in the field of providing public service activities ensuring maritime safety

Decree No. Decision No. 12/2017/NĐ-CP pursuant to Decision No. 58/2017/NĐ-CP dated February 10, 2017 of the Government detailing certain provisions of the Maritime Code of Vietnam on managing maritime activities;

Decree No. 58/2017/NĐ-CPpursuant to Decision No. 58/2017/NĐ-CP dated May 10, 2017 of the Government detailing certain provisions of the Maritime Code of Vietnam on managing maritime activities;

Decree No. 43/2018/NĐ-CP dated March 12, 2018 of the Government on the management, use, and exploitation of maritime infrastructure assets;

Decree No. 32/2019/NĐ-CP dated April 10,2019 of the Government on assigning tasks, placing orders, or tendering for the provision of products and services using state budget funds from regular funding sources;

At the proposal of the Director of Infrastructure Department and the Director of Vietnam Maritime Administration;

The Minister of Transport issues this Circular on Economic and Technical Norms in the Field of Providing Public Service Activities Ensuring Maritime Safety.

Article 1. Attached to this Circular are Economic and Technical Norms in the Field of Providing Public Service Activities Ensuring Maritime Safety, consisting of 10 sets of Economic and Technical Norms as follows:

1. Economic and Technical Norms for Operating Marine Navigation Aids Systems - Set 1.

2. Economic and Technical Norms for Operating and Maintaining Public Marine Traffic Lanes (including embankments and revetments) - Set 2.

3. Economic and Technical Norms for Supply Services - Set 3.

4. Economic and Technical Norms for Replacing, Deploying, Adjusting, and Retrieving Marine Buoy Markers - Set 4.

5. Economic and Technical Norms for Fuel Consumption - Set 5.

6. Economic and Technical Norms for Maintenance and Repair of Marine Navigation Aids Equipment - Set 6.

7. Economic and Technical Norms for Repairing Generators - Set 7.

8. Economic and Technical Norms for Repairing Watercraft - Set 8.

9. Economic and Technical Norms for Repairing Marine Buoy Markers - Set 9.

10. Economic and Technical Norms for Manufacturing Marine Buoy Markers - Set 10.

Article 2.

1. The economic and technical norms issued under Article 1 of this Circular shall apply to agencies, organizations, and individuals related to ordering and providing public service activities ensuring maritime safety.

2. The economic and technical norms issued under Article 1 of this Circular shall be used to prepare budgets, establish and approve product and service prices; place orders and settle accounts for public service activities ensuring maritime safety.

3. For works in public service activities ensuring maritime safety that have not been specified in the sets of economic and technical norms issued with this Circular, the organization entrusted with providing such public service activities shall develop economic and technical norms, submit them to the Vietnam Maritime Administration for review, and report to the Ministry of Transport for decision.

Article 3.

1. This Circular takes effect from February 20, 2022.

2. Abolish the following circulars: Circular No. 76/2014/TT-BGTVT dated December 19, 2014 of the Minister of Transport on Economic and Technical Norms in the Field of Providing Public Service Activities Ensuring Maritime Safety; Circular No. 28/2016/TT-BGTVT dated October 14, 2016 of the Minister of Transport amending and supplementing certain contents of Economic and Technical Norms for Managing and Operating Marine Navigation Aids issued together with Circular No. 76/2014/TT-BGTVT dated December 19, 2014 of the Minister of Transport; and Circular No. 38/2018/TT-BGTVT dated June 11, 2018 of the Minister of Transport amending and supplementing certain contents of Economic and Technical Norms issued together with Circular No. 76/2014/TT-BGTVT dated December 19, 2014 of the Minister of Transport.

Article 4.

The Head of the Ministry's Office, the Inspector General, the Heads of Departments, the Director of Vietnam Maritime Administration, the General Directors of the Northern and Southern Vietnam Maritime Safety Assurance Corporations, and the Heads of agencies, organizations, and individuals concerned are responsible for implementing this Circular./ .
