DECREE
On the construction and management of information systems and databases
concerning housing and the real estate market

Pursuant to Law on Government Organization No. 63/2025/QH15;

Pursuant to the Law on Local Administration Organization No. 72/2025/QH15;

Pursuant to the Law on Personal Data Protection No. 91/2025/QH15;

Pursuant to the Law on Data No. 60/2024/QH15;

Pursuant to the Law Amending and Supplementing Certain Provisions of the Land Law No. 31/2024/QH15, the Housing Law No. 27/2023/QH15, the Real Estate Business Law No. 29/2023/QH15, and the Law on Credit Institutions No. 32/2024/QH15;

Pursuant to the Housing Law No. 27/2023/QH15;

Pursuant to the Real Estate Business Law No. 29/2023/QH15;

Pursuant to the Law on Electronic Transactions No. 20/2023/QH15;

Pursuant to the Cybersecurity Law No. 24/2018/QH14;

At the proposal of the Minister of Construction;

The Government issues this Decree on the construction and management of information systems and databases concerning housing and the real estate market.

PART I
GENERAL PROVISIONS

Article 1. Scope of Regulation

Detailed provisions of certain Articles and Clauses of the Real Estate Business Law No. 29/2023/QH15 include:

1. Article 72 on technical infrastructure for information technology and software systems serving the management, operation, and exploitation of information systems about housing and the real estate market.

2. Article 73 on databases concerning housing and the real estate market.

3. Article 74 on the construction, management, and operation of information systems about housing and the real estate market.

4. Point a and Point b Clause 2 Article 75 on the exploitation of information systems about housing and the real estate market.

Article 2. Applicability

This Decree applies to agencies, organizations, and individuals related to the construction, management, and use of information systems and databases concerning housing and the real estate market.

Article 3. Explanation of Terms

1. Real estate inventory is the quantity and total value of real estate that meets the conditions for being put into business operations by the project investor according to the law but has not yet been traded.

2. Application Programming Interface (API) is an application program interface serving the connection and sharing of information and data between information systems.

3. Electronic identification on information systems and databases concerning housing and the real estate market is the activity of registering, reconciling, creating, and attaching information and data to land plots, houses, or participants in housing and real estate transactions (electronic identity subjects) according to regulations on electronic identification and authentication.

4. Electronic identification account on information systems and databases concerning housing and the real estate market is a set of identification information, including: username, password, or other authentication means established based on individual or organizational identification numbers, authenticated by authorized electronic identification and authentication management agencies; used to access and utilize the facilities and applications of the electronic identification and authentication system and connected and shared information systems according to the law.

5. Electronic product identification code for real estate (including housing and floor area in construction projects) is a string of up to 40 alphanumeric characters assigned uniquely to each house (apartment, standalone) or real estate within a construction project managed in the housing and real estate information and database system.

Article 4. Principles for building, managing, and using information systems and databases on housing and real estate markets

1. Information systems and databases on housing and real estate markets shall be constructed and managed centrally and uniformly from the central to local levels. The Ministry of Construction is the agency responsible for constructing, managing, and utilizing information systems and databases on housing and real estate markets nationwide; Provincial People's Committees are agencies responsible for collecting, updating, managing, and exploiting databases on housing and real estate markets within their respective jurisdictions.

2. Ensure timely service for state management work, national defense, security, economic and social development requirements, and transparency and clarity of information on housing and real estate markets.

3. Agencies, organizations, and individuals related to such matters shall be granted access rights to initiate, share, update, provide information and data, and perform searches and management according to the authority granted by state management agencies.

4. Information systems and databases on housing and real estate markets shall be built with openness and standards for databases, APIs, and permission models; they must comply with national data architecture framework regulations, security standards; have economic and technical specifications described by competent state authorities; ensure connectivity and data sharing with the National Integrated Database and other relevant specialized databases; data in connected and shared databases shall not be collected again.

5. Information and data collected and updated into databases on housing and real estate markets must be cleaned; have legitimate sources, accurately reflect current legal status; contain all necessary fields, regularly updated as prescribed; every data record must be logged for access, modification, and updates, ensuring the ability to trace historical changes and data fluctuations.

6. Information and data formed from databases on housing and real estate markets are state assets managed by the Ministry of Construction.

7. Databases on housing and real estate markets shall be strictly managed, ensuring information security, protecting state secrets, and personal information privacy; ensuring efficiency, simplicity, and convenience for agencies, organizations, and individuals in implementing public services, administrative procedures, and other activities.

8. Information and figures published publicly on the portal of the information system on housing and real estate markets are aggregated information and figures.

9. Building, managing, and using information and data on housing and real estate markets must ensure compliance with purposes, follow regulations on data management, connection, and sharing by state agencies, data laws, electronic transaction laws, and information access laws.

Chapter II
TECHNICAL INFRASTRUCTURE OF INFORMATION TECHNOLOGY,
SOFTWARE SYSTEM AND ELECTRONIC IDENTIFIER CODES,
ELECTRONIC IDENTIFIER ACCOUNTS

Section 1
TECHNICAL INFRASTRUCTURE OF INFORMATION TECHNOLOGY,
SOFTWARE SYSTEM

Article 5. Technical infrastructure of information technology

1. The technical infrastructure of information technology of the information system on housing and real estate markets must comply with the provisions of the Vietnam Government Digital Architecture Framework.

2. The technical infrastructure of information technology of the information system on housing and real estate markets includes the following main groups of equipment:

a) Central processing equipment;

b) Storage, backup, and data recovery equipment;

c) Network, transmission, routing, and load balancing equipment;

d) Security, network security, encryption, and authentication equipment;

đ) Environmental, energy, and technical auxiliary equipment;

e) Terminal and dedicated data communication equipment;

g) Workstations and other related equipment.

Article 6. Software System

1. The software system of the housing and real estate market information system must comply with national technical standards and norms for information technology in state agencies; ensure integration and data sharing capabilities with related information systems, including:

a) Compatibility with information technology infrastructure;

b) Solutions for data access and distribution services;

c) Solutions for data sharing and integration;

d) Scalability for nationwide deployment;

đ) Solutions to serve different user groups in management, operation, updating, and exploiting information and data;

e) Diversification of usage and experience forms on mobile applications;

g) Allow users to provide feedback and report data errors during use.

2. The software system of the housing and real estate market information system includes the following main application groups:

a) Database management and update group;

b) Information exploitation and provision group;

c) Management and operation service group;

d) Data integration and sharing group;

đ) Operation and maintenance support group;

e) Other software support groups relevant to the purpose.

Article 7. Construction and Operation of Information Technology Infrastructure and Software Systems

1. The construction and operation of the housing and real estate market information system and database include the following activities:

a) Establishing, upgrading, and maintaining information technology infrastructure;

b) Building and upgrading the software system to manage, operate, and exploit the housing and real estate market information system and database;

c) Training, instructing, and enhancing the capacity of civil servants, public officials, and workers assigned to perform tasks.

2. The information technology infrastructure of the housing and real estate market information system and database is proposed, equipped, and managed and operated at the National Data Center by the Ministry of Construction. Provincial People's Committees proactively arrange computer systems connected to the Internet to ensure connectivity, sharing, reporting, and exploitation of data from the housing and real estate market information system.

3. The software system of the housing and real estate market information system and database is developed, centrally and uniformly managed by the Ministry of Construction throughout the country.

4. The Ministry of Construction implements the maintenance of information security in accordance with the provisions of laws on cybersecurity.

5. The Ministry of Construction invests in or leases information technology infrastructure and software systems to serve management, operation, and exploitation; it is permitted to select organizations with sufficient qualifications and capabilities to build and provide services for information technology infrastructure and software systems serving the management, operation, and exploitation of the housing and real estate market information system and database according to the provisions of laws on state budget, public investment, bidding, information security, cybersecurity, data laws, and regulations on managing public investment in information technology applications using state budget funds.

6. The Ministry of Construction is the owner of the data and performs specialized business administration; technical connection, coordination, and supervision activities are carried out in accordance with current laws on mandatory data sharing between political system agencies and regulations on the national data architecture framework, data governance, and management framework.

Section 2
ELECTRONIC IDENTIFIER CODE, ELECTRONIC IDENTIFIER ACCOUNT

Article 8. Electronic identification code for real estate products that are residential properties

1. The electronic identification code for real estate products that are residential properties, as prescribed in Appendix I accompanying this Decree, includes the following groups of information fields:

a) Land parcel identification code;

b) Project and construction works information number;

c) Location identification code (if applicable);

d) Sequence of natural characters.

2. The electronic identification code for real estate products that are residential properties is automatically generated on the information system and database on residential properties and the real estate market, and the Department of Construction shall link the electronic identification code for real estate products that are residential properties to residential development projects within the same time frame as the issuance of the announcement regarding residential properties meeting the conditions for sale of future-formed residential units.

Article 9. Electronic identification code for real estate products that are floor area in construction works

1. The electronic identification code for real estate products that are floor area in construction works, as prescribed in Appendix I accompanying this Decree, includes the following groups of information fields:

a) Land parcel identification code;

b) Project and construction works information number;

c) Location identification code (if applicable);

d) Sequence of natural characters.

2. The electronic identification code for real estate products that are floor area in construction works is automatically generated on the information system and database on residential properties and the real estate market, and the Department of Construction shall link the electronic identification code for floor area in construction works to floor area in construction works within the same time frame as the issuance of the feasibility study report assessment results.

Article 10. Electronic identification code for management and operation units of apartment buildings

1. The electronic identification code for management and operation units of apartment buildings, as detailed in Appendix I accompanying this Decree, includes the following information fields:

a) Organization identification number;

b) Sequence of natural characters indicating the date of issuance of the notification of meeting the conditions for management and operation of apartment buildings by the competent authority.

2. The electronic identification code for management and operation units of apartment buildings is automatically generated on the information system and database on residential properties and the real estate market, and the Department of Construction shall link the electronic identification code for management and operation units of apartment buildings to apartment buildings within the same time frame as the issuance of the notification of meeting the conditions for management and operation of apartment buildings.

Article 11. Electronic identification code for real estate brokerage practice certificate

1. The electronic identification code for real estate brokerage practice certificate, as detailed in Appendix I accompanying this Decree, includes the following information fields:

a) Province/city code;

b) Individual identification number/foreigner identification number;

c) Sequence of natural characters indicating the date of issuance of the certificate; certificate number; revoked (if applicable).

2. The electronic identification code for real estate brokerage practice certificate is automatically generated on the information system and database on residential properties and the real estate market, and the Department of Construction shall attach the electronic identification code for real estate brokerage practice certificate to the information of real estate brokers immediately after the Department of Construction approves the list of individuals granted the certificate.

Article 12. Electronic identification code for individuals benefiting from housing support policies

1. The electronic identification code for individuals benefiting from housing support policies is detailed in Appendix I issued together with this Decree, including the following information fields:

a) Individual identification number;

b) A series of natural characters representing the beneficiary group and the housing support program (Housing support program for persons with meritorious service; housing for poor and near-poor households; other support programs).

2. The electronic identification code for individuals benefiting from housing support policies is automatically established on the housing information system and real estate market database, and local state management agencies authorized to perform the task shall establish and attach the electronic identification code of individuals benefiting from housing support policies to the beneficiaries.

Article 13. Establishment and attachment of electronic identification account information

1. Agencies, organizations, and individuals participating in the construction, management, and use of the housing information system and real estate market database must have digital identities, complying with the regulations on electronic identification and authentication as prescribed by law.

2. The Ministry of Construction shall manage, issue passwords, and grant usage rights for electronic identification accounts on the housing information system and real estate market database based on individual identification numbers, organizational identification numbers, and relevant administrative unit codes created by authorized state management agencies; implement access control, connection, data sharing, ensuring compliance with the purpose, scope, and state management authority for agencies, organizations, and individuals including:

a) Relevant ministries and sectors;

b) Provincial People's Committees;

c) Organizations and individuals requiring specialized information and detailed data on housing and the real estate market nationwide.

3. Provincial People's Committees shall attach electronic identification account information to facilitate connections and provision of housing and real estate market information and data to agencies and organizations within their jurisdiction, including:

a) Relevant departments, districts, towns, and villages;

b) Developers of real estate projects and real estate service providers within their jurisdiction;

c) The attachment of electronic identification account information for developers of real estate projects within their jurisdiction shall be carried out immediately after the competent state management agency issues the Decision on Investment Orientation or approves the investment orientation or investment project for the real estate project.

Chapter III
HOUSING AND REAL ESTATE MARKET DATABASE

Section 1
HOUSING AND REAL ESTATE DATABASE

Article 14. Housing Database

1. The system of legal documents on housing issued by the National Assembly, Government, Prime Minister, ministries, sectors, and localities within their respective authorities.

2. Indicators for developing various types of housing under the Project; Programs and plans for developing housing that have been approved by the competent authority and the results of implementation include:

a) Land area for developing social housing, resettlement housing, public service housing, reconstruction of apartment buildings, and other types of housing (if applicable);

b) Average housing floor area per person;

c) Total housing floor area, number of housing units.

3. Types of housing development include:

a) Commercial housing;

b) Social housing, worker dormitories in industrial zones, housing for the people's armed forces, housing built by the Vietnam General Confederation of Labor;

c) Public service housing;

d) Resettlement housing;

đ) Reconstruction and redevelopment of apartment buildings;

e) Mixed-use housing;

g) Housing belonging to public assets;

h) Housing support programs: Housing for persons with meritorious service and relatives of martyrs; housing for poor and near-poor households in poor communes; housing under policies supporting poor households to build houses to prevent typhoons and floods in the Central region and the Program for building clusters and residential areas and housing in flood-prone areas in the Mekong Delta; housing under other support programs (if applicable).

4. Information and data on housing from the general population and housing census; mid-term population and housing census.

Article 15. Information and data on housing projects

1. Information on the project includes:

a) The name of the project that has been approved for investment orientation/assigned to the project investor (for social housing);

b) Name of the project investor; organization identification number; project information code, construction works code; electronic product real estate identification code;

c) Total investment amount of the project, owner's capital and capital raised in accordance with laws on housing;

d) Land use scale of the project;

đ) Project implementation location;

e) Implementation progress as permitted by construction permit; currently under construction and completed acceptance for use;

g) Duration of operation of the project approved by competent authorities;

h) Number and area (house/unit/plot);

i) Number and area (house/unit/plot) meeting conditions for business;

k) Sale price, purchase lease price, rental price for social housing; expected start and end times for receiving registration applications, sales, purchase leases, and rental applications for social housing.

2. Legal document information of the project includes:

a) Information and data on publicizing real estate information, real estate projects put into business in accordance with laws on real estate business;

b) In cases where the project transfers all or part of the real estate project: Information and data include the contents prescribed in point a of this clause and additional information: The investor's document requesting permission to transfer all or part of the real estate project; commitment document regarding continued investment and construction, business in accordance with the approved project content;

c) Administrative penalty decision (if any); mortgage and release documents (if any).

Article 16. Information and data on other types of housing

1. Information and data on old apartment building renovation and reconstruction projects

a) Contents prescribed in Article 15 of this Decree;

b) Demolition time, implementation time, and completion time according to investment orientation approval;

c) Area and quantity of resettlement housing and commercial housing in the approved plan.

2. Information and data on official housing

a) Contents prescribed in Article 15 of this Decree;

b) Quantity and area of official housing under management;

c) Quantity and area of official housing currently rented out;

d) Official housing rental price.

3. Information and data on housing support programs

a) Results of implementing housing support policies for those who have rendered meritorious service to the revolution;

b) Results of implementing housing support policies for poor households and near-poor households;

c) Results of implementing housing support policies for poor households to build houses to prevent typhoons and floods in the Central region and the Program for constructing clusters and residential areas and houses in flood-prone areas in the Mekong Delta;

d) Housing under other support programs (if any).

4. Information and data on housing in the general population and housing census; mid-term population and housing census

a) By durability level: Durable and semi-durable housing, non-durable and simple housing;

b) By type: Apartment buildings, individual houses;

c) By area: Urban and rural areas.

Article 17. Real estate database

1. System of legal documents governing the real estate market issued by the National Assembly, Government, Prime Minister, ministries, sectors, and localities within their respective jurisdictions.

2. Types of real estate and real estate projects including:

a) Housing construction investment projects;

b) Urban development investment projects;

c) Rural community development investment projects;

d) Construction projects with functions serving educational, health, sports, cultural, office, commercial, service, tourism, accommodation, industrial purposes, and mixed-use construction projects;

đ) Infrastructure construction projects for housing areas to transfer land use rights to individuals for self-construction of housing;

e) Industrial park, industrial cluster, high-tech zone infrastructure construction investment projects;

g) Transfer of all or part of real estate projects;

h) Housing and construction works subject to compulsory notarization when transacting.

Article 18. Information and data on real estate projects

1. For housing construction investment projects; urban area construction investment projects; rural residential area construction investment projects; mixed-use construction works including information and data as prescribed in Article 15 of this Decree.

2. For office, commercial, and service construction investment projects including information and data as prescribed in Article 15 of this Decree.

3. For tourism and accommodation real estate projects including information and data as prescribed in Article 15 of this Decree.

4. For other real estate projects (education, healthcare, sports, culture, and other construction works) including:

a) Information and data as prescribed at points a, b, c, d, đ, e, g Clause 1, Article 15 and Clause 2, Article 15 of this Decree;

b) Quantity and area (construction works).

5. For industrial real estate projects; construction investment projects for infrastructure in industrial zones, clusters, high-tech zones including:

a) Information and data as prescribed at points a, b, c, d, đ, e, g Clause 1, Article 15 and Clause 2, Article 15 of this Decree;

b) Quantity and area (workshops/plot).

6. For construction investment projects for infrastructure in residential areas to transfer land use rights to individuals for self-construction of houses as prescribed in Article 15 of this Decree.

7. For the transfer of real estate projects

a) Information and data as prescribed in Article 15 of this Decree;

b) Information about the transferring party and the receiving party;

c) Decision allowing the transfer of the entire or part of the project.

Article 19. Information and data on real estate transactions

1. Information and data on the situation of real estate transactions of projects by type of real estate including:

a) Number of apartments/houses/land plots, area;

b) Transaction price (million dong/m2), total transaction value;

c) Number of apartments/houses/land plots, value, total value of unsold real estate.

2. Information and data on real estate transactions through notarization, certification by type of real estate including:

a) Number of apartments/houses/land plots, area;

b) Transaction price (million dong/m2), total transaction value.

3. Information on real estate transaction contracts, including:

a) Contract number, product real estate electronic identification code, time of signing; type of transaction contract (purchase and sale, lease, sublease, lease purchase, assignment);

b) Information about parties involved in the contract: Name of organization, individual; organization identification number; individual identification number or foreigner identification number of the buyer, lessee, sublessee, lease purchaser, assignee of real estate.

Section 2
INFORMATION ON HOUSING OWNERSHIP

Article 20. Information on housing ownership of organizations and individuals

1. Information on foreign organizations and individuals owning housing including:

a) Identification information: Documents proving the subject and conditions for owning housing in Vietnam as prescribed by housing laws;

b) Type of owned housing; address, area, quantity;

c) Ownership period as prescribed by law;

d) Legal status of housing (already issued certificate or still in the process of issuance);

đ) Information on rights and obligations arising from ownership;

e) List of housing construction investment projects announced by provincial People's Committees according to the law; quantity of housing (apartments, standalone houses) sold to foreign organizations and individuals;

g) Notification documents regarding leasing or terminating lease contracts of housing owned by foreign individuals.

2. Information on domestic organizations and individuals and overseas Vietnamese owning housing including:

a) Identification information: Full name/organization name, individual identification number/organization identification number, documents proving the subject and conditions for owning housing in Vietnam as prescribed by housing laws;

b) Type of housing attached to land use rights; address, area, quantity;

c) Ownership period and form of ownership (individual ownership, joint ownership);

d) Legal status of housing and attached land (already issued certificate or still in the process of issuance).

3. Information on organizations and individuals managing and using public property housing

a) Quantity, area, purpose of use;

b) Management status, rental, sale, functional conversion, cases of recovery (if any).

Article 21. Information on beneficiaries of housing support policies and housing assistance

1. Information on individuals benefiting from housing support policies as stipulated in Clause 3, Article 16 includes:

a) Individual identification number;

b) Information on housing support programs and policies.

2. Information on individuals benefiting from social housing support policies includes:

a) Individual identification number;

b) Form: Purchase, lease purchase;

c) Name of the social housing project, location of the social housing project that the individual registers to purchase or lease purchase.

Section 3
INFORMATION ON ORGANIZATIONS AND INDIVIDUALS ENGAGED IN
REAL ESTATE SERVICES AND MANAGEMENT OPERATIONS OF APARTMENT BUILDINGS
MANAGEMENT AND OPERATION OF APARTMENT BUILDINGS

Article 22. Information and data on organizations engaged in real estate service business

1. Information on real estate trading floors

a) Information on organizations, enterprises: Name of the real estate trading floor; organization identification number; personal identification number of the managing director; address; operational status (operating, temporarily suspended, terminated);

b) Number of employees with real estate brokerage practice certificates;

c) Number of real estate transactions, value of real estate transactions confirmed through the real estate trading floor.

2. Information on organizations engaged in real estate brokerage services

a) Information on organizations, enterprises: Real estate brokerage service business; organization identification number; personal identification number of the managing director; address; operational status (operating, temporarily suspended, terminated);

b) Number of employees with real estate brokerage practice certificates;

c) Number of real estate transactions, value of real estate transactions.

3. Information on organizations engaged in real estate advisory and management services

Information on organizations, enterprises: Name of the real estate advisory and management service business; organization identification number; personal identification number of the managing director; address; operational status (operating, temporarily suspended, terminated).

Article 23. Information and data on individuals granted real estate brokerage practice certificates

Information on personal identification number, electronic identification code of the real estate brokerage practice certificate as stipulated in Clause 1, Article 11 of this Decree.

Article 24. Information and data on training and capacity building institutions for real estate brokerage practices and management of real estate trading floors

1. Information on organizations, enterprises.

a) Training institution name;

b) Organization identification number;

c) Personal identification number of the managing director;

d) Registered operating address.

2. Business registration certificate and related legal information.

Article 25. Information and data on units managing and operating apartment buildings

1. Electronic identification code of the unit managing and operating apartment buildings as stipulated in Clause 1, Article 10 of this Decree.

2. List of staff of each unit managing and operating apartment buildings directly involved in construction management operations, electrical and water engineering, fire prevention and extinguishing, elevator operation: Full name; personal identification number.

3. Decision recognizing the condominium management board.

Chapter IV
CONNECTION, SHARING, AND PROVISION OF INFORMATION AND DATA
ON HOUSING AND THE REAL ESTATE MARKET

Article 26. Sources of information and data collection

1. Sources of information and data collected relating to the housing sector and the real estate market include:

a) National consolidated database;

b) National land database;

c) National population database;

d) National construction activities database;

đ) National enterprise registration database;

e) National investment database;

g) National administrative violation handling database;

h) Specialized databases on finance, taxation, notarization, banking;

i) Database of administrative procedure resolution results of state management agencies;

k) Other national databases and specialized databases relevant to the housing sector and the real estate market.

2. The agency managing the housing and real estate market information system is responsible for receiving information and data shared and provided by agencies and organizations in accordance with regulations to integrate them into the housing and real estate market database.

3. Provincial People's Committees collect, update, and supplement information and data on housing and the real estate market of their locality to serve timely management and socio-economic development.

Article 27. Specialized subject data, open data on the housing and real estate market information system and database

1. Specialized subject data is basic data on housing and the real estate market, serving as a reference for synchronizing housing and real estate market data with other national databases, databases of ministries, sectors, and localities.

2. Open data is housing and real estate market data widely published for agencies, organizations, and individuals to use, reuse, share free of charge, and made public on the housing and real estate market information system.

Article 28. Sharing, connecting, providing information and data on the housing and real estate market information system and database of ministries and sectors

1. The Ministry of Public Security shall cooperate and share information and data related to population; location identification (if applicable); administrative violations handling related to the housing sector and real estate business; individual identification numbers; foreigner identification numbers; organization identification numbers.

2. The Ministry of Agriculture and Rural Development shall cooperate and share information and data on issuing Land Use Right Certificates, Ownership Certificates of attached assets for Vietnamese people and foreign organizations and individuals; information on addresses and house numbers recorded on Land Use Right Certificates, Ownership Certificates of attached assets; information on mortgage and release of mortgage for Land Use Right Certificates, Ownership Certificates of attached assets of real estate, real estate projects; parcel identification codes.

3. The Ministry of Finance shall cooperate and share information and data on:

a) Information and data on taxes for real estate transfer activities including: Personal and organizational income tax payable for various types of real estate such as urban land, rural land, and other types of real estate;

b) Information and data on foreign direct investment activities including: Information on foreign direct investment in the real estate business sector; total newly registered capital of foreign investors in the real estate sector; total adjusted capital of foreign investors in the real estate sector; total equity contributions and purchase of shares of foreign investors in the real estate sector; foreign direct investment (FDI) already disbursed in the real estate sector; proportion of foreign investment in Vietnam in the real estate business sector/overall economy; information on the operation of enterprises engaged in the real estate business sector: number of newly registered enterprises, number of temporarily suspended enterprises, number of dissolved enterprises;

c) Information and data on corporate bond issuance in the real estate business sector including: Name of the issuer organization; value of bonds issued on domestic and international markets; total value of bonds issued up to the reporting date;

d) Information and data on housing from the general population and housing census; mid-term population and housing census.

4. The State Bank of Vietnam shall cooperate and share information and data on credit in the real estate sector, including:

a) Credit balance for investment and business activities in the real estate sector including: Credit balance for project owners to invest in building and repairing houses for sale, lease, or lease-purchase; credit balance for investing in constructing, purchasing, leasing office buildings, high-rise buildings for sale, lease, or lease-purchase; credit balance for investing in constructing technical infrastructure, construction works in industrial zones, clusters, export processing zones, high-tech zones, economic zones for sale, lease, or lease-purchase; credit balance for investing in constructing, purchasing, leasing tourist, ecological, and resort areas for sale, lease, or lease-purchase; credit balance for investing in constructing, purchasing, leasing hotels and restaurants for sale, lease, or lease-purchase; credit balance for customers buying, leasing houses for sale, lease; credit balance for customers buying, receiving transfer, leasing land use rights for business; other real estate business credit balances;

b) Balance of guarantees for future-formed housing;

c) Total credit balance in the real estate business sector;

d) Proportion of credit balance for business activities in the real estate sector compared to the total credit balance of the entire economic sector (%).

5. The Ministry of Justice shall cooperate and share information and data on the quantity and value of real estate transactions through notarization activities.

Article 29. Sharing, Connecting, Providing Information and Data on the Housing and Real Estate Market Information System and Database of the Provincial People's Committee

The provincial People's Committee shall share and provide information and data specified in Chapter III of this Decree to the Ministry of Construction for updating and supplementing the housing and real estate market database.

Article 30. Sharing, Providing Information and Data on the Housing and Real Estate Market Information System and Database of Real Estate Project Investors and Real Estate Service Business Organizations

1. Real estate project investors shall provide information and data to the provincial People's Committee where the project is located for updating and supplementing the housing and real estate market database, including:

a) Information on real estate transactions of the project as stipulated in Clause 1, Article 19 of this Decree;

b) Information and data on housing projects as stipulated in Article 15 and Clause 1, Clause 2, Article 16 of this Decree and information and data on real estate projects as stipulated in Article 18 of this Decree.

2. Real estate project investors shall publicly disclose information about real estate and real estate projects put into business operation in accordance with laws on real estate business.

3. Real estate service business organizations shall provide information and data to the provincial People's Committee in accordance with Article 22 of this Decree.

Article 31. Methods and Frequency of Sharing, Connecting, and Providing Information and Data

1. Methods of sharing, connecting, and providing information and data include:

a) The connection and sharing of information and data between state management agencies shall be carried out through APIs integrated into the housing and real estate market information system in accordance with Appendix II attached to this Decree;

b) The connection and provision of information and data from organizations and individuals to state management agencies shall be carried out through software systems of the housing and real estate market information system and database.

2. The information and data specified in Articles 28, 29, and 30 of this Decree shall be shared and provided through APIs and software systems in real-time when changes occur.

3. Prior to technical connection, the agency or unit sharing, connecting, and providing data must fully upload metadata onto the common data dictionary in accordance with current laws.

Article 32. Processing Information and Data

1. Agencies, organizations, and individuals sharing and providing information and data on housing and the real estate market shall bear legal responsibility for the accuracy and legality of the information and data.

2. The provincial People's Committee shall be responsible for checking and processing information and data before they are integrated and stored in the housing and real estate market information system and database to ensure their accuracy, rationality, and consistency, including:

a) Information and data shall be reviewed and cleaned to ensure there are no duplicates;

b) Ensuring that information and data updated into the housing and real estate market database are verified by digital signatures and digital signature certificates of reliable service providers;

c) Ensuring that information and data are electronically verified regarding the subject providing them, digitally signed with timestamp, and logged with access traces.

3. In cases of modifying information and data on the housing and real estate market information system, the local agency managing the housing and real estate market database shall be responsible for coordinating checks, reviews, modifications, updates, and supplements to the information and data based on written requests from relevant agencies and organizations.

Chapter V
EXPLOITATION OF THE INFORMATION SYSTEM AND DATABASE
ON HOUSING AND THE REAL ESTATE MARKET

Article 33. Exploitation of information and data on housing and real estate market

1. The Ministry of Construction shall exploit all information and data integrated, connected, shared, provided, and updated on the system of information and database on housing and the real estate market; activities related to personal data and main data must comply with the provisions of the law on protection of personal data and the regulations on national data architecture framework and national data governance and management framework; access to data shall be carried out according to a permission-based mechanism, supervision, and clearly described purposes; for sensitive data, anonymization or special access rights including:

a) Data shared and connected from national databases on population, land, construction, planning, and specialized databases on investment, finance, tax, banking, notarization of ministries and sectors as stipulated in Article 28 of this Decree;

b) Information and data from provincial People's Committees as stipulated in Article 29 of this Decree.

2. Ministries and sectors as stipulated in Article 28 of this Decree shall exploit information and data to serve their state management work. In cases where exploitation of housing and real estate market data exceeds the scope of management, approval from the authority managing the housing and real estate market information system is required.

3. Provincial People's Committees shall exploit all data on housing and the real estate market within their localities.

4. Organizations and individuals requiring specialized and detailed information and data on housing and the real estate market as specified in Appendix VI attached to this Decree shall submit request forms according to the model form at Appendix III attached to this Decree to the Ministry of Construction through the following methods: online submission via the National Public Service Portal, direct submission at the one-stop service window of the Ministry of Construction, submission via postal services, or submission through the administrative procedure resolution system of the Ministry of Construction.

5. Forms of exploitation and utilization of information on housing and the real estate market include:

a) Direct exploitation and utilization through the portal of the housing and real estate market information system;

b) Exploitation and utilization through online data connection and sharing between information systems;

c) Exploitation and utilization through sending documents to competent authorities.

6. Within no more than seven days from the date of receiving the application for exploitation and utilization rights of information and data on housing and the real estate market, the Ministry of Construction shall consider granting access, exploitation, and utilization rights of such information and data in electronic form or according to the notification model at Appendix IV attached to this Decree; in case of refusal to provide exploitation and utilization rights, a response with clear reasons must be given according to the notification model at Appendix V attached to this Decree.

7. Information classified as state secrets, information related to other citizens' identifying data, and information related to business operations of enterprises shall not be exploited except when serving the activities of state management agencies.

8. Foreign organizations may only access and exploit information and data through secure APIs or anonymous copies; they are not allowed to copy original data containing identifying information.

9. Cross-border sharing and transfer of information and data must comply with the provisions of the law on data before provision.

Article 34. Costs for Exploiting Information and Data

1. The sharing of information and data between state agencies shall be without charge, except where otherwise provided by law.

2. Organizations and individuals exploiting information and data as stipulated in Clause 4, Article 33 of this Decree must pay costs related to the exploitation and use of such information and data in accordance with laws on pricing.

Article 35. Disclosure of Information on Housing and Real Estate Market

1. The Ministry of Construction shall disclose comprehensive information on housing and the real estate market nationwide on the housing and real estate market information system at the website address https://batdongsan.xaydung.gov.vn, on a quarterly basis: before the 15th day of the first month following the quarter in which the disclosure was made.

2. Provincial People's Committees shall disclose comprehensive information on housing and the real estate market within their jurisdiction on the portal of the housing and real estate market information system and on the local-managed electronic information page on a quarterly basis: before the 15th day of the first month following the quarter in which the disclosure was made.

Chapter VI
IMPLEMENTATION

Article 36. Responsibilities of the Ministry of Construction

1. To be responsible before the Government for performing state management functions regarding construction, managing, and using the housing and real estate market information system and database.

2. To carry out inspections, urging, guiding relevant ministries, sectors, and localities across the country on the construction, management, exploitation, connection, sharing, updating, and use of the housing and real estate market information system; to compile the implementation situation of relevant ministries, sectors, and localities in standardizing, collecting, sharing, connecting, and interlinking data; to report to the Government for consideration and handling difficulties and obstacles during the implementation process; to utilize allocated capital to build, upgrade technical infrastructure and information technology systems, software systems, and databases, and maintain the regular operation of the housing and real estate market information system in accordance with current regulations; to be the focal point for receiving and compiling information on housing and the real estate market shared and provided by relevant ministries, sectors, and localities.

3. To organize the building and upgrading of a unified software system for managing and operating the housing and real estate market information system; to build and upgrade technical infrastructure and information technology systems for housing and the real estate market to meet the connection requirements with relevant ministries, sectors, and localities across the country; to build databases, manage, and organize the operation of the housing and real estate market information system at the central level; to share and provide information on housing and the real estate market to agencies, organizations, and individuals in accordance with the law.

4. To develop plans and manage the use of allocated capital for surveys, building databases, constructing, maintaining, and upgrading technical infrastructure and information technology systems, and software serving the management, operation, and exploitation of the housing and real estate market information system in accordance with current regulations.

5. To disclose agencies, organizations, and individuals violating the provisions of this Decree on the housing and real estate market information system.

6. To take the lead, coordinate, and urge relevant ministries, sectors, and localities to implement the contents prescribed in this Decree.

Article 37. Responsibilities of Ministries, ministerial-level agencies, and government agencies

1. Build, operate, and standardize pre-existing data before this Decree takes effect on their information systems and databases to ensure connectivity and sharing of information and data with the housing and real estate market information system and database.

2. Bear responsibility before the Government for sharing, connecting, and providing relevant information related to the housing sector and the real estate market as prescribed in this Decree within their scope of management functions to the housing and real estate market information system and database; direct subordinate agencies located at localities to share and provide information as prescribed in this Decree.

3. The Ministry of Science and Technology shall appraise and announce national standards, appraise national technical regulations; support national scientific and technological research tasks on building, managing, and using the housing and real estate market information system.

Article 38. Responsibilities of Provincial People's Committees

1. Provincial People's Committees report to the same-level People's Council to decide on allocating annual funds from the local budget for the investigation, collection of information to serve the construction of databases, management, and operation of the housing and real estate market databases and investment, maintenance, and upgrading of the specified information technology infrastructure.

2. Develop and promulgate regulations on cooperation in constructing databases, sharing, and providing information and data on housing and the real estate market within their jurisdiction.

3. Collect, standardize pre-existing data before this Decree takes effect, share, and provide to the housing and real estate market information system and database.

4. Aggregate, report, and provide information about housing and the real estate market within their jurisdiction according to the provisions of this Decree.

5. Organize implementation or entrust the provincial state management agency for real estate business to implement:

a) Aggregate information and figures about housing and the real estate market within their jurisdiction according to the provisions of this Decree and report to the provincial People's Committee;

b) Guide, urge, and inspect relevant departments and organizations, real estate businesses within their jurisdiction to comply with the regulations on building, managing, and using the housing and real estate market information system and database as prescribed in this Decree;

c) Announce agencies, organizations, and individuals violating the provisions of this Decree on the electronic information website managed by the locality;

d) Serve as the point of contact for receiving information related to housing and the real estate market within their jurisdiction provided by agencies and organizations;

đ) Share and provide information to state management agencies as prescribed by law.

6. Direct the implementation of ensuring connectivity and interoperability between the housing and real estate market databases within their jurisdiction with other specialized databases that are related.

7. Implement or select organizations with sufficient capacity to survey, collect, and analyze information to serve the construction of the housing and real estate market database of the locality.

Article 39. Responsibilities and Authorities of Organizations and Individuals

1. Organizations and individuals shall have the responsibility to:

a) Implement sharing, reporting, and providing complete information on housing and the real estate market in accordance with regulations, within the prescribed time frame. They shall bear full responsibility for the content and data they provide and share. In cases where they cannot share or provide information within the prescribed timeframe due to force majeure or objective obstacles, they must submit a report in writing and share or provide the information immediately once conditions permit;

b) Bear legal responsibility for the accounts provided and be responsible for all activities conducted using their own accounts. In cases where passwords are lost, stolen, or it is discovered that someone is using their account without authorization, they must promptly notify the management and operation agency of the housing and real estate market information system;

c) Not distort, damage, or cause loss of information and data on housing and the real estate market; not illegally possess, destroy, or damage such information and data;

d) Not take advantage of information sharing to harass, profit from, or disseminate information contrary to legal provisions; obstruct the exploitation and use of information on housing and the real estate market as prescribed;

đ) Exploit and use information on housing and the real estate market in accordance with the provisions of this Decree and other relevant laws;

e) Not share or provide third parties with data shared or provided by state agencies with authority for exploitation and use, except when permitted by the authorized management agency of the housing and real estate market information system;

g) Promptly notify the management agency of the housing and real estate market information system about any errors in the information and data shared or provided.

2. Agencies, organizations, and individuals shall have the right to:

a) Refuse requests to share or provide information and data that contravene the provisions of this Decree and other relevant laws;

b) Lodge complaints or denunciations in accordance with the law when their rights to exploit and use information are violated.

Article 40. Transitional Provisions

1. Ministries, ministerial-level agencies, government agencies, and provincial People's Committees shall undertake the construction, updating, and standardization of existing data before the effective date of this Decree, ensuring that information related to housing and the real estate market is fully provided, serving integration and connection for sharing and providing information and data into the housing and real estate market information system and database no later than July 1, 2026.

2. In cases where, at the time this Decree comes into effect, software systems, databases, or technical infrastructure of ministries, ministerial-level agencies, and government agencies have not met the requirements for connection and data sharing as prescribed, relevant agencies, organizations, and individuals shall continue to implement reporting and information provision regimes as stipulated in Decree No. 94/2024/NĐ-CP dated July 24, 2024 of the Government until the upgrade, standardization, and connection are completed in accordance with the deadline set out in Clause 1 of this Article.

Article 41. Effective Date

1. This Decree shall take effect from March 1, 2026.

2. From the date this Decree takes effect, Decree No. 94/2024/NĐ-CP dated July 24, 2024 of the Government detailing certain provisions of the Law on Real Estate Business regarding the construction and management of information systems and databases on housing and the real estate market shall cease to be effective, except for the cases specified in Clause 2 of Article 40 of this Decree.

Article 42. Responsibility for Implementation

1. The Minister of Construction shall be responsible for guiding, inspecting, and urging the implementation of this Decree.

2. Ministers, heads of ministerial-level agencies, heads of government agencies, Chairpersons of provincial People's Committees, and municipal People's Committees directly under the central government within their respective functions and authorities shall be responsible for guiding and implementing this Decree.
