DECREE
Pursuant to the Government Organization Law on February 18, 2025;
At the proposal of the Minister of Agriculture and Rural Development;
The Government promulgates this Decree to stipulate the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development.
Article 1. Position and Functions
The Ministry of Agriculture and Rural Development is a governmental agency responsible for state management in the following areas: agriculture; forestry; salt industry; fisheries; irrigation; disaster prevention and control; rural development; land; water resources; mineral resources and geology; environment; meteorology and hydrology; climate change; surveying and mapping; comprehensive resource management and marine and island environmental protection; remote sensing; state management of public services within the scope of the ministry's jurisdiction.
b) Draft five-year and annual socio-economic development plans for the province; major economic and social balances for the province; draft five-year and annual plans, programs, projects, measures to organize and implement tasks related to socio-economic development, finance-budget, planning-investment, and other tasks within the scope of state management of the Department of Finance as prescribed by law;
The Ministry of Agriculture and Rural Development shall perform the tasks and powers prescribed in the Law on the Organization of the Government, the Government’s regulations on the functions, tasks, powers, and organizational structure of ministries and ministerial-level agencies, and the following specific tasks and powers:
1. Submit to the Government draft laws, draft resolutions of the National Assembly; draft ordinances, draft resolutions of the Standing Committee of the National Assembly; draft decrees, resolutions of the Government according to the annual legislative program and plan of the ministry that has been approved and other mechanisms, policies, projects, programs, normative legal documents within the scope of the ministry's state management as assigned by the Government.
2. Submit to the Government and the Prime Minister for approval and implementation of strategies, plans, programs, and important national projects within the scope of the ministry's management.
3. Submit to the Prime Minister draft decisions, directives, and other documents within the Prime Minister's authority to issue.
4. Approve strategies, plans, programs for the development of sectors and fields under the ministry's state management; investment projects according to the delegation and authorization of the Government and the Prime Minister.
5. Issue circulars, decisions, and other documents on state management of sectors and fields under the ministry's jurisdiction; direct, guide, organize the implementation and inspect the execution of strategies, policies, plans, programs, projects, tasks, normative legal documents under the ministry's jurisdiction after approval and issuance; establish national standards; develop and issue national indicators, national technical regulations, technical provisions, statistical indicators, economic-technical norms in sectors and fields under the ministry's state management; disseminate information, promote, popularize, educate the law, and enhance community awareness about sectors and fields under the ministry's state management.
6. On crop production and plant protection
a) Direct, guide, inspect crop production activities; the development of crop cultivation zones, safe agricultural product production; reduced emission crop production, circular economy crop production, climate change adaptation; plant protection and quarantine work; build a roadmap and guide the issuance of planting area codes and packaging facility codes nationwide in accordance with the law;
b) Direct, guide the use of the budget for disease prevention and control programs in plants;
c) Direct the implementation of crop structure; cultivation techniques, harvesting techniques; summarize and evaluate the implementation of the annual crop production plan; issue the plan for converting crop structures on rice-growing land nationwide;
d) Direct, guide organic crop production; agricultural crop varieties, fertilizers, and plant protection chemicals in accordance with the law.
7. On animal husbandry and veterinary medicine
a) Develop and submit to the Government for promulgation the list of livestock breeds to be preserved and prohibited from export; collect, preserve, exploit, and develop livestock genetic resources; set criteria and recognize safe disease-free breeding zones; direct, guide, organize the implementation of disease prevention, treatment, and epidemic control activities; inspect animals and animal products; supervise animal slaughter, preliminary processing, and processing of animal products; inspect veterinary hygiene; manage veterinary drugs; practice veterinary medicine;
b) Direct, guide the use of the budget for national disease prevention and control programs in animals;
c) Direct the implementation of livestock structure; animal husbandry techniques; summarize and evaluate the implementation of the annual animal husbandry production plan;
d) Direct, inspect scientific research and application activities involving microorganisms used in veterinary medicine, chemicals used in veterinary medicine; research and production of veterinary vaccines, biological preparations used in veterinary medicine;
đ) Direct, guide, inspect, supervise the implementation of state management tasks regarding livestock breeds and livestock products, animal feed, breeding conditions, and livestock waste treatment; animal husbandry and other animals, humane treatment of livestock.
8. On forestry
a) Direct, guide, inspect the implementation of the Government and Prime Minister's regulations on mechanisms and policies for forestry development; special-use forest management regulations, protective forest management regulations, productive forest management regulations; management and protection systems for rare, precious, and endangered wild plant and animal species and lists of such species; enforcement of international conventions on the trade of endangered wild flora and fauna as prescribed by law;
b) Manage the special-use forest system, protective forest system, productive forest system; protect forest ecosystems and forest species;
c) Submit to the Prime Minister for approval of the national forestry planning; establish national-level protective forests and special-use forests of significant importance or located across multiple provinces; direct, guide central cities and provinces in establishing special-use forests and protective forests;
d) Direct, guide, inspect the conversion of forest types, changes in the purpose of use of special-use forests, protective forests, productive forests to other purposes as prescribed by law;
đ) Direct, guide forest inspection work in accordance with the law;
e) Organize the implementation of tasks related to forest fire prevention and firefighting; organize specialized forces for forest fire prevention and firefighting;
g) Direct, guide, and inspect production activities in forestry, agriculture, and aquaculture combined with cultivation and development of non-timber forest products and medicinal plants in various types of forests in accordance with the provisions of the law; take the lead in coordinating with ministries and equivalent agencies to conduct investigations, evaluations, collection, preservation of endemic or valuable microorganisms and fungi species threatened with extinction in various types of forests to include them in the list of endangered and precious species prioritized for protection;
h) Direct, guide, and inspect the organization of eco-tourism, resort, and entertainment activities in special-use forests, protective forests, and production forests in accordance with the provisions of the law;
i) Direct, guide, and inspect the implementation of policies on payment for forest environmental services and carbon absorption and retention services in forests in accordance with the provisions of the law; manage the Vietnam Forest Protection and Development Fund; guide the management and operation of provincial-level forest protection and development funds;
k) Direct the implementation of state management tasks regarding forest management, forest protection, forest development, forest utilization; timber harvesting; organization of forestry production linked to processing and trading of timber products; guide and inspect the activities of issuing sustainable forest management certificates and forest valuation in accordance with the provisions of the law;
l) Direct and guide the development of forestry crop varieties; establish national seedling systems, national nurseries, and botanical gardens; prevent forest pests; research, select, test, quality control, produce, trade, and import/export forestry crop varieties;
m) Guide and inspect the allocation of forests, forest leasing, forest recovery, forest surveys, forest inventories, and forest monitoring; establish and manage forest databases;
n) Guide and implement national programs, projects, plans of action on reducing greenhouse gas emissions through efforts to reduce deforestation, forest degradation, sustainable forest management, and increase forest carbon stock (UN-REDD+);
9. Regarding salt industry
a) Direct, guide, and inspect the technical procedures for salt production, harvesting, preliminary processing, processing, storage, and annual production plan implementation summary and evaluation;
b) Inspect the implementation of national technical standards and procedures for salt production, processing, and storage, and salt product processing (excluding salt used in the medical field);
10. Regarding fisheries
a) Develop and submit to the Prime Minister for approval the planning for fishery resource conservation and exploitation; national system of fishing port planning; advise on the promulgation of regulations for marine protected areas by the Government;
b) Direct, guide, and inspect the implementation of laws concerning the management of endangered and precious aquatic species, fishery resource protection zones, and fishery resource management within wetland conservation areas;
c) Guide and inspect the implementation of laws concerning fishing ports, anchorage areas for fishing vessels to avoid storms; vessel safety management regulations, information for fishermen and fishing vessels to prevent natural disasters at sea; determine and allocate fishing quotas and allowable catch volumes by species in offshore waters for centrally-administered provinces according to the law;
d) Direct, guide, and inspect aquaculture activities; aquaculture procedures, techniques, and seasons; organize the preservation of original aquatic species and economically valuable indigenous aquatic species;
đ) Guide and inspect the implementation of the list of endangered and precious aquatic species; aquatic species that need protection and regeneration;
e) Direct, guide, and inspect the implementation of state management tasks regarding fishery seedlings and fish feed;
g) Direct and guide fishery inspection work in accordance with the provisions of the law;
11. Regarding water resources
a) Direct, guide, and inspect basic investigation work on irrigation, drainage, and flood control (excluding urban stormwater drainage and wastewater treatment, rural concentrated residential areas, production, business, service clusters, industrial clusters, and industrial parks); investment in construction, repair, and upgrading of irrigation works and rural clean water facilities; operation of irrigation reservoirs and irrigation works in accordance with the provisions of the law;
b) Direct, guide, and inspect the establishment, submission for approval, and implementation of irrigation planning serving agriculture and multi-purpose purposes tied to economic and social sectors in accordance with the provisions of the law;
c) Direct, guide, and inspect technical procedures and policies on irrigation and drainage; management of irrigation and drainage works; management of irrigation infrastructure assets; guide and inspect the implementation of regulations on discharging wastewater into irrigation works;
d) Guide and inspect the establishment of irrigation network development plans in provincial planning in accordance with the provisions of the law;
đ) Direct, guide, and inspect the implementation of measures to prevent, combat, and mitigate the consequences of drought, salinity intrusion, flooding, desertification; organize monitoring, forecasting, and warning about drought, salinity intrusion, flooding, quantity, and quality of water in the irrigation works system in accordance with the provisions of the law;
e) Direct, guide, and inspect the protection plan for irrigation works and the scope of protection for irrigation works;
g) Direct, guide, and inspect the establishment of plans for the construction, management, use, and protection of rural water supply and drainage works;
h) Organize the establishment and review of disaster prevention and mitigation and irrigation planning submitted to the Prime Minister for approval; guide and inspect the implementation of such planning after approval by competent authorities;
i) Direct, guide, inspect basic investigations, strategies, planning for irrigation; organize inventory of water resources within irrigation works combined with drought, water shortage, saline intrusion, desertification, flood, inundation, waterlogging forecasts; invest in building irrigation works to store, supply, irrigate, drain, and discharge water for agricultural production, daily life, and other economic sectors; prevent and mitigate adverse impacts caused by natural disasters related to water, prevent water pollution in irrigation works under the management scope of the Ministry as prescribed by law;
k) Direct, guide dam safety and reservoir water storage according to the provisions of law.
12. On dyke and flood control management
a) Direct, guide, inspect the implementation of legal regulations on mechanisms, human resources, materials, equipment, information systems, essential supplies for disaster prevention and response;
b) Guide, inspect the construction and organization of implementation of disaster prevention and response plans and emergency response plans; inspect disaster prevention and response plans in local socio-economic development projects and programs;
c) Direct, guide, inspect, urge post-disaster recovery and reconstruction activities according to laws and international treaties Vietnam has joined; compile, evaluate, statistics, and publish data on losses caused by natural disasters; guide, inspect the implementation of monitoring and supervision of activities related to infrastructure and disaster prevention and response measures; monitor, analyze, and evaluate potential losses from natural disasters that may affect Vietnam as prescribed by law;
d) Direct, guide the construction and improvement of effectiveness of grassroots disaster prevention and response forces and people's dyke management forces;
đ) Direct, guide planning for flood prevention along river dykes; dyke planning; investment construction, repair, upgrading, reinforcement, protection, utilization of dykes and embankments according to legal provisions;
e) Manage investment in construction, repair, and protection of disaster prevention and response infrastructure including dyke and reservoir structures, flood drainage, drought resistance, landslide prevention, anchorage areas for storm shelters for vessels, and other facilities serving disaster prevention and response as prescribed by law;
g) Organize management of the Disaster Prevention and Response Fund.
13. On rural development
a) Direct the formulation and implementation of policies for rural development in fields under the Ministry’s jurisdiction; organize the implementation of the national target program for new-style rural areas; the program of action to eliminate hunger in Vietnam as assigned by the Government;
b) Aggregate and submit to the Prime Minister for approval comprehensive plans and programs for rural development; strategies for developing rural industries and crafts linked to households and agricultural cooperatives; issue policies encouraging the development of rural industries and preserving and developing traditional crafts;
c) Organize and inspect the implementation of programs, mechanisms, and policies for the development of agricultural machinery and rural industries and crafts linked to households, cooperatives, and agricultural cooperative unions after approval by competent authorities; direct the formulation and implementation of support programs, projects for organizing production, developing rural industries and crafts according to legal provisions;
d) Guide and inspect the implementation of resettlement plans for rural residents affected by irrigation and hydropower projects; stable resettlement of residents in disaster-prone, particularly difficult, border, island, coastal areas, regions affected by rising sea levels due to climate change, spontaneous migration, weakly protected forest areas, and very weakly protected special-use forests; direct, guide, and inspect the implementation of permanent settlement and population distribution in rural areas, ethnic minority and mountainous regions;
đ) Direct, guide, and inspect the organization of vocational training for rural laborers; procedures for confirming natural disasters and diseases in implementing agricultural insurance support policies as prescribed by law;
e) Direct, guide, and inspect rural technical infrastructure construction programs according to specialized legal provisions;
14. On food safety for agriculture, forestry, aquaculture, and salt
a) Direct, guide, inspect, and supervise the implementation of legal provisions on food safety for primary production of agriculture, forestry, aquaculture, and salt under the Ministry’s administrative management;
b) Direct, guide, inspect, and supervise the implementation of legal provisions on food safety during production, collection, slaughter, processing, preservation, transportation, export, import, trade of products, groups of products, foods, goods, and food production and trading establishments as assigned by the Government;
c) Organize monitoring, evaluation of risks, warning, prevention, blocking, and remediation of food safety incidents for food products under its management; inspect and supervise the implementation of traceability, recall, and handling of unsafe food products under its management;
d) Designate food testing facilities for state management, verification testing facilities; make final conclusions when there are discrepancies in test results between designated testing facilities within the assigned management area;
đ) Manage food safety for wholesale markets and agricultural product auctions;
e) Designate state inspection agencies for imported food safety for products within the assigned management area;
g) Announce national lists of countries, regions, and production and trading establishments permitted to export to Vietnam within the assigned management area.
15. On quality management for crop seeds, livestock, poultry, livestock, tools, equipment, materials, products, services in agriculture, forestry, salt industry, and aquaculture
a) Implement and inspect the implementation of mechanisms, policies, strategies, plans, programs for the development and enhancement of product and commodity quality under the Ministry’s jurisdiction;
b) Enact a list of products and goods that have the potential to cause safety hazards (products and goods group 2) within the scope of the ministry's management.
c) Designate and manage the activities of organizations assessing product and good conformity within the scope of the ministry's management.
16. Regarding storage, processing, transportation of agricultural, forestry, and aquatic products
a) Submit to competent authorities for issuance of mechanisms, policies, strategies, programs, projects, and plans on processing, storage, and transportation of agricultural, forestry, and aquatic products.
b) Direct, guide, and inspect the implementation of strategies, projects, programs, mechanisms, and policies for developing the processing sector in conjunction with production and markets; support reduction of post-harvest losses for commodities under the ministry’s state management.
c) Guide, inspect, and supervise the implementation of regulations concerning conditions for primary processing, processing, storage, and transportation facilities for agricultural and forestry products and aquatic products within the scope of the ministry's management.
d) Guide and support enhancement of processing capacity for agricultural, forestry, and aquatic products.
17. Regarding agricultural, forestry, and aquatic product trade and salt
a) Implement negotiations to promote market opening for agricultural products; remove technical barriers in export and import of agricultural products; develop cooperation and linkage in production and consumption of agricultural products according to the government's division of labor.
b) Coordinate with the Ministry of Industry and Trade to draft, submit to competent authorities for issuance, and organize the implementation of programs and projects on promoting agricultural, forestry, and aquatic product trade, developing agricultural brand promotion; implement activities related to market analysis, promotion, and branding for agricultural, forestry, and aquatic products and salt within the scope of the ministry's management.
c) Enact specific lists of goods prohibited from import and export; lists of goods subject to specialized management by the ministry during export and import according to the law.
18. Regarding agricultural extension services
a) Guide and inspect the implementation of regulations concerning agricultural extension activities.
b) Develop plans and organize the implementation of central-level agricultural extension activities.
c) Submit to competent authorities for issuance or issue within authority policies on socializing agricultural extension activities and policies for cooperation with domestic and foreign organizations and individuals to attract capital and resources for agricultural extension activities.
19. Regarding cooperatives and other forms of collective and private economies
a) Submit to the Government for issuance of mechanisms and policies encouraging and supporting household economies, farms, cooperative groups, cooperatives, cooperative unions, and production linkages in sectors and fields under the ministry's state management.
b) Guide and inspect compliance with business and service regulations with conditions according to the list prescribed by the Government and handle violations within authority.
c) Direct and guide cooperative groups, cooperatives, cooperative unions, and farms in sectors and fields under the ministry's state management.
20. Regarding land
a) Guide and inspect the implementation of regulations concerning land surveying, rectification, land registry map creation, current land use status maps, land use planning maps, and specialized maps for land management and use.
b) Guide and inspect land statistics and inventory work; organize periodic land statistics and inventory; conduct special topic or emergency land statistics and inventory as prescribed by law.
c) Guide and inspect land investigation, evaluation, protection, improvement, and restoration work; organize land investigations and evaluations for regions and nationwide periodically and by special topics, announce results; organize land resource monitoring across the country; organize land protection, improvement, and restoration for heavily degraded inter-regional and inter-provincial areas and particularly severely polluted areas.
d) Guide and inspect the establishment, adjustment, and management of land use planning and plans; organize the establishment, adjustment, and announcement of national land use planning and plans; submit to the Prime Minister for allocation of national land use targets after the National Assembly decides; review defense land use planning, security land use planning, and provincial land use planning.
đ) Guide and inspect the implementation of land allocation, land lease, land recovery, recognition of land use rights, land requisition, change of land use purpose, land use right auction, and bidding for investors to implement projects using land.
e) Guide and inspect the implementation of land price investigation, construction of land price tables, specific land prices, and enforcement of laws on land prices.
g) Guide and inspect compensation, support, and resettlement when the State recovers land or requisitions land; development, management, and exploitation of land funds.
h) Guide and inspect land registration work, establishment, and management of land records; issuance, correction, recovery, cancellation of Land Use Right Certificates and certificates of ownership of attached assets; issuance and management of blank Land Use Right Certificates and certificates of ownership of attached assets.
i) Guide and inspect the construction, management, operation, and exploitation of the National Land Information System. Organize the construction, management, operation, and exploitation of the National Land Information System at the central level; build and update central-level land data; connect and share information from the national land database with the national public service portal, various information systems, databases of ministries, sectors, localities, and provide land information to organizations and individuals as prescribed by law.
k) Guide the implementation of the State's rights and responsibilities; users' rights and obligations; land use regimes according to the law. Build, manage, operate, and exploit the system for monitoring and evaluating land management and use; organize monitoring and evaluation of land management and use by centrally-administered cities and provinces and land use for important national projects as prescribed.
21. Regarding water resources
a) Direct and guide the management, protection, regulation, distribution, restoration, development, exploitation, and use of water resources; management of river basins and water sources according to the law.
b) Chair and coordinate with ministries, ministerial-level agencies, provincial People's Committees to implement measures to ensure water resource security;
c) Establish and adjust plans for water resources to be submitted to the Prime Minister for consideration and approval, and organize their implementation; approve partial adjustments to comprehensive river basin plans for inter-provincial rivers within the scope of authority;
d) Chair the development and publication of water supply scenarios for inter-provincial river basins; develop, organize the implementation, and report to the Prime Minister for consideration and decision on water resource allocation plans during droughts and water shortages as prescribed;
đ) Chair the development and adjustment of operating procedures for interconnected reservoirs in river basins, to be submitted to the Prime Minister for approval;
e) Develop and operate the National Water Resources Information System and databases, and decision-support tools for water resource allocation in river basins;
g) Develop plans, programs, and projects to restore depleted, exhausted, and polluted water sources, to be submitted to the Prime Minister for approval;
h) Implement solutions to protect, regulate, distribute, develop, store, and restore water resources, prevent and mitigate adverse effects caused by water, and other activities related to water resources to ensure water security;
i) Submit to the Government and the Prime Minister proposals for resolving issues related to transboundary water resources;
k) Guide and inspect the declaration, registration, issuance of permits for exploration, exploitation, and use of water resources, and approve preliminary rights to exploit water resources as prescribed;
22. Regarding Geology and Mineral Resources
a) Organize the establishment and submission to the Prime Minister for approval of the National Strategy on Geology, Mineral Resources, and Mining Industry; plans for geology and mineral resources according to laws on geology and mineral resources and the division of labor by the Government;
b) Organize the implementation and publication of results from basic geological surveys and mineral resource surveys within the scope of authority;
c) Organize the demarcation and publication of areas with geological heritage sites, geological parks, and small and scattered mineral deposits;
d) Submit to the Prime Minister for approval of national mineral reserve areas, non-auctioned mineral exploitation rights areas, and strategic and important mineral lists within the scope of permit issuance;
đ) Review project proposals, tasks, and reports on basic geological surveys, mineral resource surveys, and mineral exploration according to the law; manage reserves and confirm mobilized reserves for mining projects according to the law;
e) Organize auctions for mineral exploitation rights within the scope of permit issuance; determine fees for mineral exploitation rights, costs for returning the use of geological data, and valuation of geological and mineral resources according to the law;
g) Organize the registration of basic geological survey and mineral resource survey activities; statistics and inventory of geological resources and mineral reserves;
h) Approve closure plans and decide on mine closures within the scope of authority according to the law;
i) Organize inspections of compliance with exploration and mining permits, and control basic geological surveys and mineral resource surveys nationwide;
23. Regarding Environment
a) Guide the review and approval of environmental impact assessment reports; provide comments on strategic environmental assessments according to the law; organize the review of environmental impact assessment reports;
b) Direct, guide, inspect, and organize the implementation of pollution source control; waste management, environmental quality management; environmental remediation; prevention and response to environmental emergencies; rural environmental protection content and criteria according to the law;
c) Organize the construction, management, and operation of the national environmental monitoring network; approve and organize the implementation of environmental monitoring programs; provide information and warnings about environmental pollution according to the law;
d) Organize statistics, construction, maintenance, and operation of environmental information systems and databases; guide and organize the preparation and publication of current environmental status reports and national environmental thematic reports; guide and organize the preparation of environmental protection work reports according to the law;
đ) Organize the inclusion of environmental protection content in regional planning; guide the inclusion of environmental protection content in provincial planning and special administrative-economic unit planning; organize the preparation, submission for approval, publication, and implementation, and evaluation of the national environmental protection plan according to the law;
e) Guide ministries, sectors, and localities on professional matters and key tasks in environmental protection; compile and propose state budget allocations for environmental protection activities of ministries, ministerial-level agencies, and provincial People's Committees; guide the compilation, tracking, and publication of environmental protection funding sources;
g) Propose tax, fee policies for environmental protection, green bond issuance, and other economic instruments to mobilize and utilize resources for environmental protection according to the law; guide the determination of environmental damage and compensation claims;
h) Implement environmental protection work in fields under the Ministry's jurisdiction according to the law;
i) Organize the management of the Vietnam Environmental Protection Fund;
24. Regarding Nature Conservation and Biodiversity
a) Organize the establishment, submission for approval, publication, implementation, and evaluation of the implementation of the National Biodiversity Conservation Plan according to the law;
b) Direct, guide the establishment, management of natural heritage areas, nature reserves, marine protected areas, biodiversity corridors, high biodiversity areas, important wetlands, key ecological landscapes, biological conservation facilities;
c) Take the lead in organizing the preparation of projects, submit for approval the establishment, post-approval organization and management of natural heritage areas, nature reserves, biodiversity corridors, high biodiversity areas, important wetlands, key ecological landscapes, marine protected areas with an area spanning two or more provinces or centrally governed cities according to the provisions of the law;
d) Submit to competent authorities for issuance or issue within their authority the list and management regime for endangered, precious, rare species, and species prioritized for protection; guide biosafety management for genetically modified organisms and products thereof; establish a list and guide preventive measures against invasive alien species; guide access to genetic resources and sharing benefits from genetic resources, collection, storage of genetic resources, gene conservation according to the provisions of the law;
đ) Direct, guide classification, management, protection of natural landscapes, natural ecosystems; investigation, assessment, establishment, organization of review, issuance of lists and regimes for conservation and sustainable use, payment for ecosystem services for important wetlands; direct, guide access to landscapes, establishment, management, protection of important natural landscapes according to the provisions of the law;
e) Guide, organize basic surveys, monitoring, inventory, statistics, build databases, report on natural conservation and biodiversity according to the provisions of the law;
g) Guide, inspect activities related to registration, recognition, issuance, revocation of permits and certificates regarding natural conservation and biodiversity according to the provisions of the law.
25. On Meteorology and Hydrology
a) Manage, organize meteorological and hydrological observation, investigation, survey activities; manage, guide meteorological and hydrological observation activities of works and other specialized meteorological and hydrological activities according to the provisions of the law; build, manage, operate the national meteorological and hydrological observation station network, lightning location observation, climate change monitoring;
b) Organize the protection of meteorological and hydrological works belonging to the national meteorological and hydrological station network;
c) Manage, organize meteorological and hydrological forecasting, warning activities; transmit forecast and warning information on meteorology and hydrology; forecast, warn, transmit disaster information and disaster risk levels; build, manage, operate the national meteorological and hydrological forecasting and warning system; develop the national climate standard; issue, provide, broadcast official forecasts and warnings on disasters and disaster risk levels according to the provisions;
d) Organize the collection and processing of information, determine, assess disaster risks, delineate disaster risk zones, monitor and supervise disasters;
đ) Receive feedback information from ministries, sectors, localities, organizations, and individuals on the information dissemination system, quality, reliability of meteorological and hydrological forecast and warning information, disasters, the use of disaster risk levels in disaster prevention, response activities, socio-economic development; periodically annually monitor, evaluate, summarize the state management situation of meteorology and hydrology nationwide according to the provisions;
e) Organize the review of tsunami warning scenarios for Vietnam according to the provisions of the law;
g) Review the contents related to meteorology and hydrology in planning and design of national key construction projects and in planning and design of construction projects according to the provisions of the law;
h) Manage the quality of meteorological and hydrological measurement instruments according to the provisions of the law;
i) Manage, guide and organize implementation of meteorological and hydrological service activities according to the provisions of the law;
k) Approve, supervise the implementation of weather modification plans according to the provisions of the law.
26. On Climate Change
a) Direct, guide greenhouse gas emissions reduction, ozone layer protection, adaptation to climate change;
b) Institutionalize mechanisms, policies, international agreements, initiatives on climate change for economic and social development, ensuring national defense and security in accordance with conditions and national interests;
c) Organize climate change monitoring, national climate evaluation; build, update, publish and guide the implementation of climate change scenarios; guide, supervise impact assessments, vulnerability, risks, losses and damages caused by climate change; guide the integration of climate change content into strategies and plans;
d) Guide, implement greenhouse gas emission monitoring, inventory; activities to reduce greenhouse gas emissions and measurement, reporting, verification (MRV) of greenhouse gas emissions reduction;
đ) Guide the management, elimination, collection, recycling, reuse, and disposal of substances that deplete the ozone layer and greenhouse gases according to international conventions on ozone layer protection to which the Socialist Republic of Vietnam is a member;
e) Guide the implementation of climate change adaptation activities, deploy and monitor the evaluation (M&E) of climate change adaptation activities;
g) Guide the implementation of carbon trading mechanisms; organize domestic carbon market operations and participate in global carbon markets; manage, organize allocation of greenhouse gas emission quotas; manage carbon credits and issue project approval documents, transfer carbon credits according to regulations consistent with the Paris Agreement on climate change;
h) Build, update, organize implementation and supervise the implementation of Nationally Determined Contributions (NDCs); build national reports on climate change and ozone layer protection according to the provisions of the law and international conventions to which the Socialist Republic of Vietnam is a member.
27. On Surveying, Mapping, and Geographic Information
a) Establish, update, manage, operate, exploit the national geographic information infrastructure in accordance with the provisions of the law, the national basic measurement data system, the national measurement network data systems, basic geodetic works, the Vietnam National Geographic Information Portal; establish, update the national geographic database foundation, and set up, update the national topographic map system; issue place name lists to be displayed on maps; provide surveying and mapping products.
b) Guide, inspect, and organize the implementation of verification, calibration, testing, and inspection of measuring instruments used in surveying and mapping activities in accordance with the provisions of the law on metrology and product quality.
c) Appraise the necessity, scope, and technical solutions of surveying and mapping content in programs, projects, and tasks using central budget funds organized by ministries, ministerial-level agencies, and government agencies; appraise basic surveying and mapping projects and tasks organized by provincial People's Committees.
d) Inspect the implementation of surveying and mapping activities for organizations and individuals who have been licensed; inspect the publication and distribution of maps; suspend the distribution and direct the recall of map publications that violate the law.
đ) Establish, update, publish, and distribute map products in accordance with the provisions of the law.
e) Organize surveying, rectification, and supplementation of administrative boundary maps to serve the establishment, dissolution, merger, division, adjustment of provincial administrative boundaries, and resolution of disputes related to provincial administrative boundaries in accordance with the law.
g) Organize surveying, establish topographic maps for planning, demarcation, and setting boundary markers for the national border and serving national border management; survey and establish, update the standard border map set; guide the representation of the national border and territorial sovereignty on surveying and mapping products and map publications.
28. On comprehensive management of marine resources and protection of the marine and island environment
a) Direct, guide, inspect, and organize the implementation of marine and island planning; key programs for basic surveys of marine and island resources and environment; comprehensive management programs for coastal zone resources.
b) Organize investigations, statistics, classification, and management of island resources; manage island resource files; specify detailed regulations on island resource files, guide the establishment and management of island resource files.
c) Guide and direct the establishment and protection of coastal protection zones; determine and adjust the lowest average sea level line; the outer limits of various marine areas according to the law.
d) Synthesize and evaluate the economic and social potential related to the sea of Vietnam; conduct statistics, classification, and evaluation of the potential of Vietnam's marine and island areas; take the lead and coordinate with relevant ministries and sectors to assess resource changes; organize analysis, assessment, and forecasting of domestic and international developments related to resource management, exploitation, utilization, scientific research, and international cooperation on the sea and islands of Vietnam.
đ) Organize monitoring and comprehensive supervision of marine and island resources and environment; build and manage the national information system and database on marine and island resources and environment; manage the storage, updating, exploitation, use, integration, exchange, and sharing of basic survey data on marine and island resources and environment; build and implement investment, exploitation, utilization, and management programs and plans for specialized facilities and equipment serving marine environmental warning, marine and ocean research and exploration within the scope of management as prescribed by law.
e) Organize investigations and assessments of pollution sources from activities at sea and on islands within the authority; investigate, assess, create risk zoning maps for marine and island environmental pollution, announce areas of sea and islands that can no longer accept waste; organize the implementation of preventive measures, detection, handling, remediation, and improvement of marine and island environmental pollution and degradation; prepare national marine and island environmental status reports, special topic environmental status reports.
g) Take the lead and coordinate with relevant ministries, sectors, and localities to implement inspections and supervision of activities exploiting and utilizing marine resources and protecting the marine and coastal environment; deploy monitoring and evaluation activities for risks, remediation, and resolution of consequences of oil spills and toxic chemical spills at sea; manage ocean plastic waste in accordance with the law.
h) Manage and guide the allocation of marine areas for marine resource exploitation and utilization; manage land reclamation activities in accordance with the law.
Monitor and synthesize the implementation of marine and ocean scientific research programs and projects of ministries, sectors, and localities in accordance with the law.
Supervise activities of marine disposal and handle violations as prescribed.
Implement coordination duties in organizing the implementation of the Sustainable Development Strategy for Vietnam's Marine Economy until 2030, vision to 2045; the Strategy for Sustainable Exploitation and Utilization of Marine Resources and Protection of the Marine and Island Environment until 2030, vision to 2050.
29. On Remote Sensing
a) Manage and guide remote sensing data acquisition activities, operation, maintenance, and protection of remote sensing data acquisition infrastructure; build, manage, exploit, and operate remote sensing data acquisition infrastructure under the Ministry's jurisdiction.
b) Aggregate the demand for remote sensing information and data from ministries, ministerial-level agencies, government agencies, provincial People's Committees, and urgent tasks assigned to develop plans for remote sensing data acquisition.
c) Guide the construction and operation of remote sensing databases; build, manage, update, and operate the national remote sensing database; aggregate and publish national remote sensing metadata; provide remote sensing products.
d) Manage, guide, organize the implementation of remote sensing applications in basic investigations, monitoring, supervision to serve agricultural production activities, resource and environmental management, disaster prevention, economic and social development, ensuring national defense and security as prescribed;
đ) Organize regular and emergency monitoring and supervision in agriculture, rural areas, resources, environment, natural disasters, climate change using remote sensing technology;
e) Review contents related to the remote sensing data collection system; the collection, storage, processing, provision, exploitation, and use of remote sensing data; the application and development of remote sensing technology for programs, projects, tasks of ministries, sectors, localities;
g) Guide and inspect remote sensing activities of organizations and individuals in accordance with the provisions of the law;
30. On investment management and construction investment
a) Direct, guide, inspect, supervise activities on investment, construction investment; construction activities in accordance with the provisions of the law;
b) Direct, guide construction investment and manage the quality of specialized works and fields under the state management of the ministry in accordance with the provisions of the law;
c) Review the contents of pre-feasibility study reports and feasibility study reports of programs, projects, plans within the scope of the ministry's management;
d) Approve investment policies; make investment decisions; approve designs, budgets, final accounts, and manage bidding for programs, projects within the ministry's authority in accordance with the provisions of the law;
đ) Guide, monitor, evaluate, inspect programs, projects on investment and construction within the ministry's decision-making authority in accordance with the provisions of the law;
e) Implement overall investment supervision and evaluation; supervise and evaluate specialized construction investment projects within the scope of the ministry's industry and field management in accordance with the provisions of the law;
31. On poverty reduction
a) Assist the Government in uniformly implementing state management on poverty reduction;
b) Develop and submit to competent authorities for issuance the national poverty standard applicable for each period, guide the organization of implementation;
c) Take the lead in developing and submitting to competent authorities for issuance or proposing to competent authorities for issuance, amendment, supplementation of policies, legal normative documents on poverty reduction to ensure minimum living standards and social services including employment, livelihoods, education, vocational training, healthcare, housing, environment, credit, information, drinking water, legal aid, etc., suitable for each period;
d) Take the lead and coordinate with ministries, sectors, and localities in building, coordinating, and organizing the implementation of poverty reduction programs, projects, plans, and the National Target Program on Sustainable Poverty Reduction according to each period;
đ) Organize the establishment of databases on poverty reduction to serve the formulation of social welfare policies and economic and social development planning;
e) Take the lead and coordinate with relevant ministries, agencies in advising and proposing participation in global anti-poverty alliance activities, international cooperation activities on poverty reduction;
g) Organize inspections, supervision, and compile, evaluate the implementation results of poverty reduction work of ministries, sectors, localities, report to competent authorities, and publish according to regulations;
h) Perform other tasks on poverty reduction as assigned by the Government and directed by the Prime Minister;
32. Organize the implementation of registration, transfer, recognition, approval, issuance, renewal, adjustment, reissuance, return approval, suspension, cessation, revocation of various licenses, certificates, decisions related to the fields under the ministry's state management in accordance with the law;
33. Manage the national reserve of crop seeds, plant protection chemicals, veterinary drugs, and other goods as assigned by the Government;
34. Carry out the task as the focal agency, national representative, permanent national body, permanent steering committee of the national program, protocol, convention, treaty, agreement, commitment, international forum related to the fields under the ministry's management as assigned by the Government;
35. Implement digital transformation, apply information technology, build information systems, databases in fields under the ministry's state management; develop electronic government towards digital government, digital economy, digital society in the sector; build, manage, operate, ensure cybersecurity of digital infrastructure, platform, data platform, digital services on national agriculture and environment; integrate, connect, analyze, process, and publish, provide, share data, information in fields under the ministry's management;
36. Direct, organize research, application, deployment of scientific and technological progress; develop scientific and technological potential, innovation, technology transfer; manage measurement and product quality in fields under the ministry's management in accordance with the law;
37. Implement international cooperation and economic integration in industries and fields under the ministry's state management in accordance with the law; organize negotiations, signing, implementation of international treaties, initiatives according to the authorization of competent state agencies; sign international agreements on behalf of the ministry; participate in international organizations as assigned by the Government;
38. Organize and direct the implementation of the ministry's administrative reform program according to the program's objectives and content approved by the Prime Minister;
39. Carry out state management tasks on public services, provision of products, public services in fields under the ministry's state management in accordance with the law; implement socialization of public service supply activities in the ministry's management fields.
40. Guide the functions, tasks, authorities, and job position catalogues of specialized agencies under provincial People's Committees and district-level People's Committees related to agriculture and environment; manage organizational structures, job positions, civil servant quotas, and the number of staff working in public institutions; workers; commendation and reward systems, and other policies for cadres, civil servants, officials, and workers under the Ministry as prescribed by law.
41. Manage associations and non-governmental organizations operating in areas within the scope of the Ministry’s state management as prescribed by law.
42. Represent the State's share of capital in enterprises under the Ministry as prescribed by law.
43. Manage allocated financial resources and assets; manage and utilize the state budget as prescribed by law.
44. Conduct inspections and audits; organize citizen reception, handle complaints and suggestions from organizations and citizens; resolve accusations from individuals; implement anti-corruption measures and address violations of laws within the scope of the Ministry’s state management.
45. Implement statistical work, inventory, and archive data on areas under the Ministry’s management as prescribed by law.
46. Perform other tasks and authorities assigned by the Government or the Prime Minister, or as prescribed by law.

In this Article, units specified from Clause 1 to Clause 26 are administrative units assisting the Minister in performing state management functions; units specified from Clause 27 to Clause 30 are public service units serving the state management functions of the Ministry.
The Minister of Agriculture and Environment shall prescribe the functions, tasks, authorities, and organizational structure of subordinate units; submit for approval.
Article 4. Effective date
1. This Decree shall take effect from March 1, 2025.
2. This Decree replaces Decree No. 68/2022/NĐ-CP dated September 22, 2022 of the Government prescribing the functions, tasks, authorities, and organizational structure of the Ministry of Natural Resources and Environment and Decree No. 105/2022/NĐ-CP dated December 22, 2022 of the Government prescribing the functions, tasks, authorities, and organizational structure of the Ministry of Agriculture and Rural Development.
Article 5. Responsibilities for Implementation
Ministers, heads of ministerial-level agencies, heads of government agencies, and Chairpersons of provincial and centrally-administered city People's Committees are responsible for implementing this Decree.
