Regulations on job code, occupational standards, and salary grading for maritime search and rescue professionals and maritime security information professionals

Pursuant to the Civil Servant Law dated November 15, 2010; Law Amending and Supplementing Certain Provisions of the Civil Servants Law and the Public Officer Law dated November 25, 2019;

Decree No. 115/2020/NĐ-CP dated 25 the 9 Pursuant to Decree No. 32/2019/NĐ-CP dated April 10, 2019 of the Government on assigning tasks, procurement or tendering for the supply of products and services using state budget from regular operating expenses;20 Pursuant to the Government's regulations on recruitment, utilization, and management of civil servants;

Based on the proposal of the Director of the Cadre Organization Department and the Director of the Vietnam Maritime Administration;The Minister of Transport issues this Circular stipulating job codes, occupational standards, and salary grading for maritime search and rescue professionals and maritime security information professionals.

Article 3. General standards for professional ethics

1. Adhering to the Party's guidelines, policies, and State laws.

2. Be honest, objective, and highly responsible for assigned tasks; fulfill all obligations of a civil servant in professional activities.

3. Be conscious of cultivating ethics, maintaining professional integrity, honor, and reputation; do not abuse the assigned position or tasks for personal gain; foster unity, creativity, self-improvement, and readiness to absorb new knowledge; be aware of cooperation, assistance to colleagues, and sharing work experience; actively participate in scientific research topics, technical improvement initiatives to develop the profession and enhance competence.

Chapter II STANDARDS AND TITLES OF PROFESSIONAL RANKS

Article 4. Marine Search and Rescue Officer Level I - Code: V.12.45.01

1. Duties:

a) Take the lead in organizing and implementing specialized tasks within the scope of responsibility of the Vietnam Maritime Search and Rescue Coordination Center as prescribed by law;

b) Take the lead in researching and proposing policies, guidelines, plans for development and application of science and technology within the scope of tasks of the Vietnam Maritime Search and Rescue Coordination Center;

c) Take the lead in researching and proposing regulations, rules, procedures for marine search and rescue operations; compile professional guidance materials for marine search and rescue operations;

d) Take the lead in researching, building research topics, projects, and scientific works aimed at reforming and improving management mechanisms, enhancing the effectiveness of activities of the Vietnam Maritime Search and Rescue Coordination Center;

đ) Organize propaganda, training, upgrading, dissemination of professional knowledge and experience in marine search and rescue operations; direct, guide, inspect the implementation and propose measures to effectively carry out marine search and rescue operations;

e) Perform other tasks assigned by competent authorities.

2. Qualifications regarding education and training:

a) Hold a bachelor’s degree or higher in a relevant field that meets the requirements of the position;

b) Hold a certificate for professional training according to the standards of the marine search and rescue officer profession;

3. Qualifications regarding professional expertise and skills:

a) Master the Party's policies and guidelines, state laws; knowledge of maritime search and rescue management and legal provisions on civil service systems, staff, functions, and responsibilities of the Vietnam Maritime Search and Rescue Coordination Center;

b) Be well-informed about the situation and trends in maritime search and rescue operations both domestically and internationally; promptly update modern technologies in maritime search and rescue operations worldwide; organize research to serve management and information processing;

c) Possess the ability to propose and advise on policy development in the field of maritime search and rescue;

d) Have skills in drafting documents and presenting; effectively handle assigned tasks;

đ) Possess the ability to analyze, synthesize, systematize, and propose methods to improve or resolve practical issues within the scope of work;

e) Possess the ability to organize the application of scientific and technological progress to enhance the quality and effectiveness of maritime search and rescue operations;

g) Have basic computer skills and be able to use a foreign language or a minority ethnic language if working in areas with ethnic minorities as required by job positions;

a) Have held the title of Marine Search and Rescue Officer Level II or equivalent for at least six years. In cases where there is equivalent time, they must have held the title of Marine Search and Rescue Officer Level II for at least one year (twelve months) up to the deadline for submitting registration applications for examinations or promotions;

b) During the period holding the rank of Marine Search and Rescue Officer Level II and equivalent, have participated in drafting at least two (2) consolidated documents, research topics, plans, projects, or departmental, sectoral, or provincial-level initiatives that have been issued or accepted by competent authorities, which were assigned by the employing agency for study and development.

Article 5. Marine Search and Rescue Category II - Code Number: V.12.45.02

1. Duties:

a) To take the lead or participate in implementing specialized tasks within the scope of responsibility of the Vietnam Maritime Search and Rescue Coordination Center as prescribed by law;

b) To take the lead or participate in researching, proposing, building policies, orientations, planning, development plans, and applying science and technology within the scope of tasks of the Vietnam Maritime Search and Rescue Coordination Center;

c) To take the lead or participate in establishing regulations, rules, and professional procedures within the assigned field; compiling professional guidance materials for search and rescue operations; promoting, training, enhancing, and disseminating knowledge and experience in professional search and rescue operations;

d) To take the lead or participate in researching and building research topics, projects, and scientific works aimed at reforming and perfecting management mechanisms, improving the effectiveness of activities of the Vietnam Maritime Search and Rescue Coordination Center;

e) To directly monitor and inspect the implementation of specialized work within the assigned field; to build reports, statistics, manage archival files, implement procedural processes; to synthesize, evaluate, and improve management policies;

f) To advise on and propose measures to enhance the effectiveness of management, inspection, and supervision capabilities within the assigned field;

g) Perform other tasks assigned by competent authorities.

2. Qualifications regarding education and training:

a) Hold a bachelor’s degree or higher in a relevant field that meets the requirements of the position;

b) Hold a certificate for professional training according to the standards of the marine search and rescue officer profession;

3. Qualifications regarding professional expertise and skills:

a) To thoroughly understand the Party's guidelines, policies, state laws, knowledge of state administration in the specialized field of the job position, and the provisions of the law regarding civil servants; the functions and responsibilities of the Vietnam Maritime Search and Rescue Coordination Center;

b) Be well-informed about the situation and trends in maritime search and rescue operations both domestically and internationally; promptly update modern technologies in maritime search and rescue operations worldwide; organize research to serve management and information processing;

c) To have the ability to analyze, synthesize, systematize, and propose methods to improve or resolve practical issues within the management scope of the Vietnam Maritime Search and Rescue Coordination Center;

d) To have the capability to ensure the progress, quality, and effectiveness of work; to have writing and presentation skills; to effectively handle assigned tasks;

đ) Have basic computer skills and be able to use foreign languages or ethnic minority languages as required by the position for civil servants working in ethnic minority areas.

a) To have held the Marine Search and Rescue Category III position and equivalent positions for at least nine years (excluding probationary and trial periods). In cases with equivalent time, they must have held the Marine Search and Rescue Category III position for at least one year (twelve months) up to the deadline for submitting registration applications for the examination or promotion consideration;

b) During the period holding the Marine Search and Rescue Category III position and equivalent positions, they must have participated in drafting at least one (one) legal normative document, topic, project, initiative at the ministry level, departmental level, sectoral level, or provincial level that has been issued or accepted by the competent authority.

Article 6. Maritime Search and Rescue Category III, Code Number: V.12.45.03

1. Duties:

a) Participate in researching and proposing policies, orientations, planning, development applications, and scientific and technological advancements within the assigned tasks; participate in establishing specialized mechanisms and regulations in accordance with the law, suitable to practical circumstances;

b) Develop specific plans and programs to implement assigned tasks; study and resolve issues within authority or advise higher authorities to make decisions on specific matters related to the assigned field;

c) Guide, monitor, urge, inspect, supervise, and propose measures to ensure the effective implementation of management regulations and decisions;

d) Participate in collecting information and statistical data on personnel, equipment, and devices; manage dedicated vessel fleets and logistical bases serving search and rescue operations; manage and archive files and documents for operational purposes;

đ) Proactively coordinate with relevant units and cooperate with other officials to carry out tasks within their respective authorities and responsibilities;

e) Perform other tasks assigned by competent authorities.

2. Qualifications regarding education and training:

a) Hold a bachelor’s degree or higher in a relevant field that meets the requirements of the position;

b) Hold a certificate for professional training according to the standards of the marine search and rescue officer profession;

3. Professional Qualification Standards

a) Master the Party's guidelines, policies, and state laws; industry and sector policies and basic knowledge about maritime search and rescue;

b) Understand the objectives and subjects of activities in the maritime sector, the system of principles and management mechanisms of specialized maritime search and rescue operations;

c) Be familiar with the procedures for developing plans, decisions, and have knowledge about the maritime search and rescue industry and sector;

d) Have research, summarization, and proposal methods to improve operations; have the ability to implement tasks ensuring progress, quality, and effectiveness;

đ) Understand practical situations and grasp the development trends of the maritime search and rescue industry and sector;

e) Possess document drafting skills; effectively handle assigned tasks;

g) Have basic computer skills and be able to use a foreign language or a minority ethnic language if working in areas with ethnic minorities as required by job positions;

Article 7. Maritime Security Information Category I - Code Number: V.12.47.01

1. Duties:

a) Lead the implementation of professional tasks within the responsibility scope of the Maritime Security Information Center in accordance with the law;

b) Lead the research and proposal for building policies, orientations, development plans, and scientific and technological applications within the Center's tasks in accordance with the law;

c) Lead the research and establishment of regulations, rules, and procedures for specialized maritime security information operations; compile professional guidance materials; guide, inspect, and implement the reception, processing, and transmission of maritime security information;

d) Lead the research and construction of topics, projects, and scientific studies to improve and perfect management mechanisms, enhance the effectiveness of the Maritime Security Information Center's operations;

đ) Lead the establishment of search systems and organize the exploitation of documents;

e) Organize training, upgrading, dissemination of professional knowledge and experience in maritime security information for related organizations and individuals;

g) Perform other tasks assigned by competent authorities.

2. Qualifications regarding education and training:

a) Hold a bachelor’s degree or higher in a relevant field that meets the requirements of the position;

b) Hold a certificate for professional training according to the standards of the maritime security information profession;

3. Qualifications regarding professional expertise and skills:

a) Master the Party's guidelines, policies, state laws; management knowledge in the maritime security information field and legal provisions regarding civil service, professional functions, and tasks of the Maritime Security Information Center;

b) Be well-informed about the situation and development trends in the maritime security information field; promptly update modern technologies in maritime security information work worldwide; organize research to serve management and information handling;

c) Have the ability to propose and advise on policy development in the maritime security information field;

d) Have skills in drafting documents and presenting; effectively handle assigned tasks;

đ) Possess the ability to analyze, synthesize, systematize, and propose methods to improve or resolve practical issues within the scope of work;

e) Have the ability to organize the application of scientific and technical progress to improve and enhance the quality and effectiveness of work in the maritime security information field;

g) Have basic computer skills and be able to use a foreign language or a minority ethnic language if working in areas with ethnic minorities as required by job positions;

a) Have held the Maritime Security Information Category II professional title or equivalent for at least six years. In cases of equivalent time, they must have held the Maritime Security Information Category II professional title for at least one year (twelve months) up to the deadline for submitting registration documents for the exam or promotion application;

b) During the period holding the Maritime Security Information Category II professional title and equivalent, they must have participated in developing at least two (two) legal normative documents, topics, projects, initiatives at the ministry, department, or provincial level that have been issued or accepted by competent authorities.

Article 8. Maritime Security Information Category II, Code: V.12.47.02

1. Duties:

a) Take the lead or participate in performing specialized tasks within the scope of responsibility of the Maritime Security Information Center as prescribed by law;

b) Take the lead or participate in researching, proposing, building policies, orientations, planning, development plans, application of science and technology within the scope of tasks of the Maritime Security Information Center;

c) Take the lead or participate in formulating regulations, rules, procedures for maritime security information work; compile professional guidance materials; promote, train, enhance, disseminate knowledge and experience in maritime security information work;

d) Take the lead or participate in researching and building topics, projects on business management, improving content and enhancing the effectiveness of management methods;

đ) Take the lead or participate in organizing and implementing maritime security information connection exercises, internships; reporting, statistics, managing archival files; summarizing, evaluating, perfecting management policies;

e) Directly perform, guide, monitor, inspect the implementation of professional tasks; propose measures to improve the effectiveness of management, enhance inspection and supervision capabilities in the field of maritime security information;

g) Perform other tasks assigned by competent authorities.

2. Qualifications regarding education and training:

a) Hold a bachelor’s degree or higher in a relevant field that meets the requirements of the position;

b) Hold a certificate for professional training according to the standards of the maritime security information profession;

3. Qualifications regarding professional expertise and skills:

a) Master the Party's guidelines, policies, state laws; management knowledge in the maritime security information field and legal provisions regarding civil service, professional functions, and tasks of the Maritime Security Information Center;

b) Understand the situation and trends in the development of maritime security information both domestically and internationally; organize research to serve management and information processing;

c) Have the ability to organize and implement regulations within the scope of maritime security information; timely, effectively, and appropriately process information according to practical circumstances;

d) Have skills in drafting documents, presenting; fulfill assigned tasks well;

e) Possess basic information technology skills and be able to use foreign languages or ethnic minority languages for civil servants working in ethnic minority areas according to job requirements.

a) Having held the position of Maritime Security Information Category III or equivalent for at least nine years (excluding probationary and trial periods). In cases with equivalent time, there must be at least one year (twelve months) holding the position of Maritime Security Information Category III up to the deadline for submitting registration applications for the examination or promotion;

b) During the period of holding the position of Maritime Security Information Category III and equivalent, participating in building at least one (one) legal normative document, topic, project, initiative at the ministry level, sectoral level, or provincial level that has been issued or accepted by the competent authority;

Article 9. Maritime Security Information Category III, Code: V.12.47.03

1. Duties:

a) Participate in researching and proposing policies, orientations, planning, development plans, application of science and technology within the assigned scope of tasks; participate in formulating specialized regulations in accordance with the law, suitable to practical circumstances;

b) Develop specific plans and programs to implement assigned tasks; study and resolve issues within authority or advise higher authorities to make decisions on specific matters related to the assigned field;

c) Guide, monitor, urge, inspect, and propose measures to ensure compliance with regulations or decisions achieve results;

d) Participate in exercises, internships, training in receiving, processing, and transmitting maritime security information; manage files, archive documents to serve work;

đ) Proactively coordinate with related units and other civil servants to implement tasks, act within the scope of authority and responsibilities assigned;

e) Perform other tasks assigned by the competent authority;

2. Qualifications regarding education and training:

a) Hold a bachelor’s degree or higher in a relevant field that meets the requirements of the position;

b) Hold a certificate for professional training according to the standards of the maritime security information profession;

3. Qualifications regarding professional expertise and skills:

a) Firmly grasp the Party's guidelines and policies, state laws; industry and sector policies and basic knowledge about maritime security information;

b) Clearly understand the goals and target groups in the maritime sector, the system of principles and mechanisms for managing specialized maritime security information operations;

c) Understand the process of building plans, decisions, and have knowledge about the industry and sector of maritime security, safety, and environmental pollution prevention;

d) Have research, summarization, and proposal methods to improve operations; have the ability to implement tasks ensuring progress, quality, and effectiveness;

đ) Be familiar with practical situations, understand the development trends of the maritime security information industry and sector; understand basic knowledge and skills about maritime security information activities;

e) Adhere to confidentiality principles regarding maritime security information;

g) Have skills in drafting documents; effectively complete assigned tasks;

h) Have basic computer skills and proficiency in foreign languages or ethnic minority languages for civil servants working in ethnic minority areas as required by job positions.

Article 10. Maritime Rescue Seafarer

1. Duties: The maritime rescue seafarer shall perform duties according to the position of seafarers working on Vietnamese ships as prescribed by specialized laws and the following tasks:

a) Managing and operating search and rescue vessels in accordance with the law;

b) Ensuring that search and rescue vessels have all necessary safety conditions for maritime safety, maritime security, and environmental pollution prevention measures, consistent with professional standards, equipment regulations, hulls, reserves, crew members, and other issues related to maritime safety, maritime security, and environmental pollution prevention for the vessel and persons on board before and during the voyage;

c) Standing by and being ready to carry out maritime search and rescue missions according to the directives, commands, and task assignments of competent authorities;

d) Participating with functional forces in ensuring maritime safety, maritime security, and contributing to protecting Vietnam's maritime sovereignty when requested; participating in firefighting, environmental pollution prevention at sea when required; conscientiously performing assigned tasks and responsibilities in accordance with professional conscience;

đ) Cooperating and supporting other occupational positions of port maritime services in implementing their responsibilities and tasks as stipulated in the port and managed areas;

2. In addition to the duties specified in Clause 1 of this Article, maritime rescue seafarer positions also perform specific tasks as follows:

a) Rescue personnel: being ready and participating in controlling lifeboats and rescue boats; playing a key role in swimming and diving at sea to search for and rescue victims;

b) Ship nurse: assisting the ship doctor in receiving, treating, and caring for victims; monitoring and checking the health of patients, preserving the bodies of deceased persons on board; managing equipment and medicines for the journey as prescribed;

c) Service personnel: cleaning the ship to meet labor hygiene and safety requirements as prescribed by law;

Clause 3. Education and training criteria:

a) Having training qualifications and certificates of professional competence, vocational training certificates suitable for the position and vessel as prescribed by law;

b) Having certificates of supplementary training according to the standards of the maritime rescue profession;

c) Meeting health standards for seafarers as prescribed by law;

d) Having swimming and diving certificates; lifeboat and rescue boat driving certificates (applicable to the rescue personnel position);

đ) Meeting educational and supplementary training standards for doctors as prescribed by the Ministry of Health; having basic safety operation training certificates (applicable to the doctor position);

e) Meeting educational and supplementary training standards for nurses as prescribed by the Ministry of Health; having basic safety operation training certificates (applicable to the nurse position);

g) Having at least初级级职业技能证书；具有基本安全操作培训证书（适用于服务员岗位）。

h) Graduating from high school or above; having basic safety operation training certificates (applicable to the service personnel position).

4. Professional and Vocational Competence Standards: Maritime rescue seafarers must meet the following standards based on their positions working on search and rescue vessels:

a) Mastering the Party's policies, State laws, international regulations, and Vietnamese laws related to the assigned industry and field; regulations for civil servants; basic knowledge about maritime search and rescue;

b) Understanding the goals and targets of activities in the maritime transport sector, principles, procedures, and regulations related to the maritime search and rescue profession;

c) Possessing knowledge and understanding of the search and rescue, maritime safety, maritime security, and environmental pollution prevention industries;

d) Being familiar with the characteristics of search and rescue vessels, techniques for mobilizing and operating search and rescue vessels;

đ) Mastering search and rescue operations for vessels and people in distress, methods for rescuing people in distress;

e) For the rescue personnel position: possessing skills in controlling lifeboats and rescue boats, excellent swimming and diving skills at sea;

g) For the ship doctor and ship nurse positions: according to the required positions, having basic scientific knowledge, fundamental medical knowledge; knowledge about diagnosing, preventing, and treating diseases; mastering laws and policies on health protection and care; diagnostic, treatment, monitoring, and preventive skills for common diseases and routine emergency care; ability to work under wave and wind conditions;

h) For the catering position: mastering food safety regulations; ensuring meal provisions for seafarers and victims on board; ability to work under wave and wind conditions;

i) For the service personnel position: mastering labor hygiene and safety regulations; ability to work under wave and wind conditions.

Chapter III RATING OF THE SALARY FOR THE PROFESSIONAL TITLES OF SPECIALIZED STAFF IN MARITIME SEARCH AND RESCUE, MARITIME INFORMATION SECURITY

Article 11. Principles for Rating the Salary for the Professional Titles of Specialized Staff in Maritime Search and Rescue, Maritime Information Security

1. The appointment and rating of the salary for the professional titles of specialized staff in maritime search and rescue, maritime information security must be based on the job position, responsibilities, tasks, and professional qualifications currently held, and must fully meet the standards stipulated in this Circular.

2. When transferring to a corresponding professional title of specialized staff in maritime search and rescue, maritime information security, it shall not combine with increasing the salary grade or promoting the professional title of specialized staff.

Article 12. Rating the Salary for the Professional Titles of Specialized Staff in Maritime Search and Rescue, Maritime Information Security

1. From the date this Circular takes effect, in cases where specialized staff do not yet meet the conditions and standards for appointment to the professional titles of specialized staff in maritime search and rescue, maritime information security as prescribed in Articles 4, 5, 6, 7, 8, 9, and 10 of this Circular, the following measures shall be implemented:

a) If the specialized staff has less than five years (60 months) remaining until retirement, they shall continue to hold their current rank or grade of professional title and be rated according to the current salary scale;

b) If the specialized staff has five years (60 months) or more remaining until retirement, within three years (36 months), the employing agency shall be responsible for arranging training to ensure that the specialized staff meets the standards of the professional title of specialized staff in maritime search and rescue, maritime information security as stipulated in this Circular. After the period specified in this point, if the specialized staff does not meet the standards stipulated in this Circular, the head of the public service unit shall consider assigning other suitable work or implementing policies as prescribed.

2. The professional titles of maritime search and rescue and maritime information security stipulated in this Circular shall apply the Table of Salaries for Professional Qualifications for Civil Servants and Staff in State Public Service Units (Table 3) issued together with Decree No. 204/2004/ND-CP dated December 14, 2004 of the Government on the salary system for civil servants, public officials, staff, and armed forces, as follows:

a) The professional title of Maritime Search and Rescue Grade I and Maritime Information Security Grade I shall apply the salary coefficient for staff type A3, group 1 (A3.1) from coefficient 6.20 to coefficient 8.00;

b) The professional title of Maritime Search and Rescue Grade II and Maritime Information Security Grade II shall apply the salary coefficient for staff type A2, group 1 (A2.1) from coefficient 4.40 to coefficient 6.78;

c) The professional title of Maritime Search and Rescue Grade III and Maritime Information Security Grade III shall apply the salary coefficient for staff type A1 from coefficient 2.34 to coefficient 4.98;

3. The rating of the salary for specialized staff in maritime search and rescue and specialized staff in maritime information security for those currently holding salaries in the ranks of civil servants and staff who are transferred to the specialized fields of maritime search and rescue and maritime information security as stipulated in this Circular shall be carried out according to the guidelines set forth in Clause 2, Section II of Circular No. 02/2007/TT-BNV dated May 25, 2007 of the Ministry of Home Affairs on rating salaries when upgrading ranks, transferring ranks, or changing types of civil servants and staff, specifically as follows:

a) Rating the professional title of Maritime Search and Rescue Grade I, code V.12.45.01 for staff currently holding salary type A3, group 1 (A3.1);

b) Rating the professional title of Maritime Search and Rescue Grade II, code V.12.45.02 for staff currently holding salary type A2, group 1 (A2.1);

c) Rating the professional title of Maritime Search and Rescue Grade III, code V.12.45.03 for staff currently holding salary type A1;

d) Rating the professional title of Maritime Information Security Grade I, code V.12.47.01 for staff currently holding salary type A3, group 1 (A3.1);

đ) Rating the professional title of Maritime Information Security Grade II, code V.12.47.02 for staff currently holding salary type A2, group 1 (A2.1);

e) Rating the professional title of Maritime Information Security Grade III, code V.12.47.03 for staff currently holding salary type A1.

Chapter IV IMPLEMENTATION PROVISIONS

Article 13. Effective Date

1. This Circular takes effect from March 1, 2023.

2. In cases where the legal documents referred to in this Circular are amended, supplemented, or replaced, implementation shall be carried out according to the provisions of the amended, supplemented, or replacing documents.

Article 14. Implementation Organization

The Head of the Office of the Ministry, the Inspector General of the Ministry, the Heads of Departments, the Director of the Vietnam Maritime Administration, the Heads of agencies, organizations, and individuals concerned are responsible for implementing this Circular./.
