CIRCULAR

Regulations on the Technical Classification of Inland Waterways

Pursuant to the Law on Inland Waterway Traffic dated June 15, 2004;

Pursuant to Decree No. 51/2008/NĐ-CP dated April 22, 2008 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Transport;

Considering the proposal of the Director of the Infrastructure Department and the Director of the Vietnam Inland Waterway Administration;

The Minister of Transport hereby issues this Circular on the Technical Classification of Inland Waterways,

Article 1. Scope of Regulation

This Circular stipulates the technical classification of national inland waterways.

Article 2. Applicability

This Circular applies to organizations and individuals involved in the management, maintenance, renovation, upgrading of inland waterways; design and construction of related works, and organizations operating inland waterway transport.

Article 3. Explanation of Terms

In this Circular, the following terms are understood as follows:

1. Special inland waterways are those with a technical classification higher than Class I.

2. The dimensions of inland waterways refer to the depth, width, and radius of curvature of the navigation channel corresponding to each technical classification of inland waterways.

Article 4. Principles for Determining the Technical Classification of Inland Waterways

1. Pursuant to Clause 3 of National Standard TCVN 5664:2009 on the Technical Classification of Inland Waterways issued together with Decision No. 3082/QĐ-BKHCN dated December 31, 2009 of the Minister of Science and Technology.

2. The overall planning for the development of the inland waterway transport sector in Vietnam.

3. The current state of the navigation channels of inland waterways.

4. The dimensions of inland waterways according to seven technical classifications specified in Appendix I of this Circular.

Article 5. Technical Classification of National Inland Waterways

1. The technical classification of national inland waterways is specified in Appendix II of this Circular.

2. Annually, the Vietnam Inland Waterway Administration updates the technical classification of national inland waterways for submission to the Ministry of Transport for adjustment and supplementation.

Article 6. Effectiveness

This Circular takes effect from December 1, 2012.

Article 7. Implementation Organization

1. Based on Article 4 of this Circular, the People's Committees of provinces and centrally governed cities shall specify the technical classification of local inland waterway routes within their jurisdiction.

2. The Heads of the Ministry's Office, the Inspectorate, the Departments under the Ministry, the Director of the Vietnam Inland Waterway Administration, the Directors of Provincial Departments of Transport, the Heads of relevant agencies, organizations, and individuals are responsible for implementing this Circular.
