REGULATIONS ON THE CONSTRUCTION, MANAGEMENT, AND EXPLOITATION OF THE NATIONAL ELECTRONIC LEGAL BOOKSHELF, THE LEGAL BOOKSHELF AT ORGANIZATIONS AND UNITS OF THE PEOPLE'S ARMED FORCES

On the basis of 61/2014/QH13;

On the basis of Law on Popularizing and Promoting Legal Education No. 14/2012/QH13;

At the proposal of the Minister of Justice;

The Prime Minister issues this Decision to regulate the construction, management, and exploitation of the National Electronic Legal Bookshelf and the Legal Bookshelf at organizations and units of the People's Armed Forces.

Article 1. Scope of Regulation and Applicability

1. This Decision regulates the construction, management, and exploitation of the National Electronic Legal Bookshelf; the Legal Bookshelf at organizations and units of the People's Armed Forces.

2. This Decision applies to agencies, organizations, and individuals responsible for the construction, management, exploitation, and use of the National Electronic Legal Bookshelf and the Legal Bookshelf at organizations and units of the People's Armed Forces.

Article 2. The National Electronic Legal Bookshelf

1. The National Electronic Legal Bookshelf is constructed and managed uniformly nationwide by the Ministry of Justice to store, manage, and exploit electronic legal books and documents, including component data of legal books and documents updated and managed by ministries, ministerial-level agencies, government agencies, central-level mass organizations, provincial People's Councils, and city People's Councils based on assigned accounts and management permissions.

2. The National Electronic Legal Bookshelf is integrated with the National Legal Portal and the National Database of Legal Documents.

Article 3. The Legal Bookshelf at Organizations and Units of the People's Armed Forces

1. The Legal Bookshelf at organizations and units of the People's Armed Forces includes parts of legal books and documents stored and managed in paper form and other information carriers to serve cadres, civil servants, public officials, officers, non-commissioned officers, professional soldiers, soldiers, workers, and other subjects under the management of the People's Armed Forces.

2. The construction, management, and exploitation of the Legal Bookshelf as stipulated in Clause 1 of this Article must comply with the requirements of each organization and unit of the People's Armed Forces and the needs of users to exploit legal books and documents; ensuring the enhanced application of information technology and digital transformation in exploiting legal books and documents and using the National Electronic Legal Bookshelf.

3. The continued maintenance, construction, management, and exploitation of the Legal Bookshelf at organizations and units of the People's Armed Forces shall be decided and implemented by the Minister of Defense and the Minister of Public Security according to the provisions of Clauses 1 and 2 of this Article.

Article 4. Budget for Construction, Management, and Exploitation of the National Electronic Legal Bookshelf and the Legal Bookshelf at Organizations and Units of the People's Armed Forces

1. The budget for constructing, operating, managing, and exploiting the National Electronic Legal Bookshelf is guaranteed by the state budget; other legitimate sources of funding as prescribed by law.

2. The budget for constructing, managing, and exploiting the Legal Bookshelf at organizations and units of the People's Armed Forces is guaranteed by the state budget, allocated within the annual regular expenditure budget of the organization or unit; other legitimate sources of funding as prescribed by law.

The minimum annual budget for each Legal Bookshelf is three million Vietnamese dong (VND 3,000,000). The preparation, execution, and settlement of the budget shall be carried out in accordance with the laws on the state budget.

Article 5. Effectiveness and Transitional Provisions

1. This Decision shall take effect from December 15, 2025.

2. The Prime Minister's Decision No. 14/2019/QĐ-TTg dated March 13, 2019 on the construction, management, and exploitation of Legal Bookcases shall cease to be effective from the date this Decision takes effect.

3. The Ministry of Justice shall take the lead and coordinate with the Ministry of Culture, Sports and Tourism, the Ministry of Science and Technology, and the Ministry of Education and Training to guide the implementation of the review and consolidation of Legal Bookcases in particularly difficult communes, border communes, safe area communes, particularly difficult coastal and island communes that have been constructed according to the Prime Minister's Decision No. 14/2019/QĐ-TTg on the construction, management, and exploitation of Legal Bookcases into parts of legal books and materials of libraries or postal and cultural centers or community learning centers or cultural and sports facilities at the grassroots level, ensuring that the consolidation is completed before June 30, 2026.

Article 6. Responsibility for Implementation

The Ministers, Heads of ministerial-level agencies, Heads of government agencies, Chairpersons of provincial People's Committees, and heads of related agencies and organizations are responsible for implementing this Decision.
