Article 1.
1. Now announcing the waters of seaports within the jurisdiction of Kiên Giang Province, including:
a) The waters before the wharves of Hon Chong Port and Binh Tri Port.
b) The waters of the seaport channel, branch channel, pilot station, quarantine area, anchorage, transshipment area, and typhoon shelter of the seaports specified in point a of this clause.
2. The waters before other wharves and berths, anchorage areas, transshipment areas, and storm shelters shall be announced in accordance with the provisions of the law.
Article 2.
The scope of the waters of seaports within the jurisdiction of Kiên Giang Province is measured according to the highest tidal level and is specifically defined as follows:
1. Hon Chong Port Area:
a) Seaward boundary: limited by straight lines connecting the following coordinate points:
HC1: 10°08'39" N, 104°36'12" E (east of Ong Thay Cape);
HC2: 09°59'56" N, 104°35'33" E;
HC3: 09°59'56" N, 104°33'36" E;
HC4: 10°09'00" N, 104°34'10" E;
HC5: 10°09'00" N, 104°35'48" E (west of Ong Thay Cape).
b) Landward boundary: from point HC1 running along the southern coast of Ong Thay Cape to point HC5.
2. Binh Tri Port Area:
a) Seaward boundary: limited by straight lines connecting the following coordinate points:
BT1: 10°12'25" N, 104°34'52" E;
BT2: 10°11'09" N, 104°24'18" E;
BT3: 10°13'24" N, 104°24'18" E;
BT4: 10°13'00" N, 104°35'18" E.
b) Landward boundary: from point BT1 running along the western coast of Binh An Commune to BT4.
3. Ha Tien Transshipment Area:
a) Seaward boundary: limited by straight lines connecting the following coordinate points:
HT1: 10°22'24" N, 104°29'00" E;
HT2: 10°21'12" N, 104°28'02" E;
HT3: 10°21'48" N, 104°27'20" E;
HT4: 10°22'36" N, 104°28'57" E.
b) Riverward boundary: from point HT1, HT4 running towards To Chu Channel, along both banks of the river upstream to a line parallel with Dong Ho Bridge and 100 meters downstream from Dong Ho Bridge.
4. Anchorage Area for Yang Dong Passenger Ships: limited by straight lines connecting the following coordinate points:
DD1: 10°13'05" N, 103°57'09" E;
DD2: 10°12'00" N, 103°56'12" E;
DD3: 10°12'00" N, 103°51'06" E;
DD4: 10°14'00" N, 103°51'06" E;
DD5: 10°14'00" N, 103°56'12" E;
DD6: 10°13'12" N, 103°57'05" E.
Article 3.
Pilot Station, Quarantine Area, Anchorage, Transshipment Area, and Typhoon Shelter for vessels entering and leaving seaports within the jurisdiction of Kiên Giang Province are specifically defined as follows:
1. Pilot Station and Quarantine Area:
a) Hon Chong Port: limited by a circle with a radius of 01 nautical mile, centered at coordinates: 10°00'56" N, 104°34'43" E.
b) Binh Tri Port: limited by a circle with a radius of 01 nautical mile, centered at coordinates: 10°12'12" N, 104°25'14" E.
c) Ha Tien Transshipment Area: limited by a semicircle to the southwest with a radius of 0.3 nautical miles, centered at coordinates: 10°21'39" N, 104°28'01" E.
d) Anchorage Area for Yang Dong Passenger Ships: limited by a circle with a radius of 01 nautical mile, centered at coordinates: 10°13'06" N, 103°52'12" E.
2. Anchorage and Transshipment Areas:
a) Hon Chong Port: within the waters limited by a circle with a radius of 01 nautical mile, centered at coordinates: 10°05'15" N, 104°34'56" E.
b) Ha Tien Transshipment Area: within the waters limited from a line crossing To Chu Channel and parallel to To Chu Bridge, 150 meters upstream from To Chu Bridge, to both banks of the river, running along both banks of the river to a line parallel to Dong Ho Bridge, 100 meters downstream from Dong Ho Bridge.
c) Yang Dong Anchorage: within the waters limited by a circle with a radius of 01 nautical mile, centered at coordinates: 10°13'06" N, 103°56'18" E.
d) An Thoi Anchorage: pursuant to the decision of the Director of the Vietnam Maritime Administration.
3. Typhoon Shelter:
a) Hon Chong Port and Binh Tri Port: within the waters within the Ba Lua Archipelago designated by the Kiên Giang Maritime Branch.
b) Ha Tien Transshipment Area: within the waters specified in point b of Clause 2 of this Article.
c) Phu Quoc Area: pursuant to the decision of the Director of the Vietnam Maritime Administration.
Article 4.
The Kiên Giang Maritime Branch shall be responsible for:
1. Performing its duties and powers as prescribed by the Vietnam Maritime Code and relevant laws concerning maritime activities within the waters of seaports within the jurisdiction of Kiên Giang Province.
2. Based on actual conditions regarding weather, waves, tide levels, and vessel load capacity, designate specific positions for vessels to pick up pilots, undergo quarantine, anchor, transship, and seek shelter from typhoons within the waters specified in Article 3 of this Decision, ensuring maritime safety, maritime security, and environmental protection.
Article 5.
Outside the waters of seaports specified in Articles 2 and 3 of this Decision, the Kiên Giang Maritime Branch shall also be responsible for state management of maritime safety and security in the sea areas within the jurisdiction of Kiên Giang Province.
Article 6.
1. This Decision takes effect fifteen days after its publication in the Official Gazette.
2. Repealing Decision No. 4465/2002/QĐ-BGTVT dated December 31, 2002 of the Minister of Transport on the waters of seaports within the jurisdiction of Kiên Giang Province and the responsibility area of the Kiên Giang Maritime Branch, and any previous regulations that conflict with this Decision.
Article 7.
The Head of the Ministry’s Office, the Inspector General of the Ministry, Heads of Departments under the Ministry, Directors of the Vietnam Maritime Administration, the Vietnam Inland Waterways Administration, the Department of Transport of Kiên Giang Province, the Director of the Kiên Giang Maritime Branch, Heads of agencies, organizations, and individuals concerned are responsible for implementing this Decision./.
