Article 1. Amending and supplementing some articles of the Regulations on Inspection of Inland Waterway Vessels issued together with Decision No. 25/2004/QĐ-BGTVT dated November 25, 2004
1. Amending Clause 3 of Article 3 as follows:
"Approving design files related to the construction, conversion, repair, restoration, importation of vessels and equipment installed on vessels."
“1. The procedure for appointing, reappointing accounting managers and accounting supervisors, and assigning accounting supervisors shall be carried out according to the procedure for appointing mid-level professional positions as prescribed in Circular No. 29/2017/TT-BCA dated September 1, 2017 of the Minister of Public Security stipulating the procedures and formalities for appointing, dismissing, demoting, and changing positions within the People's Police, amended and supplemented by Circular No. 49/2023/TT-BCA dated October 18, 2023; Circular No. 77/2021/TT-BCA dated July 15, 2021 of the Minister of Public Security stipulating the list of positions and titles and the allocation and use of titles for police officers and non-commissioned officers of the People's Police, and Circular No. 78/2021/TT-BCA dated July 15, 2021 of the Minister of Public Security stipulating the standards for titles of police officers and non-commissioned officers of the People's Police, and any amendments and supplements to these Circulars (if any) and the following provisions:”
"Article 7. Procedures for approving design files
1. Organizations and individuals complete one set of application files for the approval of design files. The application file includes:
a) One Application for Design Approval according to the model prescribed in Appendix I of these Regulations (original);
b) Three design files according to the applicable technical regulations and standards for vessels (originals).
2. Organizations and individuals submit the files directly at the headquarters of the Vietnam Marine Inspection Bureau or through the postal service. If the files are incomplete, the Vietnam Marine Inspection Bureau will guide organizations and individuals to complete them again. If the files are complete, a time for delivering the results will be scheduled.
3. Within five working days from the date of receiving the complete application files as prescribed, the Vietnam Marine Inspection Bureau will review the design files. If they do not meet the requirements, a notification will be sent to the organizations and individuals. If they meet the requirements, a certificate of design approval will be issued. For new types or complex designs, the completion time for design approval will be agreed upon between the Vietnam Marine Inspection Bureau and the organizations and individuals.
4. Organizations and individuals can collect the results directly at the headquarters of the Vietnam Marine Inspection Bureau or through the postal service."
3. Amending and supplementing Article 8 as follows:
"Article 8. Procedures for inspecting and issuing certificates of technical safety and environmental protection for inland waterway vessels
1. The owner of the vessel or the facility constructing, converting, repairing, or restoring the vessel when requesting inspection for the issuance of a certificate of technical safety and environmental protection for inland waterway vessels must submit the following documents to the inspection unit:
a) An Application for Inspection according to the model prescribed in Appendix II of these Regulations (original);
b) Technical documentation of the vessel as follows:
- For newly constructed, converted, repaired, or restored vessels, submit the approved design file (original);
- For operating vessels, submit the certificate of technical safety and environmental protection along with the vessel's technical inspection logbook (original);
- For imported vessels, submit: one copy of the customs declaration form for imported goods (with the original for verification); one approved design file by the Vietnam Marine Inspection Bureau (original), and technical documents provided by foreign organizations for the vessel (if available).
2. Organizations and individuals submit the files directly at the headquarters of the inspection unit or through the postal service. If the files are incomplete, the inspection unit will guide organizations and individuals to complete them. If the files are complete, a time and place for inspection will be scheduled. In cases where inspection is requested by direct invitation, telephone call, or fax, there is no need to submit the Application for Inspection as specified in point a of clause 1.
3. If the vessel and equipment installed on it comply with the provisions of technical regulations, standards, and environmental protection, the inspection unit will issue a certificate of technical safety and environmental protection for the vessel within one working day after completing the on-site inspection. Other cases will be handled according to the agreement between the inspection unit and the vessel owner, or the facility constructing, converting, repairing, or restoring the vessel.
4. Upon receipt of a written request for an extraordinary inspection from a competent authority, the inspection unit must organize the inspection and provide a written response about the inspection results according to the content, time, and location specified in the request."
4Supplementing Appendices I and II to Decision No. 25/2004/QĐ-BGTVT dated November 25, 2004 of the Minister.
1. Supplement Article 10a following Article 10 as follows:
"Article 10a. Procedures for issuing certificates to surveyors
1. The survey organization and the person proposed to be issued a certificate shall complete one set of documents and submit them directly at the headquarters of the Vietnam Marine Survey Bureau or through the postal system. The documents include:
a) A request form from the survey organization according to the model specified in Appendix I of this Regulation (original);
b) The scientific curriculum vitae of the person proposed to be issued a certificate according to the model specified in Appendix II of this Regulation (original);
c) An internship report of the person proposed to be issued a certificate according to the model specified in Appendix III of this Regulation (original);
d) The academic record of the person proposed to be issued a certificate according to the model specified in Appendix IV of this Regulation (certified copy or photocopied and bring the original for verification).
2. The Vietnam Marine Survey Bureau will accept and review the documents:
a) If the documents are incomplete, it will guide the survey organization and the person proposed to be issued a certificate to complete them again; if the documents are complete, it will schedule a time for conducting the capability assessment of the person proposed to be issued a certificate.
b) The Vietnam Marine Survey Bureau will conduct the capability assessment of the person proposed to be issued a certificate: If not qualified, it will notify the survey organization and the person proposed to be issued a certificate; if qualified, it will issue the certificate within five working days after the capability assessment results are obtained. The validity period of the certificate is thirty-six months from the date of issuance.
c) The survey organization and the person proposed to be issued a certificate may collect the results directly at the headquarters of the Vietnam Marine Survey Bureau or through the postal system."
2. Amend Clause 1 of Article 14 as follows:
"1. To develop plans, programs, and contents for training; organize the assessment of the capability of persons proposed to be issued certificates and issue certificates to such persons in accordance with this Regulation;"
3. Supplement Appendices I, II, III, and IV to Decision No. 2687/2000/QĐ-BGTVT dated September 14, 2000, of the Minister.
Article 3. Effectiveness
This Circular takes effect forty-five days from the date of signature.
Article 4. Organization of Implementation
The Director of the Ministry's Office, the Inspector General, Heads of Departments, the Director of the Vietnam Marine Survey Bureau, Heads of agencies, organizations, and individuals concerned are responsible for implementing this Circular./.
