CIRCULAR

Regulations on Working Conditions for Lecturers at Teacher Training Colleges

Pursuant to the Education Law dated June 14, 2019;

Pursuant to the Law on Vocational Education dated November 27, 2014;

Pursuant to Decree No. 84/2020/NĐ-CP dated July 17, 2020 of the Government detailing certain provisions of the Education Law;

Pursuant to Decree No. 48/2015/NĐ-CP dated May 15, 2015 of the Government detailing certain provisionsof the Price Law Pursuant to Decree No. 69/2017/NĐ-CP dated May 25, 2017 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Education and Training;2. Amending and supplementing Clause 2 of Article 2 as follows:

The Minister of Education and Training issues this Circular regulating working conditions for lecturers at teacher training colleges.

At the proposal of the Director of the Department of Teachers and Educational Management Staff;

Article 1. This Circular regulates working conditions for lecturers at teacher training colleges and other colleges with teacher training majors at the college level (hereinafter referred to collectively as teacher training colleges), including: duties of lecturer positions; working hours, standard teaching hours, and scientific research; conversion of other professional activities into standard hours and overtime work beyond labor quotas.

 

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation and Applicability

Article 2. This Circular applies to lecturers teaching at teacher training colleges, lecturers at colleges teaching teacher training majors at the college level under the management authority of the Ministry of Education and Training, and related organizations and individuals.

Article 3. Duties of lecturer positions shall be implemented in accordance with Circular No. 35/2020/TT-BGDĐT dated October 1, 2020 of the Minister of Education and Training stipulating job code, qualification standards, appointment, and salary grading for lecturers in public teacher training colleges.

WORKING HOURS, STANDARD TEACHING HOURS AND SCIENTIFIC RESEARCH

Article 4. Working hours, standard teaching hours, and standard teaching hour quota

Chapter II

Clause 1. The working hours of lecturers during the academic year is 44 weeks (equivalent to 1,760 administrative hours) to perform teaching, scientific research, community service, and other professional tasks, determined according to the academic year after deducting the number of days off as prescribed.

Clause 2. Standard teaching hours are units of time converted from the necessary hours of labor required to complete a specific workload within the lecturer's duties equivalent to one theoretical class session at the college level (or online teaching), including the necessary labor time before, during, and after the class session.

Clause 3. Teaching hours in the training plan are calculated in standard teaching hours, where one theoretical class session at the college level (or online teaching) lasting 50 minutes is equivalent to one standard teaching hour and is specifically provided for in Clause 1, Article 6 of this Circular.

For special natured teaching contents, class sessions at the college level (or online teaching) exceeding 50 minutes shall be converted appropriately by the principal of the teacher training college.

Clause 4. The standard teaching hour quota for lecturers in one academic year ranges from 270 to 420 standard teaching hours (equivalent to 810 to 1,260 administrative hours); among which, direct classroom teaching (or online teaching) must ensure a minimum of 50% of the prescribed quota. The principal of the teacher training college shall determine the standard teaching hour quota for lecturers in one academic year based on the unit's development goals and strategies; the characteristics of subjects and majors, and specific conditions of the unit.

Clause 5. Special cases

Point a. During the probationary period or trial period, lecturers shall only perform up to 50% of the standard teaching hour quota, while being exempted from scientific research tasks to allocate time for observing classes and participating in internships and practical training.

Point b. During periods of receiving social insurance benefits or leave as stipulated in the current Labor Code, lecturers shall be exempted from the standard teaching hour quota in proportion to the duration of their leave.

5. Special cases

a) During the probationary or trial period, lecturers shall only perform up to 50% of the standard teaching hours quota, and shall be exempted from scientific research tasks to allocate time for observing classes and participating in internships and practical activities.

b) Lecturers during the period they are receiving social insurance benefits or on leave as prescribed by the current Labor Code shall be exempted from the standard teaching hours quota in proportion to the duration of their leave.

Article 4. Standard teaching hours quota for lecturers appointed to leadership positions or concurrently performing management, party, and mass organization work

1. Lecturers appointed to leadership positions or concurrently performing management, party, and mass organization work (excluding lecturers in national defense and security education) shall have the obligation to teach according to the minimum quota below (calculated as a percentage of the standard teaching hour quota prescribed in Clause 4, Article 3 of this Circular):

12 Lecturers engaged in non-professional defense and military work as stipulated in Decree No. 168/2018/ND-CP dated December 28, 2018 of the Government on defense work at central ministries and agencies, and localities 80%
13 Lecturers who are reserve soldiers or self-defense personnel called up for annual training and exercises, the time spent in training and exercises shall be converted into working days at a rate of 2.5 standard teaching hours per day.
14 Lecturers engaged in youth union, student association, and youth league work shall implement in accordance with Decision No. 13/2013/QD-TTg dated February 6, 2013 of the Prime Minister on the system and policies for cadres of the Communist Youth Union Ho Chi Minh, Vietnam Student Association, and Vietnam Youth League in educational institutions and vocational training centers.
15 Lecturers engaged in non-professional trade union work shall implement in accordance with Circular No. 08/2016/TT-BGDĐT dated March 28, 2016 of the Minister of Education and Training.

Based on specific conditions of the unit, the rector of the college of education shall specify the standard teaching hour quota in this clause, and simultaneously specify the standard teaching hour quota for other concurrent positions (if any) appropriately.

2. Lecturers in national defense and security education appointed to leadership positions or concurrently performing management, party, and mass organization work in colleges of education shall have the obligation to teach according to the quota prescribed in Article 5 of the Joint Circular No. 15/2015/TTLT-BGDĐT-BLDTBXH-BQP-BCA-BNV-BTC dated July 16, 2015 of the Ministers of Education and Training, Labor, Invalids and Social Affairs, Defense, Public Security, Home Affairs, and Finance.

3. Lecturers concurrently holding multiple positions shall apply the lowest standard teaching hour quota among the concurrent positions prescribed in this Article.

Article 5. Provisions on scientific research

1. Lecturers must dedicate at least 1/5 of their total working time in the academic year (equivalent to 352 administrative hours) to scientific research tasks.

2. The assignment and implementation of scientific research tasks for lecturers must be appropriate to the conditions, scientific potential, development strategy of the college of education, and the professional capabilities of the lecturers.

3. Each year, lecturers must complete the assigned scientific research tasks corresponding to their title or position. The results of the lecturers' scientific research will be evaluated through scientific and technological products, research activities, and technology transfer; at a minimum, equivalent to one department-level scientific research project that has been accepted and met requirements or higher; or one specialized report at a department-level scientific seminar or equivalent.

The rector of the college of education assigns scientific research tasks to lecturers and specifies the number of research hours that can be converted from various types of scientific and technological products, research activities, and technology transfer.

4. For lecturers who fail to complete the assigned scientific research tasks as required, the rector of the college of education will consider the assessment of the performance results in the academic year, ranking for commendation, and related policies based on the degree and specific circumstances; and allow these lecturers to convert standard teaching hours into research hours.

Chapter III

CONVERSION OF SPECIALIZED ACTIVITIES INTO STANDARD TEACHING HOURS AND WORK REGIME FOR EXCEEDING LABOR QUOTA

AND THE REGIME OF WORKING HOURS EXCEEDING THE LABOR QUOTA

Article 6. Conversion of Professional Activities into Standard Teaching Hours

1. Teaching

a) One theoretical lecture session (or online teaching) for up to 40 students is equivalent to 1.0 standard teaching hour; one theoretical lecture session combined with practical demonstration at training grounds, exercise fields for national defense and security education subjects, and physical education subjects is also equivalent to 1.0 standard teaching hour. For classes exceeding 40 students, depending on specific working conditions for each class in different majors, one direct theoretical lecture session (or online teaching) may be converted at a factor not exceeding 1.5. The Rector of the College of Education shall specify in detail the conversion of teaching activities into standard teaching hours under this clause.

b) One foreign language lecture session for non-language subjects is equivalent to 1.5 to 2.0 standard teaching hours.

2. Other Professional Activities

a) The Rector of the College of Education shall stipulate the conversion of time spent on other professional activities into standard teaching hours as appropriate;

b) For tasks that have been funded with remuneration from other sources, time spent on these tasks will not be converted into standard teaching hours; however, these tasks will be considered in the total standard teaching hour quota for evaluating annual performance for lecturers who do not exceed their labor quota.

Article 7. Overtime Work System Beyond Labor Quota

1. In one academic year, lecturers who teach, conduct scientific research, serve the community, and perform other professional tasks beyond their quota shall enjoy overtime work benefits according to the provisions of the law. The Rector of the College of Education shall base decisions on current state regulations and actual conditions of the unit to determine payment policies.

2. The annual overtime work time of lecturers shall not exceed the time stipulated by the law on labor.

Chapter IV

ORGANIZATION AND IMPLEMENTATION

Article 8. Responsibilities of the Rector of the College of Education

The Rector of the College of Education shall issue detailed regulations on the working system of lecturers based on this Circular; the goals and development strategies of the unit; the characteristics of each subject and major, and specific conditions of the unit, ensuring that each lecturer must concurrently fulfill teaching and scientific research duties.

Article 9. Implementation Provisions

1. This Circular takes effect from November 20, 2020.

2. The Director of the Office, the Director of the Department of Teachers and Educational Management Staff, the Heads of relevant units under the Ministry of Education and Training, and the Rectors of Colleges of Education are responsible for implementing this Circular./.
