Decree No. 39/2026/ND-CP amends and supplements certain articles of Decree No. 27/2019/ND-CP dated March 13, 2019, of the Government detailing certain provisions of the Land Surveying and Mapping Law, which has been amended and supplemented by Decree No. 136/2021/ND-CP dated December 31, 2021, and Decree No. 22/2023/ND-CP dated May 12, 2023 of the Government.

Amending and supplementing some articles of Decree No. 27/2019/NĐ-CP

dated March 13, 2019 of the Government detailing some provisions of the Law on Surveying and Mapping amended and supplemented by Decree No.

136/2021/NĐ-CP dated December 31, 2021 of the Government and Decree No.

22/2023/NĐ-CP dated May 12, 2023 of the Government

On the basis of the Law on the Organization of the Government No. 63/2025/QH15;

On the basis of the Law on Surveying and Mapping No. 27/2018/QH14;

At the proposal of the Minister of Agriculture and Rural Development;

The Government promulgates this Decree amending and supplementing some articles of Decree No. 27/2019/NĐ-CP dated March 13, 2019 of the Government detailing some provisions of the Law on Surveying and Mapping amended and supplemented by Decree No. 136/2021/NĐ-CP dated December 31, 2021 of the Government

and Decree No. 22/2023/NĐ-CP dated May 12, 2023 of the Government. Article 1.

Amending and supplementing some articles of Decree No. 27/2019/NĐ-CP dated March 13, 2019 of the Government detailing some provisions of the Law on Surveying and Mapping amended and supplemented by Decree No. 136/2021/NĐ-CP dated December 31, 2021 of the Government 1. Amending and supplementing Article 32 of Decree No. 27/2019/NĐ-CP (amended and supplemented by Clause 7 of Article 1 of Decree No. 136/2021/NĐ-CP) as follows:

"1. The dossier for domestic organizations requesting a surveying and mapping operation permit includes:

a) A request for a surveying and mapping operation permit according to Model No. 04 Appendix IA issued together with this Decree;

b) A copy or electronic file copy of the decision specifying functions and tasks for organizations requesting a surveying and mapping operation permit without a business registration certificate;

c) A copy or electronic file copy of the graduation certificate or higher degree in surveying and mapping, technical staff work history according to Model No. 05 Appendix IA issued together with this Decree or a Class I surveying and mapping practice certificate; labor contract or recruitment decision; appointment decision of the technical staff;

d) A copy or electronic file copy of the professional qualification certificates and contracts of employment or recruitment decisions of surveying and mapping technical staff; work history of at least one technical staff member with a minimum of five years of actual experience relevant to the requested permit according to Model No. 05 Appendix IA issued together with this Decree;

đ) A copy or electronic file copy of the electronic invoice or proof of ownership of surveying equipment, devices, software, and technology; calibration and verification certificates of surveying equipment still valid. List of surveying equipment, devices, and software suitable for the organization's surveying and mapping activities according to Appendix IC issued together with this Decree;

e) In cases where academic certificates and qualifications are stored in the higher education database or vocational education database that are connected and shared, there is no need to submit copies of these certificates as required under this clause.

2. The dossier for foreign contractors requesting a surveying and mapping operation permit includes:

a) A request or electronic file containing a request for a surveying and mapping operation permit according to Model No. 11 Appendix I issued together with this Decree;

b) A copy or electronic file copy of the tender award decision (or selection decision) from the project owner, which includes content related to surveying and mapping activities requiring a permit;

c) A copy or electronic file copy of the professional qualification certificates and labor permits issued by competent authorities according to foreign labor laws for foreign technical staff; or professional qualification certificates and employment contracts of Vietnamese technical staff consistent with the quantity and expertise level in the submitted bid documents. In cases where certificates are issued by Vietnamese educational institutions and stored in the higher education database or vocational education database that are connected and shared, there is no need to submit copies of these certificates as required under this point;

d) A copy or electronic file copy of the electronic invoice or proof of ownership or right to use surveying equipment, devices, software, and technology consistent with the submitted bid documents.".

2. Amending and supplementing Clause 1 of Article 46 of Decree No. 27/2019/NĐ-CP (amended and supplemented by Point a Clause 16 of Article 1 of Decree No. 136/2021/NĐ-CP) as follows:

"1. The dossier for requesting a surveying and mapping practice certificate includes:

a) A request for a surveying and mapping practice certificate according to Model No. 12 Appendix IA issued together with this Decree accompanied by one 4x6 cm color photo with a white background;

b) A copy or electronic file copy of the professional qualification certificates issued by legitimate training institutions; health certificate for practicing issued by a medical facility meeting the prescribed conditions. In cases where certificates are stored in the higher education database or vocational education database that are connected and shared, there is no need to submit copies of these certificates as required under this point;

c) Professional experience declaration according to Model No. 13 Appendix IA issued together with this Decree;

d) A copy or electronic file copy of the proof of being exempted from practical experience examination and legal knowledge.".

3. Amending and supplementing Clause 2, Clause 4 of Article 27 of Decree No. 27/2019/NĐ-CP dated March 13, 2019 of the Government detailing some provisions of the Law on Surveying and Mapping as follows:

"2. The Ministry of Agriculture and Rural Development shall be responsible for organizing the implementation of the following contents:

a) Building the framework data specified in Clause 2 of Article 45 of the Law on Surveying and Mapping;

b) Building specialized map data specified in Points c, d, đ, and e Clause 3 of Article 45 of the Law on Surveying and Mapping; specialized map data on disaster prevention, environmental remediation, and climate change response specified in Point k Clause 3 of Article 45 of the Law on Surveying and Mapping;

c) Building national master plan map data and regional master plan map data within its management scope;

d) Integrating national geographic information data.

4. The Ministry of Construction shall be responsible for organizing the construction of:

a) Specialized map data specified in Points h and 1 Clause 3 of Article 45 of the Law on Surveying and Mapping;

b) Map data of port water areas and maritime routes specified in Point i Clause 3 of Article 45 of the Law on Surveying and Mapping;

c) Urban planning map data and rural planning map data within its management scope specified in Point m Clause 3 of Article 45 of the Law on Surveying and Mapping;

d) National master plan map data and regional master plan map data within its management scope."

Article 2. Replacing and Revoking Certain Provisions and Annexes of Government Decree No. 27/2019/NĐ-CP dated March 13, 2019, detailing certain provisions of the Land Surveying and Mapping Law, amended and supplemented by Government Decrees No. 136/2021/NĐ-CP dated December 31, 2021, and No. 22/2023/NĐ-CP dated May 12, 2023.

1. Replace certain phrases as follows:

a) Replace the phrase "Ministry of Natural Resources and Environment" with the phrase "Ministry of Agriculture and Environment" in Clause 4 of Article 4 (amended and supplemented by Clause 1 of Article 1 of Government Decree No. 136/2021/NĐ-CP); Clause 1 and Clause 2 of Article 9; Clause 2 of Article 14; Point b of Clause 6 and Point d of Clause 7 of Article 17; Clause 2 and Clause 3 of Article 18; Clause 3 of Article 24; Clause 3 of Article 26; Clause 10 of Article 27; Clause 3 and Clause 4 of Article 28; Clause 1, Clause 3 and Clause 4 of Article 33 (amended and supplemented by Clause 8 of Article 1 of Government Decree No. 136/2021/NĐ-CP); Point c of Clause 2 of Article 34 (amended and supplemented by Clause 9 of Article 1 of Government Decree No. 136/2021/NĐ-CP); Article 36 (amended and supplemented by Clause 11 of Article 1 of Government Decree No. 136/2021/NĐ-CP); Clause 3 of Article 37 (amended and supplemented by Point b of Clause 12 of Article 1 of Government Decree No. 136/2021/NĐ-CP); Clause 1 of Article 39 (amended and supplemented by Clause 14 of Article 1 of Government Decree No. 136/2021/NĐ-CP); Clause 2 of Article 40; Clause 2 of Article 41; Point a of Clause 2 of Article 43; Clause 2 of Article 45; Point a of Clause 3 of Article 46 (amended and supplemented by Point b of Clause 16 of Article 1 of Government Decree No. 136/2021/NĐ-CP); Clause 2 of Article 51; Clause 2 of Article 52 of Government Decree No. 27/2019/NĐ-CP; Clause 1 of Article 4 of Government Decree No. 136/2021/NĐ-CP; Annex I promulgated together with Government Decree No. 27/2019/NĐ-CP;

b) Replace the phrase "Ministry of Planning and Investment" with the phrase "Ministry of Finance" in Clause 2 of Article 4 of Government Decree No. 136/2021/NĐ-CP;

c) Replace the phrase "natural resources and environment" with the phrase "agriculture and environment" in Point b of Clause 4 and Clause 4a of Article 4 (amended and supplemented by Clause 1 of Article 1 of Government Decree No. 136/2021/NĐ-CP); Clause 3 of Article 12; Clause 4, Clause 5 and Clause 6 of Article 17; Clause 4 of Article 18; Clause 10 of Article 27; Point b of Clause 1, Point b and Point d of Clause 3, Point b of Clause 4 of Article 33 (amended and supplemented by Clause 8 of Article 1 of Government Decree No. 136/2021/NĐ-CP); Clause 2 of Article 36; Point b of Clause 3 of Article 37; Article 39 (amended and supplemented by Clause 14 of Article 1 of Government Decree No. 136/2021/NĐ-CP); Point a of Clause 2 of Article 43; Point b of Clause 3 of Article 46 (amended and supplemented by Point b of Clause 16 of Article 1 of Government Decree No. 136/2021/NĐ-CP); Clause 2 of Article 51; Point b of Clause 2 of Article 52; Annex I promulgated together with Government Decree No. 27/2019/NĐ-CP;

d) Replace the phrase "district level" with the phrase "commune level" in Point a of Clause 3 of Article 18 of Government Decree No. 27/2019/NĐ-CP;

đ) Replace the phrase "Form No. 07" with the phrase "Form No. 06" in Article 34 of Government Decree No. 27/2019/NĐ-CP (amended and supplemented by Clause 9 of Article 1 of Government Decree No. 136/2021/NĐ-CP).

2. Repeal Clause 3, Clause 5 of Article 27 of Government Decree No. 27/2019/NĐ-CP dated March 13, 2019, detailing certain provisions of the Land Surveying and Mapping Law.

3. Replace certain Annexes as follows:

a) Replace Form No. 03 of Annex I promulgated together with Government Decree No. 27/2019/NĐ-CP with Form No. 03 of Annex I promulgated together with this Decree;

b) Replace Annex II promulgated together with Government Decree No. 27/2019/NĐ-CP with Annex II promulgated together with this Decree;

c) Replace Annex IA promulgated together with Government Decree No. 136/2021/NĐ-CP with Annex IA promulgated together with this Decree.

Article 3. Implementation Provisions

1. This Decree shall take effect from January 25, 2026.

2. Repeal the following provisions:

a) Article 37, Article 38 of Government Decree No. 131/2025/NĐ-CP dated June 12, 2025, detailing the division of authority between two levels of local government in the field of state management by the Ministry of Agriculture and Environment;

b) Article 56, Article 57, Article 60, Article 61 of Government Decree No. 136/2025/NĐ-CP dated June 12, 2025, detailing the delegation and decentralization in the field of agriculture and environment.

3. Transitional Provisions:

a) Applications for surveying and mapping licenses and surveying and mapping practice certificates that have been received by competent authorities to be processed under administrative procedures on surveying and mapping before the date this Decree takes effect shall be processed according to the provisions of Government Decree No. 27/2019/NĐ-CP dated March 13, 2019, detailing certain provisions of the Land Surveying and Mapping Law, Government Decree No. 136/2021/NĐ-CP dated December 31, 2021, amending and supplementing certain provisions of Government Decree No. 27/2019/NĐ-CP dated March 13, 2019, detailing certain provisions of the Land Surveying and Mapping Law, and Government Decree No. 22/2023/NĐ-CP dated May 12, 2023, amending and supplementing certain provisions of related decrees concerning business activities in the field of natural resources and environment.

b) In cases where public service organizations are reorganized through mergers or consolidations, and one or more public service organizations have already been granted surveying and mapping licenses, the organization resulting from the merger or consolidation may continue to use the license to exercise rights and fulfill obligations within the scope of the license for the duration of the surveying and mapping license issued but not exceeding one year from the date of reorganization of the public service organization.
