Pursuant to Decision No. 14/1999/QĐ-TTg dated February 14, 1999 of the Prime Minister on the establishment of the Quality Control and Food Safety Administration under the Ministry of Health;

Article 1. Issued herewith are the "Regulations on the Assessment of Sanitary Safety for 20 Food Additives".

Article 2. The Standard Measurement Quality Control Department shall be responsible for organizing and guiding the implementation of the Regulations adopted herein.

Article 3. The Director of the Food Safety and Quality Control Department shall be responsible for organizing, directing, guiding implementation, and supervising compliance with this Decision.

Article 4. You, Mr./Mrs.: Head of the Office; Inspector General, Director of the Science and Training Department, Director of the Legal Affairs Department - Ministry of Health, Director of the Food Safety and Quality Control Department; Directors of Provincial Health Departments under central cities, Heads of units directly under the Ministry of Health, Heads of health sectors shall be responsible for implementing this Decision.

REGULATIONS

REGULATIONS ON THE ASSESSMENT OF SANITARY SAFETY FOR 20 FOOD ADDITIVES
(issued together with Decision No. 4021/2003/QĐ-BYT dated July 30, 2003 of the Minister of Health)

I. GENERAL PROVISIONS

Article 1. Scope of Application: These regulations set out mandatory requirements for the sanitary safety of food additives that are produced, imported, and circulated within the territory of Vietnam.

Article 2. Applicability: These regulations shall apply compulsorily to organizations and individuals producing, importing, and trading in food additives within the territory of Vietnam.

Article 3. Definitions: In these regulations, the following terms shall have the meanings given below:

Point a. Food additive: A substance that is not considered a food or a component of a food. Food additives have little or no nutritional value and are intentionally added during production, processing, handling, packaging, transportation, and storage of food to meet technological requirements. Food additives do not include contaminants or substances added to food to increase its nutritional value.

Food additives listed in the catalog are those specified in the current regulations of the Ministry of Health regarding the list of permitted food additives.

Point b. Sanitary safety requirements for food additives: Ensuring that food additives produced, imported, and traded have levels of harmful substances and main components that do not exceed permissible limits as stipulated herein.

Point c. Testing methods: Methods for detecting, determining the concentration of main components, and assessing the levels of harmful substances in food additive products to meet the sanitary safety requirements stipulated herein.

Article 4. Organizations and individuals may only produce, import, and trade in food additives listed in the catalog according to the current regulations of the Ministry of Health and must obtain certification from the competent authority confirming compliance with the sanitary safety requirements stipulated herein.

III. GENERAL GUIDELINES FOR TESTING METHODS

The testing methods are applied to assess the levels of harmful substances in the 20 food additives mentioned above in Section 2 (Appendix 21).

IV. HANDLING OF VIOLATIONS

Organizations and individuals producing, importing, or trading in food additives that violate these regulations shall be subject to administrative penalties or criminal liability, depending on the severity of the violation, and if damage is caused, they must compensate according to the provisions of the law.
