CIRCULAR

Regulations on basic health services package for primary healthcare level

Pursuant to the Social Insurance Lawn lo social health insurance number 25/2008/QH12 dated October 14, 2008 has been amended and supplemented with some articles according to Law11  46/2014/QH13 dated June 13, 2014;

"7. Decree No. 75/2017/ND-CPDepartment of Planning and Finance;In which, the adjustment rate for the monthly income already contributed to social insurance for the corresponding year shall be implemented according to Table 2 below: Table 2:The Minister of Health issues this Circular stipulating the basic health services package for primary healthcare level.

This Circular stipulates the basic health services package including technical services, medicines, chemicals, medical supplies for initial health care, health promotion, prevention, and treatment applicable to health facilities at the primary healthcare level (including district and commune levels) and all citizens.

Article 2. Basic health services packagerime Minister cThe basic health services package includes "Basic health services package funded by the social health insurance fund" and "Basic health services package for initial health care, prevention, and health promotion":developmentt s

1. "Basic health services package funded by the social health insurance fund" includes technical examination and treatment services prescribed in Appendix I and the list of medicines used at the commune level prescribed in Appendix II issued together with this Circular, applied at commune health stations, urban health stations, town health stations, and equivalent facilities, independent family doctor clinics, military-civilian health stations, and military-civilian clinics (hereinafter referred to collectively as commune-level health facilities).n lo hidevelopment2. "Basic health services package for initial health care, prevention, and health promotion" includes essential services prescribed in Appendix III issued together with this Circular, applied at district health centers, county health centers, municipal health centers, and provincial city health centers (hereinafter referred to collectively as district-level health centers) and commune health stations, urban health stations, town health stations to provide health care, prevention, and health promotion.

The Minister of the Ministry of Science and Technology issues this Circular on the issuance of National Technical Regulations on Radioactive Waste Containing Naturally Occurring Radioactive Materials.ưởArticle 3. Payment for health services under the "Basic health services package funded by the social health insurance fund" (Appendix I and Appendix II)n l1. Social health insurance participants who use health services under the basic health services package shall enjoy benefits within the scope and level of entitlements as prescribed by the law on social health insurance and the provisions of this Circular.

Article 1. Scope of Regulation and Applicability

2. Social health insurance participants who use technical services, medicines, medical supplies, and other benefits not included in the basic health services package prescribed in this Circular at healthcare facilities nationwide shall be reimbursed by the social insurance agency according to the law on social health insurance.

3. The prices of technical services shall be implemented in accordance with the law on pricing for examination and treatment services under social health insurance and Circular Jointly Issued No. 37/2015/TTLT-BYT-BTC dated October 29, 2015 of the Ministry of Health and the Ministry of Finance on uniform pricing for examination and treatment services under social health insurance among hospitals of the same grade nationwide.

4. Prices of medicines and medical supplies shall be implemented in accordance with the law on bidding for medicines and medical supplies.

1. "Basic health service package covered by the health insurance fund" includes technical examination and treatment services specified in Appendix I and the list of drugs used at commune-level facilities specified in Appendix II issued together with this Circular, applicable at commune health stations, urban district health stations, town health stations, and equivalent facilities, independent family doctor clinics, military-civilian health stations, and military-civilian health clinics (hereinafter referred to collectively as commune-level health facilities).

2. "Basic health service package for primary healthcare, prevention, and health promotion" includes essential services specified in Appendix III issued together with this Circular, applicable at district health centers, county health centers, municipal health centers under provinces (hereinafter referred to collectively as district health centers), and commune health stations, urban district health stations, town health stations for health care, prevention, and health promotion.

3. The basic health service package shall be updated periodically every 1-2 years or on an ad hoc basis when required.

Article 3. Payment for medical services included in the "Basic health service package covered by the health insurance fund" (Appendix I and Appendix II)

1. Health insurance participants who use medical services within the basic health service package shall enjoy benefits according to the scope and level of benefits stipulated by laws on health insurance and the provisions of this Circular.

2. Health insurance participants who use technical services, medicines, medical supplies, and other benefits not included in the basic health service package prescribed in this Circular at examination and treatment facilities nationwide shall be reimbursed by social insurance agencies according to the laws on health insurance.

3. The prices of technical services shall be implemented in accordance with the laws on pricing for examination and treatment services under health insurance and Joint Circular No. 37/2015/TTLT-BYT-BTC dated October 29, 2015, of the Ministry of Health and the Ministry of Finance on uniform pricing for examination and treatment services under health insurance among hospitals of the same grade nationwide.

4. Prices of medicines and medical supplies shall be implemented in accordance with the laws on bidding for medicines and medical supplies.

Article 4. Payment for services under the "Basic Health Service Package for Primary Health Care, Prevention, and Health Improvement" (Annex III)

1. For health care, prevention, and health improvement services to implement activities under the Target Program on Health and Population: the costs shall be covered by the funds of the Target Program on Health and Population according to Decision No. 1125/QĐ-TTg dated July 31, 2017 of the Government approving the Target Program on Health and Population for the period 2016-2020. The source of funding, content, and expenditure levels shall be implemented in accordance with the regulations of the Ministry of Finance.

2. For health care, prevention, and health improvement services for subjects guaranteed funding by the State according to current laws: implementation shall be carried out in accordance with the regulations of the Ministry of Finance.

3. For health care, prevention, and health improvement services outside those specified in Clause 1 and 2 of this Article: local budgets shall ensure funding from the health service expenditure according to Decision No. 46/2016/QĐ-TTg dated October 19, 2016 of the Government on the standard allocation of the regular state budget estimate for 2017.

4. For other services outside those specified in Clauses 1, 2, and 3 of this Article: they may be charged from users according to current laws, from socialized funding sources, and other lawful funding sources.

State-owned enterprises that have been assigned by the Ministry of Agriculture and Rural Development to conduct offshore wind power project surveys before the effective date of this Circular shall continue to implement according to the assigned documents; any new matters arising after the effective date of this Circular shall be implemented in accordance with the provisions of this Circular.

1. The Vietnam Social Security is responsible for directing provincial-level social security agencies to fully pay the costs of services under the basic health service package covered by the health insurance fund that medical examination and treatment facilities have provided in reality in accordance with the payment guidelines stipulated in this Circular and relevant laws.

2. Provincial People's Committees directly under the central government are responsible for directing municipal people's committees at all levels, Departments of Health, and related departments:

a) To allocate local budgets, funds of the National Target Program on New Rural Development, and other lawful capital sources (if any) to invest in infrastructure and equipment for commune health stations, ensuring the principle of non-dispersal and effectiveness:

- Prioritize investment in commune health stations capable of providing services under both basic health service packages, especially those in remote, mountainous, and difficult areas; limit investment in commune health stations near district-level medical centers with dual functions or close to hospitals;

- In accordance with local realities and groups defined in Decision No. 4667/QĐ-BYT dated November 7, 2014 of the Ministry of Health promulgating national criteria for commune health during the period up to 2020 (hereinafter referred to as Decision No. 4667/QĐ-BYT);

b) To allocate human resources so that health facilities can provide the basic health service package. Direct the implementation of a two-way rotation system suitable for each locality's conditions, from top to bottom and vice versa, to update knowledge, improve professional skills, and ensure financial resources to implement Decision No. 14/2013/QĐ-TTg dated February 20, 2013 of the Prime Minister on implementing a term-based rotation system for practitioners at medical examination and treatment facilities;

c) For the Basic Health Service Package funded by the health insurance fund:

- Direct health facilities to organize the provision of the basic health service package to insured individuals within their jurisdiction;

- Direct the Department of Health and the provincial social security agency to pay the costs of services under the basic health service package to health facilities according to this Circular and relevant laws;

d) For the Basic Health Service Package for primary health care, prevention, and health improvement:

- Ensure the budget and direct local health facilities to provide health services for primary health care, prevention, and health improvement for the population, and prioritize health care for preferential subjects as prescribed by law;

- Submit to the People's Council at the provincial level for decision within its authority regarding the use of the budget and other lawful sources to provide health services under the basic health service package stipulated in Annex III issued together with this Circular;

- Mobilize socialized funding for health care, prevention, and health improvement activities.

3. Provincial Health Departments are responsible for:

a) For the basic health service package funded by the health insurance fund:

- Organize and guide commune health facilities to provide the basic health service package in accordance with this Circular;

- Ensure sufficient medicines, medical supplies, and chemicals for commune health facilities providing the basic health service package;

- Coordinate with relevant departments and social security agencies at all levels to settle the costs of health services under the basic health service package for health facilities according to this Circular and relevant laws;

b) For the basic health service package funded by the state budget and other lawful sources:

- Organize and guide the supply of the basic health service package at primary health care facilities;

- Coordinate with relevant departments at all levels to ensure financial resources to settle the costs of the basic health service package for health facilities according to relevant laws;

c) Advise the provincial People's Committee to develop a roadmap to invest in infrastructure and equipment for health facilities in line with the actual conditions of each health station and the groups defined in Decision No. 4667/QĐ-BYT;

d) Guide, inspect, and audit health facilities to ensure that health services under the basic health service package are provided in compliance with professional and technical conditions and relevant laws.

đ) Coordinate with training facilities that have been assigned training codes to organize refresher courses, continuous medical knowledge updates, training sessions, and capacity-building programs to enhance the professional skills of healthcare staff at healthcare facilities providing basic health service packages.

4. Health centers and district-level hospitals shall be responsible for:

a) Implementing the provision of basic health service packages in accordance with this Circular;

b) Directing communal health stations under their management to organize the provision of all necessary services, medicines, and medical supplies to implement basic health service packages;

c) Being responsible for managing and regularly inspecting and supervising communal health stations in the provision of basic health service packages to the public, in the management and use of medicines and medical supplies provided to communal health stations, and in settling costs for communal health stations in accordance with relevant laws.

5. Healthcare facilities specified in this Circular shall be responsible for providing basic health service packages in accordance with the law.

Article 6. Effectiveness

This Circular takes effect from December 1, 2017.

Article 7. Reference Provisions

In cases where referenced documents in this Circular are replaced or amended, implementation shall follow the replacement document or the amended document.

During implementation, if there are difficulties or obstacles, agencies, organizations, and individuals are requested to report them in writing to the Ministry of Health (Department of Planning and Finance) for consideration and resolution./.
