Circular No. 38/2023/TT-BQP Abolishes Certain Legal Normative Documents and Internal Normative Documents within the Issuing Authority of the Minister of National Defense

CIRCULAR

Repealing certain regulatory legal documents and internal regulatory documents within the promulgation authority of the Minister of National Defense

Pursuant to the Law on Legislative Regulatory Documents dated June 22, 2015; the Law Amending and Supplementing Certain Provisions of the Law on Legislative Regulatory Documents dated June 18, 2020;

Pursuant to Decree No. 34/2016/NĐ-CP dated May 14, 2016 of the Government detailing some provisions and measures for implementing the Law on Legislative Regulatory Documents; Decree No. 154/2020/NĐ-CP dated December 31, 2020 of the Government amending and supplementing certain provisions of Decree No. 34/2016/NĐ-CP dated May 14, 2016 of the Government;

Pursuant to Decree No. 01/2022/NĐ-CP dated November 30, 2022 of the Government stipulating functions, tasks, powers, and organizational structure of the Ministry of National Defense;

At the proposal of the Director of the Legal Department;

The Minister of National Defense issues this Circular to repeal certain regulatory legal documents and internal regulatory documents within the promulgation authority of the Minister of National Defense.

Article 1. Repealing entirely eight regulatory legal documents and one internal regulatory document concerning military, national defense, and cryptographic matters within the promulgation authority of the Minister of National Defense

1. Circular No. 37/2014/TT-BQP dated May 29, 2014 of the Minister of National Defense guiding the implementation of remuneration systems for readers and inspectors of military manuscript proofreading.

2. Circular No. 124/2015/TT-BQP dated November 9, 2015 of the Minister of National Defense guiding the implementation of compensation, allowances, and medical expenses for individuals working in the military who suffer from work-related accidents or occupational diseases.

3. Circular No. 20/2010/TT-BQP dated February 23, 2010 of the Minister of National Defense approving the Financial Management Regulations of Total Company 28 operating under a parent company-subcompany model.

4. Circular No. 183/2011/TT-BQP dated October 11, 2011 of the Minister of National Defense stipulating criteria, files, procedures, and processes for recognizing and re-recognizing enterprises directly serving national defense and security.

5. Circular No. 302/2017/TT-BQP dated December 16, 2017 of the Minister of National Defense stipulating the preparation, management, utilization, and settlement of state budget funds for legislative regulatory document drafting and legal system improvement within the Ministry of National Defense.

6. Circular No. 205/2010/TT-BQP dated December 20, 2010 of the Minister of National Defense promulgating technical grade standards for motorcycle drivers and mechanics repairing military vehicles.

7. Circular No. 97/2015/TT-BQP dated August 31, 2015 of the Ministry of National Defense stipulating conditions for upgrading ranks, certificates of professional competence for ship captains and engineers performing national defense tasks.

8. Decision No. 295/1999/QĐ-BQP dated March 12, 1999 of the Minister of National Defense promulgating technical standards for military vehicle drivers.

9. Decision No. 1046/QĐ-BQP dated August 13, 1997 of the Minister of National Defense promulgating technical grade standards for automobile repair workers.

Article 2. This Circular takes effect from July 29, 2023.

Article 3. The Head of the Legal Affairs Department, Heads of agencies and units under the Ministry of National Defense; relevant agencies, units, and individuals are responsible for implementing this Circular./.
