Regulations on the working conditions of vocational education teachers
Circular No. 07/2017/TT-BLDTBXH dated March 10, 2017, issued by the Minister of Labor, Invalids, and Social Affairs, stipulates the working conditions of vocational education teachers, which took effect from July 1, 2017, and was amended and supplemented by:

Pursuant to the Labor Code dated June 18, 2012;
Pursuant to the Law on Vocational Education dated November 27, 2014;
Pursuant to the Civil Servant Law dated November 15, 2010;
Pursuant to Decree No. 14/2017/NĐ-CP dated February 17, 2017, of the Government, stipulating the functions, tasks, powers, and organizational structure of the Ministry of Labor, Invalids, and Social Affairs;
Pursuant to Decree No. 48/2015/NĐ-CP dated May 15, 2015, of the Government detailing certain provisions of the Vocational Education Law;
At the proposal of the Director General of the General Department of Vocational Education;
The Minister of Labor, Invalids, and Social Affairs issues this Circular stipulating the working conditions of vocational education teachers.[1]
Chapter I. GENERAL PROVISIONS
Article 1. Scope of Regulation and Applicability[2]
1. This Circular stipulates the working conditions of vocational education teachers teaching at vocational education institutions, vocational education activity centers, and vocational education and general education centers.
2. This Circular applies to vocational education teachers, managerial staff, and personnel participating in teaching higher vocational, intermediate vocational, and initial vocational levels and other vocational training programs specified in points a, b, c, and d of Clause 1, Article 40 of the Vocational Education Law (hereinafter referred to as other vocational training programs) at vocational education institutions, vocational education activity centers, and vocational education and general education centers; relevant agencies, organizations, and individuals.
3. This Circular does not apply to teachers teaching teacher training programs under the jurisdiction of the Ministry of Education and Training; teachers currently teaching at colleges and secondary vocational schools regulated by Circular No. 96/2017/TT-BQP dated April 27, 2017, issued by the Minister of National Defense, concerning standard teaching hours and scientific research for teachers in the Vietnam People's Army.
Article 2. Standard hours, teaching time, lecture hour quota[3]
1. A standard hour is a unit of time converted from the number of labor hours required before, during, and after class to complete direct or online teaching tasks. One standard hour of online teaching is equivalent to one standard hour of direct teaching.
A standard hour is calculated for theoretical teaching with no more than 35 students, pupils, or trainees; practical or integrated teaching with no more than 18 students, pupils, or trainees; and for teaching in heavy, hazardous, or dangerous trades listed by the Minister of Labor, Invalids, and Social Affairs with no more than 10 students, pupils, or trainees. The Principal, Director of vocational education institutions, or centers shall base the conversion of standard hours on the specific number of students, pupils, or trainees in each class to ensure suitability with actual conditions and characteristics of each trade.
2. Teaching time in the training plan is calculated in standard hours, including:
a) One theoretical teaching hour of 45 minutes is equivalent to one standard hour;
b) One integrated teaching hour (combining both theory and practice) of 60 minutes is equivalent to one standard hour;
c) One practical teaching hour of 60 minutes is equivalent to one standard hour.
3. The lecture hour quota is determined as the number of standard hours that each teacher must teach, specified annually.
Chapter II. TASKS AND WORK REGIME OF COLLEGE AND VOCATIONAL TEACHERS
Article 3. Tasks
1. Teaching work, including:
a) Lesson preparation: Drafting lesson plans, outlining lectures, preparing materials and equipment for module and subject teaching assignments;
b) Teaching assigned modules and subjects according to the schedule and program regulations;
c) Evaluating student learning outcomes, including: Preparing examination questions, supervising examinations, and evaluating periodic examinations.
2. Supervising final module and subject examinations; grading admission tests; grading graduation tests; guiding and evaluating graduation projects and theses; evaluating research results of students.
3. Completing management forms and registers for classes assigned according to regulations.
4. Guiding students in graduation projects and theses (if applicable); guiding internships combined with production work; coaching outstanding students for various levels of examinations.
5. Compiling textbooks and teaching materials; providing comments on the development of programs and module contents for assigned teaching subjects.
6. Participating in designing and building specialized classrooms; designing, improving, and making educational tools and equipment for vocational training.
7. Organizing educational activities and training students.
8. Engaging in standardization training, advanced training; practicing at enterprises or professional agencies; observing lessons and exchanging teaching experiences.
9. Participating in teacher training as required by the school's professional and vocational development needs.
10. Conducting scientific research; guiding students in scientific research; applying scientific and technological advancements or technical improvements to teaching and practical production.
11. Participating in professional and vocational activities, and training management.
12.[4] Fulfilling other tasks as required by the Principal or Director of vocational education institutions.
Article 4. Working hours and annual leave
1. The working hours for teachers teaching at college and vocational levels are 44 weeks/year under a 40-hour workweek system, including:
a) Teaching and educating students: 32 weeks for teachers teaching at the college level; 36 weeks for teachers teaching at the vocational level;
b)[5] Studying, standardizing training, advanced training, scientific research: 8 weeks for teachers teaching at the college level; 4 weeks for teachers teaching at the vocational level. The Principal, Director of vocational education institutions shall determine the requirements for scientific research based on the actual situation and characteristics of each training program and decide the minimum number of hours that teachers must complete in a school year.
c) Internship at enterprises or specialized agencies: 4 weeks for teachers teaching at both the college and vocational levels;
d)[6] In cases where teachers do not fully utilize the time allocated for studying, standardizing training, advanced training, and scientific research as prescribed, the Principal, Director may convert the remaining time to teaching duties or other tasks assigned by them. The converted hours will be added to the teacher's annual teaching hour quota. The conversion rate is calculated according to the ratio between the unused time for studying, standardizing training, advanced training, and scientific research and the time spent on teaching and educating students as stipulated in point a of this clause. If teachers participate in more courses than specified in point b of this clause, they will have their teaching hours reduced according to the provisions of point a Clause 4 Article 10 of this Circular.
2.[7] The annual summer vacation for teachers is 6 weeks; for management staff and lecturers involved in teaching as specified in Clause 5 Article 5 of this Circular is 4 weeks, including annual leave. During the summer vacation, teachers receive full salary and allowances (if applicable). In addition to the summer vacation, teachers also enjoy public holidays and other days off as stipulated in the Labor Code. The summer vacation for teachers in vocational education institutions under the Ministry of Public Security and the Ministry of National Defense shall be implemented according to the provisions of Clause 4 Article 3 Decree No. 84/2020/NĐ-CP dated July 17, 2020 of the Government detailing certain provisions of the Education Law.
Based on the academic year plan and actual conditions, the Principal, Director of vocational education institutions shall arrange the summer vacation for teachers at an appropriate time.
Article 5. Teaching Hour Quotas
1.[8] The teaching hour quotas for teachers in one academic year: from 350 to 450 standard hours for teachers teaching at the college level; from 400 to 510 standard hours for teachers teaching at the vocational level.
The Principal, Director of vocational education institutions shall decide on the teaching hour quotas and the minimum number of hours that teachers must teach in accordance with the actual situation and characteristics of each training program in the academic year.
2. The teaching hour quotas for teachers teaching general subjects in one academic year are 450 standard hours for teachers teaching at the college level; 510 standard hours for teachers teaching at the vocational level.
3.[9] The teaching hour quotas for teachers teaching general cultural subjects in vocational education institutions shall be implemented according to the regulations issued by the Ministry of Education and Training regarding the working hours for general education teachers.
4.[10] The teaching hour quotas for teachers teaching multiple levels in one academic year shall be converted and applied according to the teaching hour quotas at the highest level. The Principal, Director of vocational education institutions shall establish conversion factors for lower levels to calculate the annual standard teaching hour quotas for teachers in line with the actual situation and characteristics of each training program.
5.[11] The teaching hour quotas for management staff; lecturers and vocational education teachers holding specific positions are as follows:
a) Chairman of the School Council, Principal: 8% of the teaching hour quota per year;
b) Deputy Principal: 10% of the teaching hour quota per year;
c) Department Heads and equivalents: 14% of the teaching hour quota per year;
d) Deputy Department Heads and equivalents: 18% of the teaching hour quota per year;
đ) For other staff members: 20% of the teaching hour quota per year.
6. The teaching hour quotas for teachers in the Teacher Training Department of vocational education institutions shall be calculated according to the teaching hour quotas for teachers teaching at the college level.
7. Other professional department staff members who meet the criteria for teaching may enter into teaching contracts if needed, based on the workload and tasks assigned to them by the Principal, Director of vocational education institutions.
Chapter III. TASKS AND WORKING REGIMES OF TEACHERS TEACHING AT THE PRIMARY LEVEL
Article 6. Duties
1. Teaching work, including:
a) Teaching preparation: Preparing lesson plans, outlining lecture outlines, preparing teaching materials and equipment for the assigned module instruction;
b) Delivering the assigned module according to the plan and program regulations;
c) Evaluating students' learning outcomes including: Compiling examination questions, supervising examinations, evaluating periodic examinations.
2. Supervising examinations, conducting evaluations at the end of the module.
3. Completing management forms and registers for classes assigned according to regulations.
4. Compiling textbooks and teaching materials; providing comments on the development of the program and content of the assigned module.
5. Participating in designing and constructing specialized classrooms; designing, improving, and making educational tools and equipment.
6. Organizing educational activities and training for students.
7. Engaging in standardization training, advanced training; observing classes, exchanging teaching experiences; undergoing internships at enterprises or specialized agencies, participating in professional activities.
8. Participating in teacher training programs according to professional development requirements.
9. Participating in training management work, student management.
10.[12] Fulfilling other tasks as required by the Rector, Director of vocational education institutions, institutions engaged in vocational education activities, vocational education centers - regular education.
Article 7. Working hours and annual leave
1. The working time for teachers teaching at the basic level is 46 weeks/year under a 40-hour workweek system, including:
a) Teaching and educating students: 42 weeks;
b) Standardization training, advanced training; observing classes, exchanging teaching experiences; participating in professional activities: 02 weeks;
c) Internship at enterprises or specialized agencies: 02 weeks;
d) [13] In cases where teachers do not fully utilize the time allocated for standardization training, advanced training, observing classes, exchanging teaching experiences, and participating in professional activities as prescribed, the Rector, Director of vocational education institutions, institutions engaged in vocational education activities, vocational education centers - regular education may convert the remaining time into teaching duties or other tasks assigned by the Rector, Director. The converted hours are added to the teaching hour quota of the teacher for that academic year. The number of converted hours is calculated based on the ratio between the unused time for standardization training, advanced training, observing classes, and exchanging teaching experiences, and the time allocated for teaching and educating students as stipulated in point a of this clause. In cases where teachers participate in standardization training, advanced training exceeding 02 weeks, their teaching hours will be reduced according to the provisions of point a, Clause 4, Article 10 of this Circular.
2.[14] The annual summer vacation period for teachers is 04 weeks; for managerial staff, lecturers, and vocational education teachers who also teach, as specified in Clause 2, Article 8 of this Circular, it is 03 weeks, including annual leave. During the summer vacation, teachers receive full salary and allowances (if applicable). In addition to the summer vacation, teachers also enjoy holidays and other days off as stipulated in the Labor Code. The summer vacation for teachers in vocational education institutions under the Ministry of Public Security and the Ministry of National Defense shall be implemented according to the provisions of Clause 4, Article 3 of Decree No. 84/2020/NĐ-CP dated July 17, 2020 of the Government detailing certain provisions of the Education Law.
Based on the academic year plan and actual conditions, the Rector, Director of vocational education institutions, institutions engaged in vocational education activities, vocational education centers - regular education shall arrange for teachers to take their summer vacation at an appropriate time.
Article 8. Teaching Hour Standards[15]
1. The teaching hour standards for one academic year for teachers teaching at the primary level and other vocational training programs as specified in points a, b, c, and d of Clause 1, Article 40 of the Vocational Education Law: from 450 to 580 standard hours.
The Rector, Director of vocational education institutions, vocational education activity institutions, vocational education centers - regular education bases shall determine the teaching hour standards and the minimum number of hours that teachers must teach each academic year based on actual conditions and the characteristics of each training program.
2. The teaching hour standards for managerial staff; lecturers and vocational education teachers holding current positions are defined as follows:
a) Director: 8% of the teaching hour standard/year;
b) Deputy Director: 10% of the teaching hour standard/year;
c) Department Head or equivalent: 14% of the teaching hour standard/year;
d) Deputy Department Head or equivalent: 18% of the teaching hour standard/year;
đ) For other staff members: 20% of the teaching hour quota per year.
Chapter IV. ADDITIONAL TEACHING HOURS, REDUCED TEACHING HOURS AND CONVERSION OF OTHER SPECIALIZED ACTIVITIES INTO STANDARD HOURS
Article 9. Additional Teaching Hours System
1.[16] During the academic year, teachers, managerial staff; lecturers and vocational education teachers participating in teaching who exceed the teaching hour standards stipulated in Clauses 1, 2, 3, and 5 of Article 5 and Article 8 of this Circular shall be considered to have additional teaching hours.
2. For teachers: the number of additional teaching hours shall not exceed the number of hours prescribed by current labor laws.
3.[17] For managerial staff; lecturers and vocational education teachers participating in teaching: the number of additional teaching hours shall not exceed 50% of the teaching hour standard stipulated in Clause 5, Article 5 and Clause 2, Article 8 of this Circular.
4. The method of calculating additional teaching hour pay according to current regulations.
Article 10. Reduced Teaching Hour System
1.[18] Teachers appointed to leadership positions or concurrently performing management duties:
a) Teachers responsible for class counseling or study advising: Reduced by 15% of the teaching hour standard/class;
b) Teachers managing specialized classrooms/workshops: With dedicated staff, reduced by 10% of the teaching hour standard/classroom, workshop; without dedicated staff, reduced by 15% of the teaching hour standard/classroom, workshop;
c) Teachers serving as department heads, station chiefs, camp chiefs and equivalents; deputy department heads, deputy station chiefs, camp chiefs and equivalents; head of departments and equivalents; concurrently managing libraries: Reduced by 15% to 30% of the teaching hour standard;
Teachers concurrently performing multiple duties as specified in points a, b, c of this clause shall be granted a total reduction in teaching hours but not exceeding 50% of the teaching hour standard. The Rector, Director of vocational education institutions, vocational education activity institutions, vocational education centers - regular education bases shall decide on the specific reduction rate for each case based on actual conditions, the number of teachers, students, and learners.
2. Teachers concurrently performing Party and mass organization work:
a) Teachers concurrently serving as Secretary of the Party Committee of vocational education activity institutions or Secretary of the Branch Committee of vocational education activity institutions, Chairperson of the School Council, Management Board shall be reduced by 20% to 30% of the teaching hour standard; teachers concurrently serving as deputy positions of the aforementioned roles or secretaries of the School Council, Management Board shall be reduced by 15% to 20% of the teaching hour standard. Depending on the scale of vocational education activity institutions and the number of members in each organization, after consultation with Party and mass organizations, the Rector, Director shall decide on the reduction rate for each position within the prescribed range;
b) Teachers concurrently performing non-professional trade union work in vocational education activity institutions shall enjoy the reduced teaching hour system as stipulated in Circular No. 08/2016/TT-BGDĐT dated March 28, 2016 issued by the Minister of Education and Training regarding the reduced teaching hour system for teachers and lecturers concurrently performing non-professional trade union work in public educational institutions under the national education system;
c) Teachers serving as Communist Youth Union cadres, Vietnam Student Union cadres, Vietnam Youth Federation cadres at the school level shall enjoy the reduced teaching hour system as stipulated in Decision No. 13/2013/QĐ-TTg dated February 6, 2013 issued by the Prime Minister regarding the system and policies for Communist Youth Union cadres, Vietnam Student Union cadres, Vietnam Youth Federation cadres in educational institutions and vocational training institutions;
d) Teachers concurrently holding multiple positions shall be granted the highest reduction in teaching hours
3.[19] The reduction in teaching hours stipulated in points a, b, c of Clause 1 and Clause 2 of this Article shall not apply to managerial staff; lecturers and vocational education teachers holding current positions as stipulated in Clause 5, Article 5 and Clause 2, Article 8 of this Circular
4. Reduced teaching hours for other teachers:
a) Teachers participating in training and upgrading beyond the prescribed time shall be reduced by 14 hours/week of training and upgrading;
b) Teachers during their probationary period shall be reduced by 30% of the teaching hour standard;
c) Female teachers with children under 12 months old shall be reduced by 15% of the teaching hour standard;
d) Teachers during maternity leave or long-term illness shall be reduced in teaching hours according to the ratio between the time off receiving social insurance benefits and the time required to perform teaching duties as stipulated in point a, Clause 1, Article 4 and point a, Clause 1, Article 7 for each level of education.
Article 11. Conversion of other specialized activities into standard hours[20]
1. Teaching:
a) One hour of teaching in a foreign language for subjects or modules that are not foreign languages shall be counted as 1.5 to 2.0 standard hours;
b) One hour of theoretical teaching for classes with a number of students exceeding the provisions set forth in Clause 4, Article 2 of this Circular shall be converted at a factor but not exceeding 1.5 standard hours;
c) One hour of teaching, guiding, and enhancing the professional skills of other teachers shall be counted as 1.5 standard hours;
d) Time spent on designing, improving, and making educational vocational equipment (approved at the department level or higher) shall be converted into standard hours;
đ) For national defense education teachers and physical education teachers, time spent organizing sports and military training activities for staff members of vocational education institutions shall be counted as teaching time;
The Rector, Director of vocational education institutions, centers for vocational education and continuing education shall specify the conversion into standard hours for calculating teaching loads for teachers under points a, b, d, đ of this clause.
2. The Rector, Director of vocational education institutions, centers for vocational education and continuing education shall base on actual conditions to specify the conversion of activities such as preparing exams, invigilating, grading final module and subject exams; preparing exams, invigilating, and grading graduation exams; guiding special topics and graduation theses (if applicable); grading special topics and graduation theses (if applicable); guiding internships combined with production work; training teachers participating in teaching contests at various levels; training students participating in skill contests at various levels; and other professional activities into standard hours for calculating annual teaching loads for teachers.
Chapter V. IMPLEMENTATION
Article 12. Responsibilities of the General Department of Vocational Education
Guide, inspect, and supervise the implementation of the provisions of this Circular.
Article 13. Responsibilities of Ministries, ministerial-level agencies, government agencies, provincial People's Committees, and municipal People's Committees directly under the central government[21]
Direct, guide, and inspect the implementation of the provisions of this Circular for vocational education institutions, centers for vocational education and continuing education under their management authority.
Article 14. Responsibilities of the Department of Labor - Invalids and Social Affairs
1. Submit to the provincial People's Committee or municipal People's Committee directly under the central government for issuance of guiding documents on the implementation of the provisions of this Circular.
2.[22] Inspect, evaluate, compile, and report periodically and urgently on the implementation of working regimes for vocational education teachers at vocational education institutions, centers for vocational education and continuing education under the management authority of the provincial People's Committee or municipal People's Committee directly under the central government.
Article 15.[23] Responsibilities of vocational education institutions, centers for vocational education and continuing education
1.[24] Specify in detail the working regime for teachers teaching various levels of vocational education at vocational education institutions, centers for vocational education and continuing education according to the provisions of this Circular.
2. Develop teaching plans, scientific research plans, professional training plans, and internship plans at enterprises or specialized agencies to improve the quality and efficiency of labor for vocational education teachers.
Chapter VI. IMPLEMENTING PROVISIONS[25]
Article 16. Effective Date
1. This Circular takes effect from July 1, 2017.
2. Repeal Section II of Circular No. 09/2008/TT-BLDTBXH dated June 27, 2008, issued by the Minister of Labor - Invalids and Social Affairs, guiding the working regime for vocational teachers, and Chapter III of Circular No. 40/2015/TT-BLDTBXH dated October 20, 2015, issued by the Minister of Labor - Invalids and Social Affairs, stipulating standards for professional knowledge and working regimes for primary vocational education teachers.
3. During the implementation process, if there are difficulties, please reflect them to the Ministry of Labor, Invalids, and Social Affairs for guidance./.

The Minister of Labor - Invalids and Social Affairs issues this Circular amending and supplementing some articles of Circular No. 42/2015/TT-BLDTBXH dated October 20, 2015, on primary vocational education training, Circular No. 43/2015/TT-BLDTBXH dated October 20, 2015, on regular vocational education training, Circular No. 07/2017/TT-BLDTBXH dated March 10, 2017, on the working regime for vocational education teachers, Circular No. 08/2017/TT-BLDTBXH dated March 10, 2017, on professional standards for vocational education teachers, Circular No. 10/2017/TT-BLDTBXH dated March 13, 2017, on models of secondary and college diplomas; printing, managing, issuing, recalling, and canceling secondary and college diplomas, and Circular No. 31/2017/TT-BLDTBXH dated December 28, 2017, on secondary, college, and primary vocational education training through part-time learning."
Circular No. 28/2022/TT-BLDTBXH is based on the following grounds:
"Pursuant to the Vocational Education Law dated November 27, 2014;
Pursuant to the Education Law dated June 14, 2019;
Pursuant to the Labor Code on November 20, 2019;
Pursuant to the Civil Servant Law dated November 15, 2010;
Pursuant to the Law Amending and Supplementing Certain Provisions of the Civil Servants Law and the Public Service Law dated November 25, 2019;
Based on Decree No. 62/2022/NĐ-CP dated September 12, 2022 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Labor, Invalids, and Social Affairs;
Pursuant to Decree No. 15/2019/NĐ-CP dated February 1, 2019, of the Government detailing certain provisions and measures to implement the Law on Vocational Education;
Pursuant to Decree No. 84/2020/NĐ-CP dated July 17, 2020, of the Government detailing certain provisions of the Education Law;
Pursuant to Decree No. 115/2020/NĐ-CP dated September 25, 2020, of the Government on recruitment, use, and management of public servants;
Based on the proposal of the Director General of the General Department of Vocational Education;
The Minister of Labor - Invalids and Social Affairs issues this Circular amending and supplementing certain provisions of Circulars regulating recruitment, use, training, and working regimes for vocational education teachers."
[2] This is amended and supplemented in accordance with Clause 1, Article 2 of Circular No. 28/2022/TT-BLDTBXH, to take effect from March 1, 2023.

[23] The name of this Article is amended and supplemented in accordance with Point a, Clause 14, Article 2 of Circular No. 28/2022/TT-BLDTBXH, to take effect from March 1, 2023.
[24] This Clause is amended and supplemented in accordance with Point b, Clause 14, Article 2 of Circular No. 28/2022/TT-BLDTBXH, to take effect from March 1, 2023.
[25] Article 7 of Circular No. 34/2018/TT-BLDTBXH, which took effect from February 8, 2019, provides as follows:
"Article 7. Effective Date
1. This Circular takes effect from February 8, 2019.
2. For training courses admitted before this Circular takes effect, vocational training institutions shall organize training according to the current regulations in force at the beginning of the course until its completion.
The templates for primary certificates, training certificates, college graduation diplomas, and intermediate vocational education diplomas that have been printed or purchased before this Circular takes effect may continue to be used to issue to students in accordance with current regulations.
3. During the implementation of this Circular, agencies and organizations shall promptly report any difficulties, obstacles, or new issues discovered to the General Department of Vocational Education and Training under the Ministry of Labor, Invalids and Social Affairs for guidance or supplementation and adjustment as appropriate."
Article 3 of Circular No. 28/2022/TT-BLDTBXH, which took effect from March 1, 2022, provides as follows:
“Article 3. Effective Date
1. This Circular takes effect from March 1, 2023.
2. Repeal Clause 3 and Clause 4 of Article 12 of Circular No. 06/2017/TT-BLDTBXH dated March 8, 2017 issued by the Minister of Labor, Invalids and Social Affairs regarding the recruitment, employment, and training of vocational education teachers; Clause 1 of Article 3 of Circular No. 34/2018/TT-BLDTBXH dated December 26, 2018 issued by the Minister of Labor, Invalids and Social Affairs concerning amendments and supplements to certain provisions of Circular No. 42/2015/TT-BLDTBXH dated October 20, 2015 on primary level training, Circular No. 43/2015/TT-BLDTBXH dated October 20, 2015 on regular training, Circular No. 07/2017/TT-BLDTBXH dated March 10, 2017 on working conditions for vocational education teachers, and Circular No. 08/2017/TT-BLDTBXH dated March 10, 2017 on professional standards for vocational education teachers.”
