Pursuant to Decree No. 40/2025/NĐ-CP dated February 26, 2025 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Industry and Trade

 

Pursuant to the Law on Foreign Trade Management dated June 12, 2017;

Pursuant to Decree No. 14/2018/NĐ-CP dated January 23, 2018 of the Government detailing border trade activities;;

Pursuant to Decree No. 122/2024/NĐ-CP dated October 4, 2024 of the Government amending and supplementing certain articles of Decree No. 14/2018/NĐ-CP;

The Minister of Industry and Trade issues this Circular amending and supplementing certain articles of Circular No. 02/2018/TT-BCT dated February 27, 2018 of the Minister of Industry and Trade detailing the List of Goods for Purchase and Exchange by Border Residents.

At the proposal of the Director of the Import-Export Department,

Article 1. Amending and supplementing certain articles of Circular No. 02/2018/TT-BCT dated February 27, 2018 of the Minister of Industry and Trade detailing the List of Goods for Purchase and Exchange by Border Residents

"1. Border residents purchasing and exchanging goods across borders as prescribed in Clause 1, Article 1 of Decree No. 122/2024/NĐ-CP."

1. Amend and supplement Clause 1 of Article 2 as follows:

"Article 3. Goods purchased and exchanged across borders by border residents

2. Amending and supplementing Article 3 as follows:

1. Exported goods under the form of purchase and exchange by border residents shall be carried out in accordance with current laws.

2. Imported goods under the form of purchase and exchange by border residents are specified in Appendix I attached hereto.

3. Goods outside the list prescribed in Clause 2 of this Article shall not be imported under the form of purchase and exchange of goods by border residents.

4. In cases where food safety and disease prevention across borders need to be ensured, the Ministry of Industry and Trade, after consultation with relevant ministries and agencies, may decide to temporarily suspend the importation of certain items within the list of goods for purchase and exchange by border residents issued in accordance with Clause 2 of this Article on specific localities for a specific period of time."

Article 2. Replacing Appendix I List of Goods for Import under the Form of Purchase and Exchange by Border Residents in Circular No. 02/2018/TT-BCT

Replacing Appendix I List of Goods for Import under the Form of Purchase and Exchange by Border Residents in Circular No. 02/2018/TT-BCT with the Appendix issued herein.

This Circular takes effect from July 21, 2025./.
