at low speed without moving to the right side of the lane;
c) Operating a vehicle above the prescribed speed limit by less than 10 km/h;
d) Not reducing speed and yielding right-of-way when driving out of a driveway or side street onto a main road;
đ) Not yielding right-of-way to overtaking vehicles when it is safe to do so; not yielding right-of-way to vehicles on priority roads or main roads coming from any direction at intersections;
e) Emergency vehicles performing duties without proper signaling devices;
g) Stopping or parking in the following locations: left side of a one-way road; on a curved section or near the top of a hill where visibility is obstructed; on bridges, underpasses, parallel to another parked vehicle; at intersections or within five meters from the edge of the intersection; bus stop areas; in front of or within five meters on both sides of the entrance of government agencies or organizations with designated vehicle entry and exit lanes; on lanes only wide enough for one vehicle; obstructing traffic signs;
h) Parking not closely adjacent to the sidewalk or street curb on the right side according to the direction of travel or the nearest wheel more than 0.25 meters away from the sidewalk or street curb; parking on tram tracks, bus-only lanes; parking over storm drains, manholes of telephone lines, high-voltage power lines, fire hydrant water intake areas; parking in areas prohibited for stopping or parking; parking on the roadway or sidewalk contrary to legal provisions;
i) Turning around improperly in residential areas;
k) Turning around on pedestrian crossings, on bridges, bridge heads, underpasses, narrow roads, steep roads, curved sections with obstructed visibility, or where there are "no U-turn" signs;
l) Backing up in one-way streets, in no-stopping zones, on lanes designated for pedestrian crossings, at intersections, at grade crossings with railways, in areas with obstructed visibility; backing up without looking or without prior signal.
m) Honking continuously; sounding the horn, using high-beam lights in urban areas or densely populated areas, except for priority vehicles performing their duties as prescribed.
n) Carrying more passengers in the driver's cabin than the prescribed number.
3. Imposing a fine of VND 600,000 to VND 800,000 on persons driving vehicles violating any of the following acts:
a) Operating a vehicle not on the right side according to its direction of travel; driving not within the designated lane or road section, except for violations prescribed at point i, Clause 4 of this Article.
b) Operating a vehicle on the road with alcohol concentration in blood or breath but not reaching the level of violation prescribed at point b, Clause 5, point b, Clause 6 of this Article.
c) Changing direction without reducing speed or without signaling the intended turn.;

i) Not using sufficient lighting during nighttime or in foggy, poor weather conditions; using high-beam lights while passing other vehicles.
k) Non-priority vehicles using sirens, flags, or lights of priority vehicles.
l) Motor vehicles towing two or more motor vehicles; motor vehicles pushing other vehicles; motor vehicles towing primitive vehicles, motorcycles, or trailers on the road; semi-trailers or trailers towing other trailers or vehicles.
m) Carrying people on towed vehicles, except for the driver.
4. Imposing a fine of VND 800,000 to VND 1,200,000 on persons driving vehicles violating any of the following acts:
a) Running in a tunnel without sufficient lighting; reversing or turning around in a tunnel; stopping, parking, or overtaking in a tunnel not in designated areas.
b) Entering restricted roads, areas, or driving against the flow of a one-way street, except for priority vehicles performing urgent tasks as prescribed;
c) Operating a vehicle exceeding the prescribed speed limit by 10 km/h to 20 km/h.
d) Operating a vehicle below the minimum speed limit on sections of the road where a minimum speed limit is specified;
đ) Stopping, parking, or turning around in violation of regulations causing traffic congestion;
e) Stopping, parking, or opening the car door without ensuring safety causing accidents;
g) Not yielding or obstructing priority vehicles;
h) Not implementing safety measures as required when a motor vehicle is damaged at a road intersection at the same level with a railway;
i) Failing to comply with regulations when entering or exiting expressways; operating a vehicle in the emergency lane or shoulder of an expressway; stopping or parking on the driving lanes of an expressway; reversing or turning around on an expressway; changing lanes improperly or without signaling before changing lanes on an expressway; failing to comply with regulations on safe distance from the vehicle ahead as indicated on traffic signs on an expressway.
5. Imposing a fine of VND 2,000,000 to VND 3,000,000 on persons driving vehicles violating any of the following acts:
a) Operating a vehicle above the speed limit by more than 20 km/h to 35 km/h;
b) Operating a vehicle on the road with alcohol concentration in blood or breath exceeding 50 mg to 80 mg/100 ml of blood or 0.25 mg to 0.4 mg/liter of breath;
c) Causing a traffic accident and fleeing the scene; failing to report to the competent authority or participate in rescuing the injured.
d) Failing to observe surroundings, operating a vehicle over the speed limit causing a traffic accident; improperly avoiding or overtaking causing a traffic accident or failing to maintain the required safe distance between vehicles causing a traffic accident..
6. A fine of from VND 4,000,000 to VND 6,000,000 shall be imposed on the driver of a vehicle who commits any of the following violations:
a) Operating a vehicle over the speed limit by more than 35 km/h.
b) Operating a vehicle on the road with alcohol concentration in blood exceeding 80 milligrams per 100 milliliters of blood or exceeding 0.4 milligrams per liter of exhaled air.
c) Operating a vehicle on the road with drugs in the body.
7. Imposing a fine of from 8,000,000 dong to 12,000,000 dong for the act of weaving, swerving, or racing while driving; running over the speed limit while chasing each other on the road.
8. Imposing a fine of from 15,000,000 dong to 25,000,000 dong for violating the provisions of Clause 7 of this Article causing an accident or failing to comply with the stop command of law enforcement officers or resisting law enforcement officers.
9. In addition to being fined, the driver who commits a violation shall also be subject to the following supplementary penalties:
a) Violating point k, Clause 3 of this Article shall have the horn, flag, or light used in violation confiscated.
b) Violating points đ, h, k, l, Clause 3; points a, g, h, i, Clause 4; points a, b, Clause 5; points a, b, Clause 6 of this Article shall have the driving license suspended for thirty days.
c) Violating point e, Clause 4; points c, d, Clause 5; points a, b Clause 6; Clause 7 of this Article shall have the driving license suspended for sixty days. Violating any of the points or clauses of this Article causing a traffic accident but not reaching a serious level shall have the driving license suspended for sixty days: points a, b, c, d, đ,e, g, h, k, Clause 1; points a, b, d, g, h, i, k, l, Clause 2; points a, b, c, d, g, h, i, k, l, Clause 3; points a, b, h, i Clause 4; point b, Clause 5;
d) Violating point c Clause 6, Clause 8 of this Article or reoffending Clause 7 of this Article shall have the driving license suspended indefinitely. Violating any of the points or clauses of this Article causing a traffic accident at a serious level or higher shall have the driving license suspended indefinitely: points a, b, c, d, đ, e, g, h, k, Clause 1; points a, b, d, g, h, i, k, l, Clause 2; points a, b, c, d, g, h, i, k, l, Clause 3; points a, b, e, h, i, Clause 4; point b, d Clause 5; point b, Clause 6.
Article 9. Imposing penalties on persons driving, sitting on motorcycles, motorbikes (including electric motorbikes), similar motorcycle vehicles, and similar motorbike vehicles violating traffic rules on public roads
1. A fine of from VND 40,000 to VND 60,000 shall be imposed for any of the following violations:
a) Not complying with traffic signals, signs, road markings, except for violations stipulated at points a, b, đ, h, l Clause 2; point c, đ Clause 3; point c, d Clause 4; point a, c, d Clause 5; point d Clause 7 of this Article;
b) Not signaling before overtaking;
c) Not maintaining a safe distance to avoid collisions with the vehicle immediately ahead or not maintaining the distance specified on the "minimum distance between two vehicles" sign;
d) Changing direction without yielding the right-of-way to: pedestrians, disabled persons' wheelchairs crossing the road at locations with pedestrian crosswalk markings; non-motorized vehicles traveling on the designated lane for such vehicles;
đ) Changing direction without yielding the right-of-way to: vehicles traveling in the opposite direction; pedestrians, disabled persons' wheelchairs crossing the road at locations without pedestrian crosswalk markings;
e) Reversing a three-wheeled motorcycle without observing or without giving a signal in advance;easures;
g) Stopping or parking on the travel lane outside urban areas where there is a sidewalk;
h)stopping or parking on the roadway in urban areas obstructing traffic; gathering from 3 (three) vehicles or more on the roadway, on bridges, in tunnelsi) Using high-beam lights when passing each other;;
k) The person driving the vehicle using an umbrella, mobile phone, audio equipment, except hearing aids; the person sitting on the vehicle using an umbrella.
b) Driving the vehicle not on the right side according to the direction of travel; not driving in the correct lane or road strip as prescribed or driving on the sidewalk;
2. A fine of from VND 80,000 to VND 100,000 shall be imposed on the driver of a vehicle who commits any of the following violations:
a) Changing lanes improperly or without giving prior signal;
c) Driving the vehicle in a row of three (three) vehicles or more;
d) Parking the vehicle on the roadway or sidewalk contrary to the provisions of the law;
đ) Not complying with regulations on stopping or parking at intersections with railway crossings; stopping or parking within the safety range of railway tracks; stopping or parking at locations with "no stopping," "no parking" signs, on tram tracks, bus passenger pick-up/drop-off points, on bridges, at intersections
, on the pedestrian crossing lane;e) Not using headlights at night or in foggy, poor weather conditions that limit visibility;
g) Not yielding the right-of-way to overtaking vehicles when it is safe to do so; not yielding the right-of-way to vehicles on priority roads, main roads from any direction at intersections;
h) Passing vehicles incorrectly; not yielding the right-of-way to oncoming vehicles as prescribed in narrow, steep roads, or places with obstacles;
i) Honking from 10 PM the previous day to 5 AM the next day, using high-beam lights in urban areas, densely populated areas, except for emergency vehicles performing duties as prescribed;
k) Priority vehicles performing duties without the prescribed horn, flag, light signals;
l) Turning around at locations where turning around is prohibited.
a) Not complying with traffic signal instructions;
3. A fine of from VND 100,000 to VND 200,000 shall be imposed on any of the following violations:
đ) Entering restricted roads, areas; traveling against the flow of one-way streets, except for emergency vehicles performing urgent tasks as prescribed;
b) Not reducing speed or yielding the right-of-way when operating a vehicle exiting a side street or alley onto a main road;
c) Operating a vehicle above the prescribed speed limit by less than 10 km/h;
d) Operating a vehicle at a low speed without staying to the right of the travel lane, obstructing traffic;
g) Non-priority vehicles using the horn, flag, light signals of priority vehiclesh) The driver of the vehicle or the person sitting on the vehicle clinging, pulling, pushing another vehicle or object, leading animals, carrying bulky objects; the person sitting on the vehicle standing on the seat, cargo rack, or sitting on the handlebars; loading goods on the vehicle exceeding the prescribed limits; driving a vehicle towing another vehicle or object;
e) Honking or revving the engine continuously in urban areas or densely populated areas, except for emergency vehicles performing duties as prescribed;
k) Carrying passengers who are not wearing helmets or wearing helmets improperly, except in cases of transporting patients for emergency treatment, children under six years old, escorting individuals who have violated the law;;
4. A fine of from VND 200,000 to VND 400,000 shall be imposed on the person driving the vehicle for any of the following violations:
i) The driver or passenger of the vehicle not wearing a helmet or wearing a helmet incorrectly fastened when participating in traffic on public roads;
a) Changing direction without reducing speed or without signaling the turn;
l) Carrying two (2) passengers on the vehicle, except in cases of transporting patients for emergency treatment, children under fourteen (14) years old, escorting individuals who have violated the law.
g) Not following the directions of traffic controllers when crossing ferries, pontoon bridges, or congested areas; not complying with the instructions of traffic controllers or traffic supervisors; not yielding the right-of-way or obstructing priority vehicles;
i) Driving on the road while having a blood alcohol concentration or breath alcohol concentration exceeding 50 milligrams to 80 milligrams per 100 milliliters of blood or exceeding 0.25 milligrams to 0.4 milligrams per liter of exhaled air.;
b) Carrying three (3) or more passengers on the vehicle;
c) Operating a vehicle exceeding the prescribed speed limit by 10 km/h to 20 km/h.
d) Operating a vehicle below the minimum speed limit on sections of the road where a minimum speed limit is specified;
đ) Driving a convoy obstructing traffic;
e) Operating a vehicle on a highway, except for vehicles serving management and maintenance of the highway;
a) Exceeding the prescribed speed limit by over 20 kilometers per hour;
h) Passing on the right in cases not permitted;
c) Overtaking in situations where overtaking is prohibited, except for violations stipulated at point h Clause 4 of this Article;
5. A fine of from VND 500,000 to VND 1,000,000 shall be imposed on the driver who commits any of the following violations:
d) Driving in a tunnel without using headlights; stopping, parking, overtaking in a tunnel not in the designated location; turning around in a tunnel.
b) Operating a vehicle on the road with alcohol concentration in blood exceeding 80 milligrams per 100 milliliters of blood or exceeding 0.4 milligrams per liter of exhaled air.
a) Using a footrest or other object dragged on the road while the vehicle is moving
d) Causing a traffic accident, failing to stop, failing to preserve the scene, fleeing without reporting to the competent authority, refusing to participate in rescuing the injured.
6. A fine of from VND 2,000,000 to VND 3,000,000 shall be imposed on the driver who commits any of the following violations:
d) Driving in groups of two (two) or more vehicles exceeding the prescribed speed limit;
b) Operating a vehicle on a road while having drugs in their body;
c) Not paying attention while operating the vehicle at speeds exceeding the prescribed limit causing a traffic accident; overtaking or changing lanes contrary to regulations causing a traffic accident;
8. A fine of from VND 10,000,000 to VND 14,000,000 shall be imposed for violations of Clause 7 of this Article that do not comply with the order to stop issued by law enforcement officers or resisting law enforcement officers or causing accidents.
7. A fine of from VND 5,000,000 to VND 7,000,000 shall be imposed on the driver who commits any of the following violations:
a) Releasing both hands from the steering wheel while driving; using feet to steer the vehicle; sitting sideways while driving; lying on the seat while driving; changing drivers while the vehicle is moving;
b) Operating a vehicle weaving or swerving on roads inside or outside urban areas;
c) Operating a two-wheeled vehicle on one wheel, or a three-wheeled vehicle on two wheels;
a) Violating point g Clause 3 of this Article shall result in confiscation of the horn, flag, light used in violation of regulations;h.
b) Violating points b, g Clause 4; points a, b Clause 5 of this Article shall result in suspension of the driving license for thirty (30) days;
9. In addition to being fined, the driver who commits a violation shall also be subject to the following supplementary penalties:
c) Violating points a, c, d Clause 6; Clause 7 of this Article shall result in suspension of the driving license for sixty (60) days; repeated offenses or multiple violations of Clause 7 of this Article shall result in indefinite suspension of the driving license and confiscation of the vehicle. Violating any of the points, clauses below of this Article resulting in a traffic accident but not reaching a serious level shall result in suspension of the driving license for sixty (60) days: points a, c, d, đ, e, g, i, k Clause 1; points b, c, d, đ, e, g, h, l Clause 2; points a, b, đ, g, h Clause 3; points a, b, e, g, i Clause 4; points b, d Clause 5;
b) Violating point b, point g Clause 4; point a, point b Clause 5 of this Article shall result in the revocation of the driving license for thirty (thirty) days;
c) Violating point a, point c, point d Clause 6; Clause 7 of this Article shall result in the revocation of the driving license for sixty (sixty) days; repeat offenses or multiple violations of Clause 7 of this Article shall result in the permanent revocation of the driving license and confiscation of the vehicle. Violating any of the points or clauses listed below of this Article causing a traffic accident but not reaching a serious level shall result in the revocation of the driving license for sixty (sixty) days: point a, point c, point d, point đ, point e, point g, point i, point k Clause 1; point b, point c, point d, point đ, point e, point g, point h, point l Clause 2; point a, point b, point đ, point g, point h Clause 3; point a, point b, point e, point g, point i Clause 4; point b, point d Clause 5;
d) Violating Point b Clause 6, Clause 8 of this Article shall result in the indefinite revocation of the Driver's License. Violating any of the following Points or Clauses of this Article and causing a traffic accident at a serious level or higher shall result in the indefinite revocation of the Driver's License: Point a, Point c, Point d, Point đ, Point e, Point g, Point i, Point k Clause 1; Point b, Point c, Point d, Point đ, Point e, Point g, Point h, Point l Clause 2; Point a, Point b, Point đ, Point g, Point h Clause 3; Point a, Point b, Point e, Point g, Point i Clause 4; Point b, Point d Clause 5; Point a, Point c Clause 6.
Article 10. Imposing penalties on individuals operating tractors and specialized motor vehicles who violate traffic rules on public roads
1. A fine of VND 80,000 to VND 100,000 shall be imposed for any of the following violations:
a) Not complying with traffic signals, signs, road markings, except for violations stipulated in Point a, Point c, Point d, Point đ, Point e Clause 2; Point a, Point b, Point c Clause 3; Point a, Point b, Point đ Clause 4; Point a, Point b Clause 5 of this Article;
b) Changing direction without yielding the right-of-way to: pedestrians crossing the road at places marked with pedestrian crosswalks; non-motorized vehicles traveling on lanes designated for non-motorized vehicles;
c) Changing direction without yielding to: vehicles traveling in the opposite direction; pedestrians, wheelchair users crossing the road at locations not marked with pedestrian crosswalks;
2. A fine of VND 100,000 to VND 200,000 shall be imposed for any of the following violations:
a) Turning the vehicle around on the pedestrian crossing section of the road, on bridges, bridgeheads, underpasses, narrow roads, steep roads, curved sections with obstructed visibility, or where there is a "no U-turn" sign;
b) Reversing on one-way streets, in areas where parking is prohibited, on the pedestrian crossing section of the road, at intersections, at grade crossings with railways, or in areas with obstructed visibility; reversing without observing or without giving prior warning signals;
c) Overtaking or passing other vehicles improperly; failing to yield to oncoming vehicles as required on narrow roads, steep roads, or where obstacles are present;t;
d) Stopping or parking on the driving lane outside urban areas where sidewalks are wide; stopping or parking not close to the right edge of the road according to the direction of travel on roads with narrow sidewalks or no sidewalks; stopping or parking not in designated positions on sections of road where parking spaces are arranged; parking on slopes without wheel chocks; parking in areas where signs prohibit stopping or parking;
đ) Stopping or parking in the following positions: the left side of a one-way street; on curved sections or near the top of a hill where visibility is obstructed; on bridges, underpasses, parallel to another parked vehicle; at intersections or within five meters from the edge of the intersection; bus passenger pick-up/drop-off points; before gates or within five meters on both sides of the gate of organizations with designated lanes for vehicle entry and exit; on sections of road only wide enough for one lane; obstructing traffic signs;
e) Stopping or parking on city streets contrary to regulations; stopping or parking on tram tracks, bus-only lanes, storm drains, manholes for telephone or high-voltage power lines, fire hydrants, or on pedestrian crossing sections; leaving the driver's seat, turning off the engine when stopped; opening the car door without ensuring safety;
g) Not providing warning signals to other drivers when stopping or parking;
h) When parking partially on the driving lane, failing to immediately place warning signs in front of and behind the vehicle as required, except when parking in permitted positions;
i) Parking on sidewalks contrary to legal provisions.
3. A fine of VND 200,000 to VND 400,000 shall be imposed for any of the following violations:
a) Exceeding the speed limit by more than 5 km/h but less than 10 km/h;
b) Entering prohibited streets or zones; driving against the flow of traffic on one-way streets;
c) Not driving on the right side according to the direction of travel; not driving in the correct lane or lane as prescribed, except for violations stipulated in Point đ Clause 4 of this Article;
d) Not complying with traffic signal lights;
đ) Not yielding to or obstructing priority vehicles;
e) Failing to yield the right-of-way to vehicles on priority roads or main roads coming from any direction at intersections;
g) Not using headlights at night or during foggy, poor weather conditions that limit visibility; using high beams when passing another vehicle;
h) Honking continuously or using sirens in cities or densely populated areas, except for emergency vehicles performing duties as prescribed;
4. A fine of VND 400,000 to VND 600,000 shall be imposed for any of the following violations:
a) Exceeding the speed limit by more than 10 km/h but less than 20 km/h;
b) Operating a vehicle below the minimum speed limit on sections of road where a minimum speed limit is specified;
c) Operating a specialized motor vehicle with a design speed of less than 70 km/h, or a tractor, on expressways, except for equipment serving expressway management and maintenance;
d) Operating a vehicle on the road while having alcohol in the blood or breath but not reaching the level of violation stipulated in Point a Clause 6, Point a Clause 7 of this Article;
đ) Not adhering to regulations when entering or exiting expressways; operating a vehicle in the emergency lane or shoulder of an expressway; stopping or parking on the driving lane of an expressway; making U-turns or reversing on expressways; changing lanes improperly or without prior signaling on expressways; not adhering to safe distance regulations indicated on traffic signs on expressways;
e) Not adhering to regulations regarding stopping or parking at grade crossings with railways; stopping or parking within the safe zone of railways; making U-turns at grade crossings with railways;
g) Not following instructions from traffic controllers when crossing ferries, pontoon bridges, or congested areas; not complying with traffic signals from traffic controllers or traffic supervisors;
5. A fine of VND 800,000 to VND 1,000,000 shall be imposed for any of the following violations:
a) Exceeding the speed limit by more than 20 km/h;
b) Driving in a road tunnel without using headlights; stopping or parking in a road tunnel not in the designated area; reversing or turning around in a road tunnel;
c) Not implementing safety measures as prescribed when a vehicle breaks down on a level crossing with a railway track;
6. A fine of from 1,000,000 VND to 3,000,000 VND for any of the following violations:
a) Operating a vehicle on a road while having a blood alcohol concentration exceeding 50 milligrams to 80 milligrams per 100 milliliters of blood or breath alcohol concentration exceeding 0.25 milligrams to 0.4 milligrams per liter of breath;
b) Causing a traffic accident and failing to stop, failing to preserve the scene, fleeing without reporting to the competent authority, and not participating in rescuing the injured;
7. A fine of from 3,000,000 VND to 5,000,000 VND for any of the following violations:
a) Operating a vehicle on the road with alcohol concentration in blood or breath exceeding 80 mg/100 ml of blood or 0.4 mg/liter of breath;
b) Operating a vehicle on the road while having drugs in the body.
8. In addition to fines, individuals violating traffic rules while operating vehicles shall also face supplementary penalties as follows:
a) Violating Point a, Point c, Point đ, Point g Clause 4, Clause 5, Point a Clause 6 of this Article shall result in the revocation of the Driver's License (when operating tractors) or the Traffic Law Knowledge Certificate (when operating specialized motor vehicles) for thirty days;
b) Violating Clause 1, Clause 2, Clause 3, Clause 4, Clause 5, Point a Clause 6 of this Article and causing a traffic accident but not reaching a serious level, or violating Point b Clause 6, Point a Clause 7 of this Article shall result in the revocation of the Driver's License (when operating tractors) or the Traffic Law Knowledge Certificate (when operating specialized motor vehicles) for sixty days;
c) Violating Clause 1, Clause 2, Clause 3, Clause 4, Clause 5, Point a Clause 6, Point a Clause 7 of this Article causing traffic accidents at serious levels or higher, or violating Point b Clause 7 of this Article shall result in the indefinite revocation of the Driving License (when operating a tractor), or the Traffic Law Knowledge Enhancement Certificate (when operating a specialized motor vehicle).
Article 11. Penalties for persons controlling bicycles, motorbicycles, and other rudimentary vehicles violating traffic rules on public roads
1. Warning or imposing a fine from 40,000 VND to 60,000 VND for any of the following violations:
a) Not riding on the right side according to the direction of travel, not riding in the correct lane;
b) Stopping suddenly; changing direction without signaling in advance;
c) Not complying with the instructions or guidance of traffic controllers when crossing ferries, pontoon bridges, or during traffic congestion;
d) Not complying with traffic signal instructions, signs, or road markings, except for violations specified in Point b Clause 2 and Point e Clause 4 of this Article;
đ) Overtaking on the right in cases not permitted;
e) Parking or stopping on the driving lane outside urban areas where there is a sidewalk;
g) Parking on the roadway or sidewalk contrary to legal provisions;
h) Operating in a highway tunnel without lights or reflective devices; stopping or parking in a tunnel not in designated areas; turning around in a highway tunnel;
i) Bicycles or motorcycles riding abreast in three or more vehicles; other rudimentary vehicles riding abreast in two or more vehicles;
k) The driver of a bicycle or motorcycle using an umbrella or mobile phone; passengers on a bicycle or motorcycle using an umbrella;
l) Rudimentary vehicles traveling at night without light signals or reflective devices;g.
2. Imposing a fine from 60,000 VND to 80,000 VND for drivers violating any of the following behaviors:
a) Parking on urban roadways obstructing traffic, parking on tram tracks, or parking on bridges obstructing traffic;
b) Not adhering to regulations regarding stopping or parking at intersections with railway crossings;
c) Not yielding to or obstructing motor vehicles requesting to overtake, or obstructing priority vehicles;
d) Using a pushcart as a mobile stall on the road, obstructing traffic;
đ) Not yielding to vehicles traveling on priority roads or main roads from any direction at intersections;
e) Bicycles, motorbikes, pedicabs carrying more people than allowed, except in cases of transporting patients for emergency care;
g) Loading goods beyond the prescribed limits, not ensuring safety, obstructing traffic, or blocking the view of the driver;
3. A fine of from 80,000 VND to 100,000 VND for any of the following violations:
a) Controlling bicycles or motorcycles with both hands off; suddenly changing direction in front of an oncoming motor vehicle; using feet to control bicycles or motorcycles;;
b) Not complying with the instructions of traffic controllers or traffic supervisors;
c) The operator or passenger of a vehicle clinging, pulling, pushing another vehicle or object, carrying bulky objects; operating a vehicle towing another vehicle or object;
4. A fine of from 100,000 VND to 200,000 VND for any of the following violations:
a) Operating a vehicle weaving or swerving; chasing each other on the road;
b) Riding a bicycle or motorbike on one wheel; riding a pedicab on two wheels;
c) Causing a traffic accident and not stopping, not preserving the scene, fleeing without reporting to the competent authority, not participating in rescuing the injured;
d) Drivers or passengers on motorcycles not wearing helmets properly or not fastening chin straps correctly when participating in road traffic;
đ) Carrying passengers on motorcycles who are not wearing helmets properly or not fastening chin straps correctly, except in cases of transporting patients for emergency care, children under six years old, or escorting individuals who have violated the law;
e) Entering prohibited roads or areas; driving against the flow of a one-way street; entering expressways, except for vehicles serving expressway management and maintenance;
5. In addition to fines, repeat offenders or those repeatedly violating Point a, Point b Clause 4 of this Article shall also be subject to supplementary penalties including confiscation of the vehicle;
Article 12. Penalties for pedestrians violating traffic rules on public roads
1. Warning or imposing a fine from 40,000 VND to 60,000 VND for any of the following violations:
a) Not traveling in the designated lane;
b) Not complying with signals or instructions from traffic lights, signs, or road markings.
c) Not complying with the instructions of traffic controllers or traffic supervisors.
2. A fine of from 60,000 dong to 80,000 dong shall be imposed for any of the following violations:
a) Carrying or carrying cumbersome objects that obstruct traffic;
b) Crossing the median strip; crossing the road at unauthorized locations or without ensuring safety;
c) Hanging onto or clinging to moving vehicles.
3. A fine of from 80,000 dong to 120,000 dong shall be imposed on pedestrians entering expressways, except for those serving expressway management and maintenance.
Article 13. Penalties for persons controlling, leading animals, or controlling animal-drawn vehicles violating traffic rules on public roads
1. Warning or imposing a fine from 40,000 VND to 60,000 VND for any of the following violations:
a) Not adhering to designated lanes, entering prohibited roads or areas, failing to yield right-of-way as required, not signaling with hand when changing direction;
b) Not complying with signals or instructions from traffic lights, signs, or road markings.
c) Not having sufficient equipment to contain animal waste or not cleaning up animal waste on the road or sidewalks.
2. A fine of from 60,000 dong to 80,000 dong shall be imposed for any of the following violations:
a) Operating, leading animals into the lane for motor vehicles;
b) Allowing animals to walk on public roads; allowing animals to cross roads unsafely;
c) Walking abreast in two or more vehicles;
d) Leaving animal-drawn vehicles unattended;
đ) Vehicles not equipped with required warning devices.
3. A fine of from 80,000 VND to 100,000 VND for any of the following violations:
a) Not complying with the instructions of traffic controllers or traffic supervisors;
b) Causing noise or loud sounds affecting quietness in residential areas between 10 PM and 5 AM;
c) Leading animals while driving or sitting on a motor vehicle.
4. Imposing a fine from 100,000 VND to 120,000 VND for loading goods on vehicles beyond the prescribed limits; entering expressways contrary to regulations;
5. In addition to fines, violators of Clause 4 of this Article shall also be subject to the following remedial measures: being required to remove excess goods or rearrange goods according to regulationsh.
Article 14. Sanctions for other violations of traffic rules on roads
1. A fine of VND 100,000 to VND 200,000 shall be imposed on any of the following violations:
a) Drying rice, paddy, straw, chaff, agricultural, forestry, and marine products on roads;
b) Gathering a large number of people illegally; sitting or lying on the road causing obstruction to traffic;
c) Playing ball games, shuttlecock, badminton, or other sports activities illegally on roads; using skateboards, scooters, or similar devices on the lanes reserved for vehicles;
2. A fine of from VND 300,000 to VND 500,000 shall be imposed on any of the following violations:
a) Holding markets, buying, or selling goods on roads outside urban areas;
b) Blocking traffic signs or signal lights.
3. A fine of from 500,000 VND to 1,000,000 VND shall be imposed for any of the following violations:
a) Using roads contrary to regulations to organize cultural, sports, parade, or festival activities;
b) Erecting greeting gates or other barriers within the area reserved for roads affecting traffic order and safety;
c) Hanging banners or placards illegally within the area designated for roads, affecting road traffic safety and order;
d) Placing or hanging advertisements on land reserved for roads outside urban areas;
đ) Not providing assistance to victims of traffic accidents when requested;
e) Dumping garbage or discharging wastewater onto streets or highway tunnels outside designated areas, except for violations stipulated in point b, Clause 4, Article 14 of this Law.
4. A fine of from VND 2,000,000 to VND 5,000,000 shall be imposed for any of the following violations:
a) Illegally constructing or placing platforms on streets; arbitrarily demolishing, removing, or illegally repairing or renovating sidewalks;
b) Discharging construction wastewater onto streets from construction sites.
5. A fine of from VND 5,000,000 to VND 7,000,000 shall be imposed for any of the following violations:
a) Throwing stones, earth, or other objects that endanger persons or vehicles participating in traffic;
b) Throwing nails, scattering nails, or other sharp objects, pouring lubricants or other slippery substances on roads, stringing wires or other obstacles across roads, directly endangering persons and vehicles participating in traffic.
6. In addition to being fined, individuals or organizations committing violations as stipulated in point a, Clause 1; Clause 2; point b, point c, point d, point e, Clause 3; point a, Clause 4, Clause 5 of this Article must also dismantle illegal structures; remove wires and obstacles; collect materials, waste, and items occupying the road surface; collect nails and sharp objects and restore the original condition altered due to administrative violations. VIOLATIONS OF ROAD TRAFFIC INFRASTRUCTURE REGULATIONS
Section 2
Article 15. Sanctions for individuals and organizations violating the use and exploitation within the area designated for roads
a) Illegally constructing individual houses within the area designated for roads in non-urban sections;
1. A fine of VND 100,000 to VND 200,000 shall be imposed on any of the following violations:
a) Temporarily using or exploiting the road safety zone for agricultural purposes affecting the safety of infrastructure and traffic;
b) Planting trees within the scope of land allocated for roads outside urban areas that obstruct the view of drivers;
2. A fine of from VND 2,000,000 to VND 3,000,000 for one of the following violations:
b) Illegally setting up tents, temporary structures, or other facilities within the area designated for roads, except for violations stipulated in point d, Clause 3, and point a, Clause 5 of this Article.
a) Illegally dumping or leaving materials or waste on the land of roads or road safety zones in non-urban sections;
3. A fine of from VND 5,000,000 to VND 10,000,000 shall be imposed for any of the following violations:
d) Illegally using road safety zones as places for stacking or transferring goods or construction materials;
b) Unauthorized excavation, filling, leveling, or backfilling of the road safety zone.
c) Unauthorized attachment of unrelated content to road sign structures.
đ) Illegally trading, setting up tents, or other temporary structures within urban areas in highway tunnels, overpasses, pedestrian underpasses, except for violations stipulated in point a, Clause 5 of this Article.
4. A fine of from VND 10,000,000 to VND 15,000,000 shall be imposed for any of the following violations:
a) Illegally constructing individual houses within the area designated for roads in urban sections;
b) Planting trees on streets not in accordance with regulations.
5. A fine of from VND 20,000,000 to VND 30,000,000 shall be imposed for any of the following violations:
a) Occupying streets for: operating food service businesses; displaying and selling goods; operating or trading construction materials; producing or processing goods; parking or storing vehicles; repairing or washing vehicles; placing or hanging signs or advertisements; installing canopies; conducting other service activities obstructing traffic.
6. A fine of from VND 30,000,000 to VND 40,000,000 shall be imposed for the violation of constructing other permanent structures illegally within the area designated for roads.;
b) Erecting advertising boards on road safety zones without written approval from competent road management authorities.
c) Improperly connecting branch roads to main roads.
7. In addition to being fined, individuals or organizations committing violations as stipulated in Clauses 1, 2, 3, 4, 5, and Clause 6 of this Article must also undertake the following remedial measures: dismantling constructed buildings, removing advertisements, relocating illegally planted trees, collecting materials, waste, goods, and restoring the original condition altered due to administrative violations.
7. Article 16. Imposing penalties on individuals and organizations for violations related to construction and maintenance of works within the scope of land allocated for roads
1. A fine of VND 2,000,000 to VND 5,000,000 shall be imposed for one of the following violations:
a) Conducting construction works within the land allocated for roads without complying with the provisions stipulated in the Construction Permit;
b) Conducting construction work on operational roads without hanging warning signs or with incomplete information as required; failing to implement measures to ensure smooth traffic flow to prevent severe traffic congestion.
c) Not arranging personnel to guide and control traffic when conducting construction at narrow road sections or at both ends of bridges, culverts, and tunnels under construction as prescribed;
d) Leaving materials, soil, and construction equipment outside the construction area, obstructing traffic;
d) Not immediately collecting warning signs, barriers, construction equipment, other materials, or not restoring the road to its original condition upon completion of construction.
2. Imposing a fine of VND 5,000,000 to VND 10,000,000 for conducting construction work within the scope of land allocated for roads without a Construction Permit..
3. Impose a fine of from VND 20,000,000 to VND 30,000,000 for one of the following violations:
a) Conducting construction works on urban roads without implementing the construction plan or within the prescribed time;
b) Conducting construction work on operational roads without adequately setting up warning signs, mobile markers, barriers as required; failing to install red lights at both ends of the construction site during nighttime; failing to fully implement measures to ensure traffic safety as required, resulting in traffic accidents.
4. In addition to fines, individuals and organizations violating the provisions of Clauses 1, 2, and 3 of this Article shall also be subject to supplementary penalties and the following measures: immediately implementing traffic safety measures as required, restoring the initial state altered due to administrative violations. If such restoration cannot be achieved, construction shall be suspended or the right to use the Construction Permit (if applicable) shall be revoked until compliance with regulations is achieved.
Article 17. Imposing penalties on individuals and organizations for violations related to the construction of bus stations, parking lots, rest stops, and toll collection points on roads
1. Imposing a fine of VND 30,000,000 to VND 40,000,000 for any of the following violations:
a) Constructing or establishing bus stations, parking lots, rest stops, and toll collection stations on roads without adhering to planning or without permission from competent state agencies;
b) Constructing bus stations, parking lots, rest stops, and toll collection stations on roads without meeting technical standards or not in accordance with approved designs.
2. In addition to fines, individuals and organizations committing violations shall also be subject to the following remedial measures:
a) For violation of point a of Clause 1 of this Article, they shall be compelled to dismantle illegal constructions and restore the initial state altered due to administrative violations.
b) For violation of point b of Clause 1 of this Article, they shall be compelled to reconstruct bus stations, parking lots, rest stops, and toll collection points according to the approved design, ensuring technical standards.
Article 18. Imposing penalties on individuals and organizations for violations related to the management and protection of road traffic infrastructure
1. Warning or imposing a fine of VND 60,000 to VND 100,000 for any of the following violations:
a) Herding animals on the road surface; tying animals to roadside trees or to traffic signs, barriers, auxiliary structures of road traffic;
b) Climbing or scaling piers, columns, or beams of bridges without authorization.
2. Imposing a fine of VND 200,000 to VND 300,000 for any of the following violations:
a) Arbitrarily lighting fires on bridges or under bridge decks; mooring ships within the safe zone around bridges.
b) Unauthorizedly building embankments, pumping water across roads, placing pipes through roads, or lighting fires on roads.
3. A fine of from VND 1,000,000 to VND 3,000,000 for any of the following violations:
a) Failing to promptly replace missing warning signs at dangerous and winding sections of roads.
b) Failing to promptly report unauthorized encroachments or improper use of road traffic safety zones.
4. A fine of VND 3,000,000 to VND 5,000,000 for any of the following violations:
a) Delaying the relocation of structures, houses, stalls, or intentionally delaying relocation, obstructing land clearance for road construction, renovation, expansion, and protection when authorized by competent authorities.
b) Damaging or rendering ineffective the drainage system of road works.
c) Arbitrarily dismantling, relocating, hanging, placing, misusing, or altering the purpose of traffic warning signs, signal lights, barriers, markers, mileposts, lane markings, median strips, boundary markers, components, and accessories of road works.
5. Imposing a fine of VND 5,000,000 to VND 10,000,000 for any of the following violations:
a) Unauthorized drilling, digging, or cutting of roads or sidewalks;
b) Unauthorizedly destroying median strips, mirrors, traffic safety facilities on roads;
c) Unauthorizedly removing, opening, damaging manhole covers, gas vent covers of underground works, pipeline systems on roads;
d) Blasting or illegally extracting soil, sand, rocks, gravel affecting road works.
6. In addition to fines, individuals and organizations committing violations shall also be subject to the following remedial measures:
a) For violation of point a of Clause 3 of this Article, they shall be compelled to replace missing warning signs.
b) For violation of point b of Clause 2; point b, point c of Clause 4; Clause 5 This provision requires the restoration to the original state that was altered due to administrative violations.
Section 3
VIOLATIONS OF THE PROVISIONS ON VEHICLES PARTICIPATING IN ROAD TRAFFIC

b) Operating a vehicle without a horn or having one but it does not comply with technical standards for each type of vehicle.
c) Operating a vehicle without a muffler or having one but it does not comply with technical standards.
d) Operating a vehicle without properly installed license plates or with license plates installed in incorrect positions; license plates unclear in letters and numbers; bent, covered, damaged license plates;
e) Installing tires of incorrect size or failing to meet technical standards.
f) Arbitrarily changing the size of the cargo box; arbitrarily adding seats on passenger-carrying vehicles.
3. A fine from VND 800,000 to VND 1,000,000 for any of the following violations:
a) Operating a vehicle without adequate braking systems or having them but they do not meet safety technical standards;
b) The steering system of the vehicle does not meet safety technical standards.3. Experts, leading scientists, chief engineers participating in national defense and security industrial activities at key national defense industrial facilities and key security industrial facilities.
4. A fine from VND 2,000,000 to VND 3,000,000 for one of the following violations:
a) Not having a Vehicle Registration Certificate, trailer registration, or semi-trailer registration as prescribed;
b) Not displaying license plates (if required to display license plates);
c) Not having a Certificate or environmental protection and technical inspection label (if required to be inspected) or having one but it has expired (including trailers and semi-trailers).
5. A fine from VND 4,000,000 to VND 6,000,000 for any of the following violations:
a) Operating a temporarily registered vehicle beyond the permitted scope or duration;
b) Operating a vehicle past its service life limit (if there is a prescribed service life limit);
c) Operating a self-produced or assembled vehicle (including agricultural vehicles that have been prohibited from operating on public roads);
d) Operating a vehicle with license plates not matching the registration certificate or license plates not issued by authorized agencies.
e) Using inspection certificates, Certificates, environmental protection and technical inspection labels, registration certificates not issued by authorized agencies or using registration certificates with incorrect chassis and engine numbers (including trailers and semi-trailers).
6. In addition to being fined, the driver who violates these provisions shall also be subject to supplementary penalties and measures to rectify the consequences as follows:

c) Violating Clause 4 of this Article shall result in the suspension of the driver's license for 30 (thirty) days.

a) Without a horn; license plate light; brake light; left-side rearview mirror of the driver or having them but they are not functional;
b) Installing license plates not in accordance with regulations; license plates unclear in letters and numbers; bent, covered, damaged license plates;
c) Operating a vehicle without signal lightsor having them but they are not functional.
2. A fine of VND 100,000 to VND 200,000 shall be imposed for any of the following violations:
a) Using a horn not in accordance with technical standards for each type of vehicle;
b) Without a muffler, smoke suppressor or having them but they do not meet environmental standards for exhaust emissions and noise;
c) Without front and rear lighting lamps or having them but they are not functional;
d) Without a braking system or having one but it does not meet technical standards.
3. A fine of from 300,000 dong to 500,000 dong for any of the following violations:
a) Not having a registration certificate as prescribed;
b) Using a registration certificate that has been erased; using a registration certificate with incorrect chassis and engine numbers of the vehicle or not issued by authorized agencies;
c) Not having license plates installed (if required to install license plates); having license plates not matching the numbers or symbols in the registration certificate; license plates not issued by authorized agencies.
4. A fine from VND 800,000 to VND 1,000,000 for any of the following violations:
a) Operating a temporarily registered vehicle beyond the permitted scope or duration;
b) Operating self-produced or assembled vehicles.
5. In addition to fines, violators shall also be subject to the following supplementary penalties:
a) Violating Point a Clause 2 of this Article shall result in the confiscation of the horn;
b) Violating Point b, Point c Clause 3 of this Article shall result in the confiscation of the registration certificate and license plates not in accordance with regulations;
c) Violating Point a Clause 4 of this Article shall result in the suspension of the driver's license for 30 (thirty) days;

2. A fine from VND 60,000 to VND 100,000 for any of the following violations:

b) Simple vehicles carrying passengers or goods not meeting the convenience and hygiene standards set by local regulations.
Article 22. Imposing penalties on drivers of tractors and specialized motor vehicles violating regulations on conditions for participating in traffic
1. A fine of VND 300,000 to VND 500,000 shall be imposed for any of the following violations:
a) Not having a Vehicle Registration Certificate; not attaching license plates in the prescribed position; attaching license plates not issued by authorized agencies;
b) Braking system or steering system not meeting technical standards;
c) Specialized parts installed in incorrect positions; not ensuring safety during movement;
d) Not having lighting devices; not having mufflers according to design;
đ) Not having a Certificate of Technical Safety Inspection and Environmental Protection (if inspection is required) or having but expired.
2. A fine of from VND 1,000,000 to VND 2,000,000 shall be imposed for any of the following violations:
a) Operating outside the prescribed scope;
b) Driving tractors or specialized motor vehicles self-produced, assembled, or modified.
3. In addition to being fined, violators also face supplementary penalties and measures to remedy consequences as follows:
a) Violating points b and c Clause 1 of this Article must restore the technical function of the equipment or replace it with equipment meeting safety technical standards;;
b) Violating point b Clause 2 of this Article shall have the vehicle confiscated.
Article 23. Imposing penalties on drivers of automobiles, tractors, and similar vehicles violating environmental protection regulations when participating in traffic 1. Warning or imposing a fine from VND 50,000 to VND 100,000 for the act of driving a vehicle that does not meet requirements for hygiene in urban areas.
b) Carrying loose materials or construction materials that can scatter without a cover or with a cover but still causing scattering;carrying goods or waste causing water to flow onto the road, disrupting traffic safety and environmental hygiene.
2. A fine of from VND 200,000 to VND 300,000 shall be imposed for emitting exhaust gases exceeding prescribed standards, emitting foul odors into the air.

a) Spilling lubricating oil or chemicals onto the road;

Article 24. Imposing penalties on violations of conditions for drivers of motor vehicles

a) Having a Driving License but not suitable for the type of vehicle being operated or has expired for six months or more;
b) Not having a Driving License or using a Driving License not issued by an authorized agency, or a Driving License that has been tampered with.
9. Section 5
VIOLATIONS CONCERNING ROAD TRANSPORT
Article 26. Sanctions for drivers of passenger cars and people-carrying vehicles violating regulations on road transport

a) Not closing doors while the vehicle is moving;
b) Allowing people to sit in the vehicle when getting on or off a ferry, pontoon bridge, or while the vehicle is on a ferry (except elderly, sick, or disabled persons);
c) Not guiding passengers to sit in the designated positions in the vehicle;
d) Not complying with the regulations regarding turning off and on the "TAXI" light box; not using the fare meter when carrying passengers as prescribed.
2. A fine of VND 200,000 to VND 300,000 per person exceeding the permitted number of passengers for the vehicle shall be imposed on the driver of a passenger car or people-carrying vehicle (excluding buses) who violates the act of carrying more than two persons up to nine seats, carrying more than three persons up to ten seats to fifteen seats, carrying more than four persons up to sixteen seats to thirty seats, carrying more than five persons over thirty seats, except for violations stipulated in Clause 3 of this Article.

2. A fine of from 500,000 VND to 1,000,000 VND shall be imposed for any of the following violations:
a) Transporting goods exceeding the maximum permissible weight specified in the Vehicle Registration Certificate from 10% to 40% for vehicles with a carrying capacity under 5 tons and from 5% to 30% for vehicles with a carrying capacity of 5 tons or more (including trailers and semi-trailers);
b) Stacking goods on the top of the cargo box; stacking goods beyond the width of the cargo box; stacking goods extending more than 10% of the vehicle length in front of or behind the cargo box;
c) Transporting goods exceeding the permitted height for open cargo trucks (without a roof);
d) Carrying passengers on the cargo bed in violation of regulations; allowing people to sit on the roof or hang onto the exterior of the vehicle while it is moving;
đ) Operating a vehicle in commercial cargo transportation without carrying along a transport contract or shipping document as prescribed, except for cargo taxis;
3. A fine from VND 2,000,000 to VND 3,000,000 shall be imposed for any of the following violations:
a) Transporting goods exceeding the maximum permissible weight specified in the Vehicle Registration Certificate by over 40% for vehicles with a carrying capacity under 5 tons and over 30% for vehicles with a carrying capacity of 5 tons or more (including trailers and semi-trailers);
b) Operating a vehicle continuously beyond the prescribed time limit;
c) Operating a cargo taxi without installing a fare meter or with an improperly installed fare meter;
d) Operating a vehicle in commercial cargo transportation without installing a vehicle tracking device (if required) or with an installed device that does not operate as prescribed;
đ) Transporting prohibited goods; illegally transporting wildlife or failing to comply fully with regulations regarding the transportation of wildlife;
4. In addition to fines, violators shall also face supplementary penalties and measures to rectify consequences as follows:

b) Violations of point a, point b, point d, clause 2; point c, point d, point đ, clause 3 of this Article result in suspension of the driver's license for thirty days;
c) Violations of point c, clause 2, point a, point b, clause 3 of this Article result in suspension of the driver's license for sixty days.
Article 28. Imposing penalties on drivers of passenger cars for violations related to transporting oversized and overweight goods
1. A fine of from VND 1,000,000 to VND 2,000,000 shall be imposed for any of the following violations:
a) Transporting oversized and overweight cargo without indicating the dimensions of the cargo as prescribed;
b) Failing to comply with the provisions in the Permit for Circulation, except for violations stipulated in point b, clause 2 of this Article.
2. A fine of between 3,000,000 VND and 5,000,000 VND shall be imposed for any of the following violations:
a) Transporting oversized and overweight cargo without a valid Permit for Circulation;
b) Transporting oversized and overweight goods with a valid Permit for Circulation, but the total weight and dimensions of the vehicle (after loading) exceed the limits specified in the Permit for Circulation.
3. In addition to fines, violators shall also face supplementary penalties and measures to rectify consequences as follows:
a) Violations of clause 1 and clause 2 of this Article require cessation of circulation until compliance is achieved; if damage to bridges or roads occurs, restoration to the original state prior to the administrative violation must be carried out;
b) Violations of clause 1 of this Article result in suspension of the driver's license for thirty days; violations of clause 2 of this Article result in suspension of the driver's license for sixty days.
Article 29. Punishment for drivers of motor vehicles violating regulations on transporting pollutants and dangerous goods
1. A fine of from VND 1,000,000 to VND 2,000,000 shall be imposed for any of the following violations:
a) Transporting dangerous goods while stopping or parking in densely populated areas, residential zones, important facilities, or places where danger may easily occur; failing to display warning signs for dangerous goods as prescribed;
b) Transporting pollutants not in accordance with environmental protection regulations.
2. A fine of VND 2,000,000 to VND 3,000,000 shall be imposed for transporting dangerous goods without a permit or with a permit but not complying with the regulations stipulated therein.
3. A fine ranging from five million to ten million Vietnamese dong shall be imposed for transporting harmful waste or radioactive materials not in accordance with environmental protection regulations.
4. In addition to fines, violators shall also face supplementary penalties and measures to rectify consequences as follows:
a) Violating Clause 1, Clause 2, and Clause 3 of this Article shall be required to comply with regulations on transporting dangerous goods and protecting the environment; if causing environmental pollution, measures to remediate the environmental pollution must be implemented;
b) Violating Clause 1 and Clause 2 of this Article shall also have their driving licenses suspended for thirty (30) days; violating Clause 3 of this Article shall result in a suspension of their driving licenses for sixty (60) days.
Article 30. Punishment for drivers of environmental sanitation vehicles, trucks carrying waste, loose materials, and other cargo violating regulations on urban transportation activities
A fine of from five hundred thousand (500,000) dong to one million (1,000,000) dong shall be imposed on drivers of environmental sanitation vehicles, trucks carrying waste, loose materials, and other cargo that do not run along designated routes, within specified areas, or during designated times.
Article 31. Punishment for individuals and organizations violating road transport regulations and supporting road transport services
1. Warning or a fine of from forty thousand (40,000) dong to sixty thousand (60,000) dong shall be imposed on drivers of motorcycles, motorbikes, and simple vehicles carrying passengers or goods without license plates or uniforms as prescribed.
2. A fine of from VND 2,000,000 to VND 3,000,000 for one of the following violations:
a) Not having a management unit for traffic safety conditions as prescribed;
b) Not registering and posting service quality standards for passenger transport as prescribed;
c) Using passenger vehicles designed for ten or more passengers as taxis;
d) Using passenger taxis without a "TAXI" light, fare meter, or improperly installed fare meter;
d) Using taxis to carry passengers with vehicle paint colors, business logos, and transaction phone numbers displayed on the vehicle that do not match the business registration;
e) Not providing sufficient drivers and service staff on passenger-carrying vehicles according to the registered business plan.
3. A fine of from four million (4,000,000) dong to six million (6,000,000) dong shall be imposed for any of the following violations:
a) Organizing the operation of bus stations, parking lots, rest stops without permission from competent authorities as prescribed;
b) Allowing motor vehicles not meeting transport business conditions to enter bus stations; picking up passengers;
c) Engaging in automobile transportation without a Business Registration Certificate or a Transportation Business License as prescribed;
d) Failing to comply with the business content registered in the transport business permit;
d) Failing to meet business transport conditions according to the registered business form;
e) Failing to implement service quality content registered regarding transport services;
g) Establishing illegal passenger pick-up and drop-off points (illegal bus stops).
4. In addition to fines, enterprises and cooperatives committing violations shall also be subject to supplementary penalties and remedial measures as follows:
a) Violating Clause 2, Point a Clause 3 of this Article shall be suspended from operations until the violation is rectified;
b) Violating Point d, Point đ, Point e Clause 3 of this Article shall have their transport business permits revoked until they comply with transport business conditions and service quality commitments.
Chapter 6
OTHER VIOLATIONS RELATED TO ROAD TRAFFIC
Article 32. Punishment for individuals and organizations illegally manufacturing, assembling motor vehicles; producing, selling unauthorized motor vehicle license plates
1. A fine of from one million (1,000,000) dong to two million (2,000,000) dong shall be imposed for selling motor vehicle license plates that are not produced by authorized state agencies or not permitted by authorized state agencies.
2. A fine of from three million (3,000,000) dong to five million (5,000,000) dong shall be imposed for producing unauthorized license plates or illegally manufacturing and assembling motor vehicles.
3. In addition to fines, individuals and organizations committing violations stipulated in Clause 1 and Clause 2 of this Article shall also have unauthorized license plates and vehicles confiscated and be suspended from operations.
Article 33. Penalty for the owner of a vehicle violating regulations related to road traffic
1. A fine of from VND 100,000 to VND 200,000 shall be imposed on the owner of a motorcycle, motorbike, or similar vehicles who violate any of the following acts:
a) Not transferring ownership of the vehicle in accordance with the provisions;
b) Changing the brand name or paint color of the vehicle without complying with the Vehicle Registration Certificate.
2. A fine of from VND 500,000 to VND 1,000,000 shall be imposed on the owner of a motorcycle, motorbike, or similar vehicles who violate any of the following acts:y:
a) Arbitrarily altering the frame number or engine number;
b) Erasing, altering, or forging vehicle registration files;
c) Arbitrarily changing the frame, engine, shape, or size of the vehicle;
d) Providing false information or using fake documents to obtain new license plates or Vehicle Registration Certificates;
d) Handing over the vehicle or allowing a person not meeting the conditions stipulated by law to operate the vehicle on the road.
3. A fine of from VND 200,000 to VND 300,000 shall be imposed on the owner of an automobile, tractor, specialized motor vehicle, or similar vehicles who violate any of the following acts:
a) Installing windshields or windows that are not safety glass;
b) Changing the paint color of the vehicle without complying with the color recorded in the Vehicle Registration Certificate; failing to comply with the regulations on license plates, regulations on writing characters on the body and doors of the vehicle.
4. A fine of from VND 1,000,000 to VND 2,000,000 shall be imposed on the owner of an automobile, tractor, specialized motor vehicle, or similar vehicles who violate any of the following acts:
a) Arbitrarily altering the frame number or engine number;
b) Altering or tampering with the Vehicle Registration Certificate, registration file, Certificate of Conformity, or environmental protection inspection label or other documents related to the vehicle;
c) Failing to comply with the regulations on the recovery of the Vehicle Registration Certificate; license plate; safety technical inspection certificate of the road motor vehicle.
d) Drawing or posting advertisements on vehicles in violation of regulations;
d) Not transferring ownership of the vehicle in accordance with the provisions;
e) Not processing the procedures to replace the Vehicle Registration Certificate when the vehicle has been modified;
g) Handing over the vehicle or allowing a person not meeting the conditions stipulated by law to operate the vehicle on the road;
h) Providing false information or using fake documents to obtain new license plates or a Vehicle Registration Certificate.
5. A fine of from VND 2,000,000 to VND 3,000,000 shall be imposed on any of the following violations:
a) Renting or borrowing parts or accessories of automobiles during inspection;
b) Operating motor vehicles, specialized motor vehicles without an Inspection Certificate or environmental protection label as prescribed.
6. A fine of from VND 3,000,000 to VND 5,000,000 shall be imposed on the owner of an automobile, tractor, specialized motor vehicle, or similar vehicles who violate any of the following acts:
a) Changing the frame assembly; engine assembly; braking system; drive system; movement system or arbitrarily modifying the structure, shape, size of the vehicle not in accordance with the design of the manufacturer or the approved modification design; arbitrarily changing the usage function of the vehicle;
b) Modifying other types of automobiles into passenger cars.
7. In addition to being fined, the violator shall also be subject to supplementary penalties and measures to rectify the consequences as follows:
a) Violating Clause 1 Point b and Clause 3 Point b of this Article, the violator must restore the brand name and paint color recorded in the Vehicle Registration Certificate or comply with the regulations on license plates, regulations on writing characters on the body and doors of the vehicle;
b) Violating Clause 2 Point b, Clause 2 Point d and Clause 4 Point b, Clause 4 Point h of this Article, the license plate and Vehicle Registration Certificate (if already issued) shall be revoked, and fake documents shall be confiscated;
c) Violating Clause 3 Point a and Clause 6 Point a of this Article, the violator must restore the original shape, size, or technical safety condition of the vehicle; violating Clause 6 Point b of this Article, the vehicle shall be confiscated.
Article 34. Penalty for staff serving on buses, fixed-route passenger transport vehicles, contractual passenger transport vehicles, and tourist passenger transport vehicles violating traffic order and safety regulations
1. A warning or a fine of from VND 40,000 to VND 60,000 shall be imposed on the act of not supporting or assisting elderly passengers, children unable to board or disembark the vehicle independently, or passengers with mobility or visual disabilities.
2. A fine of from VND 100,000 to VND 200,000 shall be imposed on staff serving on buses or fixed-route passenger transport vehicles who violate the act of collecting fares but not issuing tickets to passengers or collecting fares higher than prescribed..
3. A fine of from 1,000,000 VND to 2,000,000 VND shall be imposed for any of the following violations:
a) Transferring passengers mid-journey to another vehicle without their consent; threatening, insulting, competing for, soliciting passengers; forcing passengers to use services against their will;
b) Exiting the vehicle to evade inspection or control by authorized personnel;
4. A fine of from VND 3,000,000 to VND 5,000,000 shall be imposed on the act of assaulting passengers.
Article 35. Imposing Administrative Penalties on Passengers Violating Traffic Safety Regulations
1. A fine of VND 50,000 to VND 100,000 for any of the following violations:
a) Failure to comply with the rules for riding on vehicles;
b) Causing disorder on the vehicle;
2. A fine of from VND 300,000 to VND 500,000 shall be imposed on any of the following violations:
a) Carrying toxic chemicals, flammable or explosive substances, dangerous goods, or prohibited items on passenger vehicles;
b) Threatening the lives, health, or infringing upon the property of other passengers.
c) Hanging onto or clinging to the side of the vehicle; standing, sitting, lying on the roof, luggage compartment; opening the door of the vehicle arbitrarily or engaging in other actions that do not ensure safety while the vehicle is in motion;
3. In addition to being fined, persons violating the provisions set forth in point a, Clause 2 of this Article shall also have dangerous chemicals, flammable and explosive substances, hazardous goods, and prohibited items confiscated from their vehicles.
Article 36. Imposing Administrative Penalties on Drivers of Tracked Vehicles; Vehicles Exceeding Weight Limits or Size Restrictions of Bridges and Roads (including passenger-carrying automobiles)
1. A fine of from VND 1,000,000 to VND 2,000,000 shall be imposed for any of the following violations:
a) Operating a vehicle where the total weight of the vehicle or axle load (including cargo loaded on the vehicle and passengers carried) exceeds the permitted weight limit of bridges and roads by 10% to 20%, except when there is a valid Driving Permit.
b) Not complying with the regulations stipulated in the Driving Permit, except for violations specified in points b, d, đ of Clause 3 of this Article.
2. A fine of VND 2,000,000 to VND 3,000,000 for failing to comply with vehicle weight inspection when requested..
3. A fine of from VND 3,000,000 to VND 5,000,000 for one of the following violations:
a) Shifting loads or using other methods to avoid detection of overloading or over-dimensioning;
b) Operating a vehicle with a valid Permit to Operate but the total weight of the vehicle or axle load (including cargo loaded on the vehicle if any) exceeds the permitted weight specified in the Permit to Operate;
c) Operating a vehicle where the total weight of the vehicle or axle load (including cargo loaded on the vehicle and passengers carried) exceeds the permitted weight limit of bridges and roads by more than 20%, except when there is a valid Driving Permit.
d) Transporting cargo exceeding the bridge and road dimensions specified in the Permit to Operate;
đ) Operating tracked vehicles without a valid Driving Permit as prescribed or directly traveling on roads.
4. In addition to being fined, violators shall also be subject to supplementary penalties and measures to rectify the consequences as follows:
a) Violations under Clause 1 and Clause 3 of this Article shall result in suspension of operation until compliance with regulations is achieved or immediate reduction of excess weight and removal of oversized parts; if damage to bridges or roads occurs, restoration to the original condition prior to the violation must be undertaken.
b) Violations under Clause 1 of this Article shall also result in revocation of the Driver's License (when operating automobiles, tractors, and similar vehicles) or the Traffic Law Knowledge Enhancement Certificate (when operating specialized motorcycles) for thirty days.
c) Violations under Clause 3 of this Article shall also result in revocation of the Driver's License (when operating automobiles, tractors, and similar vehicles) or the Traffic Law Knowledge Enhancement Certificate (when operating specialized motorcycles) for sixty days.
Article 37. Imposing Administrative Penalties on Persons Engaging in Unauthorized Racing or Encouraging Unauthorized Racing
1. A fine of between 500,000 dong and 1,000,000 dong shall be imposed for one of the following violations:
a) Gathering to encourage or incite the act of driving a vehicle at a speed exceeding the prescribed limit, weaving, swerving, chasing each other on the road, or engaging in illegal racing;
b) Illegally racing bicycles, bicycle motors, rickshaws, animal-drawn vehicles, or riding animals in races on public roads.
2. A fine of VND 2,000,000 to VND 4,000,000 for those who encourage unauthorized racing and obstruct or resist public officials in the performance of their duties.
3. A fine of from VND 10,000,000 to VND 20,000,000 shall be imposed on those who engage in illegal motorcycle, scooter, or electric bicycle racing.
4. A fine of from VND 20,000,000 to VND 30,000,000 shall be imposed on those who engage in illegal automobile racing.
5. A fine of from VND 30,000,000 to VND 40,000,000 shall be imposed on any of the following violations:
a) Engaging in automobile, motorcycle, scooter, or electric bicycle racing while resisting public officials in the performance of their duties;
b) Organizing illegal racing.
6. In addition to being fined, violators shall also be subject to supplementary penalties as follows: violations under point b, Clause 1 of this Article shall result in confiscation of the offending vehicle (except draft animals); violations under Clause 3, Clause 4, and point a, Clause 5 of this Article shall result in indefinite revocation of the Driver's License and confiscation of the vehicle.
Article 38. Imposing Administrative Penalties on Persons Obstructing Inspection, Examination, and Control Activities of Public Officials or Offering Bribes to Public Officials
1. A fine of VND 500,000 to VND 1,000,000 for acts of brokering, aiding, or directing drivers to evade inspections and controls conducted by public officials.
2. A fine of from VND 2,000,000 to VND 3,000,000 for one of the following violations:
a) Obstructing or refusing to comply with requests for inspection, examination, and control by public officials regarding: documents related to individuals and vehicles, operational conditions of vehicles, transportation activities and supporting services, driver training and testing, vehicle inspection.
b) Using words or actions to threaten, insult, or defame public officials, inciting others not to comply with requests for inspection, examination, and control by public officials, except for violations specified in Clause 8 of Article 8, Clause 8 of Article 9, Clause 2, and point a of Clause 5 of Article 37 of this Decree.
c) Refusing to comply with requests for drug and alcohol testing by traffic controllers or public officials.
d) Offering money, property, or other material benefits to law enforcement officers to evade administrative violation penalties.
3. In addition to being fined, violators shall also be subject to supplementary penalties and measures as follows: violations under point d, Clause 2 of this Article shall result in confiscation of money, assets, or other material benefits; if the violator is a driver, they shall also have their Driver's License (for automobiles, motorcycles, tractors, and similar vehicles) or the Traffic Law Knowledge Enhancement Certificate (for specialized motorcycles) revoked for sixty days.
Article 39. Penalty for the driver of a motor vehicle with foreign license plates
1. A fine of VND 500,000 to VND 1,000,000 shall be imposed on the driver of a motor vehicle with foreign license plates who commits any of the following violations:
a) The vehicle does not display the national identification symbol as prescribed;
b) Vehicle documents not having an English or Vietnamese translation as prescribed;
c) Passenger-carrying vehicles lacking passenger lists as prescribed.
2. A fine of from VND 4,000,000 to VND 6,000,000 shall be imposed on any of the following violations:
a) Operating the vehicle within the territory of Vietnam beyond the prescribed period;
b) Operating beyond the permitted scope;
c) Operating a vehicle without an international transport permit or international transport intermodal emblem as prescribed, or having but expired;
d) Does not display a temporary license plate or displays a temporary license plate not issued by the competent authority (if there is a requirement to display a temporary license plate);
đ) Transporting passengers or goods not in accordance with the provisions of the Road Transport Agreement or signed Protocol;
e) Operating a right-hand-drive automobile in traffic without a lead vehicle as prescribed;
g) Driving a right-hand drive automobile while the driver does not have the correct nationality as prescribed.
3. In addition to the fine, the driver of the violating vehicle shall also be subject to the following measures: if they violate Point a, Point c, Point d, and Point đ Clause 2 of this Article, their operation shall be suspended and the vehicle shall be ordered to leave Vietnam.
Article 40. Penalty for the driver of a vehicle registered to operate in Special Economic Zones
1. A fine of VND 500,000 to VND 1,000,000 shall be imposed on the driver of a motorcycle, motorbike, or similar vehicles who commits any of the following violations:
a) Not having a declaration form for temporarily imported and re-exported road transport vehicles as prescribed;
b) Operating a vehicle without a control emblem as prescribed or using an expired emblem or an emblem not issued by an authorized agency.
2. A fine of VND 4,000,000 to VND 6,000,000 shall be imposed on the driver of an automobile or similar vehicles who commits any of the following violations::
a) Not having a declaration form for temporarily imported and re-exported road transport vehicles as prescribed;
b) Operating a vehicle without a control emblem as prescribed or using an expired emblem or an emblem not issued by an authorized agency.
3. In addition to the fine, the driver of the violating vehicle shall also be subject to additional forms of supplementary penalties and measures to remedy the consequences as follows:
a) Violating Clause 1 and Clause 2 of this Article, the vehicle must be returned to the Special Economic Zone; if using unauthorized insignia, the insignia shall be confiscated;
b) Repeated violation or multiple violations of Clause 1 and Clause 2 of this Article shall result in confiscation of the vehicle.
Article 41. Penalty for violations related to driving training and examination
1. A fine of from 200,000 dong to 400,000 dong shall be imposed on practical instructors who commit any of the following violations:
a) Allowing a learner without a "Driving Learner" insignia to practice driving;
b) Carrying passengers or goods on a practice vehicle contrary to regulations;
c) Driving outside the designated route or time specified in the Driving Learner Permit;
d) Not wearing or improperly wearing the "Driving Instructor" insignia as prescribed.
2. A fine of VND 500,000 to VND 1,000,000 shall be imposed on a driving training institution that commits any of the following violations:
a) Not providing an instructor to sit beside the learner during practical lessons;
b) The training vehicle does not have a Driving Learner Permit or "Practice Driving" license plate as prescribed;;
c) The training vehicle is not equipped with an auxiliary brake or, if it is, it is ineffective;
d) Enrolling learners who do not meet the required standards;
đ) Providing instructors who do not meet the required qualifications;
e) Failing to maintain complete records of all training courses as prescribed.
3. A fine of VND 5,000,000 to VND 10,000,000 shall be imposed on a driving training institution or driving examination center that commits any of the following violations:
a) The driving training institution does not have a Training Permit or has one that has expired; does not meet the required conditions; does not comply with the prescribed training content and program; exceeds the permitted training volume;;
b) Examination centers lacking the required operational conditions.
4. In addition to the fine, individuals or organizations that commit violations shall also be subject to additional forms of supplementary penalties and measures to remedy the consequences as follows:
a) A driving training institution that violates Point a Clause 3 of this Article shall be suspended from operations until compliance with the regulations is achieved;
b) A driving examination center that violates Point b Clause 3 of this Article shall be suspended from operations until it meets the required conditions.
Article 42. Penalties for violations of regulations on vehicle technical safety inspection and environmental protection activities for motor vehicles
1. A fine of from 4,000,000 VND to 6,000,000 VND shall be imposed on Inspection Centers that violate any of the following acts:
a) Using inspectors or technical staff who do not meet the required conditions as stipulated;
b) Not meeting the operational conditions as prescribed;
c) Not conducting the inspection according to the prescribed content and procedures.
2. In addition to the fine, individuals and organizations committing violations shall be suspended from operating until the violations are fully rectified.
Section 7
TRIAL APPLICATION FOR CERTAIN VIOLATIONS IN THE INNER CITY OF SPECIAL CITIES
Article 43. Penalties for drivers of automobiles and similar vehicles violating certain acts specifically applied in the inner city of special cities
1. A fine of from 300,000 VND to 500,000 VND shall be imposed on drivers who violate any of the acts specified at point a, point k, Clause 1, Article 8 of this Decree.
2. A fine of from 600,000 VND to 1,000,000 VND shall be imposed on drivers who violate any of the acts specified at:
a) Point e, Clause 1; point g, point h, point i, point k, Clause 2; Article 8 of this Decree;
b) Point a, point b, Clause 4; Article 26 of this Decree.
3. A fine of from 1,000,000 VND to 1,400,000 VND shall be imposed on drivers who violate any of the acts specified at: point a, point b, point d, point g, point h, Clause 3; Article 8 of this Decree.
4. A fine of from 1,400,000 VND to 2,000,000 VND shall be imposed on drivers who violate any of the acts specified at: point a, point b, point c, point đ, point e, point g, Clause 4; Article 8 of this Decree.
5. In addition to the fine, violators shall also be subject to supplementary penalties and measures to remedy consequences as follows:
a) Violating point e, Clause 1; point g, point h, Clause 2; point d, Clause 3; point a, point đ, Clause 4; Article 8 of this Decree (in cases of illegal parking or stopping), the violator shall be compelled to remove the vehicle from the location of the violation;
b) Violating point e, Clause 1; point g, point h, point i, point k, Clause 2; point a, point g, point h, Clause 3; point a, point b, point đ, point g, Clause 4; Article 8 of this Decree shall have their driving licenses revoked for thirty days;
c) Violating point a, point b, Clause 4; Article 26 of this Decree shall have their driving licenses revoked for thirty days;
d) Violating point e, Clause 4; Article 8 of this Decree shall have their driving licenses revoked for sixty days. Violating any of the points or clauses of Article 8 of this Decree causing traffic accidents but not reaching serious levels shall have their driving licenses revoked for sixty days: point a, point e, point k, Clause 1; point g, point h, point i, point k, Clause 2; point a, point b, point d, point g, point h, Clause 3; point a, point b, Clause 4;
đ) Violating any of the points or clauses of Article 8 of this Decree causing traffic accidents at serious levels or higher shall have their driving licenses revoked indefinitely: point a, point e, point k, Clause 1; point g, point h, point i, point k, Clause 2; point a, point b, point d, point g, point h, Clause 3; point a, point b, point e, Clause 4.
Article 44. Imposing penalties on drivers and passengers of motorcycles, motorbikes (including electric motorbikes), similar motorcycle vehicles, and similar motorbike vehicles for violations applicable exclusively within the inner city areas of special-class cities.
1. A fine of VND 100,000 to VND 200,000 shall be imposed on the driver for violating any of the acts specified in Point a, Point h Clause 1; Point a, Point b, Point d, Point đ Clause 2 Article 9 of this Decree. violating one of the acts prescribed at: point a, point h Clause 1; point a, point b, point d, point đ Clause 2 Article 9 of this Decree.
2. A fine of VND 300,000 to VND 500,000 shall be imposed on the driver and passenger for violating any of the acts specified in Point a, Point đ, Point h Clause 3; Point c, Point g Clause 4 Article 9 of this Decree. sitting on the vehicle violating one of the acts prescribed at: point a, point đ, point h Clause 3; point c, point g Clause 4 Article 9 of this Decree.
3. In addition to the monetary penalty, the driver who violates the regulations shall also be subject to the following additional forms of punishment:
a) Violating Point a, Point đ Clause 3; Point g Clause 4 Article 9 of this Decree shall have their driving license revoked for thirty days.
b) Violating any of the points or clauses of Article 9 of this Decree causing traffic accidents but not reaching a serious level shall have their driving license revoked for sixty days: Point a Clause 1; Point b, Point d, Point đ Clause 2; Point a, Point đ, Point h Clause 3; Point g Clause 4.
c) Violating any of the points or clauses of Article 9 of this Decree causing traffic accidents at a serious level or higher shall have their driving license revoked indefinitely: Point a Clause 1; Point b, Point d, Point đ Clause 2; Point a, Point đ, Point h Clause 3; Point g Clause 4.
Article 45. Imposing penalties on drivers and passengers of bicycles, motorized bicycles, and other rudimentary vehicles for violations applicable exclusively within the inner city areas of special-class cities.
1. A fine of VND 100,000 to VND 200,000 shall be imposed on the person driving or sitting on the vehicle who commits any of the acts prescribed in:
a) Point a, Point c, Point d, Point g Clause 1; Point a, Point b, Point d, Point g Clause 2; Point b, Point c Clause 3 Article 11 of this Decree;
b) Clause 1, Article 21 of this Decree.
2. In addition to the monetary penalty, the driver who violates the provisions of Clause 1 Article 21 of this Decree shall also be subject to the additional form of punishment of confiscation of the vehicle. In addition to the penalties prescribed in Article 21 of this Decree, the supplementary penalty of confiscation of the vehicle shall also be applied.
Article 46. Imposing penalties on pedestrians for violations applicable exclusively within the inner city areas of special-class cities.
1. A fine of VND 60,000 to VND 80,000 shall be imposed on pedestrians for violating any of the acts specified in Point b, Point c Clause 1 Article 12 of this Decree.
2. A fine of VND 80,000 to VND 120,000 shall be imposed on pedestrians for violating any of the acts specified in Clause 2 Article 12 of this Decree.
Chapter III
AUTHORITY AND PROCEDURES FOR IMPOSING ADMINISTRATIVE PENALTIES ON VIOLATIONS
Section 1
AUTHORITY TO IMPOSE PENALTIES
Article 47. Determining the authority to impose administrative penalties in the field of road traffic
1. The Chairmen of People's Committees at all levels, Chiefs of Public Security Organs at all levels (except for the Chief of Public Security Organ at the commune level) have the authority to impose penalties for violations of the provisions of this Decree within the scope of management of their respective localities.
2. Traffic police have the authority to impose penalties for violations in the field of road traffic by persons and vehicles participating in road traffic as prescribed in this Decree.
3. Police officers responsible for public order, rapid response police, mobile police, administrative police for social order, Chiefs of Public Security Organs at the commune level within the scope of their functions and tasks related to road traffic safety have the authority to impose penalties for violations of the provisions of the points, clauses, and articles of this Decree as follows:
a) Point đ, Point e, Point g, Point l Clause 1; Point g, Point h, Point m Clause 2; Point b, Point d, Point h Clause 3; Point a, Point b, Point đ, Point h Clause 4; Point b Clause 5; Point b, Point c Clause 6; Clause 7; Clause 8 Article 8;
b) Point g, Point h Clause 1; Point b, Point d, Point đ, Point i Clause 2; Point đ, Point e, Point h, Point i, Point k Clause 3; Point đ, Point g, Point i Clause 4; Point b, Point d Clause 5; Point b Clause 6; Clause 7; Clause 8 Article 9;
c) Point d, Point đ, Point e, Point h, Point i Clause 2; Point b, Point đ, Point h Clause 3; Point d, Point e, Point g Clause 4; Point b, Point c Clause 5; Point a Clause 6; Clause 7 Article 10;

4. Road inspectors within the scope of their functions and tasks assigned have the authority to impose penalties for violations of the provisions regarding transport activities and supporting transport services at bus stops, parking lots, bus stations, parking areas, rest areas, weight control checkpoints, toll booths, road transport business premises, when vehicles (with violations) stop or park on the road; violations of the provisions regarding training, examination, issuance of driving licenses, activities of technical inspection and environmental protection of motor vehicles, protection of road infrastructure, ensuring technical standards of road construction projects, and some other violations prescribed in the points, clauses, and articles of this Decree as follows:
a) Point đ, Point e, Point g Clause 1; Point g, Point h Clause 2; Point d, Point h Clause 3; Point a, Point b, Point đ, Point h Clause 4 Article 8;
b) Point g, Point h Clause 1; Point d, Point đ Clause 2; Point g Clause 4; Point d Clause 5 Article 9;
c) Point d, Point đ, Point e, Point g, Point h, Point i Clause 2; Point b Clause 3; Point e, Point g Clause 4; Point b, Point c Clause 5 Article 10;
d) Point c, Point e, Point g, Point h Clause 1; Point a, Point b Clause 2; Point b Clause 3 Article 11;
đ) Point a Clause 1, Clause 2, Clause 3, Clause 4, Point b Clause 5 Article 14;

5. Police officers responsible for public order, rapid response police, mobile police, administrative police for social order, road inspectors shall impose penalties on violations applied on a trial basis within the inner city areas of special-class cities according to the authority stipulated in Clauses 3 and 4 of this Article.
Article 48. Competence to impose penalties of the Chairperson of People's Committees at various levelst,
1. The Chairperson of the People's Committee at the commune level has the right to:
a) To issue warnings;
b) To impose fines up to VND 2,000,000.
c) To confiscate items or means used for administrative violations valued up to two million dong;
d) Order restoration to the original state that was altered, order implementation of measures to remedy environmental pollution caused by administrative violations.
2. The Chairperson of the People's Committee at the district level has the right to:
a) To issue warnings;
b) Impose fines up to thirty million dong;
c) Confiscate the objects and means used to commit administrative violations;
d) Suspend the right to use licenses and certificates within their authority.
đ) Apply remedial measures prescribed in points a, b and d, Clause 3, Article 5 of this Decree.
3. The Chairman of the Provincial People's Committee has the authority to:
a) To issue warnings;
b) Impose fines up to 40,000,000 VND;
c) Confiscate the objects and means used to commit administrative violations;
d) Suspend the right to use licenses and certificates within their authority.
đ) Apply remedial measures prescribed in Clause 3, Article 5 of this Decree.
Article 49. Competence to impose penalties of the People's Public Security
1. Public security officers performing their duties have the authority to:
a) To issue warnings;
b) Imposing a fine up to VND 200,000.
2. The Head of Squad, the Head of Station of persons specified in Clause 1 of this Article have the right:
a) To issue warnings;
b) Impose a fine up to 500,000 VND.
3. The Head of Public Security of commune may apply forms of handling administrative violations prescribed in Clause 1, Article 48 of this Decree.
4. The Head of the County Public Security Office has the authority:
a) To issue warnings;
b) Impose fines up to 10,000,000 VND;
c) Suspend the right to use licenses, certificates of practice within the competence4. Reserve officer trainees undergoing training for three months or more without participating in social insurance or health insurance; defense workers and civil servants serving in the military when seeking medical examination and treatment.
d) Confiscate objects and means used to commit administrative violations;
đ) Apply remedial measures prescribed in points a, b and d Clause 3, Article 5 of this Decree.
5. The Head of Traffic Police Department, the Head of Traffic Order Police Department, the Head of Administrative Management Police Department for Social Order under Provincial Public Security, the Head of Mobile Police Unit from battalion level upwards have the authority to impose penalties as the Head of Public Security of district specified in Clause 4 of this Article.
6. The provincial public security director have the right to:
a) To issue warnings;
b) Impose fines up to thirty million dong;
c) Apply supplementary forms of administrative penalties and measures to remedy consequences as prescribed in Clause 4 of this Article.
7. The Directors of the Highway Traffic Police Corps and the Railway Traffic Police Corps, the Directors of the Administrative Management Police Corps on Public Order have the right to:
a) To issue warnings;
b) Impose fines up to 40,000,000 VND;
c) Apply supplementary forms of administrative penalties and measures to remedy consequences as prescribed in Clause 4 of this Article.
Article 50. Competence to impose penalties of Road Transport Inspectorate
1. Inspectors performing their duties have the right to:
a) To issue warnings;
b) Impose a fine up to 500,000 VND;
c) To confiscate items or means used for administrative violations valued up to two million dong;
d) Apply remedial measures prescribed in points a, b and d, Clause 3, Article 5 of this Decree, except for the measure of ordering demolition of illegal construction works.
2. The Chief Inspector of the Department of Transport Services, the Chief Inspector of Vietnam Highway Administration have the right:
a) To issue warnings;
b) Impose fines up to thirty million dong;
c) Suspend the right to use licenses, certificates of practice within the competence;
d) Confiscate objects and means used to commit administrative violations;
đ) Apply remedial measures prescribed in points a, b and d, Clause 3, Article 5 of this Decree.
5. The Director of the Port Marine Traffic Inspectorate, the Head of the Specialized Inspection Team of the Port Marine Traffic Inspectorate have the authority:
a) To issue warnings;
b) Impose fines up to 40,000,000 VND;
c) Suspend the right to use licenses, certificates of practice within the competence;
d) Confiscate objects and means used to commit administrative violations;
đ) Apply remedial measures prescribed in points a, b and d, Clause 3, Article 5 of this Decree.
Article 51. Principles for determining competence to impose penalties for administrative violationsh
The principle for determining competence to impose penalties for administrative violations in the field of road traffic shall be implemented according to the provisions of Article 42 of the Ordinance on Handling Administrative Violations.
Section 2
PROCEDURES FOR IMPOSING PENALTIES
Article 52. Collection, payment, management and use of fines
1. Individuals and organizations violating traffic regulations on highways who are fined must pay the fine according to the provisions of the law.
2. The collection and payment of fines must comply with the provisions of the Ordinance on Handling Administrative Violations. Individuals and organizations committing administrative violations can pay fines by deducting from their accounts at banks.
3. Administrative fines under this Decree must be deposited into the temporary receipt and retention account of the financial agency opened at State Treasury and will be fully used for traffic safety assurance work, preventing traffic congestion on roads.
4. The Ministry of Finance shall take the lead and coordinate with relevant ministries and sectors to guide the collection, payment, management and use of funds obtained from penalties imposed under this Decree..
Article 53. Penalty procedures
1. Penalty procedures must comply with the provisions of the Ordinance on Handling Administrative Violations, Decree No. 128/2008/NĐ-CP. Sample records and decisions for use in penalties are stipulated in the Appendix issued together with this Decree.
2. For the owner of the vehicle violating regulations related to road traffic:
a) In case the owner of the vehicle violating regulations is present at the location where the violation occurred, the person authorized to impose penalties shall record the administrative violation and issue a decision to penalize the administrative violation according to the corresponding points and clauses of Article 33 of this Decree;
b) In case the owner of the vehicle violating regulations is not present at the location where the violation occurred, the person authorized to impose penalties shall base on the violation to record the administrative violation against the owner of the vehicle and proceed to penalize according to the law, the driver of the vehicle must sign the administrative violation record as a witness and execute the penalty decision on behalf of the owner of the vehicle. In case the driver of the vehicle does not execute the penalty decision on behalf of the owner of the vehicle, the person authorized to impose penalties shall temporarily detain the vehicle to ensure the execution of the penalty against the owner of the vehicle.
Article 54. Temporary Detention of Vehicles and Related Documents Pertaining to the Driver and the Violating Vehicle
1. To immediately prevent administrative violations, the authorized person imposing penalties may temporarily detain vehicles for up to 10 (ten) days before issuing a penalty decision for the following violations specified in the Articles, Clauses, and Points of this Decree:
a) Violation of point b Clause 5, point b, point c Clause 6 Article 8;
b) Violation of point b Clause 5, point b Clause 6 Article 9;
c) Violation of point a Clause 6, Clause 7 Article 10;
d) Violation of point d, point đ Clause 4 Article 11 where the violator is under 16 years old and driving a vehicle;
đ) Violation of Clause 4, point d, point đ Clause 5 Article 19;
e) Violation of Clause 3 Article 20;
g) Violation of point a, point đ Clause 1 Article 22;
h) Violation of Clause 1, point a Clause 2, point a Clause 4, Clause 5, Clause 7, Clause 8 Article 24;
i) Violation of point c Clause 2 Article 38.
2. In addition to the temporary detention of vehicles as provided for in Clause 1 of this Article, the authorized person imposing penalties may also decide to temporarily detain vehicles and related documents pertaining to the driver and the violating vehicle for other violations in the field of road traffic as prescribed in Article 46 and Clause 3 of Article 57 of the Administrative Offense Handling Ordinance.
3. When a vehicle is temporarily detained as provided for in Clauses 1 and 2 of this Article, the owner of the vehicle must bear all costs (if any) for using another vehicle to transport persons and goods carried on the detained vehicle.
4. The Ministry of Public Security shall provide detailed guidance on the implementation of the temporary detention of vehicles as prescribed in Clauses 1 and 2 of this Article.
Article 55. Compliance with Penalty Decisions and Enforcement of Administrative Offense Penalty Decisions
1. Individuals and organizations subject to administrative offense penalties in the field of road traffic must comply with the penalty decision within 10 (ten) days from the date they receive the penalty decision, except in cases stipulated in Article 65 of the Administrative Offense Handling Ordinance.
2. If individuals and organizations subject to administrative offense penalties fail to voluntarily comply with the penalty decision beyond the time limit prescribed in Clause 1 of this Article, enforcement measures will be taken against them. Individuals and organizations subject to enforcement must bear all costs associated with organizing the implementation of enforcement measures. The enforcement of administrative offense penalty decisions and the authority to issue enforcement decisions are carried out according to the provisions of Articles 66 and 67 of the Administrative Offense Handling Ordinance and Decree No. 37/2005/NĐ-CP dated March 18, 2005 of the Government on procedures for applying enforcement measures to administrative offense penalty decisions.
Article 56. Use of Technical Equipment
1. Police forces and Road Traffic Inspectors may use technical equipment in patrol and control activities to detect and track down violators. The use of such technical equipment is implemented according to the provisions of Article 55a of the Administrative Offense Handling Ordinance.
2. In cases where violations are discovered through the use of technical equipment (recording images of vehicles and license plates), the owner of the motor vehicle (used for violation) has the obligation to cooperate with the competent authorities to identify the person who operated the vehicle committing the violation.
Chapter IV
IMPLEMENTING PROVISIONS
Article 57. Effectiveness
1. This Decree takes effect from May 20, 2010.
2. This Decree replaces Decree No. 146/2007/NĐ-CP dated September 14, 2007 of the Government on penalties for administrative violations in the field of road traffic and Decree No. 67/2008/NĐ-CP dated May 29, 2008 of the Government amending and supplementing Clause 3 of Article 42 of Decree No. 146/2007/NĐ-CP dated September 14, 2007 on penalties for administrative violations in the field of road traffic.
3. For drivers who commit violations as prescribed in point a Clause 8 Article 24 of this Decree, if using Driving licenses for categories C, D, E to drive articulated trucks pulling semi-trailers are penalized from July 1, 2010.
4. For drivers who commit violations as prescribed in point g Clause 1 Article 8, point h Clause 2 Article 10 of this Decree, if failing to properly display warning signs are penalized from January 1, 2011.
5. Cases of violations discovered and handled according to Decree No. 146/2007/NĐ-CP and Decree No. 67/2008/NĐ-CP but not yet executed or must be executed after the effective date of this Decree shall still be executed according to Decree No. 146/2007/NĐ-CP and Decree No. 67/2008/NĐ-CP.
6. The provisions in Section 7 Chapter II of this Decree shall be piloted for a period of 36 (thirty-six) months from the date this Decree takes effect. People's Committees of cities classified as special-class cities shall specify the specific scope of the inner city area of special-class cities for the pilot implementation. Annually, the Ministry of Transport shall take the lead and coordinate with the Ministry of Public Security and People's Committees of cities classified as special-class cities to report to the Prime Minister on the results of the pilot implementation; at the end of the pilot period, organize a summary evaluation of the pilot implementation and report to the Government to propose subsequent implementation policies.
Article 58. Responsibilities for Enforcement
Ministers, Heads of ministerial-level agencies, Heads of government-affiliated agencies, Chairpersons of provincial People's Committees directly under the Central Government shall be responsible for implementing this Decree.
