Circular No. 39/2025/TT-BXD amends and supplements certain norms established by Circular No. 44/2021/TT-BGTVT dated December 31, 2021, issued by the Minister of Transport regarding norms for management and regular maintenance of national roads.

CIRCULAR

AMENDING AND SUPPLEMENTING CERTAIN STANDARDS ISSUED IN CIRCULAR NO. 44/2021/TT-BGTVT OF THE MINISTER OF TRANSPORT ON STANDARDS FOR ROUTINE MANAGEMENT AND MAINTENANCE OF ROADS

Pursuant to the Road Law No. 35/2024/QH15;

Pursuant to the Construction Law No. 50/2014/QH13 (amended and supplemented by the Law Amending and Supplementing Certain Provisions of the Construction Law No. 62/2020/QH14);

Pursuant to Decree No. 33/2025/NĐ-CP dated February 25, 2025 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Construction;

Pursuant to the Government Decree No. 10/2021/NĐ-CP dated February 9, 2021 on management of construction investment costs (amended and supplemented by certain provisions of the Government Decree No. 35/2023/NĐ-CP dated June 20, 2023);

Pursuant to Decree No. 06/2021/NĐ-CP dated January 26, 2021 of the Government detailing certain contents on construction quality management, construction works, and maintenance of construction projects;

Pursuant to the Government Decree No. 32/2019/NĐ-CP dated April 10, 2019 stipulating the assignment of tasks, placing orders, or tendering for the provision of public goods and services using state budget funds from regular expenditure;

At the proposal of the Director of the Vietnam Highway Administration;

The Minister of Construction issues this Circular amending and supplementing certain standards issued in Circular No. 44/2021/TT-BGTVT dated December 31, 2021 of the Minister of Transport on standards for routine management and maintenance of roads.

Article 1. Amend and supplement certain standards for routine maintenance of roads issued together with Circular No. 44/2021/TT-BGTVT dated December 31, 2021 of the Minister of Transport on standards for routine management and maintenance of roads, including:

1. Amend and supplement certain contents of Appendix I "Standards for Routine Management and Maintenance of National Highways" issued together with Circular No. 44/2021/TT-BGTVT at Appendix I issued together with this Circular.

2. Amend and supplement certain contents of Appendix II "Standards for Routine Management and Maintenance of Expressways" issued together with Circular No. 44/2021/TT-BGTVT at Appendix II issued together with this Circular.

Article 2. Transitional Provisions

1. Approved budgets (costs of public services) for routine management and maintenance of roads that have been reviewed or approved shall not be reviewed or approved again. In cases where tender documents or request documents have not been issued, or have been issued but tenders have not yet been closed, update the standards attached to this Circular.

2. In cases where tenders have been closed or contracts have been signed, implement according to the provisions of the tender documents, request documents, bid documents, proposal documents, and the provisions of the Contracts.

Article 3. Effectiveness

This Circular takes effect from January 15, 2026./.
