THE MINISTER OF INDUSTRY AND TRADE

Pursuant to Decree No. 189/2007/NĐ-CP dated December 27, 2007 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Industry and Trade;

Pursuant to the Law on Competition and Reward dated November 26, 2003 and the Law Amending and Supplementing Certain Provisions of the Law on Competition and Reward dated June 14, 2005;

Pursuant to Decree No. 121/2005/NĐ-CP dated September 30, 2005 of the Government detailing and guiding the implementation of certain provisions ofthe Law on Competition and Reward and the Law Amending and Supplementing Certain Provisions of the Law on Competition and Reward;

Article 1. These accompanying Regulations on awarding the Women's Scientific Creativity Award in Industry and Trade are hereby issued.

Article 2. This Decision shall take effect fifteen days from the date of publication in the Official Gazette, replacing Decision No. 31/2000/QĐ-BCN dated May 4, 2000 of the Minister of Industry on establishing the Women's Scientific Creativity Award.

Article 3. The Head of the Ministry’s Office, the Inspector General, Heads of Departments, Directors of Bureaus, and Heads of units under the Ministry are responsible for implementing this Decision.

 

REGULATIONS

Regulations on awarding the Women's Scientific Creativity Award in Industry and Trade

(Issued together with Decision No. 38/2008/QĐ-BCT dated October 21, 2008 of the Minister of Industry and Trade)

Chapter 1.

GENERAL PROVISIONS

Article 1. Scope of Regulation

These Regulations provide for the awarding of the Women's Scientific Creativity Award in Industry and Trade (hereinafter referred to as the Award) concerning scientific and technological works and research topics that have been published and used since 2006.

Article 2. Applicability

The Women's Scientific Creativity Award in Industry and Trade is awarded to outstanding scientific research works and topics of exceptional merit and value in science and technology, serving as a form of recognition by the Ministry of Industry and Trade of the contributions of female collectives and individuals who have actively contributed to the construction and development of the Industry and Trade sector in Vietnam.

Article 3. Time of Awarding

The Award is presented and announced annually on March 8.

Article 4. Definitions

In these Regulations, the following terms shall be understood as follows:

1. Scientific and technological research work eligible for the award is a scientific and technological research work that creates new products; products manufactured for the first time in Vietnam; improves productivity and quality, reduces costs to enhance product competitiveness; has significant implications for economic and social development, contributing positively to the industrialization and modernization of the country; involves innovative application of new or high technologies.

2. Research topic eligible for the award is a research topic that explores scientific inventions, scientific theories leading to important changes in understanding with significant impacts on science, economy, and society within the Industry and Trade sector and the country.

3. Author of the research work or topic is the person who proposes, leads the organization and implementation, and creates the work.

4. Co-author of the research work is someone who participates in proposing and leading important parts of the work. Those who only provide technical, material, or financial support without participating in creating the work are not considered authors or co-authors.

5. is a dossier containing all required documents with complete and accurate declarations in accordance with the law. are those applications submitted on time, complete with all required documents and materials as stipulated in Clause 1 of Article 13 of these Regulations, without disputes over copyright, and without complaints about the content and results of the research work or topic at the time of awarding the prize.

Article 5. Principles for Awarding the Prize

1. The selection process must be publicly announced on the Ministry of Industry and Trade's electronic information website and the Vietnam Industry and Trade Newspaper. Any organization or individual meeting the stipulated conditions may register to participate.

2. The selection process shall be notified in writing to organizations and individuals directly responsible for implementing research topics.

3. The selection and evaluation process shall be carried out through decisions made by the Prize Awarding Council.

Chapter 2

CRITERIA FOR AWARDING THE PRIZE

Article 6. Conditions for Participation in the Prize

Research works and scientific studies considered for the Prize must meet the following conditions:

1. They have been accepted and put into effective application by the basic-level Scientific Council and the Ministry-level Scientific Council.

2. They involve research in one of the following fields:

a. Fields within industries including heavy industry, light industry, and energy;

b. Fields within the trade sector;

c. Scientific research serving state management work in the industry and trade sectors;

3. There must be no disputes over copyright or complaints about the content and results of the work at the time of award consideration.

4. Authors of research works and scientific studies considered for the Prize

a. For female authors:

- Successfully completing assigned tasks;

- Strictly adhering to the Party and State's policies, guidelines, and laws;

- Having good moral character, organizational discipline awareness, and not being under disciplinary action;

b. For groups:

The group author must consist of at least 70% women and must have continuously received the title of outstanding labor collective for at least two consecutive years or been awarded a Certificate of Merit by the Minister.

5. The work proposed for the Prize must have been published or applied in practice for at least one year as of the date of submitting the application for award consideration.

Article 7. General Standards for Participation in the Prize Awarding Process

Scientific and technological works, clusters of scientific and technological works hereinafter referred to as works.

Research and development works and technological innovation works considered for the Prize must meet the following standards:

1. Technological value with creativity and significant technological innovation:

a. Solving issues related to technological improvement, developing or creating new products;

b. Contributing to promoting production structure transformation, creating conditions for the formation and development of new industries, enhancing product competitiveness, and industry competitiveness;

c. Basic economic and technical indicators of the product or technology reaching international levels or exceeding those of similar domestic products, processes, or systems (specific comparison addresses should be provided);

d. Developing comprehensive plans with accompanying technical solutions or making significant technical improvements to successfully and creatively apply advanced technologies in economic and technical projects, having a decisive impact on their effectiveness.

2. Economic and social benefits and contributions to science and technology:

a. Creating very large economic or socio-economic benefits, making significant contributions to socio-economic development;

b. Making important contributions to the development of science and technology in the industry.

Article 8. Criteria for scientific research topics eligible for Award consideration

Scientific research topics considered for the Award must meet the following criteria:

1. Achieve an outstanding level as evaluated by a Ministry-level or State-level Scientific Council.

2. Be applied in practice to produce new products; products manufactured for the first time in Vietnam; increase productivity, reduce costs to enhance product competitiveness recognized by society;

3. Include inventions, patents, utility models that have been registered and protected by competent state authorities.

4. Propose valuable theoretical insights clarifying the path for the development of science and technology in the industry; provide particularly important contributions to the formulation of sustainable development policies and economic integration through scientific arguments, offering a deep theoretical and practical basis for the process of industrialization and modernization of the country.

5. Basic research results oriented towards application have a decisive impact on the selection, absorption, mastery, and development of advanced technologies imported from abroad into Vietnam.

6. Make particularly significant contributions to the development of the Industry and Trade sector.

Chapter 3.

PROCEDURE AND PROCEDURES FOR AWARD CONSIDERATION

Article 9. Levels of the Award Consideration Council

The award consideration process is conducted at two levels:

1. Basic level;

2. Ministry level.

Article 10. Principles of Operation of the Award Consideration Council

1. The Award Consideration Councils at all levels shall consist of representatives from institutions applying the results of the works, reputable scientists, technologists, managers with appropriate expertise and in-depth knowledge of the field of science of the work.

2. Each member of the Award Consideration Council is responsible for reviewing, commenting, and evaluating the award proposal dossier in writing. The basic level and Ministry level Award Councils assign two experts with in-depth knowledge of the field of science of the work to write comments and evaluate the work.

3. The Award Consideration Council operates according to the following principles:

a. An evaluation meeting of the Award Consideration Council (with voting) must have at least 3/4 of the Council members present, including the Chairman or Vice-Chairman and at least one Reviewer Member. In the absence of a Reviewer Member, a written comment and evaluation must be provided.

b. The Council evaluates works based on fairness, democracy, and objectivity. Works receiving at least 3/4 of the votes from the present members of the Council may be referred to the higher-level Council for consideration.

c. The higher-level Award Consideration Council only considers works proposed by the basic-level Award Consideration Council.

d. Members of the Award Consideration Council must not participate in research projects or topics where they are authors or co-authors.

Article 11. Procedure for Awarding the Award

Heads of units under the Ministry establish the basic-level Award Consideration Council and are responsible for publicly announcing the results of the award consideration within their unit before submitting the award proposal dossier to the Ministry-level Award Consideration Council.

Article 12. Application Documents for Awarding the Grassroots Level Prize

1. The application documents for awarding the grassroots level prize include:

a. The author's scientific curriculum vitae;

b. The application form for awarding the Women's Scientific Creativity Prize;

c. A summary report of the research project and a full report of the research project;

d. Intellectual property certificates (if applicable);

e. Comments from organizations or individuals using the results of the research project;

g. Certificates of technological appraisal or measurement and testing reports of science and technology products of the research project;

h. Confirmation letter of submission of the research result report to the management agency of the research project;

i. Other related documents (if applicable);

2. Organization for awarding the grassroots level prize

a. Research projects must be registered and awarded at grassroots units with legal personality, where the author of the research project is managed or where the author works;

b. The head of the grassroots unit is responsible for establishing the Grassroots Level Prize Award Council. The Grassroots Level Prize Award Council shall have from seven to nine members. The Chairman of the Grassroots Level Prize Award Council must be a reputable scientist who understands the field of the research project. In cases of shortage of experts in the relevant field, the head of the grassroots unit may invite external experts to join the Grassroots Level Prize Award Council;

c. The Grassroots Level Prize Award Council is responsible for reviewing and evaluating each research project: Writing review forms, confirming the list of co-authors, voting on evaluations, counting votes, drafting evaluation minutes, and submitting the application documents for awarding the prize to the Ministry-level Prize Award Council;

Article 13. Application Documents for Awarding the Ministry-level Prize

1. The application documents for awarding the ministry-level prize include:

a. The author's scientific curriculum vitae;

b. The official letter requesting the awarding of the Women's Scientific Creativity Prize from the head of the grassroots unit;

c. The application documents for awarding the grassroots level prize;

d. Minutes of the grassroots level prize award council;

2. The Ministry-level Prize Award Council will only consider valid application documents;

3. The final deadline for submitting application documents for awarding the ministry-level prize is October 30th each year. The date of receipt is calculated based on the postmark (in case of postal submission) or the "Received Document" stamp of the Ministry of Industry and Trade (in case of direct submission);

Article 14. Organization of the Ministry-level Prize Award Council

1. The Ministry-level Prize Award Council is established by the Minister of Industry and Trade;

2. The Science and Technology Department is responsible for assisting the leadership of the Ministry in organizing the awarding of the ministry-level prize to evaluate and select research projects;

3. The Ministry-level Prize Award Council shall have from nine to eleven members, and it is responsible for reviewing, evaluating, and selecting research projects that meet the award criteria: Writing review forms, voting on evaluations, counting votes, drafting evaluation minutes to propose commendations to the Ministry leadership;

Article 15. Timeframe for Awarding the Prize at Each Level

1. The awarding of the Women's Scientific Creativity Prize at the grassroots level must be completed before September 30th each year;

2. The awarding of the Women's Scientific Creativity Prize at the ministry level must be conducted from October 30th to February 15th each year.

Article 16. Right to Confidentiality

The works participating in the Award shall be guaranteed confidentiality regarding their content by the Organizing Committee and stored as classified documents to protect the interests of the participants.

Chapter 4.

IMPLEMENTATION

Article 17. Implementation Organization

1. The Science and Technology Department shall take the lead and coordinate with relevant units to assist the Minister in implementing this Regulation.

2. The Department of Mobilization for Competitiveness and Rewards shall serve as the permanent agency assisting the Award Council, responsible for coordinating with the Science and Technology Department to verify the validity of the nomination files for the Award.

Article 18. Complaints and Reports

1. Organizations and individuals have the right to complain about the results of the Award selection process and violations of regulations, procedures, and formalities for the Award selection process.

2. Complaint letters must clearly state the full name and address and be sent to the head of the agency that established the Award Selection Council at the corresponding level.

3. The head of the agency that established the Award Selection Council, upon receiving a complaint letter, shall be responsible for reviewing and responding to the complaint letter, and shall not consider complaints without clear names or addresses or those made under false pretenses.

Article 19. Amendments and Supplements

During implementation, if there are any difficulties, units and individuals shall promptly report them to the Ministry of Industry and Trade for review and adjustment to ensure compliance.
