Regulations on the process for conducting vocational training quality assessment

Pursuant to the Vocational Training Law dated November 29, 2006;
Pursuant to Decree No. 186/2007/NĐ-CP dated December 25, 2007 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Labor - War Invalids and Social Affairs;
Based on Decree No. 70/2009/NĐ-CP dated August 21, 2009 of the Government stipulating responsibilities for state management of vocational training;
Implementing Resolution No. 48/NQ-CP dated December 9, 2010 of the Government on simplifying administrative procedures within the scope of functions managed by the Ministry of Labor, Invalids and Social Affairs;
The Ministry of Labor, Invalids and Social Affairs hereby stipulates the process for conducting vocational training quality assessment as follows:
PART I
GENERAL PROVISIONS
Article 1. Scope and Applicability
Article 1. This Circular specifies the process for conducting vocational training quality assessment, including: self-assessment of vocational training quality by vocational training institutions; quality assessment of vocational training by state management agencies responsible for vocational training; recognition of the results of vocational training quality assessment, issuance and revocation of certificates attesting to meeting quality assessment standards.
Article 2. This Circular applies to vocational college schools, vocational secondary schools, vocational training centers of various types, including public, private, and foreign-invested entities (hereinafter referred to collectively as vocational training institutions).
Article 2. Purpose of vocational training quality assessment
Vocational training quality assessment aims to evaluate and determine the degree of achievement of vocational training objectives, programs, and content at vocational college schools, vocational secondary schools, and vocational training centers during specific periods, assisting vocational training institutions in continuously improving the quality and effectiveness of training.
Article 3. Principles for implementing vocational training quality assessment
Implementing vocational training quality assessment must ensure the following principles:
Clause 1. Independence, objectivity, compliance with laws;
Clause 2. Honesty, transparency, and clarity.
Article 4. Cycle for implementing vocational training quality assessment
Clause 1. Self-assessment of vocational training quality shall be conducted annually for all vocational training institutions nationwide.
Clause 2. Quality assessment of vocational training shall be conducted every five years for vocational training institutions that meet quality assessment standards.
Chapter II
SELF-ASSESSMENT OF VOCATIONAL TRAINING QUALITY BY VOCATIONAL TRAINING INSTITUTIONS
Article 5. Process for self-assessment of vocational training quality
Clause 1. Conduct preparatory work for self-assessment of vocational training quality.
Clause 2. Conduct self-assessment of vocational training quality by the training department and other specialized departments, faculties, and subjects under the vocational training institution, research units, service units, support units for vocational training, production units, and enterprises (collectively referred to as units) within the vocational training institution.
Clause 3. Conduct self-assessment of vocational training quality by the quality assessment council of the vocational training institution.
Clause 4. Publish the report on the results of self-assessment of vocational training quality within the vocational training institution and submit the report on the results of self-assessment of vocational training quality.
Article 6. Conduct preparatory work for self-assessment of vocational training quality
Clause 1. Establish the quality assessment council of the vocational training institution (hereinafter referred to as the Assessment Council) for vocational training institutions that have not yet established an Assessment Council; improve the Assessment Council for vocational training institutions that have already established an Assessment Council (if necessary).
Clause 2. Annually, vocational training institutions develop and approve plans for self-assessment of vocational training quality.
The plan for self-assessment of vocational training quality includes the main contents: objectives; tasks to be performed and their sequence; detailed assignment of responsibilities to units responsible for implementation; time schedule; expected results and products to be completed; and funds guaranteed for implementation of the plan.
Article 7. Quality Assessment Council for Vocational Training of Vocational Training Institutions
1. The Quality Assessment Council shall be established by the Rector of the College of Vocational Training, the Rector of the Secondary Vocational School, or the Director of the Vocational Training Center (hereinafter referred to collectively as the head of the vocational training institution).
2. The Quality Assessment Council of the College of Vocational Training and the Secondary Vocational School shall have at least 9 (nine) members. The Quality Assessment Council of the Vocational Training Center shall have at least 5 (five) members.
3. The composition of the Quality Assessment Council includes:
a) The Chairman of the Quality Assessment Council is the head of the vocational training institution;
b) The Vice-Chairman of the Quality Assessment Council is the deputy of the head of the vocational training institution responsible for training work;
c) The Secretary of the Quality Assessment Council is the head of the unit responsible for quality assessment work or the Head of the Training Department of the vocational training institution;
d) Other members of the Quality Assessment Council are representatives of leaders from various units and some reputable lecturers or teachers of the vocational training institution. The vocational training institution may invite external experts to participate in the Quality Assessment Council.
4. The Quality Assessment Council operates on the principle of democratic centralism, discussing to reach consensus.
Article 8. Tasks of the Quality Assessment Council
1. Develop a plan to implement self-assessment of vocational training quality, submit it to the head of the vocational training institution for approval.
2. Guide units within the vocational training institution to implement self-assessment of vocational training quality and write reports on the results of self-assessment of vocational training quality of the unit.
3. Implement self-assessment of vocational training quality of the vocational training institution according to Clause 3 of Article 5 and Article 11 of this Circular.
4. Manage and maintain databases, information, and evidence regarding the activities of self-assessment of vocational training quality of the vocational training institution.
Article 9. Responsibilities of Members of the Quality Assessment Council
1. The Chairman of the Quality Assessment Council is responsible for the activities of the Quality Assessment Council, assigns specific tasks to each member of the Quality Assessment Council; convenes and chairs meetings of the Quality Assessment Council; directs and organizes the implementation of tasks of the Quality Assessment Council; resolves issues arising during the implementation of self-assessment of vocational training quality; signs activity plans and reports of the Quality Assessment Council.
2. The Vice-Chairman of the Quality Assessment Council is responsible for chairing the council when authorized by the Chairman of the Quality Assessment Council and performs tasks assigned by the Chairman of the Quality Assessment Council.
3. The Secretary of the Quality Assessment Council is responsible for monitoring and urging the implementation of activities of the Quality Assessment Council; compiles and writes reports on the results of self-assessment of vocational training quality of the vocational training institution and performs other tasks assigned by the Chairman of the Quality Assessment Council.
4. Other members of the Quality Assessment Council are responsible for performing tasks assigned by the Chairman of the Quality Assessment Council.
Article 10. Implementation of Self-Assessment of Vocational Training Quality by Units within the Vocational Training Institution
1. Collect information and evidence about each activity and the results of fulfilling functions and tasks of the unit.
2. Evaluate and determine the level of achievement according to each indicator, standard, and criterion for assessing vocational training quality; analyze and clearly identify strengths, weaknesses, and causes; propose action plans to improve the quality of unit activities.
3. Write a report on the results of self-assessment of vocational training quality of the unit and send it to the Quality Assessment Council of the vocational training institution.
4. Organize management and maintenance of databases, information, and evidence about the activities of the unit.
Article 11. Implementation of Self-Assessment of Vocational Training Quality by the Quality Assessment Council
1. Study reports on the results of self-assessment of vocational training quality of units within the vocational training institution.
2. Compile information and evidence according to each indicator, standard, and criterion for assessing vocational training quality.
3. Conduct on-site inspections, collect additional information and evidence according to each indicator, standard, and criterion for assessing vocational training quality.
4. Compare with the system of criteria and standards for assessing vocational training quality issued by the Ministry of Labor, Invalids and Social Affairs, evaluate and determine the level of achievement of each indicator, standard, and criterion for assessing vocational training quality; clearly identify strengths, weaknesses, and causes; propose action plans to improve vocational training quality.
4. Draft a report on the results of self-assessment of vocational training quality of the vocational training institution (according to Model No. 1 attached to this Circular), send it to units within the vocational training institution for comments.
5. Complete the report on the results of self-assessment of vocational training quality of the vocational training institution.
Article 12. Publicizing the Report on the Results of Self-Assessment of Vocational Training Quality within the Vocational Training Institution and Submitting the Report on the Results of Self-Assessment of Vocational Training Quality
1. The head of the vocational training institution convenes a meeting to publicize the report on the results of self-assessment of vocational training quality within the vocational training institution. Participants include members of the Quality Assessment Council and heads of units within the vocational training institution.
2. Within 10 (ten) working days from the date of publicizing the report on the results of self-assessment of vocational training quality within the vocational training institution, the vocational training institution shall submit the report on the results of self-assessment of vocational training quality to the General Department of Vocational Training.
Chapter III
QUALITY ASSESSMENT OF VOCATIONAL TRAINING BY THE STATE MANAGEMENT AUTHORITY FOR VOCATIONAL TRAINING
Article 13. Quality Assurance Training Process
1. Evaluate the report on the results of self-assessment of training quality by the training institution.
2. Establish a quality assurance inspection team for training.
3. Conduct on-site surveys at the training institution.
4. Prepare the quality assurance inspection dossier.
Article 14. Evaluation of the Report on the Results of Self-Assessment of Training Quality by the Training Institution
1. The content of evaluating the report on the results of self-assessment of training quality includes: the process of implementing self-assessment of training quality, the structure of the report on the results of self-assessment of training quality, the consistency between information and evidence according to each index, standard, criterion with the content of self-evaluation and the score of the results of self-assessment of training quality of the training institution.
2. Within fifteen working days from the date of receipt of the report on the results of self-assessment of training quality by the training institution, the General Department of Vocational Training shall organize the evaluation of the report on the results of self-assessment of training quality by the training institution and notify the evaluation results in writing to the training institution.
Article 15. Establishment of the Quality Assurance Inspection Team for Training
1. Based on the results of evaluating the report on the results of self-assessment of training quality by the training institution and the annual quality assurance inspection plan, the Director of the General Department of Vocational Training decides to establish a quality assurance inspection team to conduct quality assurance inspections at the training institution.
2. The quality assurance inspection team (hereinafter referred to as the inspection team) for vocational college and higher vocational college has from five to nine members; the inspection team for vocational training center has from three to seven members; including the team leader, the team secretary, and other team members (hereinafter collectively referred to as quality assurance inspectors).
3. Standards for quality assurance inspectors:
a) Have completed the quality assurance inspector training program.
b) Hold a bachelor's degree or higher.
c) Have at least five years of experience in teaching, management, or scientific research related to training.
d) Possess good character and ethics; be honest, objective, and have a clear background.
đ) Have communication skills, information gathering abilities, analytical and synthesis capabilities, and proficiency in using computers.
4. Cases where participation in the inspection team is not allowed:
a) Previously or currently working or studying at the inspected training institution.
b) Contributing capital, purchasing shares, or performing economic contracts, consulting contracts on self-assessment of training quality with the inspected training institution.
c) Having parents, spouse, children, siblings who are currently working or studying at the inspected training institution.
5. Prohibited actions for quality assurance inspectors:
a) Colluding or coordinating with the inspected training institution to distort the content of the report on the results of quality assurance inspection.
b) Purchasing or accepting gifts of stocks, money, or other assets from the inspected training institution.
c) Disclosing information about the inspected training institution that they know during the inspection, except when the training institution agrees or the law provides otherwise.
Article 16. Tasks of the inspection team
1. Develop the inspection team's activity plan, assign specific tasks to each member of the team; report the inspection team's activity plan to the Vocational Training General Department and notify the vocational training institution at least 3 (three) working days before the actual survey date.
2. Study the vocational training quality self-inspection report of the vocational training institution and related documents, materials, information, and evidence.
3. Conduct an on-site survey at the vocational training institution.
4. Prepare the report on the results of the vocational training quality inspection (in accordance with Form No. 2 issued together with this Circular).
5. Meet with the vocational training institution regarding the draft report on the results of the vocational training quality inspection.
6. Prepare the vocational training quality inspection file and send it to the Vocational Training General Department.
7. Explain contents related to the vocational training quality inspection at the vocational training institution according to the request of the Vocational Training General Department.
Article 17. Tasks of the head of the inspection team, the secretary of the inspection team, and other members of the inspection team
1. Comply with legal regulations and bear legal responsibility for the assigned tasks.
2. The head of the inspection team directs the activities of the inspection team; is responsible for the report on the results of the vocational training quality inspection. The head signs all documents, plans, minutes, and reports of the inspection team.
3. The secretary of the inspection team assists the head in implementing activities and preparing reports of the team; performs other tasks assigned by the head and is responsible for the results of the assigned tasks.
4. Other members of the inspection team perform tasks assigned by the head of the inspection team and are responsible for the results of the assigned tasks.
5. The head of the inspection team, the secretary of the inspection team, and other members of the inspection team are responsible for keeping confidential information related to the work content, inspection results before announcing them to the vocational training institution.
Article 18. The inspection team conducts on-site surveys at vocational training institutions
1. Within 5 (five) working days from the date of the decision to establish the team, the inspection team must conduct an on-site survey at the vocational training institution.
2. The maximum duration of the on-site survey by the inspection team at the vocational training institution is 7 (seven) working days.
In cases where the vocational training institution has training facilities in different provinces and cities, the duration of the on-site survey by the inspection team at the vocational training institution may be extended, but not exceeding 10 (ten) working days.
3. On-site survey activities at the vocational training institution:
a) Meeting with the Inspection Council of the vocational training institution to announce the inspection team's work program at the vocational training institution;
b) Working with units within the vocational training institution and members of the Inspection Council to collect, check, and confirm information and evidence of the vocational training institution;
c) Meeting, interviewing, and exchanging with representatives of management staff, teachers, trainees, and employers using the random sampling method to collect and check information and evidence of the vocational training institution;
d) Summarizing information and evidence obtained during the inspection according to each index, standard, and criterion for vocational training quality inspection issued by the Ministry of Labor, Invalids and Social Affairs, and evaluating and determining the level of achievement of the vocational training institution according to each index, standard, and criterion for vocational training quality inspection;
đ) Drafting the report on the results of the vocational training quality inspection. The draft report on the results of the vocational training quality inspection must be approved by at least 2/3 of the members of the inspection team;
e) Meeting with the vocational training institution regarding the draft report on the results of the vocational training quality inspection.
Article 19. The inspection team meets with vocational training institutions regarding the draft report on the quality assessment results of vocational training
1. The inspection team meets with vocational training institutions regarding the draft report on the quality assessment results of vocational training on the last day of the actual survey to discuss the contents of the draft report on the quality assessment results of vocational training. Participants in the meeting include: the inspection team, the Inspection Council, and other representatives of the vocational training institution invited by the head of the vocational training institution. The draft report on the quality assessment results of vocational training is sent by the inspection team to the head of the vocational training institution at least one day before organizing the meeting.
2. Contents of the meeting regarding the draft report on the quality assessment results of vocational training by the inspection team:
a) The inspection team presents the full draft report on the quality assessment results of vocational training;
b) The inspection team and the vocational training institution exchange views on the contents of the draft report on the quality assessment results of vocational training.
3. A record of the meeting between the inspection team and the vocational training institution confirming the work process of the inspection team at the vocational training institution; confirming all evidence provided by the vocational training institution to the inspection team; opinions of the vocational training institution and the inspection team exchanged during the meeting.
Article 20. Establishing the quality assessment inspection dossier for vocational training
1. Within 5 (five) working days from the end date of the actual survey at the vocational training institution, the inspection team establishes the quality assessment inspection dossier for vocational training and sends it to the General Department of Vocational Training.
2. The quality assessment inspection dossier for vocational training includes:
a) Report on the implementation process of the quality assessment inspection for vocational training by the inspection team;
b) Report on the quality assessment inspection results for vocational training;
c) Record of the meeting between the inspection team and the vocational training institution regarding the draft report on the quality assessment inspection results for vocational training;
d) Report explaining the differences (if any) between the inspection team and the vocational training institution regarding the draft report on the quality assessment inspection results for vocational training.
Chapter IV
RECOGNITION OF QUALITY ASSESSMENT INSPECTION RESULTS FOR VOCATIONAL TRAINING AND ISSUANCE AND REVOCATION OF CERTIFICATES OF QUALITY ASSESSMENT STANDARDS FOR VOCATIONAL TRAINING
Article 21. Procedures for recognizing quality assessment inspection results for vocational training
1. Reviewing the quality assessment inspection dossier for vocational training.
2. Recognizing the quality assessment inspection results for vocational training and issuing certificates of compliance with quality assessment standards for vocational training.
3. Announcing the quality assessment inspection results for vocational training.
Article 22. Reviewing the quality assessment inspection dossier for vocational training
1. Within 15 (fifteen) working days from the date of receipt of the quality assessment inspection dossier for vocational training, the General Department of Vocational Training organizes the review, submits to the Minister of Labor, Invalids and Social Affairs for consideration and recognition of the quality assessment inspection results for vocational training.
2. The review of the quality assessment inspection dossier for vocational training shall be carried out by the Quality Assessment Inspection Dossier Review Board as stipulated in Article 23 of this Circular.
Article 23. Quality Assessment Inspection Dossier Review Board
1. The Quality Assessment Inspection Dossier Review Board (hereinafter referred to as the Board) is established by the Director of the General Department of Vocational Training. The Board consists of 9 members, including: the Chairman of the Board is the Deputy Director in charge of quality assessment inspection work; the Vice-Chairman of the Board is the Director of the Quality Assessment Inspection Department; the Secretary of the Board is the Head of the Quality Assessment and Recognition Section; the Board members are management staff, experts in quality assessment inspection for vocational training, and representatives of leaders of some Departments under the General Department of Vocational Training.
2. Responsibilities of the Board:
a) Reviewing the quality assessment inspection dossier for vocational training;
b) Reporting the review results to the Director of the General Department of Vocational Training.
3. The Board operates based on the principles of centralization, democracy, and collective discussion of issues within its mandate. Decisions of the Board must be agreed upon by at least 2/3 of the Board members.
Article 24. Recognition of the results of vocational training quality assessment and issuance of certificates of compliance with vocational training quality assessment standards
1. Within three (3) working days from the date of receiving the report of the Appraisal Council, the Director General of the Vocational Training General Department shall submit to the Minister of Labor, Invalids and Social Affairs for consideration and decision on recognizing the results of vocational training quality assessment and issuing certificates of compliance with vocational training quality assessment standards.
2. The Minister of Labor, Invalids and Social Affairs shall issue certificates of compliance with vocational training quality assessment standards (in accordance with Form No. 3 issued together with this Circular) to vocational training establishments that achieve vocational training quality assessment results at Level 3.
3. Decisions on recognizing the results of vocational training quality assessment and decisions on issuing certificates of compliance with vocational training quality assessment standards shall be publicly announced on the electronic information website of the Ministry of Labor, Invalids and Social Affairs, the Vocational Training General Department, and other mass media.
Article 25. Revocation of certificates of compliance with vocational training quality assessment standards
1. Certificates of compliance with vocational training quality assessment standards shall be revoked in the following cases:
a) The vocational training establishment has its right to use the decision on establishment or permission to establish, or its registration certificate for vocational training activities, temporarily or permanently withdrawn;
b) The vocational training establishment is ordered to suspend or terminate its vocational training activities;
c) The vocational training establishment does not organize self-assessment of vocational training quality and does not submit a report on the results of self-assessment of vocational training quality as prescribed in Clause 8, Article 27 of this Circular;
d) The results of self-assessment of vocational training quality of the vocational training establishment do not reach Level 3.
2. The Director General of the Vocational Training General Department shall review and submit to the Minister of Labor, Invalids and Social Affairs for decision on revoking certificates of compliance with vocational training quality assessment standards.
3. Decisions on revoking certificates of compliance with vocational training quality assessment standards shall be publicly announced on the electronic information website of the Ministry of Labor, Invalids and Social Affairs, the Vocational Training General Department, and other mass media.
Chapter V
IMPLEMENTATION
Article 26. Responsibilities of the Vocational Training General Department
1. To develop annual plans for vocational training quality assessment, submit them to the Ministry of Labor, Invalids and Social Affairs for approval, and notify vocational training establishments and relevant agencies to coordinate in directing and implementing vocational training quality assessment activities.
2. To manage and organize the implementation of vocational training quality assessment. To guide vocational training establishments in conducting self-assessment of vocational training quality. To establish inspection teams.
3. To provide specific guidance on the content of reports on the results of self-assessment of vocational training quality of vocational training establishments; reports on the results of vocational training quality assessment by inspection teams.
4. To develop training programs and materials for quality inspection officers and self-inspection staff in vocational training.
5. To organize training and upgrading of self-inspection staff in vocational training.
6. To organize training and upgrading of quality inspection officers in vocational training; to mobilize and manage a team of quality inspection officers in vocational training to participate in quality inspection activities.
7. To organize the examination and handling of complaints from vocational training establishments regarding reports on the results of vocational training quality assessment. To resolve complaints from vocational training establishments about the results of vocational training quality assessment in accordance with the law.
8. To organize the review of quality inspection documentation. To submit to the Minister of Labor, Invalids and Social Affairs for recognition of the results of vocational training quality assessment; issuance and revocation of certificates of compliance with vocational training quality assessment standards.
9. To publicly announce the results of vocational training quality assessment so that trainees and society can know and supervise.
10. To annually compile and report to the Minister of Labor, Invalids and Social Affairs on the situation of vocational training quality assessment.

Article 28. Responsibilities of Ministries, Sectors, and Localities
Ministries, ministerial-level agencies, agencies under the Government, central agencies of political and social organizations having affiliated vocational training institutions; People's Committees of provinces and centrally-administered cities; Departments of Labor, Invalids, and Social Affairs have the responsibility to direct affiliated vocational training institutions under their management to implement self-assessment of vocational training quality and cooperate with the General Department of Vocational Training and the Ministry of Labor, Invalids, and Social Affairs in vocational training quality assessment activities.
Article 29. Responsibilities and Procedures for Handling Complaints and Denunciations in Vocational Training Quality Assessment
1. Responsibilities for handling complaints and denunciations in vocational training quality assessment:
a) The Director of the General Department of Vocational Training is responsible for resolving complaints and denunciations of organizations and individuals regarding self-assessment of vocational training quality; organizing the vocational training quality assessment team; reviewing the results of vocational training quality assessment; and the results of vocational training quality assessment.
b) The Minister of Labor, Invalids, and Social Affairs is responsible for resolving complaints and denunciations of organizations and individuals regarding recognition of the results of vocational training quality assessment; issuing and revoking certificates of meeting the standards for vocational training quality assessment.
2. Procedures and formalities for handling complaints and denunciations of organizations and individuals regarding vocational training quality assessment shall be carried out in accordance with current laws on complaint and denunciation resolution.
Article 30. Funding for Vocational Training Quality Assessment Activities
1. Funding for vocational training quality assessment activities is allocated in the budget estimate of the State budget of the General Department of Vocational Training and the Ministry of Labor, Invalids, and Social Affairs according to current regulations.
2. Funding for self-assessment of vocational training quality by public vocational training institutions is allocated in the regular budget estimate according to the current分级任务并进行翻译:
3. The funds for self-assessment activities of private vocational training institutions shall be arranged from the legitimate income sources of such institutions.
4. Vocational training institutions are permitted to accept lawful sponsorships from organizations and individuals, both domestic and foreign, to support activities related to quality assessment of vocational training.
5. The preparation of budgets, management, auditing, and final settlement of funds for implementing quality assessment activities of vocational training shall be carried out in accordance with current regulations.
Article 31. Effective Date
This Circular takes effect from February 15, 2012.
2. The following regulations are abolished:
a) Decision No. 08/2008/QĐ-BLĐTBXH dated March 25, 2008, of the Minister of Labor, Invalids, and Social Affairs promulgating the Regulations on the Procedure for Vocational Training Quality Assessment;
b) Clause 2 of Article 4, Article 13, and Article 14 of Decision No. 07/2008/QĐ-BLĐTBXH dated March 25, 2008, of the Minister of Labor, Invalids, and Social Affairs promulgating the Regulations on Vocational Training Quality Assessors.
3. Agencies and organizations, during the implementation of this Circular, if they encounter difficulties, obstacles, or discover new issues arising, shall promptly reflect them to the Ministry of Labor, Invalids, and Social Affairs for guidance or supplementation and adjustment to ensure compliance./.
