PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation and Applicability

1. This Circular stipulates the job code, qualification standards, and appointment and classification of pay according to job titles for specialized civil servants in occupational safety and health technical inspection.

2. This Circular applies to specialized technical safety inspection staff working in public service units providing technical safety inspection services for various types of machines, equipment, and materials with strict requirements for occupational safety.

Article 2. Code and Classification of Occupational Titles for Specialized Technical Safety Inspection Staff in the Occupational Field

1. Senior Technical Safety Inspector (Class II), code: V.09.03.01.

2. Technical Safety Inspector (Class III), code: V.09.03.02.

3. Technical Safety Inspection Technician (Class IV), code: V.09.03.03.

Article 3. General ethical standards for specialized civil servants in occupational safety and health technical inspection

Objectively, carefully, seriously, and responsibly towards assigned tasks; actively participate in scientific research to develop the profession; comply with the rights and obligations of public officials as prescribed in the Public Official Law and other relevant laws related to technical safety inspection activities during the performance of duties.

Chapter II

OCCUPATIONAL STANDARDS

Article 4. Senior Technical Safety Inspector (Class II) - Code: V.09.03.01

1. Duties:

a) Lead the summary, evaluation, and distillation of experience regarding technical safety inspection work within the assigned scope. Propose issues that need revision and supplementation in inspection procedures, technical standards, and regulations to improve national regulations;

b) Lead or participate in compiling content, programs, and materials for training managers on technical management principles and operational management, operational procedures, and technical incident handling measures, and preventive measures for inspected objects according to current technical safety standards; participate in compiling programs, materials, and training technical safety inspectors when assigned;

c) Lead or participate in scientific and technological tasks related to occupational safety and health technical inspection within the assigned scope;

d) Perform accident investigation tasks for incidents caused by inspected objects when required;

đ) Develop and implement technical safety inspection plans for occupational safety and health according to the authority granted;

e) Organize and directly conduct technical safety inspections for various types of machines, equipment, and materials with strict occupational safety requirements, personally responsible for inspection results. Evaluate the inspection process, propose measures to ensure safety to prevent incidents and accidents caused by inspected objects;

g) Participate in drafting, compiling, and contributing opinions on technical safety standards and regulations at the request of competent authorities, develop technical safety and labor hygiene measures when required.

2. Qualifications regarding education and training:

a) Graduated from university or higher in relevant technical fields suitable for the scope of inspection work;

b) Possess foreign language proficiency level 3 as prescribed in Circular No. 01/2014/TT-BGDĐT dated January 24, 2014 of the Ministry of Education and Training on the six-level foreign language proficiency framework for Vietnam;

c) Possess computer skills meeting the basic standard for information technology usage as prescribed in Circular No. 03/2014/TT-BTTTT dated March 11, 2014 of the Ministry of Information and Communications on the Standard for Information Technology Usage Skills;

d) Hold a certificate for training in the occupational title of Senior Technical Safety Inspector (Class II).

3. Qualifications regarding professional expertise and skills:

a) Have the ability to lead and implement technical safety inspection business activities and propose solutions to enhance the effectiveness of implementation of activities in the inspection field;

b) Have the ability to coordinate with related organizations and individuals during the implementation of technical inspection activities;

c) Have the ability to guide technical inspection activities in accordance with the trained field;

d) Have led at least one provincial or ministerial-level scientific and technological task related to technical safety inspection and achieved satisfactory results, or participated in at least two such tasks and achieved satisfactory results.

4. Promotion to the position of Senior Technical Safety Inspector (Class II).

A public official promoted from the position of Technical Safety Inspector (Class III) to Senior Technical Safety Inspector (Class II) must meet all the provisions of Articles 2 and 3 of this Circular and have held the position of Technical Safety Inspector (Class III) or equivalent for a minimum of nine years, including at least two years in the most recent period holding the position of Technical Safety Inspector (Class III).

Article 5. Occupational Safety and Health Technical Inspector (Class III) - Code: V.09.03.02

1. Duties:

a) Establish or participate in establishing inspection plans for specific inspection objects within their assigned specialty, in accordance with the division of labor;

b) Directly carry out inspection of machines, equipment, materials with strict requirements for occupational safety and health, and be personally responsible for the inspection results; provide technical safety advice to entities using machines, equipment, and materials with strict requirements for occupational safety and health within the assigned scope.

c) Participate in scientific and technological tasks related to technical safety inspection within the assigned scope;

d) Participate in compiling training manuals and organizing occupational safety and hygiene training, as well as training for managers and workers operating objects with strict requirements for occupational safety and health, in accordance with the assigned inspection scope.

đ) Participate in compiling programs, documents, and training for technical inspector vocational skills when assigned;

2. Qualifications regarding education and training:

a) Graduated from university or higher in relevant technical fields suitable for the scope of inspection work;

b) Possess a level 2 foreign language proficiency as stipulated in Circular No. 01/2014/TT-BGDDT dated January 24, 2014 issued by the Ministry of Education and Training on the six-level foreign language proficiency framework for Vietnam.

c) Possess computer skills meeting the basic standard for information technology usage as prescribed in Circular No. 03/2014/TT-BTTTT dated March 11, 2014 of the Ministry of Information and Communications on the Standard for Information Technology Usage Skills;

d) Hold a certificate as an Occupational Safety and Health Technical Inspector.

đ) Hold a certificate for vocational title training of Occupational Safety and Health Technical Inspector (Class III).

3. Qualifications regarding professional expertise and skills:

a) Possess the ability to work independently and perform inspection technical safety operations within the assigned scope consistent with the trained specialty;

b) Have the ability to grasp and apply advanced methods and technologies during the implementation of tasks related to occupational safety and health technical inspection work in accordance with the trained specialty.

c) Possess the ability to lead coordination with organizations and individuals during the execution of assigned technical safety inspection tasks consistent with the trained specialty;

d) Possess the ability to guide vocational skills, disseminate experience, and participate in scientific research serving technical safety inspection work;

đ) Recognize potential hazards and establish preventive measures against accidents while performing inspection tasks.

4. Promotion to the position of Occupational Safety and Health Technical Inspector (Class III).

A civil servant promoted from the position of Occupational Safety and Health Technical Inspector (Class IV) to the position of Occupational Safety and Health Technical Inspector (Class III) must meet all the provisions set forth in Clauses 2 and 3 of this Article and have held the position of Occupational Safety and Health Technical Inspector (Class IV) for the following periods:

a) At least two years for those initially recruited into the position of Occupational Safety and Health Technical Inspector (Class IV) with a college degree.

b) At least three years for those initially recruited into the position of Occupational Safety and Health Technical Inspector (Class IV) with a secondary vocational degree.

Article 6. Occupational Safety and Health Technical Inspector (Class IV) - Code: V.09.03.03

1. Duties:

a) Perform specific tasks within the inspection process of machines, equipment, and materials with strict requirements for occupational safety and health under the direction and supervision of an Occupational Safety and Health Technical Inspector (Class III).

b) Propose measures to improve the quality of technical safety inspection work;

c) Timely identify defects in inspection equipment and tools, propose remedial measures to ensure inspection quality;

d) Bear direct responsibility for conclusions at specific inspection steps according to the assignment;

2. Qualifications regarding education and training:

a) Graduated from a secondary vocational school or higher in a technical field.

b) Possess a level 1 foreign language proficiency as stipulated in Circular No. 01/2014/TT-BGDDT dated January 24, 2014 issued by the Ministry of Education and Training on the six-level foreign language proficiency framework for Vietnam.

c) Possess computer skills meeting the basic standard for information technology usage as prescribed in Circular No. 03/2014/TT-BTTTT dated March 11, 2014 of the Ministry of Information and Communications on the Standard for Information Technology Usage Skills;

d) Hold a certificate for vocational title training of Occupational Safety and Health Technical Inspector (Class IV).

3. Qualifications regarding professional expertise and skills:

a) Possess the ability to work independently, proactively, and collaboratively in groups during the execution of technical safety inspection tasks;

b) Proficiently use tools and equipment for occupational safety and health inspections; understand the principles and structure of such tools and equipment; be familiar with the inspection procedures and relevant technical standards and regulations concerning the assigned inspection objects; understand regulations on electrical, mechanical, pressure vessel safety, and fire prevention and control.

Chapter III

APPOINTMENT AND SALARY GRADING ACCORDING TO PROFESSIONAL TITLES

CIVIL SERVANT TECHNICAL INSPECTION SPECIALTY

OCCUPATIONAL SAFETY AND HEALTH

Article 7. Principles for Appointment to Professional Titles

1. The appointment to professional titles for technical safety and health inspectors must be based on the current job position, responsibilities, and specialized vocational qualifications of the inspector, in accordance with Article 8 of this Joint Circular.

2. When appointing from the current rank to the corresponding professional title of technical safety and health inspector, it shall not combine with salary grade promotion or professional title advancement.

Article 8. Cases for Appointment to Professional Positions in the Technical Safety and Labor Inspection Specialty

1. Appoint to the professional title of Senior Technical Safety and Health Inspector (Grade II, code: V.09.03.01) for those currently holding the rank of Senior Technical Safety and Health Inspector, rank code 24.275.

2. Appoint to the professional title of Technical Safety and Health Inspector (Grade III, code: V.09.03.02) for those currently holding the rank of Technical Safety and Health Inspector, rank code 24.276.

3. Appoint to the professional title of Technical Safety and Health Inspection Technician (Grade IV, code: V.09.03.03) for those currently holding the rank of Technical Safety and Health Inspection Technician, rank code 24.277.

Article 9. Salary Grading Method

1. The professional titles of technical safety and health inspectors shall apply the salary scale for professional and vocational staff in state-run units (Scale 3) issued together with Decree No. 204/2004/NĐ-CP dated December 14, 2004 of the Government on salary regulations for civil servants, public officials, and armed forces personnel, as follows:

a) The professional title of Senior Technical Safety and Health Inspector (Grade II) shall apply the salary coefficient of Group A2 Level 1 (from coefficient 4.40 to 6.78) for officials.

b) The professional title of Technical Safety and Health Inspector (Grade III) shall apply the salary coefficient of Group A1 (from coefficient 2.34 to 4.98) for officials.

c) The professional title of Technical Safety and Health Inspection Technician (Grade IV) shall apply the salary coefficient of Group B (from coefficient 1.86 to 4.06) for officials.

2. Determination of salary upon completion of the probation period and appointment to a professional position:

a) In case of having a doctoral degree, they shall be assigned to Grade 3, coefficient 3.00 of the professional title of Technical Safety and Health Inspector (Grade III), code: V.09.03.02;

b) In case of having a master's degree, they shall be assigned to Grade 2, coefficient 2.67 of the professional title of Technical Safety and Health Inspector (Grade III), code: V.09.03.02;

c) In case of having a college degree, they shall be assigned to Grade 2, coefficient 2.06 of the professional title of Technical Safety and Health Inspection Technician (Grade IV), code: V.09.03.03.

3. The appointment and assignment of salaries to professional titles of officials as stipulated in Article 8 and Clause 1 of this Article for officials who have been assigned salaries according to the ranks of technical safety and health inspectors as prescribed in Circular No. 05/2009/TT-BNV dated May 11, 2009 of the Ministry of Home Affairs on professional titles and rank codes for technical safety and health inspectors; Decree No. 204/2004/NĐ-CP dated December 14, 2004 of the Government on salary regulations for civil servants, public officials, and armed forces personnel (hereinafter referred to as Decree No. 204/2004/NĐ-CP); and Decree No. 17/2013/NĐ-CP dated December 19, 2013 of the Government amending and supplementing certain articles of Decree No. 204/2004/NĐ-CP dated December 14, 2004 of the Government shall be implemented as follows:

a) In cases where officials meet the conditions for appointment to professional titles of technical safety and health inspectors and have the same salary coefficient and grade as their previous rank, they shall be assigned the same grade and percentage of seniority allowance exceeding the ceiling (if any) enjoyed at the previous rank (including the time for considering salary grade promotion or enjoying seniority allowance exceeding the ceiling if any at the previous rank) to the newly appointed professional title.

Example: Mr. Nguyen Van A has been assigned the rank of Technical Safety and Health Inspection Technician (code 24.277) Grade 4, coefficient 2.46 since February 1, 2013. Now, Mr. A meets the conditions and is appointed by the competent authority to the professional title of Technical Safety and Health Inspection Technician (Grade IV, code V.09.03.03). He shall be assigned Grade 4, coefficient 2.46 of the professional title of Technical Safety and Health Inspection Technician (Grade IV) from the date of the decision; the time for considering salary grade promotion shall be calculated from February 1, 2013.

b) In cases where officials meet the conditions for appointment to professional titles of technical safety and health inspectors and have a lower salary coefficient and grade than their previous rank, the assignment of salaries to grades within the professional titles of officials shall be based on the time of social insurance contributions according to the salary scale prescribed by the State (excluding probationary period) to be assigned to the grade within the newly appointed professional title as follows:

Starting from Grade 1 of the newly appointed professional title, every three years (36 months) for the professional titles of Senior Technical Safety and Health Inspector (Grade II) and Technical Safety and Health Inspector (Grade III), and every two years (24 months) for the professional title of Technical Safety and Health Inspection Technician (Grade IV) (if there is a break in service without enjoying social insurance benefits, the time can be accumulated) shall be assigned to one grade of the newly appointed professional title. In cases where there is a year during the term of service in which the tasks assigned are not completed or disciplinary action is taken, the time for considering salary grade promotion shall be extended according to the regular salary grade promotion system of the newly appointed professional title.

After transferring the salary grade to the occupational title position appointed according to this provision, if the salary coefficient assigned at the occupational title position plus any seniority allowance exceeding the ceiling (if applicable) is lower than the salary coefficient already enjoyed at the old rank, then the difference retention coefficient shall be enjoyed to equalize with the salary coefficient (including any seniority allowance exceeding the ceiling, if applicable) currently enjoyed at the old rank. The retention difference coefficient shall be enjoyed throughout the entire period during which the civil servant is assigned a salary at the new occupational title position. Subsequently, if the civil servant is further promoted to a higher occupational title position, the retention difference coefficient will be added to the current salary coefficient (including any seniority allowance exceeding the ceiling, if applicable) to determine the salary for the newly appointed occupational title position upon promotion, and the retention difference coefficient will cease to be enjoyed from the date the salary for the new occupational title position begins.

Example: Ms. Tran Thi B was recruited to work at Center C and has been contributing to the mandatory social insurance since January 1, 2008 until now. She was assigned to the Technical Safety Inspector rank (code 24.276) level 3, with a salary coefficient of 3.00 starting from January 1, 2015. During her tenure, she consistently fulfilled her assigned tasks and was not disciplined. Now that Ms. B meets the conditions and is authorized by the competent authority to be appointed to the Occupational Title of Level IV Technical Safety Inspector (code V.09.03.03), the salary assignment will be carried out as follows:

Ms. Tran Thi B's service time from January 1, 2008, excluding the six-month probationary period, and every two years advancing one level, she was assigned to level 4, with a salary coefficient of 2.46 of the Occupational Title of Level IV Technical Safety Inspector (code V.09.03.03) on July 1, 2014; the new salary level at the Occupational Title of Technical Safety Inspector will be effective from the date of signing the decision; the next salary increment review period will start from July 1, 2014; simultaneously, she will also enjoy the retention difference coefficient of 0.54 (3.00-2.46).

On July 1, 2016 (after two years), Ms. Tran Thi B meets the conditions for regular salary advancement to level 5, with a salary coefficient of 2.66 of the Occupational Title of Technical Safety Inspector, and continues to enjoy the retention difference coefficient of 0.54 (total salary coefficient enjoyed is 3.20).

4. Promotion of technical safety inspectors shall be implemented after being authorized by the competent authority to be appointed to the occupational title of technical safety inspector according to the provisions of this Circular and the salary assignment shall be carried out in accordance with the guidance provided in Clause 2, Section II, Circular No. 02/2007/TT-BNV dated May 25, 2007 issued by the Ministry of Home Affairs guiding salary assignment when upgrading ranks, transferring ranks, and changing types of civil servants.

Chapter IV

IMPLEMENTING PROVISIONS

Article 10. Effective Date

1. This Circular takes effect from October 31, 2015.

2. Repeal Circular No. 05/2009/TT-BNV dated May 11, 2009 issued by the Ministry of Home Affairs promulgating the occupational titles and code numbers of technical safety inspector ranks and Circular No. 18/2009/TT-BLDTBXH dated June 5, 2009 issued by the Ministry of Labor, Invalids and Social Affairs promulgating the professional standards of technical safety inspector ranks.

Article 11. Transitional Provisions

Civil servants who have been appointed to technical safety inspector ranks according to Circular No. 05/2009/TT-BNV dated May 11, 2009 issued by the Ministry of Home Affairs promulgating the occupational titles and code numbers of technical safety inspector ranks and Circular No. 18/2009/TT-BLDTBXH dated June 5, 2009 issued by the Ministry of Labor, Invalids and Social Affairs promulgating the professional standards of technical safety inspector ranks, and are now appointed to the occupational title of technical safety inspector as stipulated in this Joint Circular, the competent authority managing and using the civil servants shall create conditions for the civil servants to supplement the missing criteria of the appointed occupational title.

Article 12. Implementation Organization

1. Public service units shall base their recruitment, utilization, and management of the technical safety inspector workforce on the provisions of this Joint Circular.

2. Non-public sector organizations, institutions, and units may apply these provisions for recruitment, utilization, and management of personnel.

3. The heads of public technical safety and labor inspection units directly managing and utilizing specialists shall be responsible for:

a) Review job positions within the unit, develop a plan to appoint to the occupational title of technical safety inspector corresponding to the technical safety inspection unit under its management authority, submit to the competent authority for examination and decision-making or decide according to its authority;

b) Decide on the appointment of the occupational title for technical safety inspectors to the corresponding occupational title of technical safety inspector according to its authority or propose the competent authority to issue a decision on the appointment after the appointment plan for the occupational title is approved by the competent authority;

4. Ministries, agencies equivalent to ministries, agencies under the Government, People's Committees of provinces and centrally-administered cities are responsible for:

a) Direct subordinate units under its management to implement the appointment of occupational titles and salary assignment for technical safety inspectors in public technical safety inspection units;

b) Approve plans for the appointment of occupational titles and salary assignment for technical safety inspectors in public technical safety inspection units under its management authority from the current civil servant rank to the corresponding occupational title of technical safety inspector according to the provisions of this Circular; resolve issues within its authority during the process of appointing occupational titles and salary assignment;

c) Decide on the appointment of occupational titles and salary assignment for technical safety inspectors under its management to corresponding occupational titles of technical safety inspector in public technical safety inspection units according to its authority.

d) Report on the results of appointing occupational titles and grading salaries for technical safety and labor inspection professionals in public technical safety and labor inspection units under their management to be submitted to the Ministry of Labor, Invalids and Social Affairs and the Ministry of Interior.

Article 13. Responsibility for Implementation

1. The Minister, Heads of Ministries equivalent to ministries, Heads of government agencies; Chairpersons of provincial People's Committees under the Central Government and related agencies, organizations, and individuals shall be responsible for implementing this Joint Circular.

2. In the course of implementing this Joint Circular, if there are any difficulties, individuals and organizations are requested to reflect them to the Ministry of Labor, Invalids and Social Affairs for consolidation and coordination with the Ministry of Interior to consider and resolve them./.
