DECISION OF THE PRIME MINISTER

Regarding the approval of the Plan for the reorganization, renovation, and development of state-owned agricultural and forestry enterprises under the People's Committee of Quang Binh Province

PRIME MINISTER

Pursuant to the Law on Organization of the Government dated December 25, 2001;

Pursuant to Decree No. 170/2004/NĐ-CP dated September 22, 2004 of the Government on the reorganization, renovation, and development of state-owned agricultural enterprises;

Pursuant to Decree No. 200/2004/NĐ-CP dated December 3, 2004 of the Government on the reorganization, modernization, and development of state-owned forest enterprises;

Considering the proposal of the Minister of Agriculture and Rural Development and the Chairman of the People's Committee of Quang Binh Province,

DECISION:

Article 1. Approves the Plan for the reorganization, renovation, and development of state-owned agricultural and forestry enterprises under the People's Committee of Quang Binh Province, as follows:

1. Maintain the status quo to continue consolidating and enhancing the business efficiency of the Lien Ninh Company and the Viet Trung Rubber Company. The People's Committee of Quang Binh Province shall direct the shareholding reform of the processing and service units of these two companies.

2. Maintain the status quo of the Long Dai Forestry Industry Company, and reorganize the forestry enterprises and units directly under this company as follows:

a) Maintain the status quo of the Truong Son, Khe Giua, Rung Thong, Dong Hoi, and Kien Giang forestry enterprises as dependent accounting units of the Company.

b) Convert the Baren and Long Dai forestry enterprises into the Baren Protective Forest Management Board and the Long Dai Protective Forest Management Board, respectively, and transfer these boards to provincial management.

c) Separate the protective forest land of the Kien Giang Forestry Enterprise to establish the Dong Chau Protective Forest Management Board and transfer it to provincial management.

d) Implement shareholding reform, wherein the Long Dai Forestry Industry Company retains controlling shares in the following units: - The Resin Processing Plant; - Merge the Dong Hoi Wood Processing Enterprise, Nam Long Wood Processing Enterprise, and the Timber and Forestry Products Trading Enterprise into one unit and implement shareholding reform; - Merge the Timber Extraction and Transportation Enterprise and the Forestry Road Construction Enterprise into one unit and implement shareholding reform.

3. Maintain the status quo of the Bac Quang Binh Forestry Industry Company, and reorganize the forestry enterprises and units directly under this company as follows:

a) Maintain the status quo of the Minh Hoa, Bo Trach, Bong Lai, and Quang Trach forestry enterprises as dependent accounting units of the Company.

b) Convert the Tuyen Hoa Forestry Enterprise into the Tuyen Hoa Protective Forest Management Board and transfer it to provincial management.

c) Transfer the Quang Trach, Thanh Lam, and Minh Hoa Protective Forest Management Boards to provincial management.

d) Dissolve the Cao Quang Forestry Enterprise.

e) Implement shareholding reform by 2007: the Ba Don Export Wood Processing Plant, the Forestry Construction Machinery Enterprise, and the Forestry Seedling and Materials Enterprise.

Article 2. Chairman of the People's Committee of Quang Binh Province:

1. Direct the implementation of the reorganization, renovation, and development of state-owned agricultural and forestry enterprises as stipulated in Article 1 of this Decision.

2. Decide to adjust the area and boundaries of various types of land allocated to the companies and protective forest management boards in accordance with the local agricultural and forestry development plan and the individual forest development plans of each forestry enterprise.

Article 3. The Ministries of Agriculture and Rural Development, Finance, Planning and Investment, Labor, Invalids and Social Affairs, Home Affairs, Natural Resources and Environment, and related agencies shall cooperate with the People's Committee of Quang Binh Province in implementing this Plan.

The Ministry of Agriculture and Rural Development shall be responsible for monitoring the implementation of this Decision.

Article 4. This Decision takes effect fifteen days from the date of publication in the Official Gazette.

The Chairman of the People's Committee of Quang Binh Province and the heads of related agencies are responsible for enforcing this Decision./.
