Pursuant to Decree No. 94/2006/NĐ-CP dated September 7, 2006 of the Government adjusting the national minimum wage;
财政部与教育部联合发布关于指导实施政府总理2006年4月14日第82/2006/QĐ-TTg号决定第二条规定的指导意见如下：
第一部分 总则
1. 适用范围和调整范围：本通知对少数民族学生政策奖学金的标准及资金来源进行指导，该奖学金适用于在民族寄宿学校和预科大学就读的少数民族学生，并按照政府总理2006年4月14日第82/2006/QĐ-TTg号决定关于调整少数民族学生政策奖学金标准的规定执行，该规定依据政府总理2001年12月21日第194/2001/QĐ-TTg号决定。
2. 各部委、直属机构、各省政府和直辖市人民政府应确保少数民族学生政策奖学金的资金来源。
3. 民族寄宿学校和预科大学负责按照本通知的规定发放少数民族学生的政策奖学金。
II. SPECIFIC PROVISIONS
1. 根据政府总理2006年4月14日第82/2006/QĐ-TTg号决定第二条的规定，自2006年1月1日起，当国家调整全国最低工资标准时，少数民族学生享受的政策奖学金标准将相应调整。具体如下：
- 根据政府2006年9月7日第94/2006/NĐ-CP号决定关于调整全国最低工资标准的规定，自2006年1月1日起，将少数民族学生政策奖学金标准（见政府总理2006年4月14日第82/2006/QĐ-TTg号决定第一条）从每月每人28万越南盾调整为每月每人36万越南盾。
- 对于2006年10月1日后国家调整最低工资标准的决定，少数民族学生政策奖学金的调整将按国家调整最低工资标准的比例进行，确保：
政策奖学金标准 = （全国最低工资标准）× 80%
2. The financial requirement for implementing the adjustment of policy scholarships is the difference between the financial requirement for disbursing policy scholarships at the adjusted level (as provided in Point 1, Part II of this Circular) and the budget estimate for disbursing policy scholarships at the old level (allocated in the state budget estimate for boarding schools for ethnic minorities and pre-university colleges).
The financial requirement for disbursing policy scholarships at the adjusted level is calculated by multiplying the adjusted level of policy scholarships by the actual number of students present at the time the State changes its salary policy and the expected number of new admissions in the following year after the State changes its salary policy, and then multiplying by the duration during which the adjusted level of policy scholarships is enjoyed in the implementation year.
The financial requirement for disbursing policy scholarships at the old level is the budget estimate for disbursing scholarships that has been balanced within the budget allocation for boarding schools for ethnic minorities and pre-university colleges for the period during which the adjustment of policy scholarships is implemented in the implementation year.
3. The financial source for ensuring the implementation of the adjustment of policy scholarships shall be carried out according to the current regulations on分级翻译任务，以下是第1部分的翻译结果：

The funding requirement for implementing the adjustment of policy scholarships due to the adjustment of the national minimum wage but not included in the initial budget estimates of localities shall be handled as follows:
- For localities facing difficulties in funding implementation (provinces and centrally-administered cities receiving supplementary balance from the central budget and localities with a redistribution rate to the central budget below 5%), the central budget will support 100%.
- For the remaining localities, they should proactively arrange within their local budgets to implement the adjustments.
4. On the reporting system for funding requirements to implement the adjustment of policy scholarships:
When there is a decision by the Government to adjust the national minimum wage level, based on the proposals from boarding secondary schools for ethnic minorities, preparatory colleges under central agencies, central agencies, and provincial-level agencies, they are responsible for reviewing and compiling reports on the need to implement adjustments to policy scholarships for subordinate units to submit to the Ministry of Finance (for central agencies) or to the Provincial Department of Finance (for local agencies) along with the time of submitting reports on the need for additional funding to implement salary reform (as attached).
Specifically, for the report on the need for funding to implement adjustments to policy scholarships for students who are ethnic minorities in 2006 and 2007, it must be submitted no later than May 15, 2007 (Report on the need to implement adjustments to policy scholarships for students who are ethnic minorities according to the attached table).
5. The Ministry of Finance is responsible for reviewing the reports on the need for funding to implement adjustments to policy scholarships of units under central ministries and agencies to present to the Government for a decision to supplement funding for these ministries and agencies.
The Provincial Departments of Finance are responsible for reviewing the reports on the need for funding to implement adjustments to policy scholarships of subordinate units and counties; compiling and reporting to the People's Committees of provinces and centrally-administered cities for their decisions. The People's Committees of provinces and centrally-administered cities will compile and report to the Ministry of Finance for consideration to supplement funding for supported localities as stipulated in Clause 3, Part II of this Circular.
6. After being authorized by the competent authority to supplement funding for the implementation of scholarship policies for students who are ethnic minorities, boarding secondary schools and preparatory colleges shall withdraw the increased scholarship funds from the State Treasury to pay out according to the prescribed regulations.
7. The settlement of funding for implementing scholarship policies shall be carried out in accordance with the provisions of the State Budget Law and other current legal documents.
III. IMPLEMENTATION PROVISIONS
1. Based on the provisions of this Circular, central ministries and agencies and People's Committees of provinces and centrally-administered cities are responsible for organizing and guiding subordinate agencies and units to determine the need for funding and balance sources of funding to implement adjustments to policy scholarship levels.
2. This Circular takes effect fifteen days after its publication in the Official Gazette. During the implementation process, if there are any difficulties, organizations, individuals, central ministries and agencies, and localities are requested to reflect them to the Ministry of Finance and the Ministry of Education and Training for coordinated resolution. /./
