CIRCULAR
Regulations on the authority and procedures for issuing Domestic Sea Transport Permits
for foreign ships
Pursuant to the Vietnam Maritime Code 2015;
Pursuant to Decree No. 33/2025/NĐ-CP dated February 25, 2025 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Construction;
At the proposal of the Director of the Department of Transport and Traffic Safety and the Director of the Vietnam Marine and Inland Waterway Administration,
The Minister of Construction issues this Circular regulating the authority and procedures for issuing Domestic Sea Transport Permits for foreign ships.
PART I
GENERAL PROVISIONS
Article 1. Scope of Regulation
This Circular stipulates the authority and procedures for issuing Domestic Sea Transport Permits for foreign ships.
Article 2. Applicability
This Circular applies to organizations and individuals in Vietnam and foreign organizations and individuals related to foreign ships engaged in domestic sea transport.
Article 3. Explanation of Terms
1. Foreign ships are ships registered under the flag of a foreign country.
2. Domestic sea transport is the transportation of goods, passengers, and luggage by ship where both the place of receipt and the place of delivery of goods, passengers, and luggage are within Vietnamese waters.
Article 4. Authority to issue Domestic Sea Transport Permits
1. The Minister of Construction shall issue Domestic Sea Transport Permits in the following cases:
a) Transportation of oversized, overweight goods or other types of goods by specialized ships; clearance of goods, passengers, and luggage blocked at ports when Vietnamese ships are unable to transport them;
b) To prevent, mitigate natural disasters, epidemics, or urgent humanitarian aid.
2. The Director of the Port Marine Service shall issue Domestic Sea Transport Permits for foreign ships transporting passengers and luggage from cruise ships to the mainland and vice versa using the transfer means of those cruise ships.
Article 5. Validity Period of Domestic Sea Transport Permits
1. The validity period of Domestic Sea Transport Permits is one year and applies to the following cases:
a) Ships serving one production facility;
b) Types of ships that the Vietnamese fleet does not have.
2. The validity period of Domestic Sea Transport Permits is six months and applies to other types of ships not covered by Clause 1 of this Article.
3. In cases where enterprises propose a validity period for foreign ships engaged in domestic sea transport, the validity period of Domestic Sea Transport Permits issued will be based on the enterprise's proposal but shall not exceed one year for the cases specified in Clause 1 of this Article, and shall not exceed six months for the cases specified in Clause 2 of this Article.
4. The validity period of Domestic Sea Transport Permits on a voyage basis applies to ships transporting passengers and luggage from cruise ships to the mainland and vice versa.
Chapter II
PROCEDURES FOR ISSUING AND REVOKING DOMESTIC SEA TRANSPORT PERMITS FOR FOREIGN SHIPS
Section 1
CASES OF TRANSPORTATION OF OVERSIZED, OVERWEIGHT GOODS OR OTHER TYPES OF GOODS BY SPECIALIZED SHIPS; CLEARANCE OF BLOCKED GOODS, PASSENGERS, AND LUGGAGE AT PORTS
Article 6. Documents for Application for Issuance of Domestic Sea Transport Permits
The documents for application for issuance of Domestic Sea Transport Permits include:
1. Original or electronic form of Application Form according to Model No. 01 attached to this Circular.
2. One copy or electronic copy of the Certificate of Ship Registration.
3. One copy or electronic copy of the ship inspection dossier in accordance with regulations.
4. One original or electronic copy certified from the original or electronic copy certified from the original and presented for verification one of the following documents: Agency Contract or Letter of Authorization for the Agent representing the foreign ship owner (in case the applicant is the agent representing the foreign ship owner) or Charter Party (in case the ship is chartered by the applicant).
Article 7. Procedure for receiving, processing applications and issuing Domestic Sea Transport Permits
1. The organization submitting the application shall submit one set of application documents in accordance with Article 6 of this Circular directly or through the postal system to the Vietnam Maritime Administration and Inland Waterways Administration, or submit online via the online public service system.
2. The Vietnam Maritime Administration and Inland Waterways Administration shall receive and examine the application documents. In cases where the documents are received directly, the person receiving the documents must check them and clearly inform the applicant of any necessary supplements or amendments (if any). In cases where the documents are received through the postal system or the online public service system and are incomplete, within two working days from the date of receipt, the Vietnam Maritime Administration and Inland Waterways Administration shall clearly notify the contents that need to be supplemented or amended. For applications submitted through the online public service system, the notification method shall comply with the legal provisions on the single window mechanism in administrative procedures.
3. Within seven working days from the date of receipt of complete application documents, the Vietnam Maritime Administration and Inland Waterways Administration shall review the application documents, simultaneously publish them on the electronic information website of the Vietnam Maritime Administration and Inland Waterways Administration to solicit wide-ranging opinions, and prepare a review report to be submitted to the Ministry of Construction for consideration and decision.
4. Within three working days from the date of receipt of the review report from the Vietnam Maritime Administration and Inland Waterways Administration, the Ministry of Construction shall consider and issue the Domestic Sea Transport Permit according to Model No. 02 attached to this Circular. In cases where the Domestic Sea Transport Permit is not issued, the Ministry of Construction must respond in writing and specify the reasons.
5. The result of the administrative procedure shall be delivered electronically (having the same legal effect as a paper copy), except in cases where organizations or individuals request a paper copy. The Ministry of Construction shall deliver the electronic result to the Vietnam Maritime Administration and Inland Waterways Administration for delivery to the requesting organizations or individuals. In cases where organizations or individuals request a paper copy, the Ministry of Construction shall deliver the result through the postal system or other appropriate methods.
Section 2
CASES OF NATURAL DISASTER PREVENTION AND MITIGATION, DISEASE CONTROL OR URGENT HUMANITARIAN ASSISTANCE
Article 8. Application Documents for Requesting Issuance of Domestic Sea Transport Permit
The documents for application for issuance of Domestic Sea Transport Permits include:
1. Original or electronic form of the official letter from the competent state agency requesting foreign vessels to engage in domestic transport.
2. One copy or electronic copy of the Certificate of Ship Registration.
3. One copy or electronic copy of the ship inspection dossier in accordance with regulations.
Article 9. Procedure for Receiving, Processing Applications and Issuing Domestic Sea Transport Permit
1. The organization submitting the application shall submit one set of application documents in accordance with Article 8 of this Circular directly or through the postal system to the Vietnam Maritime Administration and Inland Waterways Administration, or submit online via the online public service system.
2. The Vietnam Maritime Administration and Inland Waterways Administration shall receive and examine the application documents. In cases where the documents are received directly, the person receiving the documents must check them and clearly inform the applicant of any necessary supplements or amendments (if any). Section 3
CASES OF PASSENGER AND LUGGAGE TRANSPORT FROM CRUISE SHIPS TO THE MAINLAND
Article 10. Documents for Application for Domestic Maritime Transport Permit
The documents for application for issuance of Domestic Sea Transport Permits include:
1. Original or electronic form of Application Form according to Model No. 01 attached to this Circular.
2. One copy or electronic copy of the Certificate of Ship Registration.
3. One copy or electronic copy of the ship inspection dossier in accordance with regulations.
4. 01 (one) original or an electronic copy issued from the original register or an electronic copy certified from the original or a copy and presenting the original for comparison of the Agency Contract or the Certificate of Representation of Foreign Ship Owner (in case the organization applying is the agent representing the foreign ship owner).
5. 01 (one) original or an electronic copy issued from the original register or an electronic copy certified from the original or a copy and presenting the original for comparison of the Detailed Plan for Implementing Passenger and Luggage Transportation from Cruise Ships to the Mainland and Vice Versa.
Article 11. Procedure for Acceptance, Processing of Documents and Issuance of Domestic Maritime Transport Permit
1. The organization submitting shall submit 01 (one) set of documents as prescribed in Article 10 of this Circular directly or through postal service to the Port Control Authority in the area where cruise ships dock or submit online via the online public service system.
2. The Port Control Authority accepts and checks the documents. In cases where the documents are submitted directly, the person receiving the documents must check and clearly inform the submitter about the contents that need to be supplemented or modified (if any). In cases where the documents are received through the postal service or online public service system and are incomplete, within 01 (one) working day from the date of receipt of the documents, the Port Control Authority will clearly notify the contents that need to be supplemented or modified. For documents submitted through the online public service system, the notification method shall be carried out in accordance with the legal regulations on the single window mechanism in administrative procedures.
3. Within 01 (one) working day from the date of receipt of complete documents, the Port Control Authority will review the documents and issue the Domestic Maritime Transport Permit according to Model No. 03 attached to this Circular. In case the Domestic Maritime Transport Permit is not issued, it must be replied in writing and specify the reasons.
4. The Port Control Authority delivers the results of administrative procedures in electronic form (having the same legal value as paper copies), except in cases where organizations or individuals request paper copies. In cases where organizations or individuals request paper copies, the Port Control Authority delivers the results through the postal service or other appropriate methods.
Section 4
REVOCATION OF DOMESTIC MARITIME TRANSPORT PERMIT
Article 12. Circumstances for Revocation of Domestic Maritime Transport Permit
The Domestic Maritime Transport Permit will be revoked in the following circumstances:
1. The vessel no longer meets the conditions for transporting goods, passengers, and luggage as stipulated by law.
2. Transporting goods, passengers, and luggage does not comply with the content recorded in the Domestic Maritime Transport Permit.
3. Forgery, erasure, or intentional distortion of information related to the vessel, transport route, goods, passengers, luggage, and other relevant information.
Article 13. Authority to Revoke Domestic Maritime Transport Permit
1. The Minister of Construction revokes the Domestic Maritime Transport Permit as prescribed in Clause 1, Article 4 of this Circular.
2. The Director of the Port Control Authority in the region revokes the Domestic Maritime Transport Permit as prescribed in Clause 2, Article 4 of this Circular.
Chapter III
IMPLEMENTATION
Article 14. Responsibilities of Organizations and Individuals Involved
1. Responsibilities of organizations and individuals owning foreign vessels participating in domestic maritime transport:
a) Carry out domestic maritime transport strictly in accordance with the content recorded in the Domestic Maritime Transport Permit;
b) The Domestic Maritime Transport Permit must be presented to the Port Control Authority and relevant agencies at the port when handling procedures for the vessel's arrival or departure from the port (upon request);
c) Not to erase or distort information in the Domestic Maritime Transport Permit;
d) Not to use fake Domestic Maritime Transport Permits;
e) Not to engage in any fraudulent acts to obtain a Domestic Maritime Transport Permit.
2. Responsibilities of the Vietnam Maritime Administration and Inland Waterways:
a) To accept and process documents in accordance with the procedures prescribed in this Circular and bear responsibility for the content related during the document review process;
b) To conduct inspections, audits, and reviews for issuing Domestic Maritime Transport Permits in accordance with regulations;
c) To direct Port Control Authorities to carry out inspections, audits, and supervision to promptly detect violations involving foreign vessels engaged in domestic maritime transport;
d) To be the point of contact for all information reflecting on foreign vessels engaged in domestic maritime transport. To resolve within their authority or report to higher authorities for handling cases violating the provisions of this Circular and Vietnamese laws;
e) To compile information and statistical data related to goods, passengers, and luggage transported by vessels; the results of issuing permits for foreign vessels engaged in domestic maritime transport; to report to the Ministry of Construction before December 25 each year.
3. Responsibilities of Port Control Authorities and Inland Waterway Port Control Authorities:
a) To carry out inspections and supervision to promptly detect violations related to the domestic maritime transport activities of foreign vessels;
b) To immediately report to the Vietnam Maritime Administration and Inland Waterways when detecting violations as prescribed in this Circular.
Article 15. Effective Date
1. This Circular takes effect from February 1, 2026. Decree No. 50/2016/TT-BGTVT dated December 30, 2016 of the Minister of Transport on Procedures for Issuing Domestic Maritime Transport Permits for Foreign Vessels and Article 2 of Decree No. 08/2022/TT-BGTVT dated June 16, 2022 of the Minister of Transport amending and supplementing certain articles of Circulars regulating business activities in the maritime and inland waterways sector are hereby abolished from the date this Circular takes effect.
2. Applications for Domestic Maritime Transport Permits received by competent authorities before this Circular takes effect shall continue to be processed in accordance with the law at the time of receipt.
