On the State budget estimate for 2010

SOCIALIST REPUBLIC OF VIET NAM
BASED ON THE CONSTITUTION OF THE SOCIALIST REPUBLIC OF VIETNAM IN 1992 AS AMENDED AND COMPLEMENTED BY RESOLUTION NO. 51/2001/QH10;
Pursuant to the Law on the State Budget;
After considering Report No. 13/BC-CP dated October 16, 2009 of the Government submitted to the National Assembly on the State budget estimate for 2010; Report No. 1041/BC-UBTCNS12 dated October 16, 2009 of the Committee for Finance and Budget on the examination of the State budget estimate for 2010;
Report No. 287/BC-UBTVQH12 dated November 10, 2009 of the Standing Committee of the National Assembly on the State budget estimate for 2010 and the opinions of the National Assembly deputies,
RESOLUTION:
Article 1. Approves the State budget estimate for 2010:
- The total revenue of the State budget is VND 461,500 billion (four hundred sixty-one thousand five hundred billion dong), equivalent to 23.9% of gross domestic product; including VND 1,000 billion in transferred revenue from 2009 to 2010, the total revenue of the State budget is VND 462,500 billion (four hundred sixty-two thousand five hundred billion dong);
- The total expenditure of the State budget is VND 582,200 billion (five hundred eighty-two thousand two hundred billion dong);
- The deficit of the State budget is VND 119,700 billion (one hundred nineteen thousand seven hundred billion dong), equivalent to 6.2% of gross domestic product.

Article 2. Supports the measures to implement the State budget estimate for 2010 proposed by the Government and the recommendations of the Committee for Finance and Budget in its examination report, while emphasizing the following key measures:
1. Continue to implement flexible fiscal policy with strict control, striving to increase revenue, thoroughly save expenses, and improve the efficiency of spending, aiming to reduce the State budget deficit in 2010 below 6.2% of gross domestic product and gradually decrease it in subsequent years. Coordinate fiscal policy with monetary policy and other policies in a synchronized manner to contribute effectively to the overall economic and social goals for 2010.
2. The Government shall organize the implementation of tax laws, resolutely direct tax collection activities, minimize arrears and tax evasion, especially in tax declaration. Continue to study amendments and supplements to tax laws to align with current realities and international economic integration commitments. Cease tax exemptions and reductions under Resolution No. 32/2009/QH12 of the National Assembly; implement deferred payment of corporate income tax for small and medium-sized enterprises, textile, leather, and footwear manufacturing enterprises for one quarter.
3. Strictly manage State budget expenditures in accordance with the Law on the State Budget and the Resolutions of the National Assembly; address the issue of unauthorized and non-compliant over-budget spending. Review and rearrange public investment according to priority order; gradually reduce the proportion of capital investment from the State budget while promoting socialization of investment in areas where other economic sectors can participate. Continue salary reform, increasing the minimum wage from VND 650,000 per month to VND 730,000 per month starting May 1, 2010; enhance the ability to ensure social welfare, agricultural and rural development, national defense, and security spending; prioritize funding for key projects and works that need to be completed in 2010-2011, particularly in poor regions with unbalanced budgets.
In cases where general State budget revenue increases, oil revenue increases, and the amount of transferred funds exceeds the State budget estimate, the Government shall report to the Standing Committee of the National Assembly for consideration and comments in accordance with the law, prioritizing first and foremost the reduction of the State budget deficit, followed by urgent needs for development investment and social welfare assurance; if efforts are made but revenue shortfalls occur, failing to ensure development investment, the Government shall report to the Standing Committee of the National Assembly for consideration and comments on the handling plan.
In 2010, issue government bonds worth VND 56,000 billion to invest in projects and works within the scope and list approved for government bond funding under the National Assembly's Resolution; adjust the total investment amount for projects and works due to objective reasons to align with reality; reallocate funds between projects and works in line with progress and completion capacity. The Government shall develop the allocation plan for government bonds in 2010, report to the Standing Committee of the National Assembly for consideration and decision before implementation.
Strengthen management of expenditures outside the State budget balance, loans for relending, government guarantees for loans, financial funds outside the State budget, local government loans, and budget advances in accordance with the law. Review and recover budget advances on time, following the principle of settling advances at the end of the fiscal year or deducting them from the next year's budget estimate. Address the issue of excessively large advances and long-term advance periods. At the same time, allocate and balance sources of funds to settle outstanding advances reasonably for projects and works decided by competent authorities but not resolved in previous years.
Summarize, evaluate, and review national target programs and other programs; allocate total funds for these programs and assign them to localities. Based on actual conditions, localities shall decide on integrating programs and specifically allocating funds to programs, focusing on those likely to be completed in 2010.
Continue to grant autonomy to public service units and promote socialization of public services, especially healthcare and education, at a higher level; encourage various economic sectors to participate in providing public services.
Organize the summary of the implementation of the State finance and budget tasks for the period 2006-2010 and 2001-2010; outline the development direction of State finance and budget for the period 2011-2015 and the strategy for 2011-2020.
Article 3. Supervise the implementation of the State budget estimate for 2010.
The Standing Committee of the National Assembly, the Finance-Budget Committee, the National Ethnic Council, and other Committees of the National Assembly, Delegations of National Assembly Members, and National Assembly Members shall supervise the implementation of the state budget in a practical and effective manner across various fields and areas within their respective jurisdictions as prescribed by law.
This Resolution was adopted by the Sixth Session of the Twelfth National Assembly of the Socialist Republic of Vietnam on November 11, 2009./.
