THE MINISTER OF POSTS AND TELECOMMUNICATIONS

Pursuant to the Ordinance on Posts and Telecommunications dated May 25, 2002;

Pursuant to Decree No. 24/2004/NĐ-CP dated January 14, 2004 of the Government detailing implementation of certain provisions of the Ordinance on Posts and Telecommunications regarding radio frequencies;

Pursuant to Decree No. 90/2002/NĐ-CP dated November 11, 2002 of the Government stipulating functions, tasks, powers, and organizational structure of the Ministry of Posts and Telecommunications;

Pursuant to Decision No. 85/1998/QĐ-TTg dated April 16, 1998 of the Prime Minister approving the "Radio Frequency Spectrum Planning for Vietnam's Communication Services";

Considering the proposal of the Director of the Radio Frequency Management Department,

DECISION:

Article 1. Issuing along with this Decision the "Frequency Band Allocation Plan for FM Radio Broadcasting (87 - 108) MHz until 2010" with the main contents as follows:

I. OBJECTIVES

The frequency band allocation plan for FM radio broadcasting stations (87 - 108) MHz until 2010 aims at:

1. Defining the frequency band and channel allocation for FM radio broadcasting.

2. Allocating channels to FM radio broadcasting stations to meet reasonable frequency usage needs for national and local radio programs until 2010.

II. PRINCIPLES OF PLANNING

1. Enhancing the efficiency of radio frequency spectrum utilization, minimizing interference.

2. Ensuring no impact on security, defense communication systems and aviation.

3. Being consistent with international regulations on frequency allocation for various radio communication services by the International Telecommunication Union (ITU) and other international treaties, and Vietnamese regulations.

4. Establishing channel allocation standards, frequency allocation tables, and reasonable emission regulations suitable for FM broadcasting characteristics and Vietnam's topography.

5. Taking into account the current state of FM broadcasting in Vietnam to reduce costs when transitioning from the current situation to the planning.

6. Reserving specific frequency channels for future special FM broadcasting programs.

III. SCOPE AND APPLICABLE SUBJECTS

1. Scope of application: This plan applies to FM radio broadcasting (87 - 108) MHz until 2010.

a) FM broadcasting stations of the Voice of Vietnam Radio.

b) FM broadcasting stations of provincial and centrally-administered city radio and television stations licensed by the Ministry of Culture and Information.

c) Test broadcasting stations, special program broadcasting stations, small power broadcasting stations aimed at rebroadcasting Voice of Vietnam Radio programs, provincial and centrally-administered city radio and television station programs, and district (town), commune (ward) radio stations, and stations of organizations and businesses not specified in this plan but assigned specific frequencies based on non-harmful interference to stations within the plan and other radio communication systems.

IV. CONTENTS OF THE PLAN

The frequency band allocation plan for FM radio broadcasting (87 - 108) MHz until 2010 includes:

1. Defining the frequency band and channel allocation for FM radio broadcasting.

2. Allocating channels, transmission power, and antenna height for broadcasting points of the Voice of Vietnam Radio and provincial and centrally-administered city radio and television stations. The specific contents of the plan are detailed in three appendices attached to this Decision.

V. IMPLEMENTATION OF THE PLAN

1. The Radio Frequency Management Department (Ministry of Posts and Telecommunications) shall be responsible for:

a) Promoting and guiding the implementation of this plan.

b) Based on the plan, current status, and plans for shared frequency band usage of other services, assigning frequencies, issuing frequency usage permits, and wireless transmission equipment permits according to the law.

2. Radio stations already issued frequency usage permits and wireless transmission equipment permits that are inconsistent with the plan must have transition plans as follows:

a) In cases affecting the plan, they must immediately switch to the allocated frequency channel; if the equipment cannot be switched immediately, necessary technical measures must be applied to ensure no harmful interference is caused, but they must switch to the planned frequency channel within the time limit specified in point b, clause 2 of this section.

b) In cases where there is no impact on other operating stations or those about to be deployed according to the plan and other radio communication systems, they may continue operations until the end of the equipment depreciation period, but not exceeding three years from the date the plan becomes effective.

c) When switching to the allocated frequency channel according to the plan, FM radio stations must apply for frequency usage permits and wireless transmission equipment permits according to the law.

3. Any adjustments to the plan (if any) to align with international treaties to which Vietnam is a party and Vietnamese policies and plans after approval, will be part of the plan and implemented according to the provisions of points 1 and 2 of this section.

Article 2. This Decision takes effect fifteen days from the date of publication in the Official Gazette.

Article 3. The Head of the Office, the Director of the Radio Frequency Management Department, Heads of agencies and units under the Ministry of Posts and Telecommunications, relevant organizations and individuals are responsible for implementing this Decision.
