CIRCULAR

Amending and supplementing some articles of the Regulation on the organization and operation of preparatory university schools issued together with Circular No. 24/2011/TT-BGDĐT dated June 13, 2011 of the Minister of Education and Training

Pursuant to the Education Law on June 14, 2005; the Law Amending and Supplementing Certain Articles of the Education Law on November 25, 2009;

Pursuant to Decree No. 36/2012/NĐ-CP dated April 18, 2012 of the Government stipulating the functions, tasks, powers, and organizational structure of ministries and ministerial-level agencies;

Pursuant to Decree No. 32/2008/NĐ-CP dated March 19, 2008 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Education and Training;

Pursuant to Decree No. 75/2006/NĐ-CP dated August 2, 2006 of the Government detailing and guiding the implementation of certain provisions of the Education Law; Decree No. 31/2011/NĐ-CP dated May 11, 2011 of the Government amending and supplementing certain provisions of Decree No. 75/2006/NĐ-CP dated August 2, 2006 of the Government detailing and guiding the implementation of certain provisions of the Education Law; Decree No. 07/2013/NĐ-CP dated January 9, 2013 of the Government regarding the amendment of point b Clause 13 Article 1 of Decree No. 31/2011/NĐ-CP dated May 11, 2011 of the Government amending and supplementing certain provisions of Decree No. 75/2006/NĐ-CP dated August 2, 2006 of the Government detailing and guiding the implementation of certain provisions of the Education Law;

At the proposal of the Director of the Ethnic Education Department,

The Minister of Education and Training issues this Circular amending and supplementing some articles of the Regulation on the organization and operation of preparatory university schools issued together with Circular No. 24/2011/TT-BGDĐT dated June 13, 2011 of the Minister of Education and Training.

Article 1. Amending and supplementing some articles of the Regulation on the organization and operation of preparatory university schools issued together with Circular No. 24/2011/TT-BGDĐT dated June 13, 2011 of the Minister of Education and Training

1. Article 6 shall be amended and supplemented as follows:

"Article 6. Organizational structure of preparatory university schools

The organizational structure of preparatory university schools includes:

1. Principal, deputy principals.

2. Functional departments.

3. Subject departments or specialized departments (hereinafter referred to collectively as subject departments).

4. Advisory councils.

5. Communist Party of Vietnam organization.

6. Mass organizations and social organizations."

2. Clause 2, Article 7 shall be amended and supplemented as follows:

"2. Qualifications for principal of preparatory university schools: having good political qualities, morality; having reputation, management capability, and having held positions from department head or specialized department head of secondary general education school or department head and above for at least five years; having professional capability and teaching experience at secondary general education level or preparatory university level; having master's degree or higher; having been trained in educational management; having good health. Age limit for appointing principal shall not exceed 55 for male and 50 for female."

3. Point a and point c Clause 1 Article 8 are amended and supplemented as follows:

"a) Deciding to establish and dissolve organizations of the school as stipulated in Clauses 2, 3, and 4 of Article 6 of this Regulation;

c) Deciding to appoint and dismiss positions within the organizations of the school as stipulated in Clauses 2, 3, and 4 of Article 6 of this Regulation."

5. Clause 1 and Clause 3 of Article 11 are amended and supplemented as follows:

"1. Deputy principal assists the principal in areas of work assigned by the principal. A preparatory university school may have up to two deputy principals.

Deputy principal must meet the following criteria: having good political qualities, morality; having reputation and management capability; having bachelor's degree or higher; having been trained in educational management; having good health. Deputy principal responsible for professional work must have master's degree or higher; having professional capability and teaching experience at secondary general education level or preparatory university level.

Age limit for appointing deputy principal shall not exceed 55 for male and 50 for female."

5. Article 12 shall be amended and supplemented as follows:

"Article 12. Functional Departments

1. Based on specific circumstances of the school, the principal decides to establish no more than five functional departments to carry out tasks such as administrative management, personnel organization; training, quality management; planning, finance; student affairs.

2. Tasks of functional departments:

a) Advising and assisting the principal in organizing management and implementing assigned tasks;

b) Managing staff and workers of the unit according to the principal's assignment.

3. Head of functional department is director. Director is appointed and dismissed by the principal. Assistant to the director is deputy director. Term of office of director and deputy director is five years according to the principal's term. Age limit for appointing director and deputy director shall not exceed 55 for male and 50 for female.

4. Director and deputy director must meet the following criteria: having good political qualities, morality; having bachelor's degree or higher; having good health.

5. Tasks and powers of director and deputy director are defined by the principal."

6. Article 14 is amended and supplemented as follows:

"Article 14. Subject Departments

1. Subject department is subordinate to the school. Subject department is organized according to subjects or groups of subjects. Based on specific circumstances of the school, the principal decides to establish subject departments.

2. Subject department has the following tasks:

a) Building and implementing the overall activity plan of the department; guiding the construction and management of individual plans of members according to the teaching schedule and educational activities of the school;

b) Building teaching content and reference materials for subjects according to detailed outlines of preparatory university subjects issued by the Ministry of Education and Training;

c) Organizing professional and vocational activities as prescribed by the principal; participating in evaluating and classifying members of the department;

d) Proposing rewards and disciplinary actions for members of the department.

3. Subject department has a head appointed and dismissed by the principal. Term of office of the head is five years. Assistant to the head is deputy head appointed and dismissed by the principal upon recommendation of the head. Term of office of the deputy head is five years according to the head's term.

4. Head and deputy head must meet the following criteria: having good political qualities, morality; having bachelor's degree or higher and a major suitable for the profession; having reputation for professional capability and vocational skills among teachers in the department; having good health.

5. Tasks and powers of head and deputy head are defined by the principal."

7. Supplementing Article 14a and Article 14b after Article 14 as follows:

"Article 14a. Advisory Council

1. The advisory council of the school is established according to the decision of the principal.

2. Functions, tasks, powers, duration of operation, number of members of advisory councils are defined by the principal."

Article 14b. Class Formation

Students shall be organized into classes according to examination blocks. Each class shall have no fewer than 30 students and no more than 45 students.

Article 2. Article 11, Article 13, and Article 15 are repealed.

Article 3. This Circular takes effect from February 15, 2014.

Article 4The Director of the Office, the Head of the Ethnic Education Department under the Ministry of Education and Training, the heads of relevant units under the Ministry of Education and Training, and the principals of preparatory universities and ethnic preparatory universities are responsible for implementing this Circular./.
