RESOLUTION

SUPPLEMENTARY REGULATIONS ON CERTAIN REMUNERATION AND CONDITIONS TO ENSURE THE ACTIVITIES OF NATIONAL ASSEMBLY DELEGATES

THE STANDING COMMITTEE OF THE NATIONAL ASSEMBLY

On the basis of the Constitution of the Socialist Republic of Vietnam;

Pursuant to Article 41 of the National Assembly Organization Law No. 57/2014/QH13;

RESOLUTION:

Article 1. Scope of Regulation

This Resolution stipulates supplementary regulations on certain remuneration and conditions to ensure the activities of National Assembly delegates.

Article 2. Applicability

This Resolution applies to:

1. National Assembly delegates;

2. Agencies, organizations, units, and individuals related to the implementation of remuneration and conditions to ensure the activities of National Assembly delegates.

Article 3. General Principles

The supplementary regulations on certain remuneration and conditions to ensure the activities of National Assembly delegates must be consistent with relevant provisions of competent state agencies, taking into account special factors in the operation of the National Assembly; contributing to enhancing the quality and effectiveness of the activities of National Assembly delegates.

Article 4. Remuneration for National Assembly delegates

1. Activity fees:

National Assembly delegates are granted monthly activity fees at a rate of 1.0 times the base salary level.

2. Salary and remuneration for participating in National Assembly activities:

a) Full-time National Assembly delegates are paid salaries, allowances, and other benefits from the state budget according to the regulations of the Standing Committee of the National Assembly and other relevant laws;

b) Part-time National Assembly delegates who do not fall under the circumstances specified in point c of this clause, during the time performing their duties as delegates, shall have their salaries, allowances, and other benefits guaranteed by the head of the agency, organization, or unit where they work, in accordance with the law;

c) National Assembly delegates who do not receive a salary (including those receiving pension) or monthly allowances from the state budget or social insurance fund shall be entitled to remuneration for participating in National Assembly activities at a rate of 0.2 times the base salary level/day, calculated for 120 working days/year. This remuneration is paid by the National Assembly Delegation where the delegate is active.

3. Contracted secretary support system:

a) National Assembly delegates have the right to hire persons to perform one or more tasks of secretarial work. The person hired to perform secretarial work for National Assembly delegates must be an employee of the agency, organization, or unit where the National Assembly delegate works;

b) The content of secretarial support work includes: developing work plans; receiving, preparing documents, correspondence, and contacting voters in the constituency; conveying, monitoring, and urging the implementation of the delegate's proposals; and other administrative tasks at the agency, organization, or unit where the National Assembly delegate works;

c) National Assembly delegates are granted a monthly contracted budget to hire persons to perform secretarial work. The quota for full-time National Assembly delegates is equal to 100% of 2.34 times the base salary level; for part-time National Assembly delegates, it is 40% of 2.34 times the base salary level. National Assembly delegates directly pay the hired personnel for secretarial work according to the agreed amount for each task.

In cases where National Assembly delegates handle administrative tasks themselves to fulfill their delegate duties, they are entitled to receive this budget. National Assembly delegates who have a secretarial support system according to Party and State regulations but have not been assigned a formal secretary shall apply the provisions of this clause until a formal secretary is assigned.

4. Training and capacity building:

a) National Assembly delegates are provided with training on operational skills and knowledge updates according to the regulations of the Standing Committee of the National Assembly;

b) When there is a need to participate in courses to enhance qualifications suitable to their conditions and specialized fields, full-time National Assembly delegates working at the central level submit an application to the Standing Committee of the National Assembly for consideration and decision, with the file containing the opinion of the leadership of the agency where they work; the opinion of the Head of the National Assembly Delegation for full-time National Assembly delegates working at the local level.

The funding for participation in courses for full-time National Assembly delegates at the central level is guaranteed by the National Assembly Office; for full-time National Assembly delegates at the local level, it is guaranteed by the National Assembly Delegation.

Article 5. Conditions for Assurance

1. Regarding management of cadres:

a) Full-time National Assembly deputies at the central level shall be managed by the Standing Committee of the National Assembly. The agency assisting the Standing Committee of the National Assembly in managing full-time National Assembly deputies at the central level is the Delegation Work Committee;

b) Full-time National Assembly deputies at the local level shall have their salaries, allowances, and other benefits during their term as deputies guaranteed by the Standing Committee of the National Assembly. 2. Health insurance system:

National Assembly deputies who do not receive a salary (including those receiving a pension) or monthly allowances from the state budget or social insurance fund shall enjoy health insurance benefits as prescribed by laws on health insurance. The costs for participating in the health insurance program shall be covered by the National Assembly Delegation where the deputy is active.

3. Other conditions for assurance:

a) During each term of the National Assembly, the Standing Committee of the National Assembly shall issue badges and delegate cards to National Assembly deputies. When performing duties, deputies shall wear badges; they shall present their delegate cards when necessary;

b) National Assembly deputies may use diplomatic passports when carrying out tasks under the foreign affairs program of the National Assembly, the Standing Committee of the National Assembly, the agencies of the National Assembly, the agencies under the Standing Committee of the National Assembly, the National Assembly Office, and the National Assembly Delegation.

c) The Standing People's Councils, Provincial People's Committees, and Municipal People's Committees directly under the Central Government shall be responsible for providing resolutions of the People's Councils, legal regulatory documents of the People's Committees, and reports on the socio-economic situation in their respective localities to National Assembly deputies active in the National Assembly Delegation in the same locality.

Article 6. Effectiveness

This Resolution shall take effect from June 1, 2017.

Article 7. Implementation Organization

1. The National Assembly Office and the Delegation Work Committee, within the scope of their functions and powers, shall be responsible for guiding the implementation and organizing the enforcement of this Resolution.

2. The Ethnic Council, the Committees of the National Assembly, the agencies under the Standing Committee of the National Assembly, the National Assembly Office, the National Assembly Delegations, National Assembly deputies, and related agencies, organizations, units, and individuals shall be responsible for enforcing this Resolution.
