CIRCULAR
Regulations on the list and periodic rotation period for positions of civil servants directly interacting with and handling work in the Industry and Trade sector at local levels. Article 2. Pursuant to the Anti-Corruption Law dated November 20, 2018;
Pursuant to Decree No. 59/2019/NĐ-CP dated July 1, 2019 of the Government detailing some articles and implementing measures of the Anti-Corruption Law and Decree No. 134/2021/NĐ-CP dated December 30, 2021 of the Government amending and supplementing some articles of Decree No. 59/2019/NĐ-CP;
||| Pursuant to Decree No. 96/2022/NĐ-CP dated November 29, 2022 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Industry and Trade and Decree No. 105/2024/NĐ-CP dated August 1, 2024 of the Government amending and supplementing some articles of Decree No. 96/2022/NĐ-CP and Decree No. 26/2018/NĐ-CP dated February 28, 2018 of the Government on the Charter of Organization and Operation of Vietnam Electricity Corporation;
The phrase "or examination" is abolished pursuant to Clause 6, Article 8 of Circular No. 15/2025/TT-BVHTTDL dated November 25, 2025, of the Minister of Culture, Sports and Tourism amending and supplementing certain articles of Circulars prescribing job codes, qualification standards, and salary grades for civil servants in the heritage culture, library, grassroots cultural activities, sports, fine arts, art performance, film, and cultural propaganda sectors, which takes effect from January 15, 2026.
The Minister of Industry and Trade issues this Circular stipulating the list and periodic rotation period for positions of civil servants and employees directly interacting with and handling work in the Industry and Trade sector at local levels.
Article 1. Scope of Regulation and Applicability
Article 1. This Circular stipulates the list and periodic rotation period for positions at agencies, organizations, and public service units in the Industry and Trade sector under People's Committees at all levels.
Article 2. This Circular applies to civil servants not holding leadership or management positions and employees directly interacting with and handling work in the Industry and Trade sector at local levels.
Article 2. List of positions in the Industry and Trade sector subject to periodic rotation
Clause 1. Issuance of various types of permits related to import-export, trade services, specifically:
Point a) Certificate of eligibility for traders dealing in LPG/LNG/CNG;
Point b) Certificate of eligibility for retail LPG in bottles;
Point c) Certificate of eligibility for retail gasoline and diesel;
Point d) Certificate of eligibility for retail gasoline and diesel agents;
Point đ) Notification of small-scale retail fuel sales equipment;
Point e) Wholesale alcohol permit within a province or centrally governed city;
Point g) Retail alcohol permit;
Point h) Wholesale tobacco products permit;
Point i) Retail tobacco products permit;
Point k) Permit for foreign traders' representative offices in Vietnam;
Point l) Business permit, retail establishment permit for economic organizations with foreign investment in Vietnam;
Point m) Permit for distribution of electricity up to 35 kV locally;
Point n) Permit for retail electricity up to 0.4 kV locally.
Clause 2. Issuance of various types of permits related to ensuring safety standards in production and business, specifically:
Point a) Permit for activities within the scope of dam and reservoir protection for hydropower;
Point b) Certificate of eligibility for producing explosive precursors;
Point c) Certificate of eligibility for producing/trading/expanding production and trading of chemicals regulated in the industry;
Point d) Permit for using industrial explosives;
Point đ) Certificate of training in industrial explosives safety technology for those involved in their use;
Point e) Certificate of training in explosive precursor safety technology for those managing warehouses or storage facilities for explosive precursors;
Point g) Certificate of food safety compliance;
Point h) Certificate of eligibility for LPG bottle refilling stations;
Point i) Certificate of eligibility for LPG tanker refilling stations;
Point k) Certificate of eligibility for LPG/LNG/CNG transport vehicle refueling stations;
Point l) Permit for artisanal alcohol production for commercial purposes;
Point m) Permit for industrial alcohol production (under 3 million liters/year);
Point n) Permit for power generation activities for local power plants with capacity under 3 MW;
Point o) Notification confirming product/harmonization declaration for Group 2 products in accordance with relevant technical regulations. Notification of acceptance of harmonization declaration documents for products/harmonization in accordance with national technical standards.
Article 3. Periodic Term for Position Rotation
Clause 1. The periodic term for position rotation for civil servants and public officials directly interacting with and handling work as stipulated in Article 2 of this Circular is from three to five years.
Clause 2. The time point for calculating the term of position rotation is the date when the competent authority issues a dispatching, arranging, or assigning tasks document according to the cadre management hierarchy.
Article 4. Effective date
This Circular takes effect from February 21, 2025.
Article 5. Responsibilities for Implementation
Clause 1. The Chairmen of People's Committees of provinces and centrally governed cities; relevant agencies, organizations, and individuals shall be responsible for implementing this Circular.
Clause 2. In case of difficulties during implementation, agencies, organizations, and individuals are requested to report to the Ministry of Industry and Trade for consolidation, review, and guidance./.
