Article 1. Scope of Regulation

1. Article 2. Subjects of Competition for Excellence and Commendation

1. - Office of the President of the StateSubjects of competition for excellence:g||| Commendation:

a) Units under the Ministry including: Departments, Bureaus, General Bureaus, the Ministry's Inspectorate, and the Ministry's Office;

b) Directly subordinate units of the Ministry;

c) Provincial Health Services and health services of ministries and sectors under central cities;policiesd) Funds, Programs, Projects, and other state agencies related to the healthcare sector;

e) Private healthcare facilities;policies;

f) Departments, divisions, and equivalent units directly under the agencies and organizations specified in points a, b, c, and d of this clause;Y||| private healthcare organizations;

Average loan repayment period is 10 years;g) Civil servants, public officials, employees, and workers who have worked for at least one year in the agencies and units specified in points a, b, c, d, and e of this clause.|||||| Clause 2 of this Article;

||| g) Civil servants, public officials, employees, and workers under labor contracts for at least one year at agencies and units specified in points a, b, c, d, and e of this Clause.VND|||,|||

2. Subjects of Commendation:in||| a) Medical institutions; organizations and individuals of overseas Vietnamese and foreign organizations and individuals with outstanding achievements and contributions to the development of the healthcare sector in Vietnam.

|||. The Department of Environmental Health Inspection - Ministry of Health shall be responsible for disseminating, guiding, and supervising the implementation of this Circular throughout the country.a) The subjects specified in Clause 1 of this Article;

b) Domestic agencies, organizations, and individuals outside the healthcare sector; organizations and Vietnamese citizens residing abroad, and foreign organizations and individuals who have made outstanding contributions to the development of the Vietnamese healthcare sector.g|||g||||||policies|||

Article 3. Principles for Awarding Titles of Excellence and Forms of Commendation

Principles for awarding titles of excellence and forms of commendation in the healthcare sector shall be implemented in accordance with the provisions of Article 6 of the Law on Competition for Excellence and Commendation 2003; Article 3 of Decree No. 91/2017/ND-CP dated July 31, 2017 of the Government detailing the implementation of certain articles of the Law on Competition for Excellence and Commendation (hereinafter referred to as Decree No. 91/2017/ND-CP); Clause 4 of Article 2 of Circular No. 08/2017/TT-BNV dated October 27, 2017 of the Minister of Home Affairs detailing the implementation of certain articles of Decree No. 91/2017/ND-CP dated July 31, 2017 of the Government detailing the implementation of certain articles of the Law on Competition for Excellence and Commendation (hereinafter referred to as Circular No. 08/2017/TT-BNV), and the following principles:đ||| Forms of commendation and rewards in the healthcare sector shall be carried out in accordance with Decree No. 91/2017/ND-Cabinet (hereinafter referred to as Decree No. 91/2017/ND-Cabinet); Clause 4, Article 2 of Circular No. 08/2017/TT-MOLISA dated October 27, 2017, issued by the Minister of Home Affairs detailing the implementation of certain provisions of Decree No. 91/2017/ND-Cabinet dated July 31, 2017, of the Government detailing the implementation of certain provisions of the Law on Competition and Reward (hereinafter referred to as Circular No. 08/2017/TT-MOLISA), and the following principles:1. Do not consider for awarding titles of excellence or forms of commendation to collectives or individuals during the period when the competent authority is considering disciplinary action, administrative violation handling, or during the investigation, prosecution, trial process that has not yet been concluded; or during the verification and clarification of complaints or denunciations.,||||||- Office of the President of the State|||||||||

2. In one year, no more than two Certificates of Merit from the Minister of Health can be proposed for a collective or an individual (except for special cases of commendation for outstanding and sudden achievements). Do not commend collectives or individuals for participating in conferences, seminars, symposiums, dialogues, or similar events serving political, cultural, or social occasions. Commendation on the occasion of the anniversary of the establishment of the unit, the traditional day of the sector, or each related field shall only take place in round years (10 years).|||||| For special awards, no more than one Certificate of Merit from the Minister of Health can be proposed each year.

Article 4. Basis for awarding commendation titles and forms of reward

Article 4. Basis for awarding commendation titlesforms of reward in the healthcare sector shall be implemented in accordance with the provisions of Article 10 of the 2003 Law on Commendation and Reward and Clause 7, Point 2, Article 2 of Circular No. 08/2017/TT-BNV, and based on the following provisions:

1. Not toDeclaration, re-declarationgrant commendation titles to collectives or individuals who have not registered for commendation or who have registered outside the prescribed time limit.

2. Heads of agencies and organizations specified in Points a, b, c, d, đ, and e of Clause 1, Article 2 of this Circular shall organize for individuals and collectives under their agencies and organizations to register for commendation.organize credit institutions, foreign bank branches are responsible for organizing the implementation of this Circular.|||developmentThe registration for commendation shall be compiled into a list according to the content and specific criteria for commendation titles as per Model 01 of Appendix 01 issued together with this Circular and shall be submitted to the following entities before April 10 each year:đa) Commendation titles: Outstanding Labor Collective, Ministry of Health Flag of Merit, Government Flag of Merit, Meritorious Soldier at the Ministry Level, National Meritorious Soldier – to be sent to the Standing Committee of the Ministry of Health's Commendation and Reward Council;đb) Commendation titles: Advanced Worker, Meritorious Soldier at the Grassroots Level – to be sent to the Standing Committee of the Commendation and Reward Council at the grassroots level.3. Commendation titles shall be considered for award annually at the end of the working year or academic year.4. When considering rewards for deputy heads or vice leaders of agencies and organizations, their achievements in the collective or field they are responsible for must be taken into account.đ5. The Minister of Health may grant rewards in response to thematic campaigns initiated by the Ministry of Health or outstanding and exceptional achievements to collectives and individuals under provincial and ministry-level management, political organizations, political-social organizations, and other organizations.g6. Working period for individuals:

a) Employees on maternity leave as stipulated by law; persons who bravely save lives or property, or those injured while serving in combat and require treatment or convalescence as concluded by medical facilities at district level or higher, the time spent on leave, treatment, or convalescence shall be counted as a basis for awarding commendation titles and forms of reward;b) Individuals attending short-term training courses under one year, complying with the regulations of the training institution, can combine their work time at the agency or organization to evaluate for commendation titles and forms of reward;gc) In cases where individuals are assigned to attend training or further education for one year or more, comply with the regulations of the training institution, and achieve good grades or better (if evaluated at the time of assessment), such time can be counted towards consideration for commendation titles and forms of reward;

d) For individuals transferred to new positions, if they worked at the previous unit for six months or more, the new unit shall be responsible for reviewing and voting on commendation titles and forms of reward based on the comments from the previous unit;organize credit institutions, foreign bank branches are responsible for organizing the implementation of this Circular.đ) Not to grant the title of Advanced Worker to individuals who have been employed for less than ten months or have been disciplined with a warning or worse.,7. Duration of operation for agencies and organizations: must have operated officially for twelve months or more.đ8. Voting ballots for commendation titles and forms of rewardga) When considering the titles of Advanced Worker, Meritorious Soldier at the Grassroots Level, Outstanding Labor Collective, Ministry of Health Flag of Merit, Government Flag of Merit, Prime Minister's Certificate of Merit, and various types of Orders, the number of votes in favor must reach seventy-five percent or more of the total members of the Commendation and Reward Councils at all levels (in case of absentees, opinions are obtained through voting ballots); for cases where ballots are collected from collectives, the number of votes in favor must exceed fifty percent of the total number of officials, civil servants, public officials, and employees under one-year contracts or longer (in case of absentees, opinions are obtained through voting ballots);,b) When considering the titles of Meritorious Soldier at the Ministry Level, National Meritorious Soldier, Honorary Titles of the State, Ho Chi Minh Prize, State Prize, all members of the Commendation and Reward Councils at all levels must vote secretly, and the number of votes in favor must reach ninety percent or more of the total number of members (in case of absentees, opinions are obtained through voting ballots); for cases where ballots are collected from collectives, the number of votes in favor must exceed fifty percent of the total number of officials, civil servants, public officials, and employees under one-year contracts or longer (in case of absentees, opinions are obtained through voting ballots);

c) Voting ballots shall be in the form of Model 02 of Appendix 01 issued together with this Circular.đ||| Organizations specified in points a, b, c, d, e, and f of Clause 1 of this Circular organize annual competitions for individuals and collectives.đ|||

|||in||| When considering rewards for individuals, the achievements of the collective or field they are responsible for must be taken into account if they are the head or deputy head of the agency or organization.đ|||

||| Voting ballots for honorary titles and rewardsđ||| a) When assessing the title of Advanced Worker, Outstanding Labor Collective, Excellent Labor Collective, Flag of Competition of the Ministry of Health, Flag of Competition of the Government, Certificate of Merit from the Prime Minister, Orders, the number of votes in favor must reach at least 75% of the total number of members of the Competition and Reward Council at all levels (in case of absence, opinions are collected through voting ballots); for cases where ballots are collected from collectives, the number of votes in favor must exceed 50% of the total number of civil servants, public officials, employees, and workers under labor contracts for at least one year (in case of absence, opinions are collected through voting ballots).ý||||||intention|||logo|||đ|||Deputy ministers of ministerial-level agencies,|||2. Provincial People's Committees and centrally administered city people's committees shall be responsible for:|||ì|||đ|||đ|||int 03 of the annex issued together with this Circular.ê|||

||| b) When assessing the title of Model Worker at the ministerial level, National Model Worker, State Honorary Titles, Ho Chi Minh Prize, State Prize, all members of the Competition and Reward Council must agree unanimously through secret ballot, with at least 90% of the votes in favor of the total number of members of the Council at all levels (in case of absence, opinions are collected through voting ballots); for cases where ballots are collected from collectives, the number of votes in favor must exceed 50% of the total number of civil servants, public officials, employees, and workers under labor contracts for at least one year (in case of absence, opinions are collected through voting ballots).đ|||, prize moneyin|||Associations|||in|||For coal-fired thermal power plants where the enterprise holds 100% of the registered capital and uses 100% of its own capital to invest in the project approved by the competent authority, E is determined as 100%;|||đ|||đ|||đ|||logo|||đ|||g|||g||||||logo|||

||| Ballots shall be filled out according to Model 02 of Appendix 01 attached to this Circular.FUNCTIONS, DUTIES, POWERS, ORGANIZATIONAL STRUCTURE, OPERATIONAL REGULATIONS, AND RELATIONSHIPS OF MANAGEMENT BOARDS; DUTIES, POWERS OF THE CHAIRPERSON, VICE CHAIRPERSON (IF ANY), SECRETARY, AND MEMBERS OF MANAGEMENT BOARDS|||g||| The Prime Minister's Certificate of Merit for competition movements

Article 5. Responsibilities of organizations and individuals in the work of competition and reward

1. The Minister of Healthg initiates, directs competition movementspolicies reward work, throughout the health sector; signs reward decisions within their authority.g2. The Director of the Department of Communication and Competition, Reward has the responsibility to:ga) Maintain or coordinate with the heads of units under and directly under the Ministry of Health

 advise the Minister on policies, contents, programs, plans,

measures for organizing, initiating, directing, summarizing competition movementsDeputy ministers of ministerial-level agencies, reward work in fields or throughout the health sector;policiesb) Guide, urge, inspect, mid-term review, and summarize competition movementsThe Standing Office of the Council for International Cooperation on Non-Governmental Organizations (Vietnam Friendship Association) is the agency responsible for receiving registration dossiers, leading, and coordinating with member agencies of the Council to examine dossiers and return results of reviews of registration dossiers of foreign non-governmental organizations in Vietnam. reward work; identify, promote exemplary models and role models; good deeds in the entire health sector;,c) Review files for consideration of commendation titles

 reward forms; report to the Minister of Health to decide on presenting or submit to competent authorities for considering and deciding to present commendation titles, reward forms according to the provisions of the law.3. Heads of agencies and organizations specified in points a b, c, d

 and e Clause 1 Article 2 of this Circular have the responsibility to:,a) Direct and organize the initiation of competition movements, identify and promote exemplary models; propose rewards;inb) Direct the units specified in Appendix No. 02 issued together with this Circular to develop plans to organize the initiation of specialized competition movements with a scope covering the entire sector or fields under the Ministry of Health lasting one year or more, including specific reward criteria to be sent to the Standing Committee of the Competition and Reward Council of the Ministry of Health (Department of Communication and Competition, Reward) before organizing the competition movement;đc) Organize mid-term reviews, summaries, evaluations of the results of competition movements and select outstanding and exemplary collectives and individuals to report to the Standing Committee of the Competition and Reward Council of the Ministry of Health to propose the Minister of Health to reward or recommend higher authorities to reward according to the law (Ministry of Health Flag of Merit, Prime Minister's Certificate of Merit for competition movements lasting three years or more or Labor Medal Class Three for competition movements lasting five years or more).Deputy ministers of ministerial-level agencies,4. Media, press, publishing agencies; healthcare facilities under and directly under the Ministry of Health. Departments of Health have the responsibility to publicize and disseminate competition and reward work; honor exemplary models; identify and promote good people and good deeds; combat and criticize violations of laws on competition and reward.

5. Agencies, organizations, and individuals proposing to present commendation titles. reward forms must bear responsibility for the accuracy of the files submitted to competent authorities for rewarding.Deputy ministers of ministerial-level agencies,Article 6. Title "Advanced Worker",The title "Advanced Worker" is awarded to individuals meeting the standards prescribed in Article 10 of Decree No. 91/2017/ND-CP.CONTRACT FOR SALE AND ARRANGEMENT OF RESIDENTIAL HOUSING FOR RESIDENTS DISPLACED BY URBAN RENEWALArticle 7. Title "Model Worker at the Grassroots Level"

The title "Model Worker at the Grassroots Level" is awarded to individuals meeting the standards prescribed in Clause 3 Article 9 of Decree No. 91/2017/ND-CP and must meet the following standards:

1. Completing tasks excellently recognized by the unit, including:đa) Having an evaluation result of civil servants, public officials, and employees at the end of the year as completing tasks excellently;đb) Individuals working in agencies and organizations specified in point a Clause 1 Article 2 of this Circular assigned tasks must complete the construction of legal normative documents within the plan approved by the Minister of Health (hereinafter referred to as the plan) on time and within the schedule (without changing or supplementing the plan), ensuring legality (within authority, without illegal content), complying with procedures, announcing administrative procedures on time (if there are administrative procedures), not requiring corrections, revocations, cancellations, suspensions; research projects, tasks assigned by the National Assemblyõ Government, Prime Minister, Minister of Health on time and within the schedule, meeting quality requirements (legal normative documents as stipulated by the Law on Enacting Legal Normative Documents and International Treaties concluded on behalf of the State);đc) Heads and deputy heads responsible for areas in agencies and organizations specified in point a Clause 1 Article 2 of this Circular directly handling administrative procedures (announced as administrative procedures): agencies and organizations under their management must achieve at least 80% of the points of the Administrative Performance Criteria issued by the Ministry of Home Affairs and the Ministry of Health, where each component criterion must achieve at least 60% of the points;

d) Heads and deputy heads responsible for areas in heads of agencies and organizations specified in point a and b Clause 1 Article 2 of this Circular: agencies and organizations under their management must complete at least 80% of legal normative documents in the plan approved by the Minister of Health (excluding legal normative documents outside the plan issued by the Minister of Health); research projects, tasks assigned by the National Assembly, Governmentpolicies Prime Minister, Minister of Health must meet the requirements stipulated in point b of this clause;3.2.4. For Paragraph 4:e) Heads and deputy heads of hospitals directly under the Ministry of Health must achieve at least 80% of the total points of the Hospital Quality Criteria issued by the Ministry of Health.đ||| Competitions and rewards;in2. Standards for innovative initiatives and scientific research topics for awarding the title "Model Worker at the Grassroots Level" shall be implemented in accordance with the provisions of Article 43 of this Circular.in|||đ3. The number of individuals receiving the title "Model Worker at the Grassroots Level" shall not exceed 15% of the total number of individuals receiving the title "Advanced Worker" in agencies and organizations, of which the number of individuals not holding positions must account for at least 50% of the total number of individuals receiving the title "Model Worker at the Grassroots Level", if there is a surplus, it will be rounded up.||||for the movement of competition organized by the Prime Ministerđfrom three years or more or the Labor Medal Class III for the movement of competition from five years or more).

4. Media agencies, press, publishing houses; healthcare facilities under or directly under the Ministry of Health. The Department of Health shall be responsible for propaganda and dissemination of the work of competition and reward; honoring exemplary models; identifying and promoting good people and good deeds; struggling against and criticizing acts violating laws on competition and reward., prize; promoting outstanding examples; discovering and promoting good people and good deeds; combating and criticizing acts violating laws on competition and reward.

5. Agencies, organizations, individuals proposing to present commendation awards. Chapter II

COMPETITION TITLES AND STANDARDS FOR COMPETITION TITLES

Article 6. The title "Advanced Worker"

Title"Advanced Worker" is awarded to individuals meeting the criteria stipulated in Article 10 of Decree No. 91/2017/NĐ-CP.

Article 7. The title "Model Competitor at the Grassroots Level"

The title "Model Competitor at the Grassroots Level" is awarded to individualsđ meeting the criteriarime Minister cstipulated in Clause 3, Article 9 of Decree No. 91/2017/NĐ-CP and must meet the following criteria:

1. Completing tasks excellently recognized by the unit, including:

a) Having resultsđof the annual performance evaluation of civil servants, public officials, and workersđas having completed tasks excellently;

b) Individuals working at agencies and organizations specified in Point a, Clause 1 of this Circular, assigned tasks must complete the construction of normative legal documents within the plan for constructing normative legal documentsapproved by the Minister of Health (hereinafter referred to as the plan) within the deadline and progress (without changing or supplementing the plan), ensuring legality (within the scope of authority, without content contrary to the law), in accordance with procedures and formalities,,announcing administrative procedures on time (if there are administrative procedures), without corrections, revocations, cancellations, suspensions; projects and tasks assigned by the National Assembly无效 Government, Prime Minister, Minister of Healthn lb) ADDING CLAUSES 10 AND 11 TO ARTICLE 2 AS FOLLOWS:đ on timeđ and progress, with quality (as normative legal documents according to the Law on Enacting Normative Legal Documents and International Treaties concluded on behalf of the State);,c) Headsđ and deputy heads in charge of fields in agencies and organizations specified in Point a, Clause 1 of this Circular directly handling administrative procedures (announced as administrative procedures): agencies and organizations under their management must achieve,at least 80% of the points of the Administrative Performance Criteria issued by the Ministry of Home Affairs and the Ministry of Health, where each component criterion must achieve at least 60% of the points;đd) Headsý and deputy heads in charge of fields in heads of agencies and organizations specified in Points a and b, Clause 1 of this Circular: agencies and organizations under their management must complete the construction of at least 80% of normative legal documents in the plan already approved by the Minister of Health (excluding normative legal documents outside the plan issued by the Minister of Health); projects and tasks assigned by the National Assembly, Government

 Prime Minister, Minister of Health must meet the requirements stipulated in Point b of this clause;,e) Headsđ of hospitals directly under the Ministry of Health must achieve at least 80% of the total score of the Quality Hospital Criteria issued by the Ministry of Health."b) In addition to the lists of public services issued according to the provisions of Clause 2, Article 4 of this Decree, specialized agencies under provincial People's Committees shall report to the provincial People's Committee for decision-making on amending, supplementing, or issuing the list of public services funded by the state budget within their jurisdiction and consistent with the local budget capacity within the approved budget by the Provincial People's Assembly, and send it to the Ministry of Finance and relevant ministries and sectors for supervision during implementation."2. The criteria for scientific research initiatives to be considered for the title of Model Competitor at the Grassroots Level are implemented according to the provisions of Article 43 of this Circular.n l3. a) The recognition of outstanding collectives proposed to be presented with the Flag of Competition of the Ministry of Health mustđ be reviewed through assessment,đ comparison according to the fields of work of the Ministry of Health, meeting the criteria for presenting the Flag of Competition of the Ministry of Health according to the standards proposed by the field leaders,No.b) Agencies and organizations specified in Point a, Clause 1 of this Circular must meet the criteria stipulated in Points b, c, and d, Clause 1 of this Circular;

Article 8. The title "Outstanding Soldier at the Ministry Level"

1. The title "Outstanding Soldier at the Ministry Level" shall be conferred on individuals meeting the criteria specified in Clause 2, Article 9 of Decree No. 91/2017/NĐ-CP.đ outstanding in the movement of competition

The title "Advanced Labor Collective" shall be conferred on collectives meeting the criteria specified in Clause 1, Article 28 of the Law on Competition and Reward.

Article 11. The title "Excellent Labor Collective"

The title "Excellent Labor Collective" shall be conferred on collectives meeting the criteria specified in Clause 1, Article 27 of the Law on Competition and Reward.đ for each competition movement proposed by the agency or organization hosting the competition movement to build, submit to the Standing Committee of the Competition and Reward Council of the Ministry of Health for review and report to the Minister of Health for approval.

Article 12. The Flag of Excellence of the Ministry of Health

1. The Flag of Excellence of the Ministry of Health shall be conferred on the subjects specified in Points a, b, c, d, and e of Clause 1, Article 2 of this Circular.

2. The Minister of Health shall present the Flag of Excellence of the Ministry of Health to outstanding collectives annually that meet the criteria specified in Article 26 of the Law on Competition and Reward and the following criteria: documenting the number of Flags of Competition, awarded by the Ministry of Health to agencies and organizations in the field of competition annually.đa) The recognition of outstanding collectives proposed for the Flag of Excellence of the Ministry of Health must be approved through evaluation, comparison across the fields of work of the Ministry of Health, and meeting the award criteria for each field as proposed by the lead units in those fields, approved by the Minister of Health;

Article 27. Commendation by the Minister of Health

1. The commendation by the Minister of Health shall be awarded to individuals meeting the criteria specified in Clause 1 of Article 39 of Decree No. 91/2017/ND-CP andđalso meeting one of the following criteria:

a) Regular commendation (comprehensive commendation): The commendation by the Minister of Health shall be awarded at the end of the annual mission plan, school year, or multiple years for individuals who have excelled in their duties for two consecutive years, during which time they have had two recognized and effectively applied initiatives within the scope defined in Article 43 of this Circular, and meet the criteria specified in one of the points b, c, d, or đ of Clause 1 of Article 7 of this Circular, corresponding to each individual;tob) Specialized commendation: The commendation by the Minister of Health shall be awarded to individuals with outstanding achievements evaluated in the competitive movements initiated by the Ministry of Health as stipulated in point b of Clause 3 of Article 5 of this Circular, specifically: individuals who are exemplary and outstanding, evaluated according to the criteria after the completion of a competition period or specialized work campaign initiated by the Minister of Health;rime Minister cc) Immediate commendation: The commendation by the Minister of Health shall be awarded to individuals who have achieved outstanding and immediate results with significant impact in the respective fields of the Ministry of Health, as specified in Clause 3 of Article 13 of Decree No. 91/2017/ND-CP;

d) Merit commendation: The commendation by the Minister of Health shall be awarded to individuals before retirement under social insurance regulations in the agencies and organizations specified in points a, b, c, d, đ, and e of Clause 1 of Article 2 of this Circular, specifically: individuals who have consistently completed assigned tasks well and have not been awarded a commendation by the Minister of Health in the last five years;đđ) Anniversary commendation: The commendation by the Minister of Health shall be awarded to individuals in the agencies and organizations specified in points a, b, c, d, đ, and e of Clause 1 of Article 2 of this Circular on the occasion of the anniversary of establishment (10 years), specifically: individuals who have worked in the agency or organization for at least five years and have made outstanding contributions to the development of the agency or organization, with three consecutive excellent years immediately preceding the anniversary year; the number of direct employees must account for at least 50% of the total number of individuals recommended for commendation by the Minister of Health, rounding up if there is a remainder; only one commendation may be given to an individual during their tenure in the agency or organization;

e) Foreign affairs commendation: The commendation by the Minister of Health shall be awarded to overseas Vietnamese and foreigners who have made outstanding contributions to the development of the Vietnamese healthcare sector.Declaration, re-declarationThe commendation by the Minister of Health shall be awarded to groups meeting the criteria specified in Clause 2 of Article 39 of Decree No. 91/2017/ND-CP and meeting one of the following criteria:đa) Regular commendation (comprehensive commendation): The commendation by the Minister of Health shall be awarded at the end of the annual mission plan, school year, or multiple years for groups that have excelled in their duties for two consecutive years, maintaining internal unity, implementing democratic regulations at the grassroots level, organizing competitive movements; caring for the material and spiritual lives of group members; practicing thrift and combating waste; fully implementing policies, laws, and meeting the criteria specified in one of the points b, c, d, or đ of Clause 1 of Article 7 of this Circular, corresponding to each agency or organization;

Article 28. Certificate of Merit of the Head of Agencies and Organizations under the Ministry of Health

1. The Certificate of Merit of the Head of agencies and organizations under the Ministry of Health prescribed at points a, b and d Clause 1 Article 2 of this Circular shall be awarded to collectives, individuals meeting the criteria stipulated in Article 75 of the Law on Competition and Rewards.

2. The proportion of workers and those directly working must reach at least 50% of the total numberNo. of individuals receiving the Certificate of Merit of the Head of agencies and organizations under the Ministry of Health, if anyNo.b) Agencies and organizations specified in Point a, Clause 1 of this Circular must meet the criteria stipulated in Points b, c, and d, Clause 1 of this Circular;

Article 29. Commemorative Medal "For the People's Health"

1. The Commemorative Medal "For the People's Health" of the Minister of Health shall be awarded once to individuals who have achieved many merits and contributions to the cause of protectingì and improving the people's health, including the following criteria:n la) Having worked in the healthcare sector for 20 years or more for men and 15 years or more for women. In cases where individuals have worked in specialized fields such as Tuberculosis, Leprosy, Mental Health, Radiology, Pathology, Forensic Medicine, Forensic Psychiatry, Intensive Care Emergency - Anti-toxic, Pediatricsđ||

||a) Having worked in the health sector for at least 20 yearsđor extremely difficult areas as defined by the Government, each year of work in these specialized fields or areas shall be counted as 1 year and 2 months.b) Individuals outside the healthcare sector and foreigners who have made outstanding achievements that significantly impact the completion of healthcare tasks, recognized by the collective and highly evaluated by the Minister of Health, including: Party,State leaders; leaders of Committees, Ministries, sectors, mass organizations at the central level, government agencies, news agencies, press, leaders of cities, amended and supplemented by Decree No. 109/2025/NĐ-CP and Decree No. 193/2025/NĐ-CPprovinces directly under the Central Government who have contributed to management, guidance, and successfully implementing the cause of protecting, caring for, and improving the people's health; individuals who have made significant material and spiritual contributions to the healthcare sector; foreigners who have made outstanding contributions to the cause of protecting, caring for, and improving the people's health; individuals who have shown courageous actions or exceptional achievements in preventing, combating, and mitigating the consequences of natural disasters, epidemics, and disasters, contributing to the successful implementation of the cause of protecting caring for, and improving the people's health.2. The Commemorative Medal "For the People's Health" of the Minister of Health shall be posthumously awarded to individuals specified in Article 25 of the Law on Organ, Tissue Donation and Transplantation and Cadaver Donation.đArticle 30. Commemorative Medal "For the Population Cause"1. The Commemorative Medal "For the Population Cause" of the Minister of Health shall be awarded once to individuals who have made many achievements in contributing to the population cause.đ2. Criteria for awardingi, b for individuals working in agencies and organizations engaged in population work:

a) Civil servants, public officials, and workers who have continuously worked in population work for 12 years or more at district-level agencies and organizations or higher;b) Public officials and contractual workers who have continuously worked in population work for 10 years or more at commune-level, ward-level, town-level; in cases of communes, wards, towns located in economically disadvantaged areas, extremely difficult areas as defined by the Government, they must have continuously worked for 8 years or more;c) Population volunteers at village, hamlet, village, phum, sóc who have continuously worked in population work for 8 years or more; for population volunteers at communes, wards, towns located in economically disadvantaged areas, 无效extremely difficult areas as defined by the Government, they must have continuously worked for 6 years or more;无效d) Civil servants and public officials who have continuously worked in population work for 15 years or more;shallandshalle) Leaders and managers of population work who have made significant contributions to achieving population targets during one term of office or more.đ3. Article 32. Procedure for Commendation

The procedure for commendation is carried out in accordance with Article 46 of Decree No. 91/2017/ND-CP and the following provisions:in1. The head of agencies and organizations has the responsibility to commend within their authority or to submit to the competent authority for commendation for individuals and organizations under their management in accordance with the laws on encouragement and reward and this Circular.

2. For commendation forms within the authority of the Minister of Health or the Minister of Health submits to the competent state agency for commendation, the proposal file is sent to the Standing Committee of the Encouragement and Reward Council of the Ministry of Health through the following procedures:đa) Individuals and organizations under the Ministry of Health and sectors: The head of the health sector of the Ministry and sector establishes the file, selects and prepares the report with confirmation from the leadership of the managing sector;

Heads of agencies and organizations under and directly under the Ministry establish the file, select and confirm achievements;on||

f) Individuals and organizations outside the health sector at local levels, the Provincial Department of Health establishes the file, selects and confirms with a written endorsement from the provincial People's Committee;

g) Individuals and organizations of foreign nationals working, serving, and studying in Vietnam, the International Cooperation Department acts as the focal point to establish the file, select and prepare the report.H||during the course of work, when collectives and individuals meet the criteria, the heads of units responsible for completing the file and submitting it to the Standing Board of the Competition and Award Council

Article 33. Proposal File for Commendation

1. The proposal file for commendation is implemented in accordance with Articles 49, 50, 51, 52, 53, 54, 55, 56, and 57 of Decree No. 91/2017/ND-CP.

2. The number of proposal files for commendation at the Ministry of Health level: one set.

3. 9. The Party Committee of the Ministry of Health examines and agrees with the form of reward of the Gold Star Order, Ho Chi Minh Order, Independence Order; National Model Worker title, "People's Doctor" title, "People's Teacher" title before the Minister of Health submits to the competent authority for examination and decision on rewards.3.2.4. For Paragraph 4:iVNDshall be implemented in accordance with the provisions of Article 47 of Decree No. 91/2017/NĐ-CP and the following provisions:

Article 36. Provisions on consultation for rewardsâProvisions on consultation for rewards are implemented in accordance with Article 47 of Decree No. 91/2017/ND-CP and the following provisions:

1. When receiving a request for consultation from the Central Competition and Reward Board, the Standing Committee of the Ministry of Health's Competition and Reward Council is responsible for seeking the consultation opinions of the Inspectorate, the Cadre and Civil Servant Organization Department, and relevant units under the Ministry of Health.H1. Article 37. Organization of Presentation

1. Principles of organization:

a) Ensuring solemnity, practicality, effectiveness, avoiding ostentation and waste;đượb) Ceremonies for presenting Orders, Medals; State Honorary Titles; Ho Chi Minh Prize, State Prize; Prime Minister's Flag of Excellence; Prime Minister's Commendation Certificate: carried out in accordance with the provisions of Decree No. 145/2013/NĐ-CP dated October 29, 2013 of the Government on organizing commemorative days; presentation ceremonies, reception of awards and commendations, and honorific titles; diplomatic rituals and receptions for foreign guests.

a) Orders, Medals, State Honorary Titles, Ho Chi Minh Prize, State Prize, Prime Minister's Flag of Excellence, National Outstanding Soldier Title, and Prime Minister's Commendation Certificate: after receiving the award decision, the head of the unit shall plan the reception and submit it to the Minister of Health through the Standing Committee of the Ministry of Health's Competition and Award Council for examination and approval of the policy; when the Minister agrees, the Standing Committee will guide and coordinate with the unit to present the awards;b) Honorific titles and forms of commendation within the authority of the Minister of Health to decide: the leadership of the Ministry presents or delegates to the heads of agencies and organizations to present.Article 38. Archiving of Commendation Files- Office of the President of the StateThe archiving of commendation files shall be carried out in accordance with the provisions of Circular No. 09/2011/TT-BNV dated June 30, 2011 of the Minister of Home Affairs on the retention period for files and documents formed commonly in the activities of agencies and organizations.đCOMPETITION AND REWARD COUNCIL AND INNOVATION COUNCIL

2. Procedures for holding award ceremonies:

Section 1. COMPETITION AND REWARD COUNCILđArticle 39. Competition and Reward Councils at all levels in the health sectorđ1. The Competition and Reward Council at the ministerial level: establish the Ministry of Health's Competition and Reward Council (the Department of Communication and Competition and Reward serves as the Standing Body of the Council).policies2. The Competition and Reward Council at the grassroots level:policiesa) Grassroots Competition and Reward Councils are established in units directly under the Ministry; in units under the Ministry including the General Population Agency, agencies and organizations with legal personality having 20 staff positions or more;

b) The Competition and Reward Council of the Ministry of Health's Office is established in units not falling under the cases stipulated in point a of this clause (The Ministry's Office serves as the Standing Body).

Article 40. Authority to Decide on Establishing Competition and Reward Councils at All Levels

1. The Minister of Health decides to establish the Ministry of Health's Competition and Reward Council; the Competition and Reward Council of the Ministry of Health's Office.

Chapter V

2. The heads of agencies and organizations specified in point a of Clause 2 of Article 39 of this Circular decide to establish grassroots Competition and Reward Councils.

Article 41. Composition of Competition and Reward Councils at All Levels

1. The Ministry of Health's Competition and Reward Council has no more than 17 members as follows:

a) Chairman of the Council: Minister of Health;đb) Two Vice Chairmen of the Council: Deputy Ministers responsible for competition and reward work, Director of the Department of Communication and Competition and Reward (Permanent Vice Chairman);

c) Members of the Council are the heads of agencies and organizations: Inspectorate, Office, Department of Cadre and Civil Servant Management, Legal Department, Science, Technology and Training Bureau, Chairman of the Vietnam Medical Association, and other members decided by the Minister of Health;

d) Duties and powers of the Council are regulated in Clause 3 of Article 62 of Decree No. 91/2017/NĐ-CP and the Decision of the Minister on establishing the Council. The Council's operational regulations are issued by the Minister of Health.

2. The Competition and Reward Council of the Ministry of Health's Office has no more than 11 members as follows:H||đArticle 2.

a) Chairman of the Council: Deputy Minister responsible for the Office;

b) Two Vice Chairmen of the Council: Head of the Office (Permanent Vice Chairman) and leader of the Department of Communication and Competition and Reward;

c) Members of the Council are leaders of units: Inspectorate, Department of Cadre and Civil Servant Management, Legal Department, Science, Technology and Training Bureau, Trade Union of the Ministry of Health's Office, and other members decided by the Minister of Health;

d) Duties and powers of the Council include:

- Advising the head of the unit: launching competition movements; inspecting the implementation of policies and laws on competition and reward according to their authority; deciding to grant honorific titles and forms of commendation according to their authority or submitting to competent authorities for commendation decisions; periodically evaluating and summarizing competition and reward work; proposing measures to promote competition and reward work;

- Selecting collectives and individuals with outstanding achievements in patriotic competition movements and task execution; recommending to the Minister of Health for consideration and decision on granting honorific titles and forms of commendation or submitting to competent authorities for commendation decisions;policies;

3. The Competition and Reward Council at the grassroots level in agencies and organizations with 5 to 11 members, the number of Council members is determined by the Council Chairman based on the number of staff positions of the agency or organization as follows:đa) Chairman of the Council: head of the agency or organization;đb) One Vice Chairman of the Council is the head of the unit responsible for competition and reward work in the agency or organization. If necessary, another Vice Chairman may be appointed by the head of the agency or organization;

c) Members of the Council are leaders of units appointed by the head of the agency or organization;êd) The duties and powers of the Council are implemented according to the operational regulations issued by the head of the agency or organization.đshall be specified as follows:

a) Chairman of the Council: Deputy Minister in charge of the Office of the Ministry;,b) Two Vice Chairmen of the Council: Head of the Office of the Ministry (Permanent Vice Chairman) and leader of the Department of Communication and Competition, Commendation;

c) Members of the Council aređleaders of the units: Inspectorate, Department of Organization and Cadre Affairs, Department of Law, Science, Technology and Training, Union of the Ministry of Health's Agency and other members appointed by the Minister of Health;

d) Duties, powers of the Council

- Advising the head

of the unit: launching competition movements: inspecting the implementation of policiesđượon competition and commendation according to their authority; deciding to award excellence titles and forms of commendation according to their authority or submitting to the competent authority for commendation; regularly evaluatingpoliciesinterim reviews, summaries of competition and commendation work; proposing

recommendations, suggestions for policies

to promote competition and commendation work;đ- Selecting collectives and individuals with outstanding achievements in the patriotic competition movement, implementing tasksDeputy ministers of ministerial-level agencies,to propose the Minister of Health, prize moneyinto examine and decide on commendationsinat the grassroots level in agencies and organizations with five to eleven members,the number of Council members shall be decided by the Chairman of the Council based on the number of staff of the agency or organization as follows:policiesCouncil: head of the agency or organization;Deputy ministers of ministerial-level agencies,adding one Vice Chairman of the Council appointed by the head of the agency or organization;đ||| Competitions and rewards;in;

The Competition and Reward Council at grassroots levels in agencies and organizations with from 05 to 11 members shall have the number of members determined by the Chairman of the Council based on the staffing quota of the agency or organization as follows:đprocedures for handling violations related to competitionêand commendation shall be implemented in accordance with Articles 78 and 79 of Decree No. 91/2017/NĐ-CP.policiesaccording to the roadmap,

In necessary cases, another Vice-Chairman of the Council may be decided by the head of the agency or organization;development1. This Circular takes effect from January 21, 2019.

c) Members of the Council are leaders of units decided by the head of the agency or organization;

Section 2. INNOVATION COUNCIL

Article 42. Innovation Council

1. The innovation council at the grassroots level is established by the head of the agency or organization and has the function of advising and consulting to the head of the agency or organization on organizing the implementation of innovation activities and recognizing the scope of influence and effectiveness.policiesThe powers of the Council shall be implemented according to the Working Regulations issued by the head of the agency or organization.The Minister of Science and Technology issues this Circular on the issuance of "National Technical Regulations on Gasoline, Diesel Fuel and Biofuel"at grassroots level shall be established by the head of the agency or organization with the function of advising and consulting the head of the agency or organizationconcerningto organize activities of initiatives and recognize the scopen lof influence and effectivenessn lof applicationgof grassroots-level scientific research topicsapproved by the Minister of Health (hereinafter referred to as the plan) within the deadlineResearch topics that have been reviewed and accepted can serve as grounds for considering commendation titles.in the form of rewards.

2. The innovation council in the healthcare sector is established by the Minister of Health and has the function of advising and consulting the Minister on organizing recognition of the scope of influence and assessing the effectiveness of applying research topics and innovations at the ministry level or higher, serving as grounds for considering commendation titles.,a) Direct and organize the initiation of competition movements, identify and promote exemplary models; propose rewards;inc) Participating in assessing the conditions of food production and business establishments in the area according to the分级回复

The establishment and organization of the innovation council shall be carried out in accordance with Circular No. 18/2013/TT-BKHCN dated August 1, 2013, issued by the Minister of Science and Technology to guide the implementation of certain provisions of the Innovation Charter promulgated by Decree No. 13/2012/NĐ-CP dated March 2, 2012 of the Government regarding the Innovation Charter.gThe Ministry of Science and Technology shall guide the implementation of some provisions of the Initiative Charter issued pursuant to Decree No. 13/2012/NĐ-CP dated March 2, 2012 of the Government on the Initiative Charter.

Article 43. Recognition of the Scope of Influence and Effectiveness of Applying Innovations and Research Topics to Serve as Grounds for Considering and Awarding Commendation Titles and Forms of Reward

1. The basis for recognizing innovations and research topics with a scope of influence includes:guiding competitionas the basis for proposing to award commendation titles and forms of reward including:

a) Innovations and research topics recognized according to Article 6 of Circular No. 08/2017/TT-BNV.

b) Legal normative documents issued within the plan.policiesand commendation activities in the health sector

c) Program proposals in the Government's Work Program submitted in accordance with proceduresìshall cease to be effective from the date this Circular takes effect.within the prescribed time limit and not rejected;n lArticle 50. Cross-referencing Provisions

c) Proposals in the Government's Work Program submitted in accordance with procedures and deadlines and not rejected.standardsd) International agreements in the health sector drafted by the Ministry of Health.

2. The authority to recognize the scope of influence and effectiveness of applying innovations and research topics to serve as grounds for considering and awarding commendation titles and forms of reward is as follows:đscientific research topics as the basis forDeclaration, re-declarationawarding commendation titles,đforms of reward as follows:

a) The head of the agency or organization recognizes the scope of influence and effectiveness of applying grassroots-level innovations and research topics.

b) The Minister of Health recognizes, based on the proposal of the Standing Committee of the Ministry of Health’s Competition and Reward Council, the scope of influence and effectiveness of applying innovations and research topics at the Ministry of Health and nationwide levels.inthe Minister of Health shall examine and recognize according to the proposal of the Standing Committee of the Competition and Reward Council of the Ministry of Health regarding the scope of influence and effectiveness of applying initiatives,đscientific research topics at the Ministry of Health and nationwide.đrecognition of initiatives by authorized state agencies or Decision recognizing the results of scientific and technological tasks by authorized state agencies or Minutes of acceptance by

commendation has their name in the Decision establishing the Drafting Board,đEditorial Team as the Head, Deputy Head, and regular member of the Drafting Board; Team Leader, Deputy Team Leader, and Editorial Team Secretary; for other personsn lproposed forđcommendation must participate fully in all meetings of the Drafting Board, Editorial Team, and their participation must be recorded in the Meeting Minutes orprovide comments on draft documentsin writing (excluding agreement comments).n llead competitions and campaigns in accordance with Article 66 and Article 67 of Decree No. 91/2017/NĐ-CP.shalle) Expenditure for unexpected rewards and other expenses serving the competition and reward work shall be decided by the Minister of Health.logo3. The Competition and Reward Fund of agencies and organizations shall operate as a legal entity and be managed and used for the following activities:

Chapter VI

FUND FOR COMPETITION AND REWARD

Article 44. Sources and Levels of Deduction for the Ministry of Health's Incentive Fund

1. The sources and levels of deduction for the Ministry of Health's Incentive Fund shall be implemented in accordance with Clause 1 of Article 65 of Decree No. 91/2017/NĐ-CP.

a) From the state budget (if available);

b) From other lawful revenues (if available).

2. The Ministry of Health encourages organizations and individuals both within and outside the sector to support and contribute to the Ministry of Health's Incentive Fund.

Article 45. Management and Utilization of the Incentive Fund

1. The Department of Communication and Incentives manages and utilizes the Ministry of Health's Incentive Fund in accordance with the provisions of the law and this Circular. At the end of the fiscal year, any remaining balance of the Ministry of Health's Incentive Fund shall be carried over to the next year for use in incentive activities.đ2. The Ministry of Health's Incentive Fund may be used for the following activities:a) Organizing and implementing campaigns of competition within the Ministry;b) Awarding money or accompanying gifts with commendation titles and forms of recognition to units and individuals under the Ministry's agencies (Departments, Office, Inspectorate) and other cases decided by the Minister;đc) Expenditure on printing and producing awards: certificates, medals, titles of outstanding soldiers, commemorative medals, boxes of commemorative medals, commemorative badges, flags of competition;ể d) Expenditure on award frames for joint competition activities of the Ministry of Health and certificate frames for non-industry entities, foreign individuals, and units under the Ministry of Health's agencies.

e) Expenditure on extraordinary awards and other expenses serving competition and recognition activities as decided by the Minister of Health.3. The incentive fund managed and utilized by agencies and organizations with legal personality shall be used for the following activities:ina) Organizing competition campaigns;ây:

b) Purchasing award items;

c) Expenditure on money or accompanying gifts with commendation titles and forms of recognition for subordinate units and individuals;gd) Other activities related to competition and recognition.,Article 46. Amounts of Awards and Principles of Expenditure

1. The principles of calculating monetary awards and the amounts of such awards shall be implemented in accordance with Article 68 of Decree No. 91/2017/NĐ-CP.logo2. The amounts of monetary awards accompanying commendation titles and forms of recognition shall be implemented in accordance with Articles 69, 70, 71, 72, 73, and 74 of Decree No. 91/2017/NĐ-CP and relevant legal regulations.đ1. The authority that issues the decision to grant awards has the authority to revoke the award decision, strip honorary titles, and recover awarded items and monetary awards.

2. Based on the effective legal provisions of the Court or conclusions of competent authorities, the agency proposing the award shall, for cases of violation, propose the competent authority to issue a decision to revoke the award and recover the awarded items and monetary awards received.

3. Procedures for handling violations related to competition and recognition shall be implemented in accordance with Articles 78 and 79 of Decree No. 91/2017/NĐ-CP.无效a) Organizing competition campaigns;

d) Other activities related to competition and reward.inArticle 46. Reward Amounts and Principles of Reward Disbursement1. The principle of calculating reward amounts and the actual reward amounts shall be carried out in accordance with the provisions of Article 68 of Decree No. 91/2017/NĐ-CP.2. The amount of money accompanying commendation titles and forms of reward shall be implemented in accordance with the provisions of Articles 69, 70, 71, 72, 73, and 74 of Decree No. 91/2017/NĐ-CP and relevant legal normative documents.

1. The authority that issues the reward decision has the power to revoke the reward decision, revoke honorary titles, and recover awarded items and money.to2. Based on the effective legal regulations of the Court or conclusions of authorized agencies,

the agency proposing rewardsin;

Article 48. Application of Information Technology in Competition and Reward Work

1. Encourage individuals and organizations to submit electronic files to the Standing Board of the Competition and Reward Committee of the Ministry of Health during the review process.policies2. The Directorate of Information Technology shall take the lead and coordinate with the Department of Communication and Competition to provide advisory services and build a database on competition and reward activities of the Ministry of Health according to a schedule, to be promulgated by the Minister of Health.đ1. This Circular takes effect from January 21, 2019.,2. Article 51. Responsibility for Implementation

1. Vụ trưinng Vụ Truyền thông và Thi đua, khen thưởng chịu trách nhiệm tổ chức triển khai, kiểm tra việc thực hiện Thông tư này.

2. Chánh Văn phòng Bộ, Chánh Thanh tra Bộ, Vụ trưởng, Cục trưởng, Tổng Cục trưởng thuộc Bộ; Thủ trưởng các đơn vị trực thuộc Bộ; Giám đốc Sở Y tế các tỉnh, thành phố trực thuộc Trung ương và cơ quan, tổ chức, cá nhân liên quan có trách nhiệm thi hành Thông tư này.

Trong quá trình triển khai thực hiện, nếu có vướng mắc, các cơ quan, tổ chức, cá nhân phản ánh về Bộ Y tế (Vụ Truyền thông và Thi đua, khen thưởng) để xem xét, giải quyết./.
