ORDINANCE
Amending and supplementing certain Articles of the Ordinance
benefits for those who have rendered meritorious service to the revolution
___________________
Pursuant to the Constitution of the Socialist Republic of Vietnam promulgated in 1992, amended and supplemented by Resolution No. 51/2001/QH10 dated December 25, 2001 of the 10th National Assembly, 10th session;
This Ordinance amends and supplements certain Articles of the Ordinance on Benefits for Those Who Have Rendered Meritorious Service to the Revolution which was adopted by the Standing Committee of the National Assembly on June 29, 2005.
Article 1. Amending and supplementing Article 9 and Article 10 of the Ordinance on Benefits for Those Who Have Rendered Meritorious Service to the Revolution:
Organizations and individuals involved in handling accidents in port waters and shipping channels shall follow Circular No. 27/2012/TT-BGTVT dated July 20, 2012 issued by the Minister of Transport on reporting and investigating maritime accidents. In cases where a vessel encounters an incident or accident that cannot be resolved within 30 minutes, it must immediately report to the Maritime Search and Rescue Coordination Center for rescue operations or assistance."
"Article 9.
1. A person who engaged in revolutionary activities before January 1, 1945 is recognized by competent authorities as having participated in revolutionary organizations before January 1, 1945.
2. The preferential benefits for persons who engaged in revolutionary activities before January 1, 1945 include:
a) Monthly allowances and monthly subsidies;
b) Health insurance; recuperation and health recovery; provision of assistive devices and necessary orthopedic equipment;
c) Subscription to the People's Newspaper; cultural and spiritual activities appropriate to their circumstances;
d) State support for improving housing conditions based on their contributions and individual circumstances.
3. Preferential benefits when persons who engaged in revolutionary activities before January 1, 1945 die include:
a) If a person who engaged in revolutionary activities before January 1, 1945 dies while enjoying the preferential benefits stipulated in Clause 2 of this Article, the organization responsible for burial shall receive a lump sum allowance and funeral expenses;
b) If a person who engaged in revolutionary activities before January 1, 1945 has died without enjoying the preferential benefits stipulated in Clause 2 of this Article, relatives shall receive a one-time allowance;
c) Parents, spouse, or children of a person who engaged in revolutionary activities before January 1, 1945 shall receive monthly pension allowances.
The Government shall specify in detail the preferential benefits stipulated in this clause.
4. Children of persons who engaged in revolutionary activities before January 1, 1945 shall be given priority in admission and employment, and shall enjoy preferential treatment in education and training.
5. Persons who have been recognized and are receiving the preferential benefits stipulated in Article 9 of this Ordinance shall not be subject to the provisions of this Article."
2. Article 10 is amended and supplemented as follows:
"Article 10.
1. A person who engaged in revolutionary activities from January 1, 1945 to before the August 19, 1945 General Uprising is recognized by competent authorities as having headed a mass organization at the commune level or having been detached to engage in revolutionary activities from January 1, 1945 to before the August 19, 1945 General Uprising.
2. The preferential benefits for persons who engaged in revolutionary activities from January 1, 1945 to before the August 19, 1945 General Uprising include:
a) Monthly allowances;
b) Health insurance; recuperation and health recovery; provision of assistive devices and necessary orthopedic equipment;
c) Subscription to the People's Newspaper; cultural and spiritual activities appropriate to their circumstances;
d) Support for improving housing conditions based on their contributions and individual circumstances, within the capacity of the State and localities.
3. Preferential benefits when persons who engaged in revolutionary activities from January 1, 1945 to before the August 19, 1945 General Uprising die include:
a) If a person who engaged in revolutionary activities from January 1, 1945 to before the August 19, 1945 General Uprising dies while enjoying the preferential benefits stipulated in Clause 2 of this Article, the organization responsible for burial shall receive a lump sum allowance and funeral expenses;
b) If a person who engaged in revolutionary activities from January 1, 1945 to before the August 19, 1945 General Uprising has died without enjoying the preferential benefits stipulated in Clause 2 of this Article, relatives shall receive a one-time allowance;

Article 2. This Ordinance shall take effect from October 1, 2007./.
