CIRCULAR

Regarding the issuance of the "Supplementary List of Fertilizers Permitted for Production, Business, and Use in Vietnam"

Pursuant to Decree No. 01/2008/NĐ-CP dated January 3, 2008 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development; Decree No. 75/2009/NĐ-CP amending Article 3 of Decree No. 01/2008/NĐ-CP of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development;

Pursuant to Decree No. 113/2003/NĐ-CP dated October 7, 2003 of the Government on fertilizer production, business management; Decree No. 191/2007/NĐ-CP dated December 31, 2007 of the Government amending and supplementing certain articles of Decree No. 113/2003/NĐ-CP dated October 7, 2003 of the Government on fertilizer production, business management;

Pursuant to the Law on Product Quality and Goods dated November 21, 2007;

Pursuant to Decree No. 132/2008/NĐ-CP dated December 31, 2008 of the Government detailing the implementation of certain provisions of the Law on Product Quality and Goods;

Pursuant to Decision No. 100/2008/QĐ-BNN dated October 15, 2008 of the Minister of Agriculture and Rural Development on the issuance of regulations on fertilizer production, business, and use;

The Ministry of Agriculture and Rural Development hereby issues the Supplementary List of Fertilizers Permitted for Production, Business, and Use in Vietnam,

Article 1. Attached hereto is the Supplementary List of Fertilizers Permitted for Production, Business, and Use in Vietnam (including the attached list), which includes: Types of fertilizers added to the new fertilizer list (including those recognized under Decision No. 456/QĐ-TT-ĐPB dated November 19, 2009 and Decision No. 25/QĐ-TT-ĐPB dated January 29, 2010 of the Director of the Crop Production Department, Fertilizer re-registration from the fertilizer list issued with Decision No. 40/2004/QĐ-BNN dated August 19, 2009 of the Minister of Agriculture and Rural Development) including 465 types, divided into:

1. Organic fertilizers: 13 types;

2. Bio-organic fertilizers: 46 types;

3. Mineral organic fertilizers: 67 types;

4. Microbial fertilizers: 05 types;

5. Bio-organic microbial fertilizers: 22 types;

6. Foliar fertilizers: 311 types;

7. Soil improvement agents: 01 type;

Article 2. Organizations and individuals are permitted to produce, trade, and use the types of fertilizers listed in this supplementary list when they meet the conditions stipulated in Article 5 of Decree No. 113/2003/NĐ-CP dated October 7, 2003 of the Government on fertilizer production, business management; stipulated in Clause 4, Point 1 of Decree No. 191/2007/NĐ-CP dated December 31, 2007 of the Government amending and supplementing certain articles of Decree No. 113/2003/NĐ-CP dated October 7, 2003 of the Government on fertilizer production, business management.

Article 3. This Circular shall take effect forty-five days from the date of issuance.

Article 4. The Heads of the Ministry's Office, the Director of the Crop Production Department, the Head of the Science and Technology and Environment Department, the Directors of the Departments of Agriculture and Rural Development of provinces and centrally-administered cities, the Heads of units, organizations, and individuals related to fertilizer production, business, and use in Vietnam are responsible for implementing this Circular.
