On the basis of Decree No. 35/2013/NĐ-CP dated April 22, 2013 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of National Defense;
Pursuant to Decree No. 215/2013/NĐ-CP dated December 23, 2013, promulgated by the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Finance;
Pursuant to Decree No. 09/2015/NĐ-CP dated January 22, 2015 of the Government adjusting pensions, social insurance allowances, and monthly allowances for village cadres who have retired (hereinafter referred to as Decree No. 09/2015/NĐ-CP);
Pursuant to Decision No. 142/2008/QĐ-TTg dated October 27, 2008 of the Prime Minister on implementing regulations for military personnel participating in the resistance war against America to save the country with less than 20 years of service in the Army who have been retired, discharged, and returned to localities (hereinafter referred to as Decision No. 142/2008/QĐ-TTg);
Pursuant to Decision No. 38/2010/QĐ-TTg dated May 6, 2010 of the Prime Minister on amending and supplementing Decision No. 142/2008/QĐ-TTg dated October 27, 2008 of the Prime Minister on implementing regulations for military personnel participating in the resistance war against America to save the country with less than 20 years of service in the Army who have been retired, discharged, and returned to localities (hereinafter referred to as Decision No. 38/2010/QĐ-TTg);
Pursuant to Decision No. 62/2011/QĐ-TTg dated November 9, 2011 of the Prime Minister on policies for individuals participating in wars to protect the homeland and international missions in Cambodia and assisting Laos after April 30, 1975 who have been retired, discharged, or left their positions (hereinafter referred to as Decision No. 62/2011/QĐ-TTg),
The Minister of National Defense and the Minister of Finance issue this Circular guiding the adjustment of monthly allowances for military personnel, individuals engaged in confidential work receiving salaries equivalent to those of military personnel, and police officers who have been retired, discharged, or left their positions and are currently receiving monthly allowances.
Article 1. Scope of Regulation and Applicability
This Circular guides the adjustment of monthly allowance levels for the following subjects:
1. Military personnel who have been retired, discharged, or left their positions and are currently receiving monthly allowances according to Decision No. 142/2008/QĐ-TTg and Decision No. 38/2010/QĐ-TTg.
2. Military personnel, individuals engaged in confidential work receiving salaries equivalent to those of military personnel, and police officers who have been retired, discharged, or left their positions and are currently receiving monthly allowances according to Decision No. 62/2011/QĐ-TTg.
Article 2. Method of calculation and adjustment level
1. Increase the monthly allowance level for the subjects guided in Article 1 of this Circular by 8% according to the following formula:
Monthly allowance received from January 1, 2015 = Monthly allowance received at the end of December 2014 x 1.08
2. The adjustment level of monthly allowances for the subjects in Article 1 of this Circular is as follows:
- From 15 to less than 16 years, the allowance is 1,385,000 VND/month;
- From 16 to less than 17 years, the allowance is 1,455,000 VND/month;
- From 17 to less than 18 years, the allowance is 1,524,000 VND/month;
- From 18 to less than 19 years, the allowance is 1,593,000 VND/month;
- From 19 to less than 20 years, the allowance is 1,662,000 VND/month.
1. The funding for the implementation of the policy on exemption and subsidy of tuition fees shall be guaranteed by the state budget in accordance with the provisions of the law on the decentralization of budget management.
The funds for paying monthly allowances to these subjects shall be guaranteed by the central budget. The Ministry of Finance shall ensure the allocation based on the proposal of the Ministry of Labor, Invalids, and Social Affairs to authorize the Department of Labor, Invalids, and Social Affairs to make payments.
Article 4. Effective date
1. This Circular takes effect from July 15, 2015.
2. Subjects guided in Article 1 of this Circular will have their monthly allowances increased from January 1, 2015.
State-owned enterprises that have been assigned by the Ministry of Agriculture and Rural Development to conduct offshore wind power project surveys before the effective date of this Circular shall continue to implement according to the assigned documents; any new matters arising after the effective date of this Circular shall be implemented in accordance with the provisions of this Circular.
1. The Ministry of National Defense shall take the lead and coordinate with the Ministry of Finance to direct, guide, and inspect agencies, units, and localities in implementing this Circular.
2. For subjects who had decisions on receiving monthly allowances before Decree No. 09/2015/NĐ-CP took effect, the competent labor, invalids, and social affairs authority shall be responsible for adjusting the benefit level according to the guidance in this Circular. For subjects currently under consideration for benefits, the Ministry of National Defense shall be responsible for adjusting the benefit level according to the guidance in this Circular.
3. During implementation, if there are any difficulties, agencies, units, and localities shall report to the Ministry of National Defense for coordination with the Ministry of Finance to examine and resolve them./.
